Abstract

In the partnership agreement between PT. GO-JEK Indonesia with online motorcycle taxi drivers does not meet the principle of balance. The principle of balance which is intended to harmonize legal institutions in agreements known in civil law which has the aim of making the agreement equal or balanced. This study aims to determine the legal consequences of not fulfilling the principle of balance in the partnership agreement between PT. GO-JEK Indonesia Bali Branch With Online Ojek Drivers. As discussed in this study are the legal consequences and legal protection of agreements that do not meet the principle of balance in the partnership agreement between PT. GO-JEK Indonesia Bali Branch with online motorcycle taxi drivers. The research method in this study is a normative research method, which is a legal research library by reviewing regulations and theories of experts related to the problems discussed. After doing the research, it was concluded that the result of the partnership agreement between PT. GO-JEK Indonesia Bali Branch with online motorcycle taxi drivers creates an imbalance between the rights and obligations of the parties. And GO-JEK in resolving problems that cannot be carried out through deliberation is allowed to take legal action by bringing the dispute to a court that has been determined by GO-JEK, namely the South Jakarta Court, but with the determination of the Court by GO-JEK, it can be difficult for partners who live outside city or far from the Court.

Abstract

Penelitian ini bertujuan mengetahui bagaimana sistem pengupahan bagi pekerja yang dirumahkan karena Covid-19 serta penyelesaian perselisihan hubungan industri berkaitan pengupahan pekerja apabila tak tercapainya suatu kesepakatan. Metode penelitian ini yakni metode penelitian normatif yang diteliti memakai literatur serta sumber data sekunder. Jika melihat pada UU ketenagakerjaan pasal 93 ayat 1 yang tidak mewajibkan mebayar upah bagi tenaga kerja yang tidak mengadakan pekerjaan yang dimana bertentangan dengan Keputusan Menteri Tenaga Kerja No.104 Tahun 2021 angka 2 yang menyatakan tetap mebayar upah dengan kesepakatan yang telah dilakukan antara pengusaha dan pekerja. Menurut asas “lex posterior derogat legi priori” dimana UU yang baru meniadakan keberlakuan UU lama. Jadi, UU yang berlaku bagi tenaga kerja di PHK yaitu Keputusan Menteri Tenaga Kerja No.104 Tahun 2021. Kata kunci: Tenaga Kerja, Dirumahkan, Pandemi Covid 19 ABSTRACT Purpose this study is to understand how the wage system functions for workers who have been laid off as a result of the Covid-19 outbreak and, in the event that an agreement cannot be reached, to settle labormanagement conflicts over workers' wages. The normative research approach utilized in this publication is investigated using secondary data sources and literature. When compared to the Decree of the Minister of Manpower No. 104 of 2021 number 2, which states that paying wages is still subject to the agreement that has been reached between employers and employees, the Manpower Act's article 93 paragraph 1 does not require employers to pay wages for employees who do not perform work. According to the legal theory known as lex posterior derogat legi prima, new laws nullify the preceding ones' legal standing. Therefore, the Decree of the Minister of Manpower No. 104 of 2021 is the law that governs workers who have been laid off. Key Words: Manpower, Layoff, Covid 19 Pandemic.

Abstract

The purpose of this research is to understand the aspects of legal certainty related to the Retention/Submission of Original Diplomas Clause in the employment contract applied by the Company and this research also aims to find out the legal protection efforts given to workers who agree to the retention of diploma clause in their employment contract, especially in the context where the Company is considered negligent in maintaining the original diploma belonging to its workers. The research method is normative legal research with an approach to legislation. The results of this study show that in the implementation of employment contracts that include diploma retention/submission clauses, there are no explicit statutory provisions that allow or prohibit the practice. However, regarding the legal requirements of agreements in employment contracts, this is regulated by the Civil Code. Therefore, the legal vacuum regarding whether or not the withholding of diplomas can cause this practice to occur as a result of customs in the world of work, and when related to RI Law No. 39 of 1999 concerning Human Rights is contrary to the principles of human rights because it hampers workers' rights to get better jobs and improve their quality of life. In addition, in the legal protection efforts for workers who agree to the clause of withholding/submission of diplomas in their employment contracts, there are preventive and responsive legal protections. This shows that there are measures to prevent and respond to potential violations of workers' rights in the context of such clauses.

Abstract

Penelitian ini guna mendapatkan pemahaman yang lebih baik tentang perlindungan konsunen terhahdap penjualan rokok kepada anak di bawah unur dan upaya yang dapat dilakukan pemerntah dan warga negra untuk mencegah anak-anak menjadi pengguna rokok. Metde penelitian yang digunakan adalah penelitian kaidah normatif. Informasi yang diperoleh berasal dari studi kepustakaan yang mengacu pada sumber peraturan sekunder seperti buku-buku dan perturan perundang-undangan yang relavan untuk kasus tertentu. Berdasarkan hasil penelitian, dapat ditark kesimpulan sebagai beikut (1) Perlindngan hukum bagi anak yang menggunakan tembakau masih belum optimal. Padahal Pasal 25 Peraturan Pemerintah Republik Indonesia Tahun 2012 No. 109 tentang Pengawasan Bahan Yang Mengandung Narkotika Pada Produk Tembakau melarang keras penjualan rokok terhadap anak berusia di bawah umur, pengingkaran terhadap peraturan tersebut terus terjadi. Hal ini biasa terjadi, sehingga anak-anak terus menjadi sasaran penjualan rokok oleh pengecer. (2) Pemerintah berusaha melindungi konsumen karena kandunggan tar dan nikotin pada prorduk rokok. Sebagai langkah preventiff, Badan Pengawas Obat dan Makaman (BPOM) menekan perusahaan dan produsen rokok untuk menberikan informasi yang jelas, akurat, dan jujur. Selain itu, promosi rokok juga memiliki efek lingkungan yang mempengaruhi anak di bawah umur. Oleh sebab itu, harus mengambil langkah yang tegas dari pemerintah untuk mengatasi masalah ini. ABSTRACT This research aims to gain a better understanding of consumer protection against the sale of cigarettes to children under age and efforts that can be made by the government and citizens to prevent children from becoming smokers. The research method used is normative research. The information obtained comes from a literature study that refers to secondary regulatory sources such as books and laws and regulations that are relevant to certain cases. Based on the research results, the following conclusions can be drawn (1) Legal protection for children who use tobacco is still not optimal. Even though Article 25 of the Government Regulation of the Republic of Indonesia of 2012 No. 109 concerning Control of Substances Containing Narcotics in Tobacco Products strictly prohibits the sale of cigarettes to minors, violations of these regulations continue to occur. This is so common, that children continue to be targeted by retailers for cigarette sales. (2) The government tries to protect consumers because of the tar and nicotine content in cigarette products. As a preventive measure, the Drug and Cemetery Monitoring Agency (BPOM) is pressing cigarette companies and manufacturers to provide clear, accurate and honest information. In addition, cigarette promotion also has environmental effects that affect minors. Therefore, the government must take firm steps to overcome this problem.

Abstract

Penelitian bertujuan untuk mengetahui pelaksanaan pemberian kredit bagi krama desa lain oleh Lembaga Perkreditan Desa (LPD) beserta keabsahan Personal Guarantee dalam menjamin pinjaman krama desa lain di LPD. Penulisan artikel ini menggunakan metode penelitian hukum empiris dengan pendekatan perundang-undangan dan fakta. Penelitian ini menunjukkan hasil bahwa pelaksanaan pemberian kredit bagi krama desa lain oleh LPD tidak memenuhi syarat perjanjian kerjasama antar desa, melainkan digantikan dengan syarat berupa Perjanjian Personal Guarantee dari krama desa setempat. Hal ini disebabkan oleh masih belum adanya bentuk perjanjian kerjasama antar desa yang disepakati dan dapat dijadikan acuan oleh LPD dalam memberikan pinjaman kepada krama desa lain. Keabsahan Personal Guarantee dalam menjamin pinjaman krama desa lain ditinjau dari pasal 1320 KUHPerdata telah melanggar syarat objektif dari perjanjian sebagaimana tercantum dalam pasal 1320 KUHPerdata point 4 (sebab yang halal) yakni tidak memenuhi ketentuan Pasal 7 ayat (1) huruf c Peraturan Daerah Provinsi Bali No. 3 Tahun 2017 tentang Lembaga Perkreditan Desa (LPD) yang mewajibkan adanya perjanjian Kerjasama Antar Desa. Akibat hukum dari tidak sahnya Personal Guarantee dalam menjamin pinjaman krama desa lain adalah perjanjian Personal Guarantee tersebut batal demi hukum, sehingga tidak memiliki kekuatan hukum yang mengikat pihak penjamin krama desa setempat untuk melunasi kewajiban debitur krama desa lain yang wanprestasi. Pihak LPD juga tidak dapat menuntut pihak penjamin untuk memenuhi isi dari Personal Guarantee karena Personal Guarantee tersebut batal demi hukum, sehingga hal ini tentu sangat merugikan pihak LPD. ABSTRACT The research aims to determine the implementation of providing credit for other village resident by the Village Credit Institution (LPD) along with the validity of the Personal Guarantee in guaranteeing loans for another village resident in the LPD. This article was written using empirical legal research methods with a statute and factual approach. This research shows the results that the implementation of credit provision for other village by the LPD does not fulfill the requirements of the inter-village cooperation agreement, but is replaced by Personal Guarantee Agreement from the local village resident. It’s because there is still no agreed form of cooperation agreement between villages that can be used as a reference by the LPD in providing loans to another village resident. The validity of the Personal Guarantee in guaranteeing other villages' resident loans has violated the objective terms of the agreement as stated in Article 1320 of the Civil Code point 4 (halal causes), namely not fulfilling the provisions of Article 7 paragraph (1) letter c of Bali Provincial Regulation No. 3 of 2017 concerning Village Credit Institutions (LPD) which requires cooperation agreements between villages. The legal consequence of the invalidity of a Personal Guarantee in guaranteeing another village's resident loan is that the Personal Guarantee agreement is null and void, so it has no legal force binding the local village resident guarantor to pay off the obligations of other village resident debtors who are in default. The LPD also cannot demand that the guarantor fulfill the contents of the Personal Guarantee because the Personal Guarantee is null and void, so this is of course very detrimental to the LPD.

Abstract

Penelitian ini akan menganalisis penyebab tidak optimalnya pelayanan bantuan hukum dan memformulasikan mekanisme penyelenggaraan pelayanan bantuan hukum. Penelitian ini merupakan penelitian normative dengan pendekatan perundang-undangan, analisis dan konsep. Bahan hukum primer berupa peraturan perundang-undangan dan bahan hukum skunder berupa buku, jurnal dan artikel terkait dengan bantuan hukum dikumpulkan dengan metode studi dokumen, kemudian dianalisa dengan teknik deskriptif. Penelitian ini menemukan terdapat tiga alasan pelayanan bantuan hukum belum optimal bagi masyarakat tidak mampu, diantaranya adalah mengenai pengaturan penerima bantuan hukum terbatas pada orang atau kelompok orang miskin yang mengesampingkan kelompok rentan lainnya, kemudian belum jelasnya pengaturan fungsi dan kewajiban pemberi bantuan hukum diantaranya advokat, paralegal, dosen dan mahasiswa fakultas hukum serta penataan verifikasi dan akreditasi lembaga bantuan hukum dan pendanaan yang dialokasikan oleh daerah masih perlu dibenahi. Mengenai formulsi mekanisme pelayanan bantuan hukum perlu dilakukan penataan ulang lembaga bantuan hukum dengan membagi keberadaan lembaga bantuan hukum, perbaikan ketentuan verifikasi dan akreditasi, Memperluas pendanaan bantuan hukum dengan mewajibkan daerah dalam mengalokasikan pendanaan pemberian bantuan hukum, memberikan penghargaan tergadap lembaga bantuan hukum yang mampu memberikan bantuan hukum secara optimal, serta membentuk pengawasan yang terintegrasi terhadap pelayanan bantuan hukum dan mengikut sertakan masyarakat dalam pengawasan. ABSTRACT This research will analyze the causes of non-optimal legal aid services and formulate a mechanism for providing legal aid services. This research is normative research with statutory, analytical and conceptual approaches. Primary legal materials in the form of laws and regulations and secondary legal materials in the form of books, journals and articles related to legal aid were collected using the document study method, then analyzed using descriptive techniques. This research found that there are three reasons legal aid services have not been optimal for the poor, including the regulation of legal aid recipients limited to people or groups of poor people who exclude other vulnerable groups, then the unclear regulation of the functions and obligations of legal aid providers including advocates, paralegals, lecturers and law faculty students as well as the arrangement of verification and accreditation of legal aid institutions and funding allocated by the regions still need to be addressed. Regarding the formulation of legal aid service mechanisms, it is necessary to reorganize legal aid institutions by dividing the existence of legal aid institutions, improving verification and accreditation provisions, expanding legal aid funding by requiring regions to allocate funding for legal aid, giving awards to legal aid institutions that are able to provide legal aid optimally, and forming integrated supervision of legal aid services and including the community in supervision.

Abstract

Penelitian ini bertujuan untuk mengetahui hambatan penerapan mekanisme perlindungan hukum yang dijamin oleh Undang-Undang Nomor 30 Tahun 2000 tentang Rahasia Dagang, dan untuk melihat pengaplikasian mekanisme perlindungan hukum tersebut dalam perspektif penggunaan rahasia dagang di era digital. Penelitian ini menggunakan metode normatif yang bersifat deskriptif dengan pendekatan perundang-undangan. Hasil penelitian menunjukan bahwa perlindungan preventif yang dijamin oleh Undang-Undang Nomor 30 Tahun 2000 tentang Rahasia Dagang tidak dapat memberikan kepastian hukum di era digital ini. Arus akselerasi transformasi digital telah membuka ancaman baru bagi rahasia dagang melalui keterbukaan informasi yang tidak terkontrol. Penerapan mekanisme perlindungan hukum yang masih belum berubah selama lebih dari dua dekade tersebut akan berakhir dengan diperolehnya perlindungan yang pasif oleh para inventor. Sehingga pembaharuan terhadap mekanisme perlindungan rahasia dagang akan diperlukan.

Abstract

IPTEK menjadi bagian penting dalam berbagai aspek kehidupan manusia. Perkembangan IPTEK mempengaruhi berbagai bidang, diantaranya bidang pendidikan, pertahanan, transportasi, perdagangan, dan komunikasi. Penelitian ini bertujuan untuk mengetahui dan menganalisa pelanggaran hukum atas pengunggahan kembali potongan video podcast yang mengndung hoax merugikan content creator dan mengetahui dan menganalisa perlindungan hukum atas pengunggahan kembali potongan video podcast yang mengndung hoax merugikan content creator. Penulisan artikel hukum digolongkan sebagai penelitian normatif. Penulisan menggunakan 2 (dua) pendekatan yakni, pendekatan perundang-undangan dan strategi konseptual. Jenis pendekatan ini menggunakan tiga sumber bahan hukum: bahan primer, sekunder, dan tersier. Semua sumber ini dikumpulkan seluruhnya melalui teknik studi dokumen, dan teknik kualitatif akan digunakan untuk analisis. Hasil penelitian ini menunjukkan bahwa pengunggahan potongan video podcast yang mengandung hoaks melanggar hukum dan merugikan content creator, dengan pelanggaran tersebut diatur oleh UU ITE dan UU Hak Cipta. Meskipun undang-undang tersebut memberikan perlindungan, implementasinya seringkali tidak efektif karena ketidakjelasan dalam penegakan hukum dan definisi yang multitafsir. Science and Technology (IPTEK) has become an important part of various aspects of human life. The development of IPTEK impacts several fields, including education, defense, transportation, trade, and communication. This research aims to understand and analyze the legal violations related to the reposting of podcast video clips containing hoaxes that harm content creators and to examine the legal protection against such reposting. The legal article writing is classified as normative research. The writing uses two approaches: the legislative approach and the conceptual strategy. This approach employs three sources of legal materials: primary, secondary, and tertiary. All these sources are collected through document study techniques, and qualitative techniques will be used for analysis. The results of this study indicate that reposting podcast video clips containing hoaxes violates the law and harms content creators, with such violations regulated by the ITE Law and the Copyright Law. Although these laws provide protection, their implementation is often ineffective due to ambiguities in law enforcement and interpretative issues.
