Abstract

The following article denotes the result of research. It tries to explain the curriculum and competencies of graduation that have been produced by Islamic law program in three Islamic universities of Yogyakarta , the State Islamic Universitas Sunan Kalijaga (UIN SUKA), Universitas Islam Indonesia (UII) and Universitas Tjokroaminoto (UCY). The research has been conducted by tracing documents and interviews with stakeholders in the three- universities. The results of this study has revealed that there are dynamics of the learning curriculum of Islamic law in three universities of Yogyakarta. The Competence of graduation from the curriculum of Islamic law is the result of the application of three universities of Yogyakarta can be categorized into two basic competencies both academic competence and professional competence. The basic of epistemological bases of Islamic jurisprudence in three universities of Yogyakarta still yet to be established form. Therefore, in order to produce the graduation, it takes the courage of stakeholders in three universities of Yogyakarta above mentioned to choose the alternative development of the study of Islamic law in the future.

Abstract

The political decision of government of the decentralization policy through the Act No. 22,1999, is one of the fundamental political decision. The implications of the decision give vast impact on territories and the central government. Generally, all of the society components accept with pleasure the decision because it is the democracy gate for the democracy on all of aspects. This era is described as the economical democracy era. The resource of territory will be used optimally by the people. From this is where the economics distribution is going to move.

Abstract

Islamic economics system becomes more popular currently not only in Moslem states but also those of western. In Indonesia, the development of thought regarding the urgent need to apply economics system based on syariah is emerged at 1974. Until year 2004, the quantities of Islamic banking in Indonesia grow rapidly. But the Islamic banking system growth needs to be supported by the growth of quality system of Islamic banking. To develop syariah banking in Indonesia in the future needs to advance new strategies, beside to pay attention to spiritual market (Moslems), and also to offer the products of syariah banking to floating market, for instances to non-moslem at all provinces in Indonesia. So the benefits of syariah banking will be served not only by Moslems but also by whole Indonesian people.

Abstract

This article investigates the transactions in social affairs from Islamic Law point of view. Based on the understanding of Quranic verses, Prophet Tradition, and the basic principles of Islamic Law, it is clearly stated that every form of transaction in Islamic Law regarding social affairs problem is principally permitted as long as not contrary to the basic of Islamic teaching. In this sense, Muslims are free to formulate new kinds of transaction, agreement or contract in accordance with the need and the challenge of their lives. In other words, the form of contract in Islamic Lawis not limited only to those declared in the books of fiqh according to the schools of Islamic law. Actually Islamic Law relating to social affairs does not determine definite form of contract because the determining definite form of contract emerges the difficulties of Muslims lives. In this respect clearly that the goal of Islamic legislation is the promotion of public interest. So, to solve new challenge of contemporary economic problem, Islamic Law prepares the ethics and basic principle.

Abstract

The article below tries to trace the roots of state violence toward the communities in Indonesia. The case of Act No. 5 year 1979 regarding the Community (desa, marga, nagari and so on). Government denotes an example of State dominant intervention to communities. This polity has emerged the negative impacts, for instance destructing creative social energy of society, contradicting to self government, and contrary to democracy and the justice principles. The polity of state to regulate and unify the form of community government could be called a kind of the state terror ism. Hence, it is urgent to deconstruct, reconstruct and criticizes the possibilities state re-regulate the similar cases in reformation era nowadays either by accident or by design.

Abstract

Tulisan ini mengkaji Kitab Simbur Cahaya yang merupakan sumber tertulis peradatan yang pernah berlaku di lingkungan masyarakat Sumatera Selatan  yang dianggap sebagai karya Ratu Sinuhun Penguasa Palembang 1639-1650. Dalam Kitab Simbur Cahaya terkandung nilai-nilai pendidikan etika atau moral bagi masyarakat Sumatera Selatan pada umumnya dan terutama bagi  pergaulan remaja. Aspek-aspek keislaman dari Kitab Simbur  Cahaya  terdapat dalam aspek formal bahasa dan istilah dan aspek materi. Ajaran  moral atau etika pergaulan yang terdapat dalam  Kitab Simbur Cahaya sudah selayaknya dipertimbangkan, terutama dalam upaya penggalian dan pengembangan nilai-nilai budaya lokal daerah di era otonomi daerah sekarang ini.

Abstract

Buku ini merupakan pengembangan lebih lanjut dari kertas kerja penulis dalam mata kuliah Sejarah Isiam Nusantara di Jurusan Ushuluddin STAIN Ponorogo dan hasil penelitian kompetirif individual Depag RI. Nilai lebih buku ini terletak pada penyuguhan proses dan tawaran solusi epistemologis dalam  pembacaan atas pemikiran Islam di Indonesia kontemporer.Secara keseluruhan, fokus pembahasan buku ini tentang Islam Pribumi ala  Gus Dur, pemikiran Islam merupakan pemikiran Islam yang lahir untuk membela kepentingan rakyat secara keseluruhan, dan untuk menjaga pluralitas,  baik budaya, etnis, maupun agama. Abstract

The research below tries to investigate the trend of  Islamic discourse and writing  structure of  bulletins published every Friday in Yogyakarta Special Territory. The research constitutes descriptive and survey methods based on religiousity and sociological approaches. The data are obtained from  six different bulletins namely al-Ikhtilaf al-Rasikh, al-I’tishom, al-Ikhlas, at-Tauhid, and Risalah Jumat. The result revealed that the bulletins distributed in Yogyakarta are generally categorized as substantive either in its paragraph, content, closing paragraph or in their Islamicity discourse.

Abstract

The following article discusses that in fact from the beginning Indonesia was designed as a common home for all citizen of the nation. These differences, for instances religions, races, ethnicities, gender, beliefs, social classes, and opinions constitute the realities in society, nation and state of Indonesia. Those are protected by the constitution and Pancasila as a collective consensus. However, to realize the multicultural Indonesia in the reform era faces obstacles and stumbling blocks in three levels, namely  the level of discourse, the level of legislation and the level of application in public life. This is the homework that needs to be completed with the nation’s citizenship. However, Indonesian people remain optimistic about the future because the Indonesian nation is a nation that has a strong social cohesiveness. To reach Indonesia a prosperous and multicultural nation, Indonesian Islamic thought is required to always be critical and innovative and responsive to new developments in the life of nation and state. There are still many stumbling blocks of exams that continue to confront at all times in the long journey towards a more just and prosperous nation and state life. With the concept of accommodative multicultural citizenship, Muslims and other people as civil society are expected to encourage the state to be fair in providing protection, security and public services to all components of the nation.
