This paper aims to analyze the state jurisdiction in the resolution of human rights abuses by UN peacekeepers from the perspective of International law. Comparative study and analysis of the data used to determine the extent of the jurisdiction of the state role in the resolution of cases of human rights violations committed by UN peacekeepers. This study shows that, tasks and functions carried by UN peacekeepers must be in accordance with the provisions of international law including the UN Charter, the International Human Rights Law, International Humanitarian Law, and Security Council mandates. This study also shows that UN peacekeepers committing human rights violations received special immunity as stated on UNSOFA (United Nation Status of Force Agreement) Paragraphs 24, 31, and 47 (b ), but if the case of human rights violations is serious, systematic and widespread impact the jurisdiction of the ICC (International Criminal Court) which applies to the record, that the country is willing to surrender his troops violated the perpetrators to justice in accordance with the jurisdiction of the ICC, it is given that the ICC complement of the court is a domestic court.

Tulisan ini membahas mengenai krisis kemanusiaan Muslim Rohingya, sebuah kelompok minoritas yang mengalami pelanggaran hak asasi manusia di Negara mereka sendiri, Myanmar. edatangan Muslim Rohingya secara massal telah mengalami penolakan bahkan dari Negara mayoritas Muslim seperti Malaysia, Indonesia dan Bangladesh yang mengklaim ‘ketakutan terhadap kedatangan Muslim Rohingya yang tidak dapat terkontrol’ sebagai alasan pembenar mereka. Tulisan ini mengaplikasikan metode penelitian normatif dipadukan dengan pendekatan perbandingan, perundang-undangan, kasus, dan analisis konsep hukum. Kesimpulannya, masyarakat internasional dapat menuntut tanggung jawab dari Myanmar atas krisis Muslim Rohingya, yang diakibatkan atas tindakan Myanmar yang salah berdasarkan hukum internasional. In the article 27 paragraph 2 of the constitution 1945 each citizenship have right on working and proper life for human. Hence development at labour field is one of them designed to improve worker prosperity so that able to move business development. One of effort to move it is improvement on minimum wage that adjusted with economic condition and development. In its implementation determination of minimum wage not yet accommodate the companies at sector that able to pay more so that it can delay improvement of worker prosperity. In Indonesia which follow Pancasila industrial relationship can not universally to determine wage level, but can not ignore it. Because the government through many mechanism and rule will continue arrange and control of wage level. As the purpose for knowing the intention of the enactment of minimum wage along with government regulation is the basis of authority in setting the minimum wage as well as understand how the process of setting a minimum wage. Approach method in this article is normative juridical approach. The result showed that protection of wage through government policy on minimum wage still need as safety net toward protection of labor that is as anticipate step in order to obligation wage paid as according to minimum wage standard applied.

Beberapa waktu lalu, pelaku bisnis internasional dikejutkan dengan sengketa antara perusahaan Apple dan Samsung mengenai pelanggaran hak paten yang digunakan di salah satu produk terbaru keluaran Samsung. Sengketa tersebut diselesaikan oleh Samsung melalui jalur litigasi dengan cara mengajukan gugatan terhadap Apple di negara-negara tempat anak perusahaan mereka berada. Tulisan ini bertujuan untuk menganalisis apakah Apple Inc. dan Samsung Electronics Ltd. Co. sebagai perusahaan transnasional dapat menyelesaikan sengketa di setiap peradilan dimana perusahaan mereka berada dan menganalisis apakah keputusan pengadilan di suatu negara dapat dieksekusi di negara lain. Tulisan ini merupakan penelitian hukum normatif dengan menggunakan pendekatan kasus, pendekatan fakta, pendekatan perundang-undangan, dan pendekatan perbandingan. Tulisan ini menyimpulkan bahwa Apple dan Samsung memiliki kedudukan hukum untuk menyelesaikan sengketa hak paten di setiap negara dimana perusahaan mereka berada melalui anak perusahaan mereka dan putusan pengadilan di suatu negara pada umumnya tidak dapat dieksekusi di wilayah negara lain.

Perkembangan teknologi yang sangat pesat berbanding lurus dengan kebutuhan manusia akan wisata. Wisata alam adalah salah satu alternatif pilihan bagi manusia untuk menenangkan pikirannya namun, tidak semua manusia yang melakukan kegiatan wisata ikut serta dalam menjaga kelestarian alam tersebut. Tangan-tangan perusak seringkali menghasilkan dampak yang sangat buruk bagi kelangsungan makhluk hidup yang berada disekitar tempat wisata. Atas hal tersebut maka timbulah suatu permasalahan pertama bagaimanakah penjabaran pengaturan internasional mengenai vandalisme terhadap terumbu karang?; kedua, bagaimanakah penjabaran pengaturan pertanggungjawaban hukum vandalisme terumbu karang di Indonesia? Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Dalam menyusun penelitian ini, penulis menggunakan sumber bahan hukum primer yang merupakan pengaturan internasional dan nasional yang terkait dengan pokok permasalahan serta sumber hukum sekunder dan tersier yang mendukung sumber hukum primer. Dalam pengumpulan sumber bahan hukum primer, penulis akan melakukan penelitian terhadap pengaturan internasional dan nasional yang berkaitan dengan pokok bahasan pertama dan kedua, sedangkan pengumpulan sumber bahan hukum sekunder dan tersier penulis melakukan penelitian kepustakaan. Berdasarkan analisis yang telah dilakukan penulis, maka didapat kesimpulan sebagai berikut: 1. Telah terdapat pengaturan internasional yang dapat digunakan Indonesia dalam melindungi terumbu karang akan tetapi pengaturan tersebut masih bersifat Softlaw. 2. Dalam hal tidak terdapatnya suatu konvensi yang bersifat Hardlaw dan global maka Indonesia dapat melakukan ekstradisi karena vandalisme telah melanggar ketentuan UUPPLH dan UU Kepariwisataan Indonesia. Hukum Internasional harus mampu menghasilkan suatu peraturan yang bersifat Hard Law dan global. Indonesia juga harus memanfaatkan perjanjian ekstradisi yang telah diratifikasi dengan baik.

Sociological study of local MSMEs in facing various obstacles in their growth and development and juridical studies related to the legal basis underlying the need to strengthen the competitiveness of local MSMEs in Bali. This research aims to analyze the factors that affect the competitiveness of local micro, small and medium enterprises (MSMEs) in organizing the trade in tourism services in Bali. This research used is normative research method. This research uses several approaches including: conceptual approach, philosophical approach and analytical approach. The results of this study showed that the formulation of strengthening the competitiveness of local micro, small and medium enterprises (MSMEs) in organizing the tourism services trade in Bali is based on the principle of fair efficiency and the principle of subsidarity so that local MSMEs can become new entities that reflect the philosophy of Tri Hita Karana and have strong competitiveness realize sustainable tourism. It is recommended to the Provincial Government of Bali, to make efforts to crystallize the value of local wisdom that can be applied as the identity of local MSMEs, so that there are formal standards in determining local MSMEs as a new entity in the economic world.

Introduction to The Problem: The background of this research is the existence of problems related to legal protection policies for women and children who are victims of human trafficking in Indonesia. Based on data from the Ministry of Foreign Affairs, it is known that there were 35 victims of human trafficking in 2010, while in 2011 and 2012, there were 33 people and 92 people, respectively. One of the policies made by the government regarding the above problems is Law Number 21 of 2007 concerning the Eradication of the Crime of Human Trafficking. However, it is found that this law has not been able to reduce human trafficking in Indonesia. In addition, this law is considered ineffective in fulfilling the rights of victims in which the criminal law's provision of protection to victims of human trafficking has not yet produced a clear pattern.Purpose/Objective Study: This study aims to analyze the legal protection for women and children as victims of human trafficking in Indonesia.Design/Methodology/Approach: This research is normative legal research (juridical normative) which uses a statute approach and a conceptual approach related to legal protection for women and children victims of human trafficking in Indonesia. Research results are further associated with the values contained in Human Rights.Findings: Based on the description above, the problems found are as follows: The number of cases of human trafficking in Indonesia continues to increase; Legal protection efforts for women and children victims of human trafficking viewed from a human rights perspective in Indonesia have not been effective; The form of protection for victims of human trafficking by criminal law has not yet shown a clear pattern.Paper Type: Research Article

New Zealand relies heavily on its agricultural industry. There are over 4,150 cultivators in the horticultural sector. They require the cooperation of foreign workers. Some of them were recruited from Indonesia, where most of the labour force is poor and unskilled. This research is conducted to analyse the compatibility of legislation and policy in Indonesia and New Zealand. So, they may enjoy their rights and possibilities for choosing, acquiring, or migrating from one work to another and earning a fair salary, whether domestically or internationally. Based on the contextual law method, it has been concluded that New Zealand’s laws provide excellent regulations for such enjoyment. Regarding the equal enjoyment of their fundamental employment rights, Indonesian Law and policy have failed to meet the needs of employees. This article demonstrates the Indonesian and New Zealand legal systems’ capacity and the need for Indonesian Law to be reconstructed to fulfil workers' demands.

This study aimed to analyze Pancasila as the source of all sources of law and the actualization of Pancasila in constructing the national legal system. The type of research was normative legal research with a statutory and conceptual approach. The researchers did library research techniques as secondary data sources. This study analyzed qualitatively juridically. The study results showed that the formulation of laws in every political stage of legal reform should follow the values contained in Pancasila as the source of all sources of law. The formation or renewal of norms would have implications for interests and impact people's lives or the construction of national and community life. In the development of law, Pancasila was a philosophical foundation, namely the view of life, awareness, and legal ideals of the Indonesian nation. The values of divinity, humanity, unity, democracy, and justice should be actualized into the legal substance, legal structure, and legal culture that would be built.
