Abstract

This study examines the thoughts of Sheikh Nawawi al-Bantani, a great Banten scholar who lived in 1813-1897 AD. The aim is to find out about his thoughts on several legal issues, especially those related to family law. This study is fully literary using the content analysis method as an analytical tool. This study concluded that Sheikh Nawawi al-Bantani tended to follow the Shafi’i school. This can be seen from his thoughts when discussing family law issues, ranging from marriage contracts, marriage conditions, guardians and witnesses, to divorce problems and its legal consequences. When discussing the position and role of a husband in a household, al-Bantani stressed that a husband is a leader in his household. He is obliged to fulfill all the needs of his wife and children, especially those related to food, clothing, residence, education and other needs. Al-Bantani’s thoughts were subsequently adopted into positive law in Indonesia, especially in Law No. 1/1974 concerning marriage and Compilation of Islamic Law (KHI), which become his biggest contribution in the development of National Law.

Abstract

In contemporary religious fatwas, the term emergency (dharurat) often appears, such as health emergencies (dharurat al-shihhiyah), cultural civilization emergencies (dharurat al-tsaqafiyah), and so on, all of which are aimed at dealing with certain emergency issues that are really urgent (mulji'ah). This paper tries to analyze the MUI Fatwa Number 33 of 2018 concerning the Measles-Rubella Vaccine. According to LPPOM MUI, this vaccine contains an element that is considered haram (unlawful) in Islam. Because of this, the use of the vaccine raises the question of whether or not it is religiously permitted. After conducting a comprehensive study, MUI, through the MUI Fatwa Number 33 of 2018, stated that even though the Rubella Measles Vaccine contains haram elements, its use is permitted. This permission, as this research concludes, is based on reasons of emergency. Such because until now there has been no other vaccine that is classified as halal  (lawful) that can be used against the measles diseases. Thus, the use of the vaccine is deemed essential and urgent in the interests of the next generation of Muslims in Indonesia and the safety of the life of the wider community.

Abstract

Understanding the rights and obligations of husband and wife and carrying them out in a balanced manner is the main pillar for creating a family that is sakīnah mawaddah wa rahmah (peaceful, harmonious, and prosperous). Unfortunately, these rights and obligations are often ignored, resulting in various problems in the household. This research aims to find out the views of Sheikh Nawawi al-Bantani regarding the rights and obligations of husband and wife as written in his book 'Uqūd al-Lujain fī Bayāni Huqūq al-Zaujain. Apart from that, this research also tries to draw out the relevance of this view to changes in the attitudes of women members of the Da'arul Asy-ariyah taklim assembly towards their husbands in their daily household life. This research uses qualitative methods with a socio-empirical approach. The results of this research show that the study material of the 'Uqud al-Lujain book, which contains the rights and obligations of husbands and wives, has a positive influence on the mothers who are members of the study, which is marked by changes in the attitudes and behavior of wives towards their husbands from previously being disrespectful, disobedient and lacking respect for their husbands to being wives who are obedient, respectful and appreciative of their husbands. This positive attitude then makes household life more harmonious, serene, and peaceful so that a sakīnah mawaddah wa rahmah family atmosphere can be created.
