Abstract

Dalam hal penyelenggaraan pemilu 2024, KPU akan berpedoman dengan Putusan Mahkamah Konstitusi Nomor 87/PUU-XX/2022 Atas Pelaksanaan Pencalonan Legislatif Pada Pemilihan Umum Tahun 2024. Substansi dari peraturan tersebut adalah larangan mantan narapidana bandar narkoba, kejahatan seksual terhadap anak, dan korupsi untuk mencalonkan diri dalam kontestasi pemilu legislatif. Pencalonan mantan narapidana kasus korupsi tidak lepas dari peran partai politik dalam rekrutmen politik dan kaderisasi anggotanya. Tujuan penelitian ini adalah untuk mengetahui pandangan hukum progresif terhadap pencalegan mantan terpidana korupsi dan upaya dalam mengurangi dan mencegah kader-kader partai politik dalam kontestasi pilihan legislatif tahun 2024. Hasil penelitian menunjukkan, putusan MK Nomor No.87/PUU-XX/2022 ini menerapkan Judicial Activism, dapat dilihat dari penafsiran hukum dan memperlihatkan adanya keadilan bagi masyarakat, yang kemudian keputusannya Lembaga Yudisial dapat memutuskan peraturan perundang-undangan diatas sebagai peraturan perundang-undangan yang sedang di uji materiil. Komisi Pemilihan Umum demi menjaga profesionalitasnya sebagai lembaga pemilu yang mandiri tidak meloloskan bacaleg eks koruptor seperti yang telah ditetapkan melalui PKPU

Abstract

Regional expansion is considered a solution to accelerate development and bring public, social, and economic services closer to the community. The 1945 Constitution of the Republic of Indonesia provides a constitutional basis for regional autonomy policies, including the formation of New Autonomous Regions (DOB) as occurred in 2022 with the birth of three new provinces in Papua: South Papua, Central Papua, and Papua Mountains. The Indonesian House of Representatives stated that the expansion aims to equalize development, accelerate services, and strengthen the role of customary areas. However, this policy has drawn pros and cons among the Papuan people. The purpose of this study is to determine the plan to implement the regional expansion of Papua Province in terms of Law Number 23 of 2014 concerning Regional Government and the plan to establish the New Autonomous Region of Papua in terms of the principle of public participation. The results of the study show that regional formation can be carried out through regional expansion or merger. However, regional expansion often presents challenges, such as weaknesses in the quality of the apparatus, natural resource management capacity, and less than optimal improvement in community welfare. Nevertheless, regional expansion, including in Papua, is carried out to accelerate equitable development, improve public services, and raise the dignity of indigenous Papuans by considering political, legal, socio-cultural, economic aspects, as well as community aspirations.. Abstract

ABSTRACT This study examines the application of the pacta sunt servanda principle in the context of Germany’s Open the Gate Policy as a response to the Syrian refugee crisis. The pacta sunt servanda principle obliges states to honor international agreements they have ratified, including the 1951 Refugee Convention and various European Union regulations such as the Lisbon Treaty and the Dublin Regulation. In practice, Germany initially became one of the most open countries to refugees; however, this policy triggered serious challenges, including allegations of human rights violations in refugee camps and procedural inconsistencies with international standards. This research employs a normative juridical method with statutory and historical approaches. The findings indicate that although Germany adhered to international agreements at the outset, it faced legal and reputational consequences due to inadequate human rights protections in implementation. The study recommends the importance of aligning domestic policies with international obligations to prevent violations against refugees and asylum seekers. Furthermore, the active involvement of international institutions such as the UNHCR is essential in monitoring the enforcement of human rights principles at the global level.
