Abstract

Hubungan antara dokter dan pasien merupakan suatu perikatan yang timbul dari suatu perjanjian. Perjanjian dokter dan pasien merupakan perjanjian terapeutik. yang menimbulkan suatu perikatan usaha (inspannings verbintenis). Gugatan pasien terhadap dokter dalam perkara perdata Nomor 1145K/Pdt/2017 mendalilkan bahwa dokter jaga yang bertugas tidak merujuk kepada dokter spesialis sehingga dikatakan melampaui kewenangannya dalam menangani pasien gawat darurat. tidak melaksanakan code blue yaitu tidak memanggil dokter spesialis terkait. tidak mengambil tindakan menyuntikkan obat untuk meningkatkan tekanan darah pasien untuk penanganan syok sehingga dianggap oleh keluarga pasien sebagai penyebab pasien meninggal dunia dan selanjutnya Dokter Penanggung Jawab Pasen (DPJP) dianggap telah membuat kesalahan dalam memberikan keterangan tentang waktu meninggalnya pasien. Abstract

The Medical Checkup (MCU) service that includes a treadmill test facility is a routine health examination designed to identify potential cardiovascular diseases, implemented using the Bruce Protocol method as Standard Operating Procedures (SOP) and Hospital Practice Guidelines to conduct the treadmill test. The legal basis for this medical service outlined in Indonesian Ministry of Health Decree Number 772/Menkes/SK/VI/2002 and Indonesian Ministry of Health Regulation Number 512/Menkes/PER/IV/2007. The treadmill test has risks and contraindications, which means that not all patients may be able to undergo the treadmill test procedure in the MCU package. This study will explore the legal implications of incomplete information during medical checkups in cases of MCU package services which treadmill test facilities cannot be carried out due to patient's medical condition. Consumer Protection Law Number 8 of 1999 and Article 1320 of the Civil Code will serve as the foundation for analyzing therapeutic contracts. The research method which used in this study is normative juridical approach which is supported by interveiw data. The Results of this study found that when a treadmill test cannot be performed due to patients' medical condition, the patient unable to undergo the procedure, , resulting in legal consequences in form of financial loss which may causes potential disputes if not handled properly. This incident cannot be considered as as breach of contract because the hospital has fulfilled its obligations by providing information and asking for approval through informed consent, so the hospital is not required to reimburse the patient. Abstract

Background: To maintain oral health, the body needs good nutrition. The relationship between nutritional status and oral health conditions is very complex, influenced by many factors, both internal and external. Inadequate nutrition can increase the risk of oral disease. Purpose: To analyze the association between malnutrition and oral diseases. Methods: This study used the cross-sectional analytic observational design. Data were collected from the Manarul Huda Islamic Boarding School in Bandung, which 38 participants were selected based on criteria. Body mass index perform to asses nutritional status, while oral disease was collected through form data. Analysis’s data using chi-square and SPSS 23 version. Results: Classification of body mass index the highest in undernutrition group (47.4%) and oral disease the highest for tooth staining (52.6%), there was no significant association between malnutrition and oral disease with p value >0.05. Conclusion: Early analysis of nutritional assessment reduced oral disease. Further assessment will be needed to determine the long-term oral health effect of malnutrition.
