Abstract

Dynastic politics, practiced by certain groups of individuals with kinship ties or close relationships, dominate political positions in regional head elections and local government administration processes. This phenomenon persists due to the lack of concrete regulations, thereby normalizing it as a political practice in Indonesia. This study aims to elaborate on the facts surrounding dynastic political practices, examine how such practices undermine the democratic ideals envisioned by the people, and propose prospective regulatory frameworks to address this issue. The research employs a normative juridical method with statutory, historical, and conceptual approaches. The findings reveal that dynastic political practices harm the democratic system and tend to be more formalistic rather than providing a genuine opportunity for the people to elect leaders aligned with their will. To prevent such practices in the future, the government, the legislature, and election organizers must collaborate to formulate concrete regulatory norms in the Regional Head Election Law.

Abstract

This research explores the concept of parakang in the Bugis myth of Indonesia, addressing three main questions: How does the phenomenon of parakang emerge as part of the mystical beliefs in the Bugis community? What impact does parakang have on the Bugis community? What role does Islamic education play in mitigating the effects of parakang-related violence? These questions are the focus of the discussion. The research aims to scientifically examine the Bugis people's myth surrounding the existence of parakang, a creature believed to be highly disruptive to the community. To analyze its emergence and societal impact, the research applies Durkheim's and Popper's perspectives on metaphysical realism. Additionally, James A. Banks' Theory of Multicultural Education is utilized to explore how cultural diversity in education can address these challenges. This research employs a qualitative method with a phenomenological approach. Primary data were gathered through observations and interviews, while secondary data were sourced from texts, e-books, journals, video documentaries, parakang-related films, and the internet. The findings are as follows: Several factors contribute to the emergence of parakang, including pesugihan (seeking wealth through mystical means), supernatural orders, heredity, the transmission of the sakratul maut (the agony of death), and frequent visits to shamans. Parakang victims often experience severe illness and, in some cases, death. Islamic education provides a critical perspective, highlighting that the concept of parakang contradicts Islamic teachings. As a result, it is essential to equip the younger Muslim generation with a robust Islamic education to prevent them from being influenced by parakang-related beliefs. This research explores the concept of parakang in the Bugis myth of Indonesia, addressing three main questions: How does the phenomenon of parakang emerge as part of the mystical beliefs in the Bugis community? Abstract

The continued hijack of shipping vessels on the Red Sea by extremists who claim to have declared war against Israel is one of those blowouts that have been caused by the Israel - Hamas conflict. The journey to unencumbered waters and unfettered shipping access itself has led to several agreements between sovereign states towards the maintenance of seamless high-seas traffic. Unfortunately, non-state actors occasionally come on the scene to wreak havoc and destabilize the fragile peace on international waterways. It is in this regard, that this study tends to examine the Red Sea crisis as it affects global shipping maritime transit and economic growth, especially of African countries vis-a-vis the UN Security Council's role of maintaining world peace and security. The study adopts a doctrinal method of study, the data obtained from primary and secondary sources such as laws and academic literature were analyzed using a descriptive and analytical method. The study therefore found that Rebels are using the pretext of Israel's attacks on Gaza to perpetrate piracy. The Israel - Hamas deadlock has created a deadlocked lose-lose situation for the international community and resulted in new incidents of insecurity within the Red Sea. The study therefore concludes and recommends that the United Nations as the global police especially through the UN Security Council examine all options for securing peace and stability in the Red Sea region as attacks on shipping vessels have global ramifications affecting multiple nationalities and invariably affecting world peace. The result, Islam provides space for ijtihad in the area of siyasah or state politics provided that it is done to achieve the goals of benefit and justice as well as the welfare of the general public. One of the things related to the siyasah area is related to the implementation of regional autonomy in Indonesia. Basically, the provision of regional autonomy in Indonesia is a space to provide opportunities for each region in this country to explore and develop the potential of each region in order to provide prosperity for regional communities. Abstract

Abstract

Indonesia’s shift from criminal to administrative sanctions in addressing illegal use of forest areas—stipulated under Articles 110A and 110B of Law No. 6 of 2023—aims to legalize approximately 3.3 million hectares of unlicensed oil palm plantations. This study evaluates the effectiveness of administrative sanctions in promoting legal compliance and environmental accountability. Employing a normative legal research method with a descriptive qualitative approach, the study examines statutory frameworks, case studies, and empirical data from the Ministry of Environment and Forestry (MoEF). Findings reveal that while administrative sanctions offer expedited enforcement and reduce judicial burdens, they risk becoming legal loopholes exploited by corporations. The limited number of sanctioned companies—only 49—and the total fines of IDR 175.5 billion are disproportionately low relative to the scale of ecological damage. Nevertheless, the research highlights the potential of a hybrid enforcement model—integrating administrative, criminal, and civil legal instruments—to enhance compliance and ecological justice. It underscores the urgency of robust oversight and the application of criminal sanctions in severe cases to uphold the constitutional right to a healthy environment.

Abstract

The purpose of this study is to compare the taxation policies of legislative members’ terms of office in Indonesia with the Philippines and the United States, along with an analysis of the urgency of the legislative member’s term of office. The study methodology employed is normative legal research. The findings of the research show that the legislative member’s term of office has not been regulated in the Indonesian constitution because Law No. 17 of 2014 only regulates the length of office in one period. This is distinct to the Philippines, which establishes a term limit for legislative members, where the term of office of senate members is 6 years and may be re-elected twice, while the term of office for the House of Representatives is 3 years and can be re-elected in three terms. Meanwhile, in the United States, there is also no regulation regarding the taking of terms of office, only the term of office of legislative members in the United States is only 2 (two) years each period, while in Indonesia it is quite long, namely 5 (five) years.

Abstract

This study rigorously examines the practical implementation of participatory village autonomy, a linchpin for inclusive governance in Indonesia. Despite formal recognition by Law No. 6 of 2014 and its 2024 amendment , significant  hurdles persist, including elite domination, financial mismanagement, limited community engagement, and insufficient institutional capacity. Employing a normative legal methodology, this inquiry  identifies effective models of community engagement and application for the Indonesian context. Findings  affirm that village autonomy's democratization requires comprehensive legal reform, institutional strengthening, transparent administration, and active citizen involvement. Beyond mere electoral procedures, true democratization  demands cultural adaptation, community empowerment, and robust accountability mechanisms to prevent elite capture.  Synergistic collaboration among central, regional, and village governments is paramount for genuinely responsive local governance. Lessons from diverse precedents  underscore the necessity of community-driven planning and legally mandated public participation for sustainable village development. This research  concludes that empowered village autonomy can substantially foster an equitable and resilient Indonesian governance landscape, contingent upon holistic systemic reforms and diligent application of innovative engagement models.

Abstract

This study explores the intersection between Islamic teachings and local traditions within the Annyorong Lopi ritual in Bontobahari District, Bulukumba, with particular emphasis on the concept of Living Hadith—how hadith values are not merely understood as textual doctrine but are actively embodied in the community’s cultural practices. The primary aim of this study is to investigate the existence of the Annyorong Lopi ritual, describe its implementation process, analyze the forms of acculturation between Islamic principles and indigenous customs, and examine the actualization of hadith values within this tradition. The study adopts a descriptive qualitative method, guided by a religious phenomenological approach. Data were collected through participatory observation, in-depth interviews with traditional and religious leaders, including Panrita Lopi, and documentation of ritual artifacts and texts. The findings indicate that Annyorong Lopi continues to thrive as a sustainable, adaptive, and spiritually infused cultural heritage. Across each stage of the procession, from selecting an auspicious day, performing the Appassili and Ammossi rituals, to launching the boat, Islamic values such as gratitude (shukr), trust in God (tawakkal), brotherhood (ukhuwah), and reverence for ancestors are seamlessly integrated. The encounter between Islam and local tradition is characterized by complementary acculturation, wherein religious and cultural elements coexist and reinforce one another. The values of Living Hadith are reflected in communal cooperation, collective prayer, and the balance between human effort and divine reliance. This study contributes significantly to understanding how Islamic values are embedded within local cultural expressions and highlights the role such practices play in preserving cultural heritage while reinforcing the religious identity of coastal communities.
