Abstract

This research aims to explain why Finland did not play role as peacemaker in UkraineCrisis. The great contribution on mediating conflicts in international relation has made Finland plays role as peacemaker, a country who being well known with their peace action. But as Ukraine Crisis occurs, Finland only helps by sending foreign aid and giving advice toRussia and Ukraine to arrange a mediation, without present itself as the mediator. Usingconstructivist approaches, this research argues that there is identity conflict betweenFinland’s identity as a peacemaker and as a member of The European Union which isagainst Russia. The strong solidarity between The European Union and Finland causedFinland tends to support The European Union’s decision to impose economic sanctionagainst Russia, instead of mediating the conflict. This research confirms a constructivist assumption that states must consider their identities in determining foreign policy, so they will not turned dilemma when they face a situation where they need to use more than one identity to conduct foreign policy.

Abstract

South China Sea dispute is a complicated problem faced by ASEAN countries. Through the Nine Dash Line, China claims that the South China Sea still as its territory. China takes action by militarizing the islands in it. Even though Indonesia is not included in the disputes, it turns out that Natuna waters overlap with the Nine Dash Line owned by China. These problems had caused tensions between the two countries because China had intervened in law enforcement efforts carried out by Indonesian patrol vessels against Chinese fishing vessels that violated Indonesia’s sovereignty. This study will explain the behavior of Indonesia in the dispute. Using the idiosyncratic approach, this study analyzes the political leader, Jokowi, specifically his personal character. This study will use content analysis that focus on Jokowi's statements on the dynamics of the South China Sea dispute and his response to sovereignty violation by China. The results of this study show that there are similarities in Jokowi’s behavior patterns since he was a mayor in responding to a problem. In response to China, Jokowi has character of high nationalism, high need of power, high belief in control over event, low conceptual complexity, and low distrust to other.

Abstract

ASEAN as a regional organization of Southeast Asia is considered absent and did notcontribute in the case of child soldiers’ recruitment in Myanmar. ASEAN, which hashuman rights commission such as the ASEAN Intergovernmental Commission on HumanRights (AICHR) and the ASEAN Commission on the Promotion and Protection of theRights of Women and Children (ACWC), has failed in promoting the protection of humanrights and child rights in the case of child soldiers in Myanmar. The absence of ASEAN iscontradictory to the actions taken by UN, Human Rights Watch (HRW), Child SoldierInternational (CSI) and neighboring countries in preventing and stopping the recruitmentof child soldiers in Myanmar. This research is aimed to analyze the reason behind suchsituation. Based on the view of pluralist international society, the absence of ASEAN inchild soldiers’ case in Myanmar is caused by two main reasons. First, non-interferenceprinciple which is upheld by ASEAN to respect the sovereignty of Myanmar. Second, inability to reach consensus within ASEAN, while consensus itself is decision makingprinciple in ASEAN aimed to avoid any action which may compromise the sovereignty ofother member states. On the other hand, the opposite responses given by UN, NGOs andneighboring country of Myanmar can be viewed by solidarist international society, whichargued that such actions are forms of protection of the values of individual freedom andhuman rights.

Abstract

Post WW-II world eyewitnessed one of the darkest age of humanity. Numerous bloodbaths of innocents occurred as forms of tyranny legitimation. Cambodia, Rwanda, and Yugoslavia were three of the abundant infamous degradations of humanity at the 2nd semester of the 20th century. However, under the universal spirit of humanity, international society reacted actively against those inhumane actions ergo UN formed ad hoc tribunal such as ICTY or ICTR. Yet those ad hoc tribunal were considered ineffective ergo the escalation of permanent court demands. This resulted in the birth of Rome Statute of the International Criminal Court. Rome Statute was positively acclaimed by international society and currently had been ratified by 124 countries. Still, Indonesia were not among them. This thesis would examine Indonesia’s policy of Rome Statute. Through constructivist perspective, this thesis would unfold norms disparities between international norms of Rome Statute and domestic norms of Indonesia. The perception of norms disparity would lead Indonesia to create a congruence of its norms ergo the policy to not ratify Rome Statute yet. To put the finger on the answer, this thesis would also encompass institutional dynamics of ICC and Indonesia’s commitment on Rome Statute, both explicit and implied commitments, started from Megawati’s, SBY’s, to Jokowi’s rule. As the result, it would be concluded whether there is norms disparity as the factor behind Indonesia’s policy to not ratify Rome Statute.

Abstract

The Association of Southeast Asia Nations (ASEAN) has several mechanisms for resolving conflicts, the ASEAN Institute for Peace and Reconciliation (AIPR) is one of them, which formed by the legitimacy of ASEAN to resolve conflicts. But, since it was formed, A-IPR did not going well resolving those conflicts. Southeast Asian countries prefer to resolve conflicts in their own ways, namely by means of unilateralism and bilateralism. So A-IPR becomes a pseudo institutionbecause it doesn't work according to the function they’ve been set. Some conflicts, such as theborder conflicts between Thailand and Cambodia, Myanmar's internal conflict, and the Sabahconflict between Malaysia and the Philippines also went that way. These countries prefer toresolve those conflicts in their own way rather than through the AIPR path. Even though AIPR has a management and conflict resolution function. This research wants to explain the reasons of the Southeast Asian countries not using A-IPR as conflict resolution mechanism using the perspective of idiosyncratism. This study argues that the ineffectiveness of A-IPR is because the institution was formed based solely on the personal preferences of the initiatior which is Susilo Bambang Yudhoyono without considering the desires of other countries. So that A-IPR only becomes a pseudo institution without support from it’s member.
