Abstract

This study aims to examine the implementation of restorative justice in the resolution of minor criminal cases at the Sragen Police Department. The research employs an empirical method using a case study design and a sociological approach that conceptualizes law not merely as a set of written norms but as a social phenomenon operating within society. Data were collected through observations, interviews, and a review of relevant literature focusing on the stages of restorative justice implementation and the factors hindering its effectiveness. The findings indicate that the restorative justice process begins with the submission of a formal request, followed by investigators’ assessment of case eligibility, a mediation process to achieve mutual agreement, and the formalization of the outcome through a written agreement between the parties. However, its implementation faces several obstacles, including limited institutional resources, insufficient understanding among law enforcement officers, disagreements among the parties involved, logistical and scheduling constraints, time limitations, and public perceptions of justice that generate skepticism toward restorative mechanisms. Accordingly, effective solutions are required. The Sragen Police Department should strengthen institutional commitment and regulatory frameworks to ensure that restorative justice is implemented effectively and develops into an embedded organizational culture.

Abstract

This study examines the legal responsibility of e-commerce platforms for consumer losses resulting from defective products in electronic transactions. The concept of consumer loss is explored through the Consumer Protection Law (UUPK), the Electronic Information and Transactions Law (UU ITE), and the Government Regulation on Electronic System Operators (PP PMSE), which reveal normative gaps related to the role of digital platforms. The research identifies an optimal liability model, including business entity verification, system oversight, and dispute resolution mechanisms, in line with the EU Digital Services Act. These findings emphasize the need for regulatory harmonization and strengthening of platform obligations for effective consumer protection

Abstract

Abstrak: Sertifikat halal penting bagi pelaku UMKM untuk menjamin dan memastikan bahwa produk yang diproduksi benar-benar halal untuk dikonsumsi. Sertifikasi halal menjadi bagian dari senjata UMKM dalam menembus competitive advantage sehingga mampu berkembang dan bersaing di Tingkat lokal maupun internasional. Undang-undang Nomor 11 Tahun 2020 tentang Cipta Kerja, mewajibkan pelaku UMKM untuk memiliki sertifikat halal bagi produk olahannya. Tujuan utama pengabdian adalah memberikan sosialisasi, pemahaman, pengetahuan dan kemudahan dalam mendaftarkan sertifikasi halal bagi para pelaku usaha di Kabupaten Kudus khususnya UMKM di sekitar kampus IAIN Kudus. Hasil literasi dan pendampingan dari total 30 pelaku usaha hampir 90% belum pernah mengikuti pelatiahan sisanya 10% pernah mendapatkan pelatihan/sosialisasi. Sedangkan pemahaman peserta pasca pelatihan terkait dengan literasi sertifikasi halal yang kami sampaikan 50% memahami, 36,7% kurang memahami dan 13,3% tidak faham. Adapun keinginan mendaftarkan sertifikasi halal pasca kegiatan 56,7% memiliki keinginan, 26, 7% masih ragu-ragu dan sisanya 16,7% belum memiliki keinginan. Dalam memantau keberhasilan kegiatan literasi dan pendampingan sertifikasi halal bagi pelaku UMKM dilakukan pendampingan pasca pelatihan untuk teknis pendaftaran dan syarat mendapatkan sertifikat halal. Evaluasi kegiatan kami lakukan melalui pengisian google form yang sudah kami sediakan. Kegiatan pengabdian Masyarakat yang kami laksankan mendapatkan apresiasi dari peserta dan mengharapkan dilakukan kegiatan.Abstract: Halal certificates are important for MSME players to guarantee and ensure that the products produced are truly halal for consumption. Halal certification is part of MSMEs' weapons in gaining competitive advantage so that they are able to develop and compete at local and international levels. Law Number 11 of 2020 concerning Job Creation requires MSMEs to have halal certificates for their processed products. The main aim of the service is to provide outreach, understanding, knowledge and convenience in registering halal certification for business actors in Kudus Regency, especially MSMEs around the IAIN Kudus campus. Nearly 90% of the literacy and mentoring results from a total of 30 business actors have never attended training, the remaining 10% have received training/socialization. Meanwhile, post-training participants' understanding regarding halal certification literacy, we said, was 50% understanding, 36.7% did not understand and 13.3% did not understand. Regarding the desire to register for halal certification after the activity, 56.7% had the desire, 26.7% were still unsure and the remaining 16.7% did not have the desire. In monitoring the success of literacy activities and halal certification assistance for MSME players, post-training assistance is provided for technical registration and requirements for obtaining a halal certificate. We evaluate our activities by filling in the Google form that we have provided. The community service activities that we carry out receive appreciation from the participants and they hope that the activities will be carried out.

Abstract

This written aim to know about the implementation of good its principles on the health insurance agreement and to know the legal settlement when a good faith principle is involved in the health insurance agreement. Good communication required between insurance and responsible companies to conduct insurance agreements to minimize the possibility of the breach of relationship related to the good principles in the agreement. Liability responsibility tells the state with their actual insurance company can provide policy according to responsible conditions. Sharing of risk was done by a policy on the insurance company. But in practice the claims payment process is not as easy as it seems, this is because a lot of processes to go through before a claim will be paid, not even melted because of many things and one of the things that most often the problem is due to the prospective insured to peruse the contents of the contract of insurance to be entered. It should society must understand the clauses contained in the policy and the insurance company was already supposed to explain in detail the agreements contained in the policy so as not to cause disagreement in response to the content rather than the insurance polic and insurance issues are based on bad faith can be avoided. Although the disputes in the insurance sometimes can not be avoided should the parties to remain calm in the face and prefer to resolve their disputes out of court so as to achieve the concept of win-win solution for both parties.

Abstract

Perkembangan teknologi digital telah mengubah pola konsumsi masyarakat dari belanja konvensional di toko fisik menjadi transaksi elektronik melalui marketplace. Perubahan ini mempermudah akses barang dan memperluas pilihan produk bagi konsumen. Namun, kemajuan tersebut memunculkan persoalan baru, terutama maraknya peredaran barang palsu yang ditawarkan oleh penjual di platform e-commerce. Kondisi ini menimbulkan kerugian ekonomi, ancaman keselamatan, dan melemahkan kepastian hukum bagi konsumen. Platform marketplace seperti Lazada merespons persoalan ini melalui penerapan garansi keaslian sebagai bentuk perlindungan bagi konsumen terhadap barang tiruan. Garansi keaslian memberikan jaminan bahwa barang yang dibeli merupakan produk asli dan konsumen berhak atas pengembalian dana atau kompensasi bila terbukti palsu.Penelitian ini bertujuan menganalisis mekanisme penerapan garansi keaslian di Lazada dan mengevaluasi efektivitasnya dalam melindungi hak konsumen. Penelitian menggunakan metode yuridis normatif dengan pendekatan deskriptif-analitis melalui telaah peraturan perundang-undangan, doktrin, literatur hukum, serta kebijakan platform terkait perlindungan konsumen dalam transaksi digital. Analisis difokuskan pada aspek normatif perlindungan konsumen, tanggung jawab hukum penyelenggara marketplace, dan mekanisme klaim garansi keaslian.
