Abstract

Islam as a comprehensive religion has regulated the Shari'a for the conduct of all human actions which the Shari'a is universal and its use is not limited by the times. There are four main sources in the determination of law in Islam, namely Alquran, Sunnah, Ijma and Qiyas. Apart from the source of the law, there are several methods used by ulul Usul Fiqh to determine the law on a new problem. The issue in this research is whether the methods of ijtihad such as Istihsan, Maslahah Mursalah, Urf, and Syar'u man qablana can be accepted and allowed by the Ulema Ushul fiqh in determining a law? What is the success in Islamic law? And how is it applied in human life and activity? The method used in this paper is the library study method. The results of the research obtained that Istihsan, Maslahah Mursalah, ‘Urf, and Syar’u man qablana are part of Islamic Shari'a. Despite the differences of opinion among the scholars regarding the ability to use the ijtihad methods. There are those who directly allow, some also give certain conditions in the process of determining the law. Described the arguments that strengthen the opinions of the scholars in issuing their fatwa. There are also examples of the implementation and application of the ijtihad method both at the time of the Prophet's best friend and in the present in accordance with the true Islamic Shari'a

Abstract

Syariah banking in Indonesia is experiencing significant developments, including assets, financial services, and the number of customers. Haj funds is a financial service using a contract of qard or ijarah given to prospective pilgrims in an effort to obtain the portion number of Hajj or Biaya Perjalanan Ibadah Haji (BPIH). The implementation of this product gives a positive and negative impression, so the legitimacy of the product and the consequences of its implementation need to be reviewed. This article will explain the implementation of the Hajj Fund of Bank Mega Syariah Branch Pekanbaru and revisit the Islamic Law on the implementation of these products. The purpose of this research is to facilitate the implementation of Hajj Funds products as well as to get a legitimate status of product. The results of this study shows that the akad/contract itself has a great risk of hidden usury because in this contract there is a merger between akad qard and ijarah by requiring additional benefits as a service and the amount of the benefit  depends on the amount and the length of loan. In fiqh muamalah, it is mentioned that that any profitable loan is riba. Perbankan Syariah di Indonesia mengalami perkembangan signifikan, termasuk aset, pembiayaan yang diberikan dan jumlah pelanggan. Dana haji adalah pembiayaan dengan menggunakan kontrak qard atau ijarah yang diberikan kepada calon jemaah haji dalam upaya mendapatkan porsi jumlah Haji atau Biaya Perjalanan Ibadah Haji (BPIH). Penerapan produk ini memberi kesan positif dan negatif, sehingga perlu meninjau tentang legitimasi produk dan konsekuensi yang dihasilkan dalam pelaksanaannya. Karena artikel ini akan menjelaskan pelaksanaan Dana Haji Bank Mega Syariah Cabang Pekanbaru dan peninjauan kembali Hukum Islam tentang pelaksanaan produk tersebut. Tujuan penelitian ini agar pelaksanaan produk Dana Haji selain untuk memudahkan pelanggan dalam melakukan ziarah, tetapi juga mendapatkan status legitimasi produk. Hasil dari penelitian ini adalah validitas akadnya yang sangat berisiko untuk terjerembab ke riba yang tersembunyi, karena dalam kontrak ini ada penggabungan antara akad qard dan ijarah dengan membutuhkan manfaat tambahan sebagai layanan, bahkan jumlahnya tergantung pada jumlah pinjaman dan panjang pinjaman. Dalam fiqh muamalah diketahui kaedah bahwa "Setiap piutang yang untung atau lebih adalah riba"

Abstract

Bay?u al-?inah merupakan akad jual beli yang menjadi perdebatan para ulama klasik dan kontemporer dari segi hukum dan pelaksanaannya. Hal tersebut mengharuskan adanya artikel yang menjelaskan konsep bay?u al-?inah untuk menentukan hukumnya. Dalam artikel ini penulis menjelaskan konsep, hukum dan aplikasi bay?u al-?inah menurut mazhab dan ulama kontemporer dengan menyatakan alasan-alasan mereka untuk memilih pendapat yang kuat. Para fuqaha sepakat mengharamkan bay?u al-??nah jika ada syarat ma?q?d ?alayh harus dijual kembali kepada penjual asalnya. Begitu juga jika terdapat petunjuk adanya ??lah melakukan rib? maka hukumnya juga adalah batal. Apa yang menjadi perdebatan fuqaha adalah apabila tidak ada syarat demikian dan tidak adanya pentujuk ??lah melakukan rib?. Dalam masalah ini penulis berpandangan bahwa akad bay?u al-?inah adalah haram jika niat melakukan rib? tidak dinyatakan dalam berkontrak. Namun, status akad tersebut adalah sah atau tidak batal selama tidak ada syarat mab?? harus dijual kembali kepada penjual asalnya dan tidak adanya di antara kedua belah pihak yang berakad untuk melakukan rib?. Ini karena dengan adanya niat, walaupun di luar akad maka niat melakukan rib? telah dinyatakan dan dapat membatalkan akad. Bay?u al-?inah is a buying and selling contract that became the debate of classical and contemporary scholars in terms of law and its implementation. Therefore, it is necessary to have an article describing the concept of bay?u al-?inah to determine the law of the bay?u al-?inah. In this paper, the author will explain the concepts, laws and applications of bay?u al-?inah according to contemporary schools and scholars by stating their reasons for choosing strong opinions. The fuqaha agree to forbid the bay?u al-?inah if there is a condition that ma?qud ?alayh must be resold to the seller of origin. Likewise, if there is a hint of the existence of ??lah do the usury then the law also is void. What is fuqaha debate is that if there is no such requirement and no referent. In this case, the author holds that the bay?u al-?inah contract is haram if the intention of doing usury is not stated in contract. However, the status of the contract is valid or not void as long as there is no requirement of mab?? to be resold to the original seller and the absence between the two parties who intend to do usury. This is because with the intention, although outside the contract, then the intention of usury has been declared and it can cancel the contract.

Abstract

Many Syariah banks in Indonesia are experiencing problematic financing because customers can not pay their debt installments, then the bank takes the settlement step by rescheduling the debt installment. In the process the bank charges a fee to the customer and this incriminates the customer. This research was conducted to analyze Islamic law against the cost charged to the customers in the process of rescheduling micro murabahah financing conducted by Bank Syariah Mandiri Branch Dumai Riau Province. This research uses data collection method with observation method, interview and library data, then analyzed by using inductive, deductive and comparative method. The results of this study conclude that the cost of micro-financing rescheduling in Bank Syariah Mandiri Branch Dumai Riau Province is not fully in accordance with Fatwa of Shariah and National Shari'ah Council Fatwa that has not been implemented, ie the bank charges the customer in rescheduling in addition to the actual cost required for the rescheduling process. And the authors provide suggestions for improving this by (1) providing the time period so that the customer can afford to pay, (2) the conversion of the financing contract of the murabahah to qard financing, and (3) rescheduling by charging real costs at no cost others.

Abstract

The development of the Indonesian economy is inseparable from the rapid development of the banking sector, including Islamic banking. This will cause competition between banks to be even tighter to increase competitiveness in various sectors, including the level of profitability. However, the profitability of Sharia Commercial Banks is still low, which is below the standard set by Bank Indonesia of 1.5%. This study aims to describe the description of murabahah financing and profitability, as well as verify the effect of murabahah financing on profitability in sharia commercial banks in Indonesia. Profitability is measured using Return On Assets (ROA) and murabahah financing measured by net murabahah financing on the financial statements of each bank. The research method used is descriptive and verification method. The number of samples used in this study were 72 observational data from 9 Islamic Commercial Banks in Indonesia during the period 2010-2017. The results of this study murabahah financing have a positive and significant effect on the profitability of Islamic Commercial Banks in Indonesia

Abstract

The issues surrounding Migration and the Problems of Muslim Minorities in the Modern World have become a hot topic of discussion and are constantly changing. This issue is fascinating, not only by Muslims but also by non-Muslims. The coverage of foreign (Western) media that always corners Islam (not individuals in Islam) and global terror events is very effective in changing a country’s policy to fight Islam. However, this does not mean that they (the West) are discriminatory actions against Muslims who live there. This study aims to review migration events and how the conditions of Muslim immigrants in Bali and several essential countries in Europe and Asia. This article is library research and empirical facts obtained from various current and reliable news sources. This event examines the extent of the fate of Muslim immigrants in multiple countries with different characters and critically examines how the policies of these countries impact Muslim minorities. In addition, a comparative study was also conducted on the condition of Muslim immigrants who became minorities in several countries with different backgrounds and characters. The results of this research are: First, Western countries highly uphold human rights. Some of the friction that occurs with the Muslim minority is a precautionary measure, not discrimination as is often presented to them. Second, the conflict between the Muslim minority and the local population is motivated by two factors (a) their ignorance of the real Islam and think that terrorist Islam is the same as King Salman’s in Saudi Arabia or Imām Khumaeni in Iran, and (b) improve security to protect the country and all its people from acts of terrorism. Third, discriminatory treatment occurs in the East World, China, Myanmar, Thailand, which are real examples that until now have not received a solution, even the United Nations has stated that the Rohingya are the most oppressed minority on earth.

Abstract

Islamic banking in Indonesia has experienced significant growth, including assets, financing provided and the number of customers. In 2012-2017 Sharia bank financing 70-80% is given to the community by using the contract of murābaḥah, in the form of consumptive and productive. The activities of sharia banks should be guided by the National Sharia Council Fatwa in performing its functions optimally and implementing the Shari'a comprehensively. While murābaḥah financing is still reaping a variety of criticism from Islamic finance experts because there are provisions that are not in accordance with fiqh muamalat and also need to find solutions how to calculate the price and mark up allowed so that customers do not burden at a cost much more expensive than the interest applied in conventional banks. This is so that Sharia banks can compete with other banks. Therefore, this article will explain concept concept of murābaḥah conceptually and application in Bank Islam in Indonesia. The purpose of writing this article so that the implementation of the contract murābaḥah in Bank Syariah in Indonesia can be in accordance with the principles of sharia that put forward the principle of justice and no party is harmed. Abstract

Ihtikar is a sale and purchase transaction which fulfills the terms and conditions in the sale and purchase contract, but is included in prohibited transactions. In practice, many people are still confused about the ihtikar problem. There are differences regarding the law and the object of Ihikar as transactions that are prohibited from social and economic interests. Therefore, this article will explain the ihtikar law according to scholars and the impact of its application on the economy. This article is a central study with qualitative assessment, a method of collecting data with documentation originating from journals, books and other sources, which are then analyzed by inductive, deductive and comparative methods. The results of the study found that the verses and hadith raised in this paper textually prohibit the existence of ihtikar. Ihtikar law is haram if the goods stockpiled are needed by the community which results in price increases. When this happens, Islam allows for intervention in these economic activities by issuing policies and rules that affect normal prices

Abstract

Islamic economics is a science that combines economics with the principle of Sharia. The development of Islamic economic thought has begun from the time of the Prophet Muhammad. In writing this article aims to find out the economic scholars of Islam and their contribution in its development. The author distributes Islamic economic scholars in two categories Classical and Contemporary. In the classical Islamic economic scholars include; Zayd ibn ‘Alī, Abū Ḥanīfa, Abū Yūsuf, al-Ghazālī, Ibn Taimiyah, Ibn Khladun, Ibn Qayyim, Shah Wali Allāh al-Naḍwī, Muhammad Abduh and Muhammad Iqbal. When Contemporary Islamic economic scholars are distributed in 3 categories, Iqtiṣādunā (Baqir al-Sadr), Mainstream (Muhammad Abdul Mannan, Nejatullah Siddiqi, Syed Nawab Heider Naqvi and Monzer Kahf), and Alternative (Timur Kuran). Abstrak: Ekonomi Islam merupakan ilmu pengetahuan yang menggabungkan antara ilmu ekonomi dengan prinsip ajaran Syariah. Perkembangan pemikiran dan ilmu ekonomi Islam sudah bermula dari zaman Rasulullah SAW, Sahabat sampai saat ini. Dalam penulisan artikel ini bertujuan untuk mengetahui tokoh ekonomi Islam dan kontribusi mereka dalam pengembangannya. Penulis membagikan tokoh ekonomi Islam dalam dua kategori Klasik dan Kontemporer. Dalam tokoh ekonomi Islam Klasik, yaitu Zaid bin ʻAlī, Abū Ḥanīfah, Abū Yūsuf, al-Ghazālī, Ibn Taimiyah, Ibn Khladun dan Ibn Qayyim, Shah Wali Allāh al-Naḍwī, Muhammad Abduh dan Muhammad Iqbal. Pembiayaan bank syariah 70-80% diberikan kepada masyarakat dengan menggunakan kontrak murābaḥah, dalam bentuk konsumtif dan produktif. Kegiatan bank syariah harus dipandu oleh Fatwa Dewan Syariah Nasional untuk menjalankan fungsi optimalnya secara ekonomis dan menjalankan syariat secara komprehensif. Oleh karena itu, artikel ini akan menjelaskan tentang konsep murābaḥah secara konseptual dan aplikasinya pada Bank Islam di Indonesia. Tujuan penulisan artikel ini agar pelaksanaan kontrak Murābaḥah di Bank Syariah di Indonesia dapat sesuai dengan prinsip syariah yang mengedepankan asas keadilan dan tidak ada pihak yang dirugikan.
