Abstract

Children are very valuable assets for a nation, this makes the State must pursue various policies to protect the growth and development of the children themselves. One of the efforts made is to provide maximum protection to children in conflict with the law. Related to children who have problems with the law both as perpetrators and as victims, of course law enforcement officials should provide special space for children in criminal justice related to the punishment of children and the conditions of children who are victims so that children's rights are protected. Efforts to protect the rights of children in conflict with the law, then the settlement of cases against children in conflict with the law and as victims, of course, the settlement requires all elements of both children being perpetrators, children being victims, law enforcement officials, and the community to realize a court based on the protection of children. Justice based on the protection of children in conflict with the law and as victims is one of them by using the principle of restorative justice. Abstract

Perkembangan teknologi dan informasi yang kian pesat tidak hanya memberi akses kemudahan bagi masyarakat, namun juga diikuti oleh munculnya kejahatan baru yang salah satunya adalah cyber terrorism. Tujuan penelitian ini untuk menganalisis pengaturan cyber terrorism ditinjau dari perspektif organizational transnational crime; dan aksi global cyber terrorism. Metode penelitian yang digunakan adalah jenis penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah studi kepustakaan. Analisis data dalam penelitian ini yaitu Keseluruhan data yang terdiri dari data primer dan data sekunder akan diolah dan dianalisis secara kualitatif. Hasil penelitian menunjukkan Pengaturan cyber terrorism ditinjau dari perspektif organizational transnational crime menunjukkan bahwa belum terdapat pengaturan secara khusus terkait cyber terrorism dalam hukum internasional. Dalam situasi kekosongan hukum ini, ASEAN Convention on Counter Terrorism dan International Convention for the Suppression of Terrorist Bombings mulai dipergunakan sebagai dasar hukum untuk mempidanakan pelaku cyber terrorism. ASEAN Convention on Counter Terrorism telah diratifikasi oleh Indonesia melalui Undang-undang Nomor 5 tahun 2012 tentang Pengesahan ASEAN Convention on Counter Terrorism; Aksi global cyber terrorism seiring dengan kecanggihan teknologi era digital semakin menguat dan semakin beragam aksi yang bisa dilakukannya. Sejauh ini, aksi cyber-terrorism dilakukan mulai dengan mengintimidasi pemerintah dan masyarakat sipil dengan menganggu sistem jaringan infrastruktur; melakukan serangan, pembunuhan, dan propaganda dengan akurasi yang tinggi tanpa terdeteksi tempat dan media yang digunakan.

Abstract

Sexual crimes nowadays do not only occur to adult victims, but also to children. Of course this will endanger the growth and development of children as the next generation of the nation. In order to prevent pedophilia cases against children, families and all levels of society play an active role in paying attention, protecting and protecting from treatments such as discrimination, exploitation, neglect, cruelty and injustice. The purpose of this study is to provide countermeasures taken to prevent the crime of pedophilia against children in Bali. Assistance for children in the examination process at the police until trial in court is expected to be able to improve the child's mentality and reduce the psychological impact of the pedophilia case that befell him. The research method used is empirical legal research method, the data processing and analysis used in this research is qualitative analysis. The final results of this comprehensive study are formulated to determine and analyze the factors causing the rampant crime of pedophilia and its implications for child victims, especially in the jurisdiction of the Bali Police as well as the obstacles faced in handling pedophilia cases.

Abstract

Indonesia’s legal system provides a robust framework for protecting witnesses. In criminal cases, justice and legal certainty are ensured while also prioritizing the safety and well-being of witnesses. This study examines the regulation of legal protection for witnesses and victims under the Witness and Victim Protection Law and assesses if the Law has been effective in providing justice and legal certainty. The research method employed normative legal research. The Criminal Procedure Code (KUHAP) inadequately protects witnesses, as revealed by the study. The Witness and Victim Protection Law clearly outlines the rights of witnesses and victims of criminal acts in specific cases, as determined by the Witness and Victim Protection Agency (LPSK). In addition, the law requires that victims of gross human rights crimes receive compensation from the state. According to Government Regulation No. 44/2008, the state provides compensation when the perpetrators are unable to fully meet their responsibility.Keywords: Legal Protection, Witness, Victim
