Abstract

Child exploitation within Child Social Welfare Institutions (Lembaga Kesejahteraan Sosial Anak or LKSA) remains a significant concern that undermines the fulfillment of children's fundamental rights, particularly in relation to access to education, health care, proper care, and protection. This study aims to examine the role of legal frameworks in preventing and addressing exploitative practices within LKSAs, focusing on the extent to which these institutions ensure the fulfillment of children's basic needs in accordance with national welfare standards. Employing a qualitative research design with a case study approach, the study was conducted in several LKSAs in Medan, North Sumatra. Data collection methods included in-depth interviews with key stakeholders, analysis of relevant legal and institutional documents, and direct field observations. The results show that there are still practices of child exploitation in several LKSA, including forced labor and misuse of foster child status for economic interests. Other important findings include weak supervision by government agencies, limited coordination between agencies, and a lack of understanding by LKSA managers of children's rights. On the other hand, the role of the police as law enforcers is considered reactive and not optimal in preventing and prosecuting cases of child exploitation in LKSA. The main obstacles faced by POLRI include limited resources, lack of specialized training, and the absence of strong synergy between the police and other child protection agencies. Hence, the research emphasizes that although the legal framework is in place through various laws and regulations, its implementation is still not effective.

Abstract

Village-Owned Enterprises (BUMDes) support village economic development, but community participation in Betimus Mbaru remained limited following the failed pig farming program. This study aims to analyze community participation in the planning, formation, and supervision of Village-Owned Enterprises (BUMDes) in Betimus Mbaru Village, Sibolangit District. This study uses a qualitative descriptive method with data collection techniques through observation, interviews, and documentation. The research informants consisted of the village government, BUMDes administrators, and the people of Betimus Mbaru Village who were involved in the management of BUMDes. The data was analyzed descriptively to determine the form and level of community participation in each stage of BUMDes management. The results of the study showed that community participation in the planning and formation stages of BUMDes was quite good through community involvement in village deliberations, providing ideas, and supporting village business programs. However, the implementation of BUMDes in Betimus Mbaru Village has failed, especially in the livestock development program. The failure was caused by limited human resources (HR), both in terms of knowledge, business management skills, and supervision of BUMDes activities. In addition, low community participation in the supervision stage is also a factor that affects the suboptimal management of BUMDes. Therefore, it is necessary to increase the capacity of human resources through training, mentoring, and strengthening transparency and supervision so that the management of BUMDes can run more effectively and sustainably.

Abstract

This study aims to analyze corporate mergers as a business strategy—whether they are pursued as a deliberate choice or as a necessity driven by external pressures such as financial crises, intense market competition, or regulatory changes. In the era of globalization and rapid market dynamics, many companies opt to merge to strengthen their market position, improve operational efficiency, and enhance shareholder value. This research employs a qualitative method with a case study approach, focusing on several Indonesian companies that have undergone mergers in the past five years. Data were collected through in-depth interviews, document analysis, and literature review on mergers and acquisitions. The findings reveal that most mergers are driven by a combination of strategic choices and market-driven necessities. In certain cases, mergers were imperative to ensure business continuity due to poor financial performance or regulatory pressures. The study concludes that corporate mergers should not be viewed dichotomously as either a choice or a necessity, but rather as a strategic process influenced by a variety of internal and external factors.

Abstract

Hukum pembuktian sendiri terkait dengan hak-hak terdakwa dalam sistem peradilan pidana, seperti hak untuk berdiam diri atau hak mendapat pembelaan yang layak. Hukum pembuktian memastikan dalam prosesnya peradilan pidana adil dan bahwa terdakwa memiliki hak-hak yang dilindungi dalam proses pengadilan. Tujuan penelitian ini adalah untuk mengetahui pembuktian terhadap penipuan online berkedok asmara sesuai dengan UU ITE. Metode penelitian yang diterapkan adalah jenis penelitian kepustakaan, di mana sumber data yang digunakan adalah data sekunder yang telah ada dalam bentuk dokumen-dokumen. Sumber data utama adalah jurnal ilmiah yang terkait dengan penipuan online berkedok asmara yang ditemukan secara online. Hasil yang didapat pada penelitian ini adalah dengan majunya perkembangan zaman, tindak pidana penipuan online berkedok asmara sudah bisa dihukum. Dan yang bisa dan berkompeten dalam mencari barang bukti tersebut merupakan polisi virtual sesuai Surat Edaran Kapolri Nomor SE/2/II/2021 tentang Kesadaran Budaya Beretika untuk Mewujudkan Ruangan Digital Indonesia yang Bersih, Sehat, dan Produktif. Kesimpulan yang didapat adalah dengan seiring berkembangnya globalisasi teknologi, tidak sedikit orang memanfaatkan media sosial menggunakan citra palsu, identitas palsu, sampai banyak korban yang merasakan kerugian baik secara finansial sampai fisik ataupun jasmani mereka.
