Abstract

The very existence of the Constitutional Court is interpreted as a constitutional tribunal, which then becomes a new branch of power included in the judicial power. The model for appointing judges to the Constitutional Court may affect the independence and impartiality of the judiciary. In order to implement changes and improvements in the appointment of judges in Indonesia, we need to look at the model of appointment of constitutional judges in other countries. The aim of this research is to analyse the model of constitutional judges' appointment in Indonesia and compare it with the models of constitutional judges' appointment in other countries. The research method used is normative legal research by examining primary and secondary legal materials related to the appointment of constitutional judges. The research results show that there are several models of constitutional judge appointments in different countries, namely models involving the executive and legislative branches, models involving only the legislative branch, models involving all three branches of government, and models conducted by special institutions. Indonesia itself uses a model involving all three branches of government. This research also compares the system for appointing constitutional judges in Indonesia with other countries such as Germany, Austria and South Korea. The conclusion of this research is that the mechanism for appointing constitutional judges must be carried out in a transparent, independent and accountable manner in order to guarantee the independence of the Constitutional Court.

Abstract

Determination Project National Strategic Area in the Pantai Indah Kapuk-2 (PIK-2) area, Tangerang Regency, has caused polemic Because suspicion spatial planning violations and lack of analysis impact environment as well as social for public around. Research This aim analyze policy determination of PIK-2 as Project National Strategic and enforcement justice in implementation regulations the method law normative used with reviewing secondary data in the form of regulation legislation and documents related. Findings main show that determination of PIK-2 not in accordance with Constitution Number 26 of 2007 concerning Spatial Planning and Banten Regional Regulation Number 1 of 2023. Regulatory process done without notice spatial planning regulations and impacts environment in a way comprehensive and minimal involvement community. Impact identified concrete covering damage environment coast and loss access public to land productive. Research propose giving sanctions in the form of enforcement law strict to the issuing official regulations No in accordance rules to avoid violations in the future. The implication is that enforcement more laws strong and evaluation repeat PIK-2 Project National Strategic policy is important done with involving community and stakeholders interests so that development walk sustainable, fair, and maintain sustainability environment as well as social.

Abstract

Medical malpractice disputes can occur in health services, treatments, actions, and care when patients feel disadvantaged or do not get the results they expected. It often arises when there are patients who are sick or unhealthy, then receive medical/medical actions that cause their illness to not heal or even become sicker or can also cause disability to the patient and even death or death. Medical malpractice disputes are disputes about bad practices, namely doing what should not be done or not doing what should be done. This incident often occurs in health services, both in hospitals, health centers, clinics, and even in independent practice places that end up in court. The purpose of the study is to understand and analyze the implementation of health law in Indonesia in resolving medical malpractice disputes with a legal certainty approach based on Law Number 17 of 2023 in conjunction with Government Regulation Number 20 of 2024, to understand, analyze, and seek proposals on what government policy should be in regulating the settlement of medical malpractice. The research method used is descriptive analysis with a normative legal approach through library and field research with data collection techniques through literature studies. Results of the study show that the policies contained in Law Number 17 Year 2023 still lack clarity because the law has yet to establish a precise and authoritative definition of medical malpractice which results in there being no legal certainty.

Abstract

Stunting dan gizi buruk masih menjadi permasalahan serius di Indonesia, khususnya di wilayah pedesaan seperti Desa Peuteuycondong, Kecamatan Cibeber, Kabupaten Cianjur. Kondisi ini tidak hanya berdampak pada pertumbuhan fisik dan kognitif anak, tetapi juga secara fundamental melanggar hak-hak dasar anak yang dijamin oleh Pasal 28B ayat (2) Undang-Undang Dasar 1945, yaitu hak untuk tumbuh dan berkembang serta berhak atas perlindungan dari kekerasan dan diskriminasi. Kegiatan pengabdian kepada masyarakat ini bertujuan untuk meningkatkan pengetahuan dan kesadaran masyarakat Desa Peuteuycondong mengenai pencegahan stunting dan gizi buruk melalui edukasi komprehensif. Jenis m etode yang digunakan adalah metode Community Participatory Research (CBPR)  yaitu pendekatan yang melibatkan kolaborasi antara tim pengabdi dan peneliti  dengan  masyarakat dalam seluruh proses pengabdian, meliputi sosialisasi interaktif, penyuluhan gizi seimbang, demonstrasi pengolahan makanan bergizi lokal, serta pendampingan langsung kepada keluarga berisiko. Partisipasi aktif masyarakat, terutama ibu hamil, ibu menyusui, dan orang tua, menjadi kunci keberhasilan program ini.  Diharapkan, dengan peningkatan pemahaman dan perubahan perilaku positif, angka stunting dan gizi buruk di Desa Peuteuycondong dapat menurun secara signifikan, sehingga hak anak untuk tumbuh kembang optimal dan sehat dapat terpenuhi, sejalan dengan amanat konstitusi.

Abstract

This study examines the application of the principle of non-retroactivity by judges in Indonesian industrial relations courts, specifically in cases of termination of employment (PHK) arising after the enactment of the Job Creation Law (UU Cipta Kerja). The research analyzes how courts balance the application of the new law with the legal principles protecting workers' rights and ensuring legal certainty. By examining relevant court decisions and legal doctrines, the study finds that judges generally adhere to the principle of non-retroactivity, applying the labor laws in effect at the time the cause of action arose (the PHK event). This adherence upholds constitutional rights and prevents unfair application of the Job Creation Law to pre-existing disputes. However, challenges remain in ensuring consistent application and interpretation, highlighting the need for clear guidelines and ongoing judicial education to promote legal certainty and fairness in industrial relations disputes.

Abstract

As the guardian of the constitution, Indonesia’s Constitutional Court (MK) exercises absolute judicial authority, with decisions that are final and binding. However, in practice, the Court also performs institutional administrative actions, such as appointing officials and managing internal structures. This study examines the jurisdictional boundary between the Court’s judicial and administrative functions, questioning whether the latter can be subject to administrative judicial review before the Administrative Court (PTUN). Using a normative legal approach supported by a case study (Decision No. 604/G/2023/PTUN.JKT) and comparative analysis from Germany, India, and South Korea, the study finds that constitutional immunity does not extend absolutely to administrative actions of judicial bodies. Administrative decisions that are concrete, individual, and have legal consequences must adhere to the principles of administrative law and good governance (AAUPB). The findings highlight the importance of a functional distinction between judicial and administrative authority and emphasize the need for legal oversight to ensure accountability of constitutional bodies in a democratic rule of law state.

Abstract

A notarial deed, particularly the Sale and Purchase Binding Agreement (PPJB), remains a controversial instrument in the process of transferring land ownership rights. This phenomenon is commonly found in society, where many laypeople assume that a PPJB is sufficient to process the transfer of title (balik nama) of purchased land. In practice, however, issues may arise when the PPJB, especially those executed before a Notary, does not clearly stipulate the rights and obligations of the parties involved. This condition may lead to disputes, considering that the PPJB serves as a preliminary agreement and a reference for the Deed of Sale and Purchase (AJB) prepared by the Land Deed Official (PPAT), which is a formal requirement for the legal transfer of land rights. This research employs a descriptive-analytical approach using a normative legal method based on literature review. The objective of this study is to examine and demonstrate the legal principles concerning binding force and legal protection for parties engaged in a notarial PPJB, as part of the broader philosophy of legal order within the state.

Abstract

The Prevention and Eradication of Narcotics Abuse and Illicit Trafficking (P4GN) represents Indonesia’s principal national policy response to the escalating narcotics threat. This study evaluates the effectiveness of P4GN implementation by the National Narcotics Agency (BNN) and proposes an alternative model to strengthen its policy framework. Recognizing narcotics abuse as not merely a legal violation but also a complex social and public health issue, the research underscores the need to integrate legal, institutional, and socio-cultural dimensions in both policy design and execution. This study adopts a normative legal approach, supported by qualitative analysis of key regulatory instruments, including Law No. 35 of 2009 on Narcotics, Presidential Instructions, the National Action Plan for P4GN (RAN P4GN), and internal BNN regulations. The analysis focuses on policy coherence, orientation, and implementation gaps within the existing framework. The findings reveal that, despite a relatively comprehensive legal and institutional foundation, P4GN implementation remains predominantly repressive. Current strategies prioritize law enforcement while insufficiently addressing prevention, rehabilitation, and community empowerment. Moreover, the absence of clear differentiation between drug users and traffickers undermines policy effectiveness and raises human rights concerns, ultimately limiting the sustainability of narcotics control efforts. To address these shortcomings, this study proposes an alternative policy model that reconfigures P4GN through a more balanced and integrated approach. The model emphasizes legal reform, institutional strengthening, and transformation of legal culture, while prioritizing preventive measures, rehabilitation, and community engagement alongside targeted enforcement against drug syndicates. It also advocates the use of data-driven strategies and information technology to enhance coordination. Within this framework, BNN is repositioned as a central cross-sectoral coordinator, promoting synergy among stakeholders. Grounded in public health and restorative justice perspectives, the model offers a more adaptive, effective, and humane approach to narcotics control in Indonesia.
