Abstract

Abstrak. Pemberhentian hakim konstitusi Aswanto oleh DPR yang melanggar mekanisme yang diatur dalam UU Nomor 7 Tahun 2020 tentang Perubahan Ketiga atas Undang-undang Nomor 24 Tahun 2003 tentang Mahkamah Konstitusi dan Pasal 12 Peraturan Mahkamah Konstitusi Nomor 4 Tahun 2012 tentang tata cara pemecatan hakim konstitusi, hal ini jelas akan mengganggu prinsip checks and balances yang semestinya lembaga-lembaga tersebut tidak saling campur tangan dalam tugas masing-masing. Penelitian ini menggunakan metode yuridis normatif. Penelitian ini memiliki dua tujuan yaitu 1) untuk menganalisis proses pemberhentian hakim MK oleh DPR akankah memengaruhi prinsip-prinsip keseimbangan kekuasaan dalam sistem Ketatanegaraan di Indonesia; 2) untuk menganalisis adanya peran kekuasaan DPR terhadap pemberhentian Hakim Mahkamah Konstitusi berdasarkan Sistem Ketatanegaraan Pemberhentian hakim Aswanto yang melanggar aturan menunjukkan pelanggaran terhadap prinsip Checks and balances, mengancam proses penegakan keadilan dan independensi lembaga, merusak integritas demokrasi 1). Pemberhentian hakim MK oleh DPR tanpa mengikuti mekanisme menunjukkan ketidakpahaman DPR terhadap aturan, melanggar check and balances, dan mengancam integritas demokrasi. 2). Pasca reformasi dalam ketatanegaraan Indonesia, DPR dan MK memiliki peran vital dalam menerapkan checks and balances sesuai UUD 1945. Abstract. The dismissal of constitutional judge Aswanto by the DPR, which violates the mechanisms stipulated in Law Number 7 of 2020 amending Law Number 24 of 2003 on the Constitutional Court and Article 12 of Constitutional Court Regulation Number 4 of 2012 regarding the procedures for dismissing constitutional judges, clearly disrupts the principles of examination and balance. Ideally, these institutions should not interfere with each other's tasks. This research employs a normative juridical method with a literature study technique, collecting secondary legal materials such as primary, secondary, and tertiary legal sources. The study aims to 1) analyze whether the process of dismissing a Constitutional Court judge by the DPR will affect the principles of power balance in Indonesia's Constitutional System; 2) analyze the role of DPR in the dismissal of Constitutional Court judges based on the Constitutional System. The dismissal of Judge Aswanto, in violation of regulations, indicates a breach of checks and balances, threatening the justice enforcement process and the institution's independence, thereby undermining democratic integrity. 1) The DPR's dismissal of a Constitutional Court judge without following the proper mechanism shows a lack of understanding of the rules, violating checks and balances and endangering democratic integrity. 2) Post-reform in Indonesia's constitutional system, the DPR and the Constitutional Court play a vital role in implementing checks and balances according to the 1945 Constitution. The dismissal of Judge Aswanto by the DPR poses a potential violation of these principles

Abstract

Abstract. Technological developments influence the use of the ETLE (Electronic Traffic Law Enforcement) system to record violations electronically. ETLE innovation comes in the midst of conventional police methods in solving traffic violations.. ETLE's innovation comes amidst conventional police methods in solving traffic violation problems. However, ETLE does not eliminate conventional methods because they are still needed for direct control. This research uses a qualitative juridical analysis method, namely an in-depth interpretation of legal materials such as normative legal research. The results will be linked to the problem and produce an objective assessment to answer the problem. The author uses qualitative juridical analysis methods to compile data and regulations to achieve clarity on the problem. The implementation of ETLE is effective in reducing irregular practices such as illegal levies during fines. However, it is still less than optimal in disciplining the community because the facilities and infrastructure are not evenly distributed. ETLE CCTV works 24/7, and police officers in the ETLE Backoffice work 1 x 24 hours. Action is still taken by the ETLE Backoffice Officer even if the violation occurs on a holiday or religious holiday. Legal institutions in Indonesia include the police, prosecutors, judiciary and advocates. To overcome law enforcement problems, it is important to document and analyze the problem in order to provide solutions for policy makers. Violators are given a deadline to pay fines after committing the violation. If you do not pay the traffic fine on time, the violator's STNK will be blocked. ETLE frees up police officers, creates security, discipline and traffic order, detects violations, minimizes extortion, and provides valid evidence. Preventive law enforcement is divided into physical prevention and guidance. Counterfeiting police number plates on vehicles is a criminal act that violates truth and public order. Abstrak. Perkembangan teknologi mempengaruhi penegakan hukum dalam penindakan pelanggaran lalu lintas. Salah satunya adalah penggunaan sistem ETLE (Electronic Traffic Law Enforcement) untuk mencatat pelanggaran secara elektronik. Inovasi ETLE hadir di tengah metode konvensional kepolisian dalam penyelesaian masalah pelanggaran lalu lintas. Namun ETLE tidak menghapus metode konvensional karena masih diperlukan untuk pengendalian langsung. Penelitian ini menggunakan metode análisis yuridis kualitatif, yaitu interpretasi mendalam terhadap bahan-bahan hukum sebagaimana penelitian hukum normatif. Hasilnya akan dihubungkan dengan permasalahan dan menghasilkan penilaian obyektif untuk menjawab permasalahan. Penulis menggunakan metode analisis yuridis kualitatif untuk menyusun data dan peraturan guna mencapai kejelasan masalah. Penerapan ETLE efektif dalam mengurangi praktik tidak teratur seperti pungutan liar saat denda. Namun masih kurang optimal dalam mendisiplinkan masyarakat karena sarana dan prasarana belum merata. CCTV ETLE bekerja 24/7, dan petugas polisi di Backoffice ETLE bekerja 1 x 24 jam. Tindakan tetap diambil oleh Backoffice Officer ETLE meskipun pelanggaran terjadi pada hari libur atau hari raya keagamaan. Lembaga hukum di Indonesia meliputi kepolisian, kejaksaan, lembaga peradilan, dan advokat. Untuk mengatasi permasalahan penegakan hukum, penting mendokumentasikan dan menganalisis masalah agar dapat memberikan solusi bagi pembuat kebijakan. Pelanggar diberi batas waktu pembayaran denda setelah melakukan pelanggaran. Jika tidak membayar denda tilang tepat waktu, STNK pelanggar akan diblokir. ETLE membebaskan petugas polisi, ciptakan keamanan, disiplin, dan ketertiban lalu lintas, deteksi pelanggaran, minimalisir pungli, serta bukti yang valid. Penegakan hukum preventif terbagi menjadi pencegahan fisik dan pembinaan. Pemalsuan plat nomor polisi pada kendaraan adalah tindak pidana yang melanggar kebenaran dan ketertiban umum.

Abstract

Good Governance is a fundamental concept in public Good Governance is a fundamental concept in public sector management that emphasizes the importance of transparency, integrity, responsibility, fairness, trust, balance, clarity, honesty, consistency, rule of law, vision, and mission in the public sector. In Indonesia, the government administration system is recognized as a crucial element in ensuring national progress and development. Thus, the concept of Good Governance is viewed as an important element in reforming the public sector and transforming it into a system that reflects accountability, responsibility, and transparency in its operations. To achieve the goals of Good Governance, it is essential to establish a strong and effective system of government administration. Such a system must prioritize the application of Good Governance principles in the planning, implementation, and accountability processes. The relationship between the attitudes of state administration and public service delivery is also critical in achieving Good Governance. The attitudes of state administration play a crucial role in shaping the foundation for Good Governance. It is important to note that Good Governance cannot be achieved solely through the implementation of policies and regulations.

Abstract

Indonesia is the country with the most regulation (hyper regulation) in the world when compared to several large countries such as the United States, Germany and England. Hyper regulation that occurs in Indonesia will cause regulations in Indonesia to malfunction and become a threat, this is because these regulations will overlap, entangle each other. The Hyper Regulation that is occurring in Indonesia can be overcome, one way is to revise the statutory regulations, however implementing this conventional revision will take a very long time to carry out harmonization and synchronization. The omnibus law method is the government's solution to overcome hyper regulation and create harmonization of regulations. The research method used is a normative juridical research method with descriptive analytical research specifications. The result of this research is the question of whether the omnibus law method can be the main solution in solving the problem of hyper regulation that occurs in Indonesia and really provide benefits or even cause more problems and losses, depending on how wise and mature the policy makers are in reviewing it. various perspectives. Because this omnibus law is very complex because it requires an in-depth study of the many regulations that will be changed, revoked and/or combined.

Abstract

This research is presented as a response to the rampant phenomenon of revenge porn, a cruel act that takes away privacy and causes deep trauma for its victims. This research seeks to examine more deeply about how the implementation of legal protection for individuals who are victims of revenge porn in Indonesia, especially within the framework of Law Number 31 of 2014 concerning Protection of Witnesses and Victims. Through the lens of victimology, this dissertation not only sees victims as passive objects in the justice system, but as individuals who have the right to comprehensive recovery and protection. This research explores further how legal protection for witnesses and victims can truly be felt by survivors of revenge porn, considering the unique characteristics of this crime that often leave deep psychological wounds and severe social stigma. To understand the reality of implementation in the field, this research uses empirical legal methods. This approach involves an in-depth analysis of relevant laws and regulations, combined with direct data collection from various related parties. In-depth interviews with victims of revenge porn, law enforcement officers, victim service institutions, and experts in the fields of law and psychology provide a window to understanding the challenges, obstacles and hopes in realizing effective legal protection for victims. The results of this study are expected to provide a complete picture of the extent to which Law Number 31 of 2014 has answered the protection needs of revenge porn victims. Moreover, this dissertation aims to identify gaps in implementation and formulate constructive recommendations. It is hoped that the findings of this study can contribute to collective efforts to create a legal system that is more empathetic and responsive to the suffering of revenge porn victims, as well as encourage the realization of true justice and recovery for them.

Abstract

This study examines the application of the principle of non-retroactivity by judges in Indonesian industrial relations courts, specifically in cases of termination of employment (PHK) arising after the enactment of the Job Creation Law (UU Cipta Kerja). The research analyzes how courts balance the application of the new law with the legal principles protecting workers' rights and ensuring legal certainty. By examining relevant court decisions and legal doctrines, the study finds that judges generally adhere to the principle of non-retroactivity, applying the labor laws in effect at the time the cause of action arose (the PHK event). This adherence upholds constitutional rights and prevents unfair application of the Job Creation Law to pre-existing disputes. However, challenges remain in ensuring consistent application and interpretation, highlighting the need for clear guidelines and ongoing judicial education to promote legal certainty and fairness in industrial relations disputes.

Abstract

A credit contract serves as an initial framework for the redistribution of financial resources between a lending party and a borrowing party. When the borrower fails to fulfill the obligations stipulated within the credit arrangement, a transfer of receivables commonly known as a cession is carried out, wherein the original debtor transfers their obligations to a successor debtor. This is subsequently followed by a formal amendment of the registered ownership title at the Land Office, particularly for the property used as collateral. Several years after the certificate was changed, a dispute lawsuit arose in Court without involving the new Debtor holding the cession deed who had controlled and changed the name on the certificate as a party. In accordance with Execution Decision Number 1/Pdt.Eks/2022/PA.Bgl, the Bangil Religious Court enforced the seizure and auction of the property that had been pledged as collateral by the assignee, reflecting the court’s authority to enforce judgments involving transferred debts. This research adopts a normative legal methodology, primarily due to the absence of comprehensive legal provisions governing the transfer of property rights via cession, particularly as they are not explicitly regulated under Article 37 of Government Regulation No. 24 of 1997 concerning Land Registration. The research applies both a conceptual framework and a case-study method, enabling an analysis that bridges theoretical understanding with practical application. This study investigates the process of title change at the Land Office following the execution of a deed of cession. The analysis seeks to evaluate the procedural legitimacy and legal safeguards available to the new rights holder, particularly in cases where the cession is not acknowledged in execution proceedings by the Religious Court.
