Abstract

This paper examines the legal certainty of state administrative dispute resolution in taking governmental measures. How is the existence of administrative efforts? What is the judge's legal consideration of not carrying out administrative effort? The results of this study indicate that administrative efforts must be made consisting of administrative objections and appeals unless otherwise stipulated by a law. Based on the judge's legal considerations regarding state administration disputes that do not and/or take administrative measures but are not in accordance with the provisions of Law Number 30 of 2014 concerning Government Administration juncto Supreme Court Regulation Number 6 of 2018 concerning Guidelines for the Settlement of Government Administrative Disputes After Taking Administrative Efforts then the lawsuit is declared not accepted (niet ontvankelijkverklraad).

Abstract

Natural disasters seem to be daily events and news in Indonesia, and even the world. Various forms of disasters have caused enormous losses, both moral and material losses. The earthquake that occurred on February 25 2022, centered in Talamau District, West Pasaman Regency, was a major disaster. As the epicenter of the earthquake, Talamau District was the worst affected area. It was recorded that 25 people were killed and 465 people were injured, 14 of whom were residents of East Pasaman. Apart from immaterial losses, the earthquake that occurred in West Pasaman Regency also resulted in material losses such as heavily damaged public facilities, schools and houses of worship (mosques). Due to this disaster, thousands of West Pasaman residents are waiting for development assistance from the government, however the expected assistance is still being delayed before it can be realized immediately by the Regional Government. This problem needs to be formulated into two problem statements. First, how is the implementation of regional government authority in post-earthquake rehabilitation efforts in Nagari Kajai, West Pasaman Regency? Second, what are the obstacles to implementing Regional Government Authority in post-earthquake rehabilitation efforts in Nagari Kajai, West Pasaman Regency? This research is a type of normative legal research or doctrinal legal research. The results of this research show that as a form of disaster management, the West Pasaman Regional Government carries out rehabilitation activities, one of these activities is providing assistance to repair houses for people affected by the disaster. This development is carried out through three systems, namely: independent reinbuce, facilitator reinbuce, and self-sufficiency. In an effort to exercise its authority to carry out post-disaster rehabilitation, the Regional Government encountered obstacles, including APIP's finding that there was an error in collecting data on houses of disaster victims which required data collection again, which took quite a long time and the regional financial capacity was inadequate.

Abstract

Melihat pentingnya literasi keuangan bagi setiap individu, maka kegiatan pengabdian yang bertujuan untuk meningkatkan literasi keuangan bagi santri panti asuhan menjadi sangat relevan. Kegiatan ini diharapkan dapat memberikan pemahaman dasar tentang konsep-konsep keuangan, seperti menabung, mengelola pengeluaran, serta pentingnya investasi sejak dini. Dengan demikian, santri panti asuhan akan lebih siap dalam menghadapi tantangan keuangan di masa depan dan mampu membangun kehidupan yang lebih baik. Berdasarkan Hasil kegiatan pengabdian yang dilaksanakan, adapun kesimpulan yang dapat ditarik dari kegiatan tersebut adalah: (1). Santri memahami literasi keuangan (2). Literasi keuangan harus dimiliki santri untuk memhami pentingnya pengelolaan keuangan. (3). Pengabdian keberlanjutan harus dilakukan sebagai upaya penerapan ilmu pengetahuan baik bagi dosen selaku pengabdian maupun santri sebagai mitra

Abstract

Kegiatan ini dilakukan di kawawan Pantai Melawi, Kabupaten Bachok, Provinsi Kelantan, Malaysia oleh tim pengabdian kepada masyarakat diantaranya dosen Program Studi Manajemen Fakultas Ekonomi dan Bisnis yang berkolaborasi dengan Dosen Fakulti Keusahawanan dan Perniagaan Universiti Malaysia Kelantan kepada pelaku UMKM kuliner di Pantai Melawi. Dalam kegiatan pengabdian kepada masyarakat untuk mencapai tujuan ini dilaksanakan melalui metode pendampingan dan sosialisasi. Adapun langkah-langkah pendampingan yaitu perencanaan dengan melakukan koordinasi. Tahap ke-2 adalah pelaksanaan, kegiatan dilakukan dalam bentuk penyampaian materi dengan memberikan pengetahuan dan pemahaman tentang strategi pemasaran marketing mix/bauran pemasaran 4P. Berdasarkan hasil dari kegiatan pengabdian dapat disimpulkan beberapa hal, yaitu: (1) Kegiatan pengabdian kepada masyarakat internasional oleh Dosen Program Studi Manajemen Fakultas Ekonomi dan Bisnis Universitas Muhammadiyah Riau yang berkolaborasi dengan Dosen Fakulti Keusahawanan dan Perniagaan Universiti Malaysia berjalan dengan baik. (2) Mitra pengabdian dapat memahami dengan baik atas materi yang telah diberikan oleh tim pengabdian kepada masyarakat. (3) Pelaksanaan kegiatan pengabdian kepada masyakat berhasil dilakukan sebagai wujud pelaksanaan kerja sama antara Universiti Malaysia Kelantan, dengan Universitas Muhammadiyah Riau.

Abstract

Penguatan soft skill merupakan elemen penting dalam pengelolaan talent manajemen guna meningkatkan daya saing dan kesiapan mahasiswa menghadapi tantangan dunia kerja global. Program pengabdian kepada masyarakat internasional yang dilaksanakan di Fatony University, Thailand, bertujuan untuk membekali mahasiswa dengan keterampilan non-teknis seperti komunikasi efektif, kepemimpinan adaptif, manajemen emosi, etika profesional, dan personal branding. Metode pelaksanaan menggunakan pendekatan interaktif, termasuk ceramah, diskusi kelompok, simulasi, dan refleksi, yang memungkinkan mahasiswa berpartisipasi aktif dan mengaplikasikan materi dalam konteks nyata. Hasil evaluasi menunjukkan peningkatan signifikan pada kepercayaan diri, kemampuan interpersonal, dan pemahaman pengembangan karier mahasiswa. Kegiatan ini memberikan kontribusi positif dalam membangun sumber daya manusia unggul yang siap bersaing di tingkat regional dan global. Penguatan soft skill harus terus menjadi bagian integral dalam strategi pengembangan talenta di perguruan tinggi untuk menghadapi era kompetisi yang semakin kompleks.

Abstract

Recommendations are suggestions from the examiner based on the results of the examination contained in the Audit Report (LHP) of the Supreme Audit Agency (BPK). Law No. 15/2004 mandates that recommendations must be followed up by responsible officials or parties. On several occasions, BPK has stated that its audit results are final and binding. A common recommendation in BPK's LHP is to return state losses to the state or regional treasury by stating the amount of money to be returned. Meanwhile, in other provisions, namely PP No. 38 of 2016 and BPK Regulation No. 3 of 2007, it is stated that the BPK audit results are one of the sources of information on the occurrence of losses, which will then be processed for imposition and compensation claims. In its provisions, all decisions arising from the process may differ from the state losses stated in the BPK's LHP. The purpose of this article is to examine the nature of the recommendations for the recovery of state losses in the BPK's LHP. This research is normative legal research with the approach of principles, cases, laws, and regulations. The results show that the BPK's recommendation is final and binding since the LHP is issued and submitted to the representative institution, so it must be followed up by providing answers and explanations to the BPK. Meanwhile, the state loss stated in the LHP BPK is not final. This is related to the authority of BPK, where the recommendation to recover state losses in the LHP BPK is not in the context of exercising the authority to calculate state losses, as well as assessing and/or determining the amount of state losses.

Abstract

A mortgage is a guarantee of debt repayment. The write-off of the Mortgage Right (Roya) on the land certificate is the most important stage. It releases the Mortgage right on the certificate and land book (archive) located at the Office of the National Land Agency (BPN) because the debt has been paid off. This legal research uses an empirical juridical approach. While this type of research is descriptive and analytical. Data collection techniques were carried out through structured interviews and document studies. The results of the study of the implementation of the deletion of mortgage rights (roya) on certificates at the Pekanbaru City Land Office in providing legal certainty, namely that there is disharmony in each of the regulations governing the timeframe for arranging mortgage rights, there are differences in working days. In the latest provisions, the type of royal management service is 3 working days for manual and 1 working day for electronic, this is by the Decree of the Minister of ATR/BPN Number 440/SK-HR.02/III/2023. The abolition of the Mortgage must be followed by the erasing of the Mortgage Right from the Land Book of land rights burdened with the Mortgage Right, it is necessary to have evidence in the form of a written statement issued by the Creditor holding the Mortgage Right, that the debt guaranteed by the Mortgage has been repaid by the Debtor or has been deleted by law, thus the Mortgage can be crossed out for registration of deletion at the Land Office.

Abstract

The confiscation of the assets of the Taxpayer has been regulated in the Tax Collection Law with a Forced Letter. There are many tax arrears and additional debt by taxpayers every year with the realization of the disbursement of tax arrears that is not balanced with the number of existing tax arrears. The problems that occurred at KPP Pratama Padang Dua had not fully complied with the procedures and provisions of the General Tax Provisions Law and the Law on Tax Collection by Forced Letter. The main problem in this research is how is the implementation of collecting tax debts with a forced letter and what is the mechanism for using the assets of the tax bearer stored in the bank as a debt settlement. This legal research uses an empirical juridical approach, namely a research that uses an approach to the problem by looking at the applicable legal norms and then connecting it with the legal facts contained in the field. While this type of research is descriptive analytical. Data collection techniques were carried out through structured interviews and document studies. The results of the research implementation of the collection of tax debts with forced letters are first, basically tax collection is carried out if the tax bearer does not pay off the tax debt and tax collection fees, second, against the tax bearer who does not pay off the tax debt, officials can take action to collect taxes, third, implementation Tax Collection stages are carried out in accordance with statutory provisions in the field of Tax Collection with Distress Warrants, fourth, the implementation of Tax Collection stages is carried out against Tax Bearers by considering the order of priority. However, the priority is the significant value of the tax debt. The problems that occurred at KPP Pratama Padang Dua had not fully complied with the provisions of the KUP Law and the PPSP Law. And the mechanism for using the taxpayer's assets stored in the bank as a debt settlement, namely when a forced letter has been issued, at least 2x24 hours directly block the account, the way the KPP writes to the destination bank, then the bank blocks it, the bailiff (tax officer) will meet the taxpayer to discuss how payment will be made, if the taxpayer will pay off with money in a blocked account before 14 days, then the officer makes a billing and Minutes of Overbooking and an unblocking letter but if more than 14 days there is no response from the taxpayer, then the Officer can can directly transfer to the tax payable. However, in this case KPP Pratama Padang Dua has not fully implemented it for tax arrears whose accounts have been blocked. The settlement of tax debts with the assets of the taxpayers stored in the bank has been carried out by KPP Pratama Padang Dua, although it has been successfully implemented, it has not yet achieved maximum results in disbursing tax arrears.

Abstract

The Assignment of members of the Indonesian National Army and the National Police of the Republic of Indonesia active as acting regional heads by the Minister of Home Affairs reaped polemics. Law Number 10 of 2016 concerning Regional Elections even though it has clearly regulated the filling of vacancies in the positions of governor, regent and mayor, where acting (Pj.) are appointed from the position of intermediate leaders for the Acting Governor and primary leaders for the Acting Regent and Mayor. However, the Minister of Home Affairs issued Minister of Home Affairs Regulation Number 4 of 2023 concerning Acting Governors, Regents and Mayors as a reference to fill the position of Acting Regional Head. Article 3 paragraph (b) of Permendagri Number 4 of 2023, contains norms stating that the acting regional head is from an ASN official or an official in a certain ASN position who occupies JPT Madya within the Central Government or within the Regional Government for candidates for Pj. Governor and occupies JPT Pratama within the Central Government or within the Regional Government for candidates for Pj. Regent and Pj. Mayor. Therefore, there is an addition of position criteria and an expansion of meaning in Permendagri Number 4 of 2023 which then becomes a gap and opportunity for the Minister of Home Affairs to appoint active TNI and Polri members to become Acting (Pj.). The formulation of the problem in this study is: (1) How is the validity of the appointment of members of the Indonesian National Army and members of the Negatra Police of the Republic of Indonesia active as Acting Regional Heads? (2) What are the criteria for the ideal official who can be appointed as Acting Regional Head? (3) What is the ideal mechanism for appointing and appointing acting regional heads to fill regional head vacancies ahead of the 2024 simultaneous regional elections? This research is a normative legal research or literature, with the research specifications used are analytical descriptive research. The results of this study are: (1) The appointment of members of the Indonesian National Army and active members of the Indonesian National Police to become Acting Regional Heads is not legally positive Indonesia at this time. (2) The position of the official who should be appointed as Pj. Regional Head shall be JPT Madya within the Central Government or within the Regional Government. (3) the ideal mechanism for the appointment and appointment of acting regional heads is to involve the people through the Senators so that the appointed PJ. still has legitimacy from the people.

Abstract

Land is basically owned and controlled by a person or together. Sometimes the land can be transferred to another person by using an underhand sale and purchase agreement, in Padang Pariaman Regency it is known as Siliah Jariah, where the buyer replaces someone's hard work on the land he previously controlled to become the property of the buyer. So that the Siliah Jariah Letter becomes the basis for land registration at the Padang Pariaman Land Office, what is examined in this thesis are: 1) What is the certainty of the legal force of using a Sale Purchase Certificate under the hand as the basis for rights in land registration in Padang Pariaman Regency? 2) How is the implementation of the registration of land rights using a sales and purchase agreement under the hand at the Land Office of the Padang Pariaman Regency? The approach method used in this study is an empirical juridical method. This research is descriptive in nature. The data used are primary data and secondary data. The data sources in this research are library research and field research. Data was collected through interviews and document studies. The data obtained was processed through editing and coding, then analyzed using qualitative analysis. Furthermore, the data is presented descriptively. Based on the results of the research, the authors conclude: 1) The private sale and purchase agreement cannot be the basis for land registration at the Padang Pariaman Land Office, because basically the land must be owned for 20 years, or land registration can be done by means of, register the land in the name of the previous owner (seller), after which the rights can be transferred to the name of the buyer. 2) The land registration system based on private sale and purchase is generally registered through a sporadic land registration system, in which cultivators collectively register their rights with the National Land Agency of Padang Pariaman Regency.
