Abstract

In Indonesia, tofu is one of the most widely consumed foods by the Indonesian people with various variants circulating on the market such as tofu Sumedang, tofu content, tofu cakes and so on. This is what has resulted in the tofu industry experiencing significant development both from small and medium-scale industries Tofu processing will produce waste or there is waste that can be in the form of waste. Waste if not handled properly will cause pollution. In Indonesia, in fact, the development of the tofu industry is not followed by environmental awareness. The liquid waste is directly discharged into the riverbank so that it causes a decline and deterioration in the quality of river water, if the water is consumed it can cause health problems, because it creates a medium for the growth of disease germs or other germs that are detrimental to both the tofu product itself and the human body. Seeing this environmental phenomenon, legal awareness is the main highlight in it. Assessing a person's legal awareness, it is important to understand their knowledge, understanding, and acceptance of the law. A person's level of legal knowledge reflects their familiarity with legal principles and laws, while comprehension indicates their ability to interpret and apply this knowledge in practical situations. Additionally, acceptance indicates how well individuals accept legal norms and values in their social context. Together, these elements provide a comprehensive view of a person's legal awareness, influencing their behavior and interactions within the legal system.

Abstract

Bullying prone to occur in the community, especially children, bullying occurs in various forms such as verbal, physical violence and also cyberbullying. In Indonesia the act of bullying is not explicitly regulated in legislation. The problem discuss in this research is how the legal arrangements for criminal acts of bullying against children according to Indonesian legislation and the form of legal protection for child victims of criminal acts of bullying. The aim is to be able to know and explain the legal arrangements of bullying against children and what forms of protection the law provides for child victims of bullying in Indonesian legislation.The researchers used normative research, wich uses a conceptual and legislative approach to describe and analyse the problems found. The results of this study indicate that act of bullying in criminal law is not specifically regulated, so it is necessary to pay attention to the type of bullying in order to determine the right laws and regulation. In terms of protection of bullying victims, criminal laws only regulate the victim's right to receive restitution or compensation, but do not regulate specific rights to the psychological protection of victims. From the research result, it can be concluded that bullying is generally defined as an act of violence which is then futher described into several forms of criminal acts in statutory provisions, so that in order to protect society from bullying,several legal protection efforts are made, including preventive, preemptive, and repressive legal protection.

Abstract

Criminal responsibility means that every person who commits a criminal offense or against the law, as formulated in the law, then that person should be held accountable for his actions in accordance with his guilt. Criminal responsibility is determined after there is a criminal offense. To be held criminally responsible, a person must first prove that he has fulfilled all the elements of the criminal offense charged to him. This research is an empirical legal research, which examines and analyzes data obtained from the research location.This research was conducted at the Kefamenanu District Court. Data processing is carried out with data obtained both primary data and secondary data and analyzed based on the formulation of problems that have been applied. The results of this study indicate that (1) the perpetrator defendant fulfills the four conditions of criminal responsibility, namely the existence of a criminal act, the element of guilt, the existence of a responsible maker, there is no excuse so that he is punishable in Article 82 paragraph (2) of the Law of the Republic of Indonesia Number 35 of 2014 concerning amendments to the Law of the Republic of Indonesia Number 23 of 2002 concerning Child Protection Jo. Article 65 paragraph (1) of the Criminal Code, therefore the Chief Judge sentenced the defendant to 20 (twenty) years imprisonment and a fine of Rp.100.000.000,- (one hundred million rupiahs). (2) the protection of child victims is very important to ensure that their rights are fulfilled and they get proper justice by providing legal assistance or assistance from the police investigation to the court, which can be provided by the Consultation and Legal Aid Institute or institutions such as the Indonesian Child Protection Commission (KPAI) and the Witness and Victim Protection Agency (LPSK), conducting a post mortem at the hospital and laboratory examinations according to the direction of medical personnel and asking for psychologist assistance. Apart from the police, there are also institutions that cooperate in protecting victims, namely the Social Service Unit of the Indonesian Ministry of Social Affairs.

Abstract

This research discusses criminal responsibility and the application of legal sanctions against an employee of PT Aneka Niaga in Kupang City who was involved in the criminal act of embezzling company funds. This case involves AAF, an employee authorized to collect payments from customers in Rote and Sabu Districts, who misused funds amounting to IDR 135,568,090 for personal interests, including online gambling. This research uses empirical juridical methods with an empirical legal approach, analyzing legal provisions in Articles 372-376 of the Criminal Code (KUHP), Law no. 31 of 1999 concerning Eradication of Corruption Crimes, and Law no. 13 of 2013 concerning Employment. The findings show that the perpetrator fulfills the elements of embezzlement in a position of trust as regulated in Article 374 of the Criminal Code, which includes the existence of the perpetrator, the ability to be held accountable, malicious intent, and no justification. Although the perpetrator was also involved in online gambling, the judge decided to impose a sentence based on the embezzlement charge, imposing a prison sentence of 2 years and 6 months, while considering online gambling as an aggravating factor. This research concludes that law enforcement needs to be increased more firmly and proportionally to create a deterrent effect, and companies must strengthen internal supervision to prevent abuse of authority by employees.

Abstract

This study aims to analyze the factors causing suicide in Kupang City from a criminological perspective, focusing on three suicide cases that occurred among students. The method used in this study is a qualitative approach, which includes case studies, in-depth interviews with the victim's family, and analysis of official documents. The results of the study indicate that suicide is influenced by several factors, including academic pressure such as study load, thesis revision, and demands from lecturers; conflict within the family including forced choice of college major and discriminatory treatment; and psychological disorders such as depression and feelings of isolation. Based on Durkheim's theory, these cases can be categorized as anomic suicide, which is caused by difficulty adapting to academic pressure, and fatalistic suicide related to excessive family control. The most common methods used in these cases are hanging and jumping from bridges, which reflect the ease of access to tools and the geographical conditions in the area. To prevent similar incidents, multidisciplinary collaboration is needed that includes counseling services on campus, strengthening communication within families, community support programs, and policy interventions from the police and government. This study emphasizes the importance of a holistic approach in addressing the problem of suicide, by combining psychological, social, and institutional aspects.

Abstract

Technological advances have created virtual reality that allows for digital interaction, but also opens up opportunities for sexual harassment. Positive law in Indonesia does not yet have specific rules to regulate cases of sexual harassment in the context of virtual reality. This research aims to find out and analyze criminal policy, namely penal policy and non penal policy in the protection of potential victims of sexual harassment via virtual reality. This research is a normative legal research with a legislative, conceptual, and case approach. The source of legal materials used consists of primary, secondary, and tertiary legal materials. The technique of collecting legal materials is carried out through literature studies. Criminal policy analysis in the criminal act of sexual harassment via Virtual Reality is carried out using descriptive analysis techniques, which involve the analysis of penal policy and non penal policy to understand the applicable criminal law policy and find out preventive measures that can be used to protect potential victims of sexual harassment via virtual reality in the future. Based on the results of the research, criminal law policy in Indonesia can provide protection for potential victims of harassment via virtual reality. However, the implementation of penal policy alone is not enough, so there needs to be a non-penal policy that can help prevent and handle sexual harassment via virtual reality. Thus, criminal law policy or penal policy and non-criminal law policy or non-penal policy can be an effective solution to protect victims of sexual harassment via virtual reality.

Abstract

Law enforcement efforts by the BPOM in Kupang were carried out by the BPOM Civil Servant Investigator (PPNS) by conducting an investigation based on sample results. During the 2021-2023 period, there was a surge in the discovery of foods containing borax with crackers being the most products. The formulation of the problem in this study is: (1) How are the law enforcement efforts by the BPOM in Kupang against the case of the discovery of crackers containing borax. (2) What is the inhibiting factor for the BPOM in Kupang in carrying out law enforcement efforts against the case of the discovery of crackers containing borax. The type of research used in this study is empirical juridical, namely in analyzing problems carried out by combining legal materials with data in the field. The results of the research obtained: (1) Law enforcement efforts by the BPOM were carried out by BPOM investigators based on the results of sample tests and investigations were carried out by investigators with the provision of administrative sanctions. (2) The factors that hinder law enforcement by the BPOM are due to; lack of investigators, lack of ability, understanding and awareness of actors, actors who sell from place to place, lack of optimal implementation of regulations, lack of awareness of parties collaborating with the BPOM, geographical conditions in the form of islands, and lack of community participation. Suggestions need to increase law enforcement in the food sector, especially in the production and sale of crackers with borax, increase in cooperation with parties who collaborate with the BPOM in socializing food security and the dangers of chemical additives, strict supervision of the distribution and sale of cracker products containing borax, and followed by increasing awareness of each sector in collaboration with BPOM.

Abstract

The increasing number of elderly inmates in correctional institutions presents new challenges for Indonesia’s legal system and correctional policy, particularly in the context of Eastern Indonesia. As part of the correctional population, elderly inmates have specific needs that are not yet fully accommodated by the existing system. This study aims to analyze the policy on the treatment of elderly inmates at Class IIA Correctional Facility in Kupang and assess its effectiveness in ensuring their well-being and mental health, including identifying key obstacles and formulating adaptive rehabilitation approaches. The research adopts an empirical juridical method by combining normative analysis of relevant legislation with field studies conducted through interviews, observation, and documentation. The findings reveal that current policies are insufficiently responsive to the specific conditions of elderly inmates. Key issues identified include the limited availability of medical personnel and mental health services, inadequate elderly-friendly infrastructure, and the absence of rehabilitation programs tailored to their physical and psychosocial conditions. This study concludes that the correctional system remains oriented toward a standard model that fails to comprehensively address the needs of vulnerable groups. Therefore, there is an urgent need for participatory correctional policies based on individual needs and strengthened rehabilitative approaches. Moreover, this research contributes to the enrichment of legal literature on correctional policies for elderly inmates at the regional level, particularly in Eastern Indonesia, which has received limited attention in academic discourse.

Abstract

This research discusses the practice of Hai Niki, a post-circumcision ritual performed by the Atoni Pah Meto indigenous community on Timor Island. In this ritual, newly circumcised men are required to have sexual intercourse with women who are not their legal partners as part of the healing and purification process according to local beliefs. Although considered sacred in the local culture, this practice raises legal, ethical and human rights issues, especially because it places women as sexual objects without full control over their bodies. Using an empirical juridical approach, this research explores data through interviews with traditional leaders, perpetrators, and women involved. The results show that this ritual has the potential to violate national criminal law, including adultery, trafficking, and the protection of women and children. This research highlights the tension between customary law and formal state law. Therefore, a responsive and transformative legal approach is needed by emphasising the importance of legal awareness, gender equality education, and human rights protection, without ignoring local cultural identity.

Abstract

The purpose of this study is to find out and analyze the extent of the role of victims in the occurrence of fraud crimes in the admission of members of the National Police as well as legal protection efforts for victims of fraud in the admission of members of the National Police in Rote Ndao Regency. This research is an empirical juridical research, so the data used are interviews, literature and literature studies. The data was analyzed descriptively. The results of research in the field show that the victim played a role in the fraudulent act that occurred where the victim gave the perpetrator the opportunity to commit a criminal act by inadvertently having made a bribery attempt to qualify as a member of the Indonesian National Police Force. Legal protection efforts for victims are carried out by following up on reports from victims or repressive efforts, and socializing and educating the public not to easily believe in existing lures or known as preventive efforts and sanctioning the perpetrators by dismissing them so that the same thing does not happen again.
