Abstract

Recent decades, the issue of drug protection has become one of the serious problems faced by many countries. The traditional approach that focuses on punishment often fails to reduce the number of drug referrals, and instead causes various other social problems. Therefore, an alternative approach that is more humane and effective is needed. Restorative justice offers a solution that focuses on recovery and reintegrating perpetrators into society. The type of research used in this study is normative legal research, using a comparative law method which examines the principles of law. In the conclusion, the author uses a deductive thinking method, namely a way of thinking that draws conclusions from a general statement or argument into a specific statement.

Abstract

This research aims to see whether or not chemical castration sanctions are applied to sex offenders when viewed from the Relative Theory of Punishment and is associated with several examples of decisions. From the research results. The application of chemical castration sanctions against sex offenders has not been implemented effectively in law enforcement in Indonesia because there is still a discrepancy between the provisions of additional punishment determined by the legislator with the facts or circumstances that occur. The Relative theory of punishment views the provision of punishment not as retaliation for the wrongdoing committed by the perpetrator, the justification of punishment lies in its purpose, namely to reduce the frequency of crime. Therefore, it is necessary to reformulate the sanction of chemical castration from various aspects, including socio-philosophical, socio-political, and socio-cultural aspects. The need for a legal breakthrough to provide therapeutic/treatment effects to perpetrators of sexual crimes through psychiatric rehabilitation efforts. Because basically, punishment is no longer solely as retaliation, but to re-educate the person who committed the criminal act to become a useful member of society.

Abstract

Pemblokiran rekening dorman oleh PPATK sebagai tindakan pencegahan terhadap perjudian daring dan pencucian uang telah menimbulkan kekhawatiran hukum, khususnya mengenai kejelasan norma, batasan kewenangan, dan perlindungan hak kepemilikan. Meskipun dimaksudkan sebagai upaya pencegahan, pemblokiran rekening dorman menimbulkan pertanyaan hukum tentang kesesuaiannya dengan prinsip-prinsip negara hukum, terutama prinsip legalitas, proses hukum yang wajar, dan perlindungan hak milik. Penelitian ini bertujuan untuk menganalisis sejauh mana kewenangan PPATK dalam memblokir rekening dorman sebagai bagian dari upaya pencegahan perjudian daring dan pencucian uang. Metode yang digunakan adalah yuridis normatif, dengan menggunakan pendekatan perundang-undangan, asas-asas hukum, dan kajian pustaka. Temuan penelitian menunjukkan bahwa meskipun PPATK memiliki dasar hukum, belum terdapat ketentuan yang secara eksplisit mengatur pemblokiran rekening dorman, sehingga berpotensi terjadi overreach dan pelanggaran hak konstitusional. Oleh karena itu, diperlukan peraturan dan prosedur yang lebih jelas yang menjamin perlindungan hukum.

Abstract

The regulation of positive Indonesian law on human trafficking, as outlined in the Immigration Law, faces normative obstacles, especially in regions like Bengkalis. These obstacles include weak sanctions under immigration law and the absence of a legal framework to enforce commitments under international protocols, such as the Protocol Against Migrant Smuggling by Land, Sea, and Air, which Indonesia has signed. This lack of strong legislation has made Indonesia a preferred transit country for human smugglers, tarnishing its reputation and directly harming its interests. Additionally, overlapping duties between police investigators and Civil Servant Investigators (PPNS) often lead to disharmony and inefficiency in law enforcement. To address these challenges, amendments to Law Number 6 of 2011 concerning Immigration are urgently needed, alongside synchronization between national and international laws. Clear and effective implementing regulations should be drafted to resolve ambiguities, and the capacity of immigration law enforcers must be enhanced. Furthermore, jurisdictional boundaries in transnational cases need to be clarified to ensure effective and harmonious law enforcement against human trafficking crimes in regions like Bengkalis

Abstract

Employment is everything related to workers before, during and after the work period. It cannot be denied that the role of labor in national development is increasing accompanied by the various challenges and risks it faces so that in turn it will be able to increase national productivity. One of the efforts to protect workers is to carry out supervision regarding the implementation of employment. This is because employment development in Indonesia is part of national development based on Pancasila and the 1945 Constitution, which is carried out in the context of community development to increase the dignity and self-respect of workers as well as realizing welfare, justice and equitable prosperity, both materially and spiritually.This research is classified as research with an empirical juridical approach. Empirical juridical research is legal research regarding the application or implementation of normative legal provisions directly to each specific legal event that occurs in society.Based on the results of the research and discussion, it can be concluded. First: implementation of corporate responsibility for work accidents that cause workers to die at the subcontractor PT Pertamina Hulu Rokan reflect the existence of weaknesses in law enforcement related to Occupational Health and Safety, which involves three the main elements are legal substance, legal structure, and legal culture. Second: the criminal liability of corporations and their management for work accidents that cause workers to die at PT Pertamina Hulu Rokan has given great attention to the issue of criminal liability of corporations and their management. In this sentence, criminal punishment was only given to the company management, namely the defendant Harry Rahmady, who was sentenced to 3 (three) months in prison. Even though the sentence handed down to Harry Rahmady was inadequate and did not provide proper justice for the victim and his family. It is felt that a prison sentence of 3 (three) months is not commensurate with the severity of the consequences of the accident that occurred. In addition, the relatively light sentence for company management does not touch the responsibility of the corporation itself

Abstract

Penyengat Village has been designated as a Traditional Village by the Siak Regency Government. The determination carries juridical implications in the form of the necessity of implementing village government based on the customary government system. However, efforts to restore the long-running village government system to the previously abandoned customary government system face various normative and sociological challenges. This study aims to analyze the formulation of the Customary Village policy by the Siak Regency Government and examine the readiness of Penyengat Village as the Original Customary Village of Anak Rawa Penyengat in organizing the government affairs of the Customary Village in Sungai Apit District, Siak Regency. This study uses a normative legal approach supported by empirical data to obtain a comprehensive picture of the implementation of Customary Village policies. The results of the study show that Kampung Penyengat is not fully ready to implement the Traditional Village government. The main obstacles faced include the unresolved boundaries of the village area, community heterogeneity, limited public understanding of the customary government system that has been in effect, low participation of the younger generation, and the lack of optimal socialization of Customary Village policies. In addition, the traditional government system of Kampung Penyengat has different characteristics from the Siak Malay customs, so it requires a deeper arrangement and understanding. Therefore, strategic steps are needed from local governments and indigenous peoples to strengthen institutional aspects, policy socialization, and revitalization of customary values as the basis for the implementation of the Traditional Village government.

Abstract

Corruption Crime (Tindak Pidana Korupsi or Tipikor) poses serious threats to state finances, governance, and public trust, prompting its long-standing classification in Indonesia as an extraordinary crime regulated under Law No. 31 of 1999 in conjunction with Law No. 20 of 2001. The enactment of Law No. 1 of 2023 concerning the Indonesian Criminal Code (KUHP), however, marks a significant shift in the regulatory framework of corruption offenses, including changes in criminal sanctions and the integration of corruption into the general criminal law system. This transformation raises critical concerns regarding the future effectiveness of anti-corruption law enforcement and the consistency of criminal policy. This study aims to compare the regulation of corruption crimes under the 2023 Criminal Code and the Anti-Corruption Law, focusing on offense formulation and sanctioning patterns. Using a normative juridical method with a comparative legal approach, this research analyzes the implications of the regulatory shift for anti-corruption strategies in Indonesia. The findings highlight the need for careful legal harmonization to ensure that the reform of the Criminal Code does not undermine the deterrent function and integrity of corruption law enforcement. Keywords: Legal Comparison; Indonesian Criminal Code 2023; Anti-Corruption Law; Corruption Crime; Criminal Sanctions
