Abstract

Tujuan penelitian menganalisis pengaturan gratifikasi dalam UU No. 31 Tahun 1999 jo UU No. 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi. Metode yang digunakan peneliti di sini adalah Penelitian secara umum dapat digolongkan dalam dua jenis yaitu penelitian empiris sosiologis (lapangan). Hasil penelitian bahwa Setiap gratifikasi kepada pegawai negeri atau penyelenggara Negara dianggap pemberian suap, apabila berhubungan dengan jabatannya dan yang berlawanan dengan kewajiban atau tugasnya dengan ketentuan: Yang nilainya Rp 10.000.000,00 (sepuluh juta rupiah) atau lebih pembuktiaannya bahwa gratifikasi tersebut bukan merupakan suap dilakukan oleh penerima gratifikasi. Ketentuan ini merupakan sistem pembebanan pembuktian terbalik, dimana kepada penerima gratifikasi diberi kewajiban untuk membuktikan bahwa dia tidak ada menerima gratifikasi, atau bahwa hadiah yang diterimanya tidak ada hubungannya dengan jabatannya, dan tidak bertentangan dengan tugas dan kewajibannya. The research objective is to analyze the gratuity regulations in Law No. 31 of 1999 in conjunction with Law No. 20 of 2001 concerning the Eradication of Corruption Crimes. The method used by researchers here is Research can generally be classified into two types, namely empirical sociological (field) research. The research results show that every gratuity to a civil servant or state administrator is considered a bribe if it is related to his/her position and is contrary to his or her obligations or duties with the provisions: The value of IDR 10,000,000.00 (ten million rupiah) or more is proof that the gratuity is not bribery is carried out by the recipient of the gratification. This provision is a reverse burden of proof system, where the recipient of the gratification is given the obligation to prove that he or she did not receive the gratuity, or that the gift he or she received has nothing to do with his position, and does not conflict with his duties and obligations.

Abstract

This research was conducted to determine how the investigation of the Makassar Police Traffic Police, in carrying out investigations into negligence that resulted in the death of motorists on the highway, and what are the factors that affect the course of the investigation process carried out by the Makassar Police Traffic Police.Based on the results of research conducted in empirically analyzing the investigation process and the factors that can influence it, it can be concluded that the investigation of negligence that results in death on the road is that the driver's behavior in driving his vehicle has been negligent or careless which results in death, in this case. is a criminal act that can be subject to criminal penalties for the rider. The Makassar Police District Police handled the case by processing motorists who due to their negligence resulted in death by carrying out investigations and investigations where the process was to find out whether the rider fulfilled the elements and could be made a suspect so that the event could be made to delegate the case to the prosecutor for further processing. .The investigation process can be influenced by the absence of eye witnesses at the scene of the case, which complicates the course of the investigation process and the lack of public awareness to report when they find out about a crime that has occurred on the road because they consider it an important act. Abstract

Abstract

The Special Capital Region of Jakarta Bill has generated controversy regarding the proposal to grant the President the authority to appoint the Governor. Despite concerns about conflicting with regional autonomy, this provision is considered crucial for maintaining the stability of the capital. This research aims to analyze the controversy surrounding the mechanism of the President's appointment of the Governor in the bill and formulate an ideal policy orientation to bridge the interests of the central and local governments. A normative method, utilizing legislative and case law approaches, is employed to examine primary, secondary, and tertiary legal materials, qualitatively analyzing the controversy and policy orientation. The study identifies the controversy arising from Article 10, paragraph (1), allowing the President's direct appointment, potentially undermining citizen participation and democratic principles. To balance central and local government interests, policy orientation can refer to Law No. 23 of 2014, involving direct election of the Governor by the people, with additional conditions and recommendations from the central government. Aligning the Governor of Jakarta's term with the President's and establishing a Jakarta Consideration Council involving both central and local government elements ensures checks and balances. Detailed tasks for the Governor regarding the coordination of national development programs in Jakarta, along with incentives and affirmative policies from the central government, support the region's development as the capital.
