Debates concerning women’s roles in public and domestic spheres remain a dynamic and contested issue within Muslim societies. This study seeks to negotiate the competing paradigms that support and oppose women’s positioning in these two domains by employing feminist hermeneutics and the qirāʾah mubādalah approach. The research adopts a historical–factual design based on a library research method. Data are collected through systematic documentation of relevant texts and analyzed using a descriptive qualitative approach, with validity ensured through source triangulation and data cross-checking. The findings indicate that a proportional reinterpretation of women’s public and domestic roles requires a transformation in mindset among both men and women, enabling each to optimize their respective potentials and contributions. Gender equality is understood not as a fixed or static endpoint, but as a dynamic and evolving condition in which men and women share balanced rights, obligations, roles, and opportunities grounded in mutual respect. The study emphasizes several foundational principles: reciprocity (mubādalah) in gender relations, the central role of education as a cornerstone of gender equality, and the synergistic relationship between public and domestic roles. Accordingly, both men and women possess the legitimate right to determine and perform roles that correspond to their capacities, potentials, and personal choices, whether within the family or in the broader social sphere.

The increasing rate of divorce in Indonesia indicates that marital conflicts are no longer merely private matters but have evolved into broader social issues affecting community stability. In addition to litigation through religious courts, community-based alternative dispute resolution mechanisms emphasizing deliberation and local wisdom have developed, one of which is mediation conducted by village governments. This study aims to analyze the effectiveness of divorce dispute mediation carried out by the Village Government of Banra’as, Sumenep Regency, and to examine the practice from the perspectives of progressive legal theory and maqasid al-sharia as proposed by Jasser Auda. This research employs an empirical legal method with a qualitative approach. Data were collected through field observations, interviews with village officials and relevant stakeholders, as well as documentation studies, and were analyzed using descriptive-analytical techniques. The findings reveal that village mediation plays a significant role in reducing domestic conflicts and encouraging reconciliation between spouses before cases are brought to the religious court. From the perspective of progressive law, this practice reflects a humanistic, flexible, and substantively just legal approach. Meanwhile, from the perspective of maqasid al-sharia, village mediation represents an effort to preserve family welfare (hifz al-nasl), maintain social stability, and promote holistic societal well-being. Therefore, mediation conducted by village governments can be regarded as an effective and contextual dispute resolution model that aligns with both legal values and socio-religious norms.

This study examines the implementation of the Himpun Satempap Sajari customary tradition in Malay marriage practices in Muaro Tabun Village, VII Koto District, Tebo Regency, Jambi Province, and analyzes it from the perspective of Najmuddin At-Thufi’s concept of maslahah. The study aims to describe the stages, functions, and social relevance of the tradition in contemporary society. This research employs an empirical legal research method using a field research approach. Data were collected through observation, interviews with customary leaders, religious figures, and community members, as well as documentation studies. The data were analyzed using the interactive analysis model of Miles and Huberman, including data reduction, data presentation, and conclusion verification. The findings indicate that Himpun Satempap Sajari consists of several stages, namely Baangkat Bapak, Ngantar Tando, Himpun Ahli Waris, Himpun Sanagari, and Pasang Patauh. These traditions reflect values of solidarity, mutual cooperation, deliberation, and social harmony. From the perspective of Najmuddin At-Thufi’s maslahah theory, the tradition contains social benefits because it strengthens kinship and social relations within the community. However, excessive economic burdens and social sanctions may potentially create social hardship for certain families. Therefore, the implementation of customary practices should prioritize public welfare and adjust to contemporary socio-economic conditions.

Research on the analysis of KH. Faqih Maskumambang's thoughts on the prohibition of using the Kentongan as a prayer time marker from the perspective of the prophet's hadith needs to be conducted. The aim is to describe the understanding of hadith in the classical and contemporary eras. Kentongan is a tool commonly used by some people as a sign of prayer. The use of this tool is a part of the characteristics of Islam in the archipelago. Along with the development of knowledge, traditions have drawn the attention of many circles. The main reason for criticism and refutation is because the use of these tools is considered an act of bid'ah and resembles non-Muslim worship. Even the founding figure of the NU and KH. Hasyim Asy'ari was among those who opposed traditions. In this study, the author used a descriptive-qualitative method with a contextual approach. The primary source used the book Sharh Hazzu al-Ru'us fi Radd al-Jasus 'an Tahrim al-Naqus by KH. Faqih Maskumambang. The result of this study is that, according to KH. Faqih Maskumambang, the hadith used as the basis for the prohibition of the use of the horn is not valid. In fact, another Hadith refutes Hadith, which is more valid. In explaining this, Kyai Faqih took explanations from the Qur'an and Hadith, which have similar topics of discussion. He also takes the opinions of scholars and the methods of fiqh and logic as reinforcements.

This study examines the persistence of the Pitungan tradition as a living legal institution that continues to regulate marital decision-making within the plural socio-religious community of Kraton Gunung Kawi, Malang Regency. While previous studies have primarily interpreted Pitungan as a cultural belief or mystical practice, its function as an autonomous normative system within contemporary legal pluralism remains underexplored. Employing an empirical socio-legal approach, this research integrates field observations, document analysis, and in-depth interviews with kuncen, religious leaders, interfaith couples, and community elders. The findings demonstrate that Pitungan operates as an autopoietic normative subsystem that reproduces legal meaning through an internal binary code of patut and gak patut, thereby reducing uncertainty and reinforcing family stability. Interpreted through Niklas Luhmann's legal functionalism, Teubner's autopoiesis, Latour's Actor-Network Theory, and Jasser Auda's systemic Maqāṣid al-Sharī‘ah, the tradition reveals a mature form of interlegality in which customary norms, Islamic values, and state law interact complementarily rather than competitively. This interaction generates a new epistemological construct, Living Maqasid, operationalized through a Contextual Benefit-Based Harmonious Family Model that embeds hifẓ al-nasl and jalb al-maṣāliḥ within localized legal practices. The study contributes to socio-legal scholarship by reconceptualizing local wisdom as an adaptive legal-functional mechanism and recommends integrating respected customary authorities into state-based premarital counseling and family resilience programs.
