Abstract

The rapid expansion of fintech lending services, particularly cross-border peer-to-peer (P2P) lending, has created significant legal challenges concerning consumer protection. This study examines whether existing legal frameworks adequately safeguard consumer rights within the borderless digital lending environment. Utilizing a normative-juridical method combined with a comparative approach, the research analyzes Indonesia’s regulatory structure alongside selected international frameworks. The findings reveal substantial gaps in consumer protection, exacerbated by the proliferation of illegal online lending platforms, regulatory fragmentation across jurisdictions, and the misuse of personal data. National regulations often prove insufficient to address complex cross-border legal issues. This study underscores the urgency of global regulatory harmonization, enhanced national oversight mechanisms, and improved digital literacy among consumers. It concludes with recommendations for regulatory reform, the establishment of international supervisory cooperation, and the strengthening of institutional roles, particularly by financial and communication authorities, to ensure robust consumer protection in the evolving fintech lending ecosystem.

Abstract

Indonesia, as the world’s largest archipelagic country, occupies a strategic position in the Asia-Pacific region, which makes its sea lanes vulnerable to transnational narcotics smuggling. Narcotics trafficking through Indonesian waters not only disrupts national security but also has far-reaching consequences for international security, global politics, and human rights. Despite existing international legal frameworks such as the 1982 United Nations Convention on the Law of the Sea (UNCLOS) and the 1961 Single Convention on Narcotic Drugs, Indonesia faces significant enforcement challenges. These include vast maritime borders, limited resources for surveillance, and the involvement of sophisticated international criminal syndicates. This research aims to analyze international law enforcement efforts in combating narcotics smuggling in Indonesian sea lanes, focusing on both legal frameworks and the practical challenges faced in enforcement. The study uses a normative legal research method, examining secondary data from legal documents, books, and journals. The results indicate that while international cooperation frameworks have been established, the effectiveness of narcotics law enforcement remains hindered by logistical and technological gaps. The study concludes that improving international collaboration, enhancing surveillance technology, and strengthening community-based preventive measures are essential for combating narcotics trafficking in Indonesian waters effectively.

Abstract

The determination of child custody in divorce cases involving dual citizens is a complex issue that requires special attention to Indonesian legal jurisdiction. This study analyzes how Indonesian legal jurisdiction is applied in determining child custody in divorce cases involving couples of different nationalities, based on the Marriage Law No. 1 of 1974 and related international regulations. The case study of the Supreme Court Decision No. 2021 K/Pdt/2020 was also studied to understand the factors considered in decisions related to child custody. The main factors that the Supreme Court considers include the psychological and emotional well-being of the child, the financial ability of the parents, the relationship between the child and the parents, as well as the residence and nationality of the child. The results of the study show that custody decisions are always aimed at the best interests of the child, taking into account relevant national and international legal aspects.

Abstract

This research examines Supreme Court Decision No. 321 K/Pdt/2017 which deals with name borrowing agreements for land ownership by foreigners in Indonesia. In the context of increasing foreign investment, the practice of name borrowing is often a solution for foreigners to circumvent the prohibition on land ownership, but it also poses various legal challenges. Through a normative analytical descriptive juridical approach, this study analyzes the substance of the decision, the legal risks for the parties involved, and the social and economic implications of this practice. The results of the analysis show that name loan agreements are not legally recognized and are potentially null and void, resulting in legal uncertainty and conflicts that harm both foreigners and Indonesian citizens. The research also highlights that the absence of legal protection for the parties can result in financial and reputational losses. Overall, the findings indicate the need for policy reformulation and stricter regulations to govern land ownership by foreigners in Indonesia, in order to maintain social and economic balance and encourage sustainable investment development.

Abstract

Globalisasi dan meningkatnya pernikahan lintas negara telah menyebabkan meningkatnya sengketa hukum keluarga, khususnya terkait perwalian anak. Penelitian ini bertujuan untuk menganalisis peran hukum nasional Indonesia dan hukum internasional, seperti Konvensi Den Haag, dalam menentukan kepentingan terbaik anak pada sengketa lintas negara. Dengan menggunakan metode penelitian yuridis normatif, data primer berupa putusan Mahkamah Agung No.486 K/Pdt.Sus/2014 serta literatur hukum dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa Mahkamah Agung menekankan stabilitas emosional anak, akses pendidikan dan kesehatan, serta hubungan orang tua sebagai prioritas utama. Namun, ketidaksejajaran antara hukum nasional dan internasional masih menjadi tantangan dalam pelaksanaannya. Penelitian ini menegaskan perlunya integrasi prinsip-prinsip internasional ke dalam hukum nasional untuk menjamin kepentingan terbaik anak secara optimal. Studi ini memberikan kontribusi terhadap pengembangan hukum keluarga lintas negara di Indonesia, meskipun keterbatasan berupa minimnya data lapangan menjadi tantangan. Penelitian selanjutnya direkomendasikan untuk mengeksplorasi strategi praktis dalam mengharmonisasikan hukum domestik dan internasional dalam kasus serupa.

Abstract

Bagi UMKM, penggunaan AI di sektor bisnis online berpotensi mengganggu masyarakat jika tidak ada regulasi lebih lanjut. Hal ini mencakup beberapa kasus pembobolan data pengguna dan kebocoran data di kalangan pengguna Marketplace yang terjadi beberapa kali dalam beberapa waktu terakhir. Selain itu, permasalahan juga dapat terjadi di dalam sistem, misalnya informasi atau instruksi dari AI yang tidak akurat sehingga dapat mengakibatkan kerugian bagi konsumen. Penelitian ini menggunakan metode penelitian hukum normatif kualitatif, deskriptif. Problematika  yang dihadapi adalah Tindakan AI yang menimbulkan kerugian seperti kebocoran data atau tindakan menyimpang lainnya dapat disebabkan oleh ketidaksesuaian dalam pemrosesan perintah pada mesin. Setidaknya ada dua pilihan. Pertama, perintah yang diberikan tidak sesuai dengan data masukan pada mesin atau tidak lengkap sehingga mesin inferensi tidak dapat memprosesnya dengan baik. Kedua, kesalahan manusia awal dalam entri data, yaitu kesalahan dalam pelatihan mesin atau pemrograman yang tidak tepat, juga dapat menjadi penyebabnya. Persoalan lainnya adalah tanggung jawab hukum, yang didefinisikan sebagai tanggung jawab hukum seseorang atau suatu badan atas tindakan yang merugikan. Kurangnya pengakuan AI sebagai badan hukum berdasarkan hukum positif Indonesia menimbulkan tantangan baru. Dasar tanggung jawab AI adalah prinsip vicarious liabilitas, yang mengatur tanggung jawab pihak lain yang tidak melakukan kesalahan. Artinya tanggung jawab perbuatan hukum AI ada pada penyelenggara atau wakil AI.

Abstract

Penelitian ini dilakukan dengan tujuan untuk mengetahui pengaturan hukum mengenai transaksi jual beli alat bantu sex (sex toys) di market place menurut undang-undang pornografi serta pengaruh transaksi jual beli alat bantu sex terhadap berkembangnya tindak pidana pornografi. Metodelogi penelitian ini metode yang digunakan adalah penelitian hukum normatif. Jenis penelitian hukum ini dilakukan dengan meneliti bahan pustaka dan data sekunder. Jenis penelitian yang digunakan dalam penelitian ini adalah deskriptif. Penelitian deskriptif merupakan penelitian yang bersifat penjelasan dan bertujuan untuk memperoleh gambaran menyeluruh mengenai keadaan hukum yang berlaku di suatu tempat tertentu, atau wujud hukum yang ada pada suatu peristiwa sosial. Metode pengumpulan data yang digunakan adalah Penelitian Kepustakaan, yaitu suatu metode pengumpulan data dengan cara melakukan penelitian kepustakaan terhadap bahan-bahan hukum baik bahan hukum primer, bahan hukum sekunder, maupun bahan hukum tersier yang akan dilaksanakan. Penelitian hukum normatif Suatu tinjauan singkat. Penelitian ini menggunakan metode pendekatan hukum. Pendekatan ini dilakukan dengan mempertimbangkan seluruh undang-undang yang relevan dengan permasalahan hukum. Teknik analisis data yang digunakan adalah analisis kualitatif. Hasil dari penelitian ini adalah Belum ada peraturan khusus yang mengatur mengenai kebijakan penggunaan sex toys. Sex toys juga memiliki dampak positif dan negatif bagi kehidupan masyarakat. Di Indonesia sendiri, sudah banyak masyarakat yang merupakan pengguna alat bantu seks (Sex Toys).

Abstract

Hacking is a technique carried out by someone (hacker, cracker, intruder, or attacker) to attack a system, network, and application by exploiting weaknesses with the intention of gaining access rights to data and systems. Currently, the development of Information and Communication Technology (ICT) is experiencing very rapid growth. The development of information technology, especially the internet, has provided many positive benefits for its users. However, the use of internet technology also has negative impacts that cannot be ignored. The increase in Cybercrime cases in Indonesia is also caused by the impact of advances in Information Technology. Based on this explanation, the aim of this research is to find out how to study law enforcement procedures for hacking victims on digital platforms and how to ensure that digital platform users are more regulated regarding cyber security. The research method used is a descriptive analytical method. The results and discussion in this research are that handling crime cases in the field of information and electronic transactions is a responsibility that has been established for investigators, especially cyber patrols, to investigate and uncover these crimes. The investigation process has a very important and strategic role in determining the success of criminal law enforcement. The quality of a good investigation greatly determines the possibility of success in the prosecution process and makes it easier to reveal material truths during the trial. In order to prevent cybercrime, it is important for individuals and governments to have a deep understanding of crime patterns in the digital realm as well as current and ongoing internet trends and behavior carried out by perpetrators of these crimes. Abstract

Child exploitation is an act of using children for the benefit of others, satisfaction or profit which often results in unfair, cruel and harmful treatment of children. Child protection is non-discrimination, non-exploitation and non-abandonment; it is a form of child rights that must be fulfilled, respected and protected by the family, community, government and state. Child exploitation is one of the most severe forms of violence against children, and it will adversely affect children themselves, both physically and mentally. This exploitation is like forcing them to work, this is very unacceptable because it will hamper their development, Children should have freedom, enjoy the world, and have their rights protected. The occurrence of child exploitation is also influenced by various social factors such as poverty and economics. The protection of child labor has been regulated in the formulation of laws with International Conventions ratified by various countries (Nieuwenhuys, O. (2000).
