Abstract

Syariah banking in Indonesia is experiencing significant developments, including assets, financial services, and the number of customers. Haj funds is a financial service using a contract of qard or ijarah given to prospective pilgrims in an effort to obtain the portion number of Hajj or Biaya Perjalanan Ibadah Haji (BPIH). The implementation of this product gives a positive and negative impression, so the legitimacy of the product and the consequences of its implementation need to be reviewed. This article will explain the implementation of the Hajj Fund of Bank Mega Syariah Branch Pekanbaru and revisit the Islamic Law on the implementation of these products. The purpose of this research is to facilitate the implementation of Hajj Funds products as well as to get a legitimate status of product. The results of this study shows that the akad/contract itself has a great risk of hidden usury because in this contract there is a merger between akad qard and ijarah by requiring additional benefits as a service and the amount of the benefit  depends on the amount and the length of loan. In fiqh muamalah, it is mentioned that that any profitable loan is riba. Perbankan Syariah di Indonesia mengalami perkembangan signifikan, termasuk aset, pembiayaan yang diberikan dan jumlah pelanggan. Dana haji adalah pembiayaan dengan menggunakan kontrak qard atau ijarah yang diberikan kepada calon jemaah haji dalam upaya mendapatkan porsi jumlah Haji atau Biaya Perjalanan Ibadah Haji (BPIH). Penerapan produk ini memberi kesan positif dan negatif, sehingga perlu meninjau tentang legitimasi produk dan konsekuensi yang dihasilkan dalam pelaksanaannya. Karena artikel ini akan menjelaskan pelaksanaan Dana Haji Bank Mega Syariah Cabang Pekanbaru dan peninjauan kembali Hukum Islam tentang pelaksanaan produk tersebut. Tujuan penelitian ini agar pelaksanaan produk Dana Haji selain untuk memudahkan pelanggan dalam melakukan ziarah, tetapi juga mendapatkan status legitimasi produk. Hasil dari penelitian ini adalah validitas akadnya yang sangat berisiko untuk terjerembab ke riba yang tersembunyi, karena dalam kontrak ini ada penggabungan antara akad qard dan ijarah dengan membutuhkan manfaat tambahan sebagai layanan, bahkan jumlahnya tergantung pada jumlah pinjaman dan panjang pinjaman. Dalam fiqh muamalah diketahui kaedah bahwa "Setiap piutang yang untung atau lebih adalah riba"

Abstract

Bay’u al-‘inah merupakan akad jual beli yang menjadi perdebatan para ulama klasik dan kontemporer dari segi hukum dan pelaksanaannya. Hal tersebut mengharuskan adanya artikel yang menjelaskan konsep bay’u al-‘inah untuk menentukan hukumnya. Dalam artikel ini penulis menjelaskan konsep, hukum dan aplikasi bay’u al-‘inah menurut mazhab dan ulama kontemporer dengan menyatakan alasan-alasan mereka untuk memilih pendapat yang kuat. Para fuqaha sepakat mengharamkan bay’u al-‘īnah jika ada syarat ma‘qūd ‘alayh harus dijual kembali kepada penjual asalnya. Begitu juga jika terdapat petunjuk adanya ḥīlah melakukan ribā maka hukumnya juga adalah batal. Apa yang menjadi perdebatan fuqaha adalah apabila tidak ada syarat demikian dan tidak adanya pentujuk ḥīlah melakukan ribā. Dalam masalah ini penulis berpandangan bahwa akad bay’u al-‘inah adalah haram jika niat melakukan ribā tidak dinyatakan dalam berkontrak. Namun, status akad tersebut adalah sah atau tidak batal selama tidak ada syarat mab‘ī harus dijual kembali kepada penjual asalnya dan tidak adanya di antara kedua belah pihak yang berakad untuk melakukan ribā. Ini karena dengan adanya niat, walaupun di luar akad maka niat melakukan ribā telah dinyatakan dan dapat membatalkan akad. Bay’u al-‘inah is a buying and selling contract that became the debate of classical and contemporary scholars in terms of law and its implementation. Therefore, it is necessary to have an article describing the concept of bay’u al-‘inah to determine the law of the bay’u al-‘inah. In this paper, the author will explain the concepts, laws and applications of bay’u al-‘inah according to contemporary schools and scholars by stating their reasons for choosing strong opinions. The fuqaha agree to forbid the bay’u al-‘inah if there is a condition that ma‘qud ‘alayh must be resold to the seller of origin. Likewise, if there is a hint of the existence of ḥīlah do the usury then the law also is void. What is fuqaha debate is that if there is no such requirement and no referent. In this case, the author holds that the bay’u al-‘inah contract is haram if the intention of doing usury is not stated in contract. However, the status of the contract is valid or not void as long as there is no requirement of mabī‘ to be resold to the original seller and the absence between the two parties who intend to do usury. This is because with the intention, although outside the contract, then the intention of usury has been declared and it can cancel the contract.

Abstract

There are three economic systems that apply in this world, namely those originating from the product of human reason (science) and which come from revelation. From the first source a secular capitalist and socialist system was born, while the second one was born a sharia-based economy. In reality, the secular system is unable to provide equitable prosperity, and it is not uncommon to even cause human tempest. In this case what is considered capable of providing solutions is another revelation-based system. However, the sharia teachings originating from the revelation still need to be explored and cultivated so that the community will become more insightful, understanding, and finally able to apply. This research is library research. The data is extracted using the documentary method. The results showed that Qardhawi's thinking was purely based on revelation with muamalah, fiqh and moral approach. While Chapra tried to cover how conventional economic work practices and compare them with the Islamic system, while offering solutions, through scientific approaches and Islamic values. The relevance of both thoughts is to be able to provide Islamic values in the development of an economic spirituality

Abstract

Islam as a comprehensive religion has regulated the Shari'a for the conduct of all human actions which the Shari'a is universal and its use is not limited by the times. There are four main sources in the determination of law in Islam, namely Alquran, Sunnah, Ijma and Qiyas. Apart from the source of the law, there are several methods used by ulul Usul Fiqh to determine the law on a new problem. The issue in this research is whether the methods of ijtihad such as Istihsan, Maslahah Mursalah, Urf, and Syar'u man qablana can be accepted and allowed by the Ulema Ushul fiqh in determining a law? What is the success in Islamic law? And how is it applied in human life and activity? The method used in this paper is the library study method. The results of the research obtained that Istihsan, Maslahah Mursalah, Urf, and Syar'u man qablana are part of Islamic Shari'a. Despite the differences of opinion among the scholars regarding the ability to use the ijtihad methods. There are those who directly allow, some also give certain conditions in the process of determining the law. Described the arguments that strengthen the opinions of the scholars in issuing their fatwa. There are also examples of the implementation and application of the ijtihad method both at the time of the Prophet's best friend and in the present in accordance with the true Islamic Shari'a

Abstract

Human resource planning is a very important activity to meet the needs of organizational staff as a result of organizational changes in the face of a dynamic and complex business environment. This paper aims to explain the management of human resources in improving company performance. This paper is a literature review that analyzes reference sources from journals, books and websites that discuss project management conceptually and comprehensively. This paper uses the method of collecting data in documentation, as well as various articles and books. Then analyzed using content analysis, namely by analyzing descriptive literature data or scientific analysis of the message of a premise. While the data analysis method is deductive, inductive and comparative. The findings of the paper are that human resource planning is the process of planning manpower to suit the company's needs effectively and efficiently in helping the realization of company goals. Of all the resources available in the company, human resources are very important and decisive resources. All the potentials possessed by human resources greatly affect the company's efforts to achieve its goals. The similarity of this paper with others is to discuss human resource management conceptually, but the difference is that it is accompanied by the application of human resource management in improving company performance

Abstract

This research aims to determine the effect of internal and external factors on bank lending. The independent variables analyzed were Third-Party Funds (DPK), Capital Adequacy Ratio (CAR), CASA ratio, BI rates, and inflation. While the dependent variable in this study is bank credit distribution. This research was conducted by taking secondary data through the publication of Bank Indonesia (www.bi.go.id), the Financial Services Authority (www.ojk.go.id), and Bureau Van Dijk (www.orbis.bvdinfo.com). The population in this study are banks listed on the Indonesia Stock Exchange (IDX). A sampling of this study was conducted using the purposive sampling method, which amounted to 15 banks with the largest assets in Indonesia in 2018. The research period used is based on annual banking reports, 2011-2018. This research is a quantitative study using the FEM (Fixed Effect Model) method. The results of this research indicate that the variable of Third-Party Funds, Capital Adequacy Ratios, CASA ratio, and Inflation is significantly effective towards the distribution of credit banking partially. On the other hand, the variable BI rate is not significantly effective to the distribution of credit banking. Meanwhile, DPK, CAR, CASA, BI rates, and inflation simultaneously have a significant effect on the distribution of credit banking.

Abstract

Human resources are the most important aspect in forming an effective and efficient company performance. Human resources are the main determinants of the company's production process. By applying a human resource strategy that includes: job design, job analysis, and various related approaches and methods that can create a quality work ecosystem. In its application, good human resources are obtained with difficult achievements and costs that are expensive and difficult to maintain. Then the human resource strategy arrangement must be managed as well as possible to create a scope of work and work processes according to company goals. A good company is indicated by the happiness of the workers who are happy financially, mentally, and spiritually. Therefore, it is the responsibility of the company to provide the sufficiency of these factors. This article was compiled by collecting data from various credible literature, sourced and based on a conceptual understanding with a sprinkling of narrative science style language. The explanation of this article correlates with other articles, namely discussing the consolidation between humans and their place of work. Related descriptions of theories, ideas, problems, methods, solutions, application of human resources as capital and as individuals who are empowered in operations management. This article describes the structural procedures in human resource management with relevance to spiritual quotient (SQ).

Abstract

Kinerja merupakan salah satu faktor penentu meningkatkan sikap profesionalitas karyawan dalam mengembangkan aktivitas bekerja. Di masa pandemi covid-19 telah diberlakukan work from home (WFH) dan meningkatnya stress yang dialami oleh karyawan dalam menyelesaikan tugas dan dan tanggung jawabnya. Penelitian ini bertujuan untuk menganalisa pengaruh reformasi birokrasi dan stress kerja terhadap kinerja karyawan kantor pusat perusahaan XYZ di masa pandemi covid-19. Penelitian ini, asumsi homogen digambarkan pada satu kesatuan karyawan Kantor Pusat Perusahaan XYZ dari seluruh unit kerja sehingga hasil penelitian ini menggambarkan dan menjelaskan kondisi karyawan Kantor Pusat Perusahaan XYZ secara menyeluruh. Pendekatan penelitian ini adalah kuantitatif dengan menggunakan metode deskriptif dan analisis regresi. Sumber data yang digunakan dalam penelitian ini adalah data primer dengan metode pengumpulan data yang digunakan adalah metode survei. Sampel yang digunakan dalam penelitian sebanyak 132 karyawan dengan teknik purposive sampling. Hasil penelitian ini menunjukkan bahwa (1) tidak terdapat pengaruh positif dan signifikan antara reformasi birokrasi terhadap kinerja karyawan, (2) terdapat pengaruh positif dan signifikan stres kerja terhadap kinerja karyawan, dan (3) terdapat pengaruh reformasi birokrasi dan stres kerja secara bersama-sama terhadap kinerja karyawan

Abstract

This article describes the definition of quality management and examples of implementing quality management at PT. Wika Manufacturing Industries in the manufacture of GESITS electric motorcycle products, which we divided into five discussion points. The first is a discussion of the quality basis from the consumer's perspective, commonly referred to as the consumer's perspective, and the quality basis from the side, commonly referred to as the producers' perspective. The second is a discussion of the strategic role of Quality Management with the basic concept of determining excellence so that products can compete optimally when marketed. The third is a discussion of an evolution of the quality paradigm from the Technical to the Managerial Paradigm. The four analyses of quality management are trying to be explored according to experts' understanding and discuss Total Quality Management. The fifth is a detailed discussion of examples of the implementation of quality management at PT. Wika Manufacturing Industry in the manufacture of electric motorcycle products GESITS. And at the end of the discussion, we will provide conclusions about the challenges and strategic issues contained in quality management to answer every challenge in the times
