Abstract

Realitas sosial adalah kenyataan atau fakta yang terjadi dalam kehidupan masyarakat. Ia selalu berubah dan berkembang sesuai dengan perubahan dan perkembangan zaman. Dalam ajaran Islam realitas sosial tidak dibiarkan mengalir begitu saja, melainkan ada syariat yang mengatur dan mengarahkannya kepada sesuatu yang diridhai oleh Allah SWT. Ushul fiqh sebenarnya cukup bisa memberikan respon terhadap realitas sosial. Hanya saja, bukan ushul fiqh yang bertumpu pada makna teks. Melainkan, dengan ushul fiqh baru yang lebih mengedepankan sisi nalar atau bertumpu kepada maqashid syari’ah, yakni makna atau tujuan yang ada di balik teks. Ushul fiqh yang semacam ini yang kemudian juga mampu melahirkan fiqh kontekstual atau fiqh sosial yakni fiqh sebagai respon terhadap realitas sosial masyarakat. Pesantren sendiri sebenarnya sangat potensial untuk menjaga dan mengambangkan ilmu ushul fiqh semacam ini. Sebaliknya, tidak berkutat dengan fiqh tradisional (klasik) begitu juga ushul fiqh tradisional yang hanya terpaku kepada makna-makna literal.

Abstract

The study of local custom law and Islamic law in Minangkabau is a media to know how Islamic law and local custom law contacted. The current development descibed that there was a harmony and contact between both of them. It created an acculturation in activity of Minangkabau Traditional Inheritance today. This paper discussed contiguity between Islamic law and custom law in Minangkabau society. Furthermore, this paper wrote Kajian hukum adat dan hukum Islam di Minangkabau menjadi wacana untuk melihat bagaimana perjumpaan antara hukum Islam dan hukum adat di Minangkabau. Perkembangan terakhir menunjukkan adanya harmoni dan interaksi di antara keduanya. Sehingga ada proses akulturasi dalam menampilkan praktik kewarisan harta pusaka di Minangkabau saat ini. Untuk itu, penelitian ini mengkaji interaksi antara hukum Islam dan hukum adat di masyarakat Minangkabau dalam tinjauan akulturasi. Artikel ini disusun dengan studi kepustakaan. Adapun metode analisa yang digunakan adalah metode konten analisis. Studi ini menunjukkan bahwa ada sinergi antara keteguhan dalam menjalankan hukum adat dengan ketaatan untuk melaksanakan hukum Islam dengan menjadikan falsafah Adat Basandi Syara’ Syara’ Basandi Kitabullah, Syara’ mangato adat mamakai sebagai dasar bagi penyatuan kedua sistem hukum yang berbeda tersebut. Akhirnya, perjumpaan hukum adat dan hukum Islam dalam masyarakat Minangkabau menunjukkan telah terjadi dialog dan merekonstruksi hukum Islam baru dalam nuansa lokal.

Abstract

the curriculum in a broad sense needs to be continuously criticized. In this case, a formulation of PBM activities is needed that does not separate the science, skills and cultural values of the local community. This paper explains the idea of a formulation of the integration of Minangkabau cultural values which is contained in the adagium "Adat Basandi Syarak Syarak Basandi Kitabullah" (ABS SBK) into the curriculum of Islamic Religious Education (PAI) in elementary schools. This integration formulation is carried out as a solution to various kinds of social and moral problems faced by the world of education in the face of the wave of modernization. In addition, it can be believed that the values of "Adat Basandi Syarak Syarak Basandi Kitabullah" are an adagium that becomes the system of life of the people of West Sumatra (Minangkabau) which is based on Islamic religious values (Quran and Hadith of Prophet Muhammad SAW). The purpose of this study was to formulate the idea of ​​an integrated curriculum in the perspective of Minangkabau socio-cultural, adat basandi syarak syarak basandi Kitabullah into Islamic religious education subjects in the basic segolah curriculum. The research method is library research with a descriptive qualitative approach. The results of the study show that the traditional values ​​of basandi syarak syarak basandi Kitabullah can be integrated into Islamic religious education lessons in the elementary school curriculum through a process of integration and interconnection by strengthening the organization of curriculum content.

Abstract

As a tourist destination, West Sumatra will certainly interact directly with foreign cultures. This interaction has the potential to result in the emergence of changes and shrinkage of the pattern of traditional community life. This study examines the enculturation of Minangkabau customs by local leaders (Tali Tigo Sapilin). The problems in this research are, first, how is the process of cultural enculturation carried out by Tali Tigo Sapilin's leadership in West Sumatra? Second, what factors influenced Tali Tigo Sapilin's leadership in the enculturation process in West Sumatra? This study uses a qualitative approach by collecting data through observation, in-depth interviews, and documentation studies, as well as with Focus Group Discussions (FGD). The results of this research indicate that the inheritance of cultural values by Tali Tigo Sapilin's leadership is carried out through alek batagak penghulu, batamat kaji/Khatam Qur'an, Malapeh paga, and badoa bajamba. The factors that influence Tali Tigo Sapilin's leadership in the enculturation process in West Sumatra are the changing role of Tali Tigo Sapilin's leadership in Development, Changes in the Role of Ninik Mamak in Land Ownership.

Abstract

The claim for child’s nafaqah māḍiyah (past income) is often overlooked in the rulings of the Religious Court. This research aims to propose a shifting from the concept of li al-intifā’ (benefit) to li al-tamlīk (ownership) regarding child’s living costs claims in the Religious Court, employing the istihsān (juristic preference) approach. The objective is to ensure a more equitable judgment for the child. This study was conducted as a literature review using a normative juridical approach. The research findings reveal that the legal standpoint, which rejects any claim for child’s nafaqah māḍiyah in the Religious Court based on the argument that child’s living costs is categorized as li al-intifā’, contradicts Islamic legal principles regarding child’s living costs and fails to fulfill the principles of justice, as well as being incongruent with several other legislative provisions related to child protection. Therefore, this article proposes a shifting from the concept of li al-intifā’ to li al-tamlīk in determining child’s nafaqah māḍiyah in the Religious Court.

Abstract

This research aims to examine how Malaysia strives to harmonies the formulation of Civil law, Shariah law, and customary law in its legal system. In 1422, the Law of the Malacca Code was Islamic law and a custom practiced and spread into the Law of the Pahang Code, the Law of Kedah, and the Law of 99 Perak. After the arrival of the British in Malaya, one of the conditions of Malaysia's independence was the adoption of English law based on Common Law with Islam as the official religion of the Federation of Malaysia. This study concludes that first, customary law exerted a significant influence in the formation of laws in Malaysia, as evidenced by the development of laws in Malaysia through the pre-colonial phase of the British occupation, which practiced Islamic law mixed with customary laws, and phases after British colonialism. Second, the global situation in Malaysia does not weaken the development of Islamic law through sanctions, so the relationship between Islamic law and Customs is strengthened by the Malaysian customary constitutional system, Islamic family law, and Islamic jinayah law.Penelitian ini bertujuan untuk mengkaji bagaimana Malaysia berusaha mengharmonikan penggubalan  undang-undang Sivil, undang-undang Shariah dan undang adat dalam sistem undang-undang nya. Pada tahun 1422 Hukum Kanun Melaka adalah undang-undang Islam dan adat yang diamalkan dan tersebar menjadi Hukum Kanun Pahang, Undang-undang Kedah dan Undang-undang 99 Perak. Setelah kedatangan British di Tanah Melayu, salah satu syarat  kemerdekaan Malaysia ialah penerimaan undang-undang Inggeris berasaskan Common Law dengan Islam sebagai agama rasmi bagi Persekutuan Malaysia. Penelitian ini menyimpulkan bahwa pertama, hukum adat memberikan pengaruh yang signifikan dalam pembentukan undang-undang di Malaysia dibuktikan dengan perkembangan undang-undang di Malaysia melalui fase sebelum penjajahan British yang mengamalkan undang-undang Islam bercampur dengan undang-undang adat dan fase setelah penjajahan Inggeris. Kedua, situasi global di Malaysia tidak membuat pelemahan terhadap perkembangan hukum Islam melalui pengkanunan, justru antara hukum Islam dan hukum Adat mengalami penguatan pada sistem perlembagaan adat Malaysia, undang-undang kekeluargaan Islam dan undang-undang jinayah Islam.

Abstract

Legalizing alcoholic beverages under Indonesian Presidential Decree Number 10 of 2021 concerning to Investment Business raises conflicting view with Islamic norms in Indonesian as religious state. Under Islamic norm such prohibition intended to   maintaining of reason (ḥifẓ al-ʿaql), while on the one hand it is for the improvement of the country’s economy (ḥifẓ al-mal). This paper measures such contradictory under maqasid Syariah auspice. The method used is a normative research with a content analysis approach. This paper found that the legalization of investment in alcoholic beverages has not reached to the stage of necessity (ḍaruriyya), while the acquisition of property (ḥifẓ al-mal) was obtained through the legalization of alcoholic beverage investments, only at the level of (taḥsiniyyah). Therefore, something related to the tahsiniya level should not negate the position of ḍaruriyya of ḥifẓ al-ʿaql. Eliminating the potential of greater mafsadah must be put forward by the Indonesian government rather than producing uncertain maslahah.

Abstract

The background of this research is the existence of a very unique tradition in Merangin Village, Kuok District, Kampar Regency, Riau Province to hold walimatul 'ursy, which is the name of the tradition, the bakampuong ughang tradition. The bakampuong ughang tradition is carried out a week before the implementation of the walimatul 'ursy which aims to raise funds so that the bride and groom can also hold a walimatul 'ursy party. The main problems in this study are how the implementation and objectives of the bakampuong ughang tradition and the factors that cause the persistence of the bakampuong ughang tradition, what are the implications or impacts of the bakampuong ughang tradition on the lives of Muslim communities in Merangin Village, Kuok District, Kampar Regency, Riau Province and how is the review 'urf on the implications or impacts of the bakampuong ughang tradition. Based on the results of the research that the writer has done, the writer can conclude that the bakampuong ughang tradition is a habit of the people of Merangin Village, Kuok District, Kampar Regency, Riau Province before the walimatul 'ursy event takes place. The implications or impacts of the bakampuong ughang tradition are: first, the good and bad impacts. The Qur'an and Hadith stipulate that the implementation of walimatul 'ursy is sunnah muakkad, meaning that it is permissible to do it and it is permissible not to do it.
