Abstract

Secara umum disebutkan dalam UU No 18 Tahun 2019 bahwa pengaturan pada Pesantren diarahkan pada beberapa aspek, yaitu: penyelenggaraan, proses pembelajaran, pengelolaan dana, kerjasama, dan partisipasi masyarakat serta Negara. Tulisan ini bertujuan untuk mengetahui keterkaitan UU 18 Tahun 2019 terhadap rumusan HAM. Hasil penelitian menunjukkan bahwa terdapat 5 (lima) rumusan HAM sebagai perpaduan antara Konferensi Wina 1993 dengan UUD 1945 yang saling terkait satu sama lain, yang dapat digunakan sebagai indikator dalam menjawab sejauhmana penerapan HAM dalam UU Pesantren. Sementara itu terdapat beberapa pasal yang dinilai sejalan dengan kelima indikator tersebut di atas.

Abstract

Leasing  agreement  is  a  mixture  of  agreements  on purchasing,  selling,  and  renting.  In  leasing,  when  a  buyer  can’t  buy goods in cash, then the agreement is held in which the buyer is allowed to  repay  with  several  installments.  The  goods  will  be  owned by  the buyer by the time the installments have been paid. Duringthe payment of installments, as long as it is not paid completely, the  buyer is still a tenant. As a tenant, the buyer is only allowed to take  advantage of the goods  and  does  not  have  the  right  to  transfer  the  goods  to another person.  If  the  transfer  term  is  broken  before  the  payment  of installments is completed, then the buyer will be subjectedto criminal accusations because he/she makes the others’ property lost. Then, the leasing  agreement  here  is  likely  to  lead  to  a  form  of  a  purchase agreement rather than of a renting, for the main point is all about the transfer of property rights. The different status over the ownership of goods  will  also  have  different  legal  consequences.  In  terms  of purchase, a buyer becomes the owner of the goods, which makes him feel free to do over the things possessed, such as leasing them as rental, mortgage, and so on to another party. In terms of leasing, whereas the buyer  has  not  become  the  owner  of  the  goods,  he  could  not  act lawfully  over  them.  While  Islam  has  the  basic  law  upon  leasing agreement, it is necessary to implement this law in leasingagreement towards the Indonesia Civil Code.

Abstract

Abstract: Arbitration in Indonesia is governed by the Civil Code and Law No. 30 of 1999 on Arbitration. However, there are indications of disharmony between the provisions in both laws, especially related to the fulfilment of the rights of justice seekers outside the court. This paper seeks to examine the fulfilment of rights of justice seekers outside the courts contained in Law No. 30 of 1999 and in the Civil Code. This study concluded that Law No. 30 of 1999 contains 6 (six) points of fulfilment of rights in the settlement of disputes outside the court, namely: the right to choose arbitration; the right to choose a mediator/arbitrator; the right to argue; the right to determine the event of dispute resolution; the right to a verdict; and the right to deny the verdict. In contrast, some articles in the Civil Code are not in line with the provisions of Law No. 30 of 1999 given some regulations accompanying the Civil Code related to the settlement of disputes outside the court, namely: Reglement op de Rechtsvordering (Rv) and Rechtsreglement Buitengewesten (RBg). Therefore, new regulations are needed to respond to the modern development.Abstrak: Arbitrase di Indonesia didasarkan pada KUHPerdata dan UU No. 30 Tahun 1999 tentang Arbitrase. Namun demikian, terdapat indikasi adanya ketidakselarasan antara ketentuan yang ada dalam keduanya terkait pemenuhan hak para pencari keadilan di luar pengadilan. Tulisan ini berupaya mengkaji konsep pemenuhan hak bagi para pencari keadilan di luar pengadilan yang terdapat dalam UU No 30 tahun 1999 dan juga KUHPerdata. Dari kajian yang telah dilakukan diperoleh kesimpulan bahwa terdapat 6 (enam) poin pemenuhan hak dalam penyelesaian sengketa di luar pengadilan yang tertuang dalam UU No. 30 Tahun 1999, yaitu: hak memilih arbitrase; hak memilih mediator/arbiter; hak berpendapat; hak menentukan acara penyelesaian sengketa; hak mendapat putusan; dan hak menyanggah putusan. Di sisi lain, terdapat pasal-pasal dalam KUHPerdata yang belum selaras dengan tuntutan UU No. 30 Tahun 1999 dikarenakan telah ada peraturan yang menyertai KUHPerdata berkaitan dengan penyelesaian sengketa di luar pengadilan, yaitu: Reglement op de Rechtsvordering (Rv) dan Rechtsreglement Buitengewesten (RBg). Untuk itulah diperlukan peraturan baru yang mampu menjawab perkembangan zaman.

Abstract

Justice contracts is essentially the fulfillment of rights and obligations in line with the principle of proportionality by observing the contract process from start to finish. The value of fairness in Contracting is: first, the principle of proportionality, where it governs the exchange of rights and obligations of the parties in accordance with proportion or part thereof; second, the principle of consensualism, in which it governs the agreement of both sides. The agreement is a conformity between the will and the statements made by the parties, so that legally an agreement can be held accountable; and third, the principle of freedom, in which it governs the freedom of a person in making a contract accompanied by good faith. Meanwhile, there are 9 (nine) chapters in the book III Civil Code of the partnership requiring the reconstruction of chapters.

Abstract

This research attempts to find forms of discrimination in the Act No. 40 of 2008, Act No. 13 of 2003, as well as Act No. 7 of 1984, and compare with Civil Code. Research using the method of librarianship. The results showed there are 19 articles in the Civil Code which is discriminatory.  In the meantime there are 6 forms of discrimination in the Act No. 40 of 2008; and 17 form in Act No. 7 of 1984.

Abstract

This study aims to determine the effect of virtual learning on Islamic Religious Education learning outcomes, the effect of parental participation on Islamic Religious Education learning outcomes, as well as the effect of virtual learning and parental participation on PAI learning outcomes at SMPN 4 Karanganyar academic year 2020/2021. The hypothesis proposed is that virtual learning and parental participation have a significant effect on PAI learning outcomes for class VIII SMPN 4 Karanganyar academic year 2020/2021. This research is quantitative descriptive with data collection methods are questionnaires, observations, interviews and documentation. Subjects were taken by class VIII SMPN 4 Karanganyar with a population of 360 and a sample of 100 students. Data analysis used preliminary analysis, hypothesis testing and further analysis. The results showed that the effect of virtual learning on PAI learning outcomes was in good category, the influence of parental participation on PAI learning outcomes was in good criteria, and the influence of virtual learning and parental participation had a significant effect on PAI learning outcomes for class VIII students of SMPN 4 Karanganyar academix year 2020/2021 which is in the good category.

Abstract

This study aims to find out: 1) Islamic Education Values in Suluk Bismillah for Abdi Dalem in Padepokan Jabalahad Keraton Surakarta Hadiningrat, 2) Sufism Teachings in Suluk Bismillah for Abdi Dalem in Padepokan Jabalahad Keraton Surakarta Hadiningrat, 3) Relevance of Islamic Education Values and Sufism Teachings in Suluk Bismillah for Abdi Dalem in Padepokan Jabalahad Keraton Surakarta Hadiningrat. This research is library research, namely collecting research data from the literature and making the "text world" the main object of analysis. In this case the author analyzes the text of Suluk Bismillah for Abdi Dalem in Padepokan Jabalahad Keraton Surakarta Hadiningrat. In addition, the author also made observations, interviews, and documentation with Abdi Dalem at Padepokan Jabalahad Keraton Surakarta Hadiningrat. The data collection method used in this writing is hermeneutic studies, interviews, and documentation. The results of the study can be concluded that: (1) The values of Islamic Education in Suluk Bismillah for Abdi Dalem in Padepokan Jabalahad Keraton Surakarta Hadiningrat include: a) The values of relationship with the Creator, b) The relationship of man with man (society) is the value of ta'awun (help), the value of ' adalah (justice) and 'ihsan (doing more or best towards others), c) Human relationship with world life is the value of ibtila (test),  d) Man's relationship with the universe is the value of taskhir (utilization and management) and the value of learning, e) The relationship of man with the afterlife is the value of mas'uliyah (accountability) and jaza' (retribution), f) The relationship of man with science is the value of fard (individual obligation). (2) The teachings of Suawuf in Suluk Bismillah for Courtiers in Padepokan Jabalahad Keraton Surakarta Hadiningrat include: a) Alam Ahadiyah, b) Alam Wahdah, c) Alam Wahidiyah, d) Alam Arwah, e) Alam Mitsal, f) Alam Ajsam, g) Alam Insan Kamil (3) Relevance of Islamic Educational Values and Sufism Teachings in Suluk Bismillah for Courtiers in Padepokan Jabalahad Keraton Surakarta Hadiningrat,  includes: Suluk Bismillah is used as a means of drawing closer to the Creator, affirming our position as human beings in the position of insan kamil, then to reach insan kamil or return perfectly must meet two conditions, namely khalifatullah fil ard and obedient abdullah.

Abstract

The method used to know the epistemology of Muhammad Sholeh's educational thought is carried out through three main elements, namely: riyadhoh (spiritual practice), maqamat (stages of Sufistic ascent), and ahwal (Sufism experience). Riyadhah is an exercise of the soul in truth and sincerity in the context of istiqomah in worshiping Allah SWT. The mental training carried out in this guidance process is as exemplified and carried out by the Prophet Muhammad SAW. There are three forms of riyadhoh that can be done by a student to get to know Allah SWT through three activities, namely; seeking knowledge, being consistent with the practice of the sunnah, and always maintaining time.

Abstract

Perencanaan pembangunan yang berwawasan HAM merupakan perencanaan pembangunan yang menjadikan nilai-nilai HAM sebagai rambu-rambu dalam perencanaan pembangunan. HAM harus dipatuhi oleh negara atau pemerintah dalam menjalankan misinya sehingga tidak menjadikan pembangunan sebagai tujuan dengan mengorbankan manusia demi pembangunan, melainkan sebagai alat untuk mencapai tujuan penegakkan hak atas pembangunan. Dari sisi pembangunan hukum, hukum yang relevan untuk dikembangkan sejalan dengan nilai-nilai HAM adalah model humanis partisipatoris. Manifestasi dari model pembangunan hukum ini adalah memberi perhatian pada aspek dan dimensi manusiawi sebagai tujuan utama pembangunan yang memberi akses kepada warga negara untuk ikut serta dalam pengambilan keputusan di berbagai bidang kehidupan. Hukum memberi alokasi wewenang yang lebih besar kepada warga negara untuk menentukan realisasi dirinya sebagai subjek, bukan objek yang dibentuk dan dikontrol oleh subjek lain. Kata-kata kunci: Pembangunan, Hak asasi manusia, hukum, pendidikan.
