Abstract

In line with the progress of the global economy, especially in Indonesia, it is recognized that a digitalization and modernization era has taken place, which continues to evolve and never ceases. This necessitates cooperatives to strengthen themselves to be healthier, self-reliant, modern, strong, and competitive, in accordance with cooperative principles, enabling them to play a role as a "pillar of the national economy." In April 2022, the Minister of Cooperatives and Small and Medium Enterprises Regulation on Cooperatives with a Multi-Party Model Number 8 of 2021, hereinafter referred to as "Permenkop UKM KMP," came into effect on October 21, 2021. In other countries, the Multi-Party Model Cooperatives, referred to as "KMP," have been commonly used for various business purposes. For example, they have been established in the United Kingdom since 1870, in the United States since the 1990s, in Italy since 1991, in Canada since 1997, in Portugal since 1998, and in France since 2001. Firdaus Putra, the Chairman of the Indonesian Consortium For Cooperative Innovation (ICCI), mentioned in a webinar on the dissemination of Minister of Cooperatives and SMEs Regulation No. 8 of 2021 concerning Multi-Party Model Cooperatives, that Italy is the best-practice example of KMP globally, with approximately 14,000 KMPs as of today. However, with the issuance of Permenkop UKM KMP in Indonesia, the history of Permenkop UKM KMP began only in 2022, making it a relatively new terminology in Indonesia. The issuance of Minister of Cooperatives and SMEs Regulation Number 8 of 2021 on Cooperatives with a Multi-Party Model raises several questions about the reasons behind the introduction of this new regulation. For instance, is the regulation solely implemented as a UUCK (Job Creation Law) enforcement measure, given the mention of the need for cooperatives to support job creation, even though it is not explicitly explained which type of cooperatives are referred to in the UUCK.

Abstract

This article conducts an analysis of securities-based crowdfunding (SCF) as an alternative funding source outside traditional banking institutions. It explores whether the primary objective of SCF in Indonesia is indeed to advance the economy of the people, particularly focusing on Small and Medium Enterprises (SMEs). The article presents various perspectives on the concept of collective funding, where a group of contributors finance SME and startup projects, enabling these ventures to operate and progress. This approach aligns with the principles of a people-centered economy, which is characterized by an economy of the people, by the people, and for the people. The aim is to foster the people's economy, imbued with the characteristics of the Indonesian society which is religious and believes in sharing prosperity with others, as mandated by Article 33 of the 1945 Constitution of the Republic of Indonesia.

Abstract

This research aims to analyze indications of monopolistic practices in the digital space and find formulations for digital market regulation to create a fairer digital ecosystem. Law No. 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition does not yet specifically regulate the prohibition of monopolistic practices and unfair business competition in the digital space, so the incompleteness of this regulation needs to be investigated further. This research was conducted using a normative juridical approach. The results of this research show that indications of monopolistic practices in the digital space are related to the unclear categories of business actors who sell at a loss in e-commerce and the combination of social media and e-commerce. Based on these weaknesses, the author obtains a formulation based on the Digital Markets Act regulations in the European Union which creates "gatekeepers" in the digital economy to create a healthy market.

Abstract

Penelitian ini bertujuan untuk mengkaji dan menganalisis bagaimana perlindungan data dan informasi pelanggan debitur dalam perspektif hak asasi manusia. Metode penelitian yang digunakan adalah penelitian hukum dengan pendekatan perundang-undangan, pendekatan filosofis, dan pendekatan konseptual. Hasil penelitian ini menunjukkan bahwa perlindungan data dan informasi pelanggan debitur dilakukan dengan menerapkan aturan kerahasiaan bank. Namun, aturan kerahasiaan bank di Indonesia masih tidak memadai, karena ruang lingkup perlindungannya sempit, hanya mencakup pelanggan penyimpan dan simpanan dari pelanggan penyimpan. Hal ini telah melanggar hak-hak pelanggan debitur. Perlindungan data dan informasi merupakan hak asasi manusia yang fundamental, sebagaimana diakui dalam UDHR dan ICCPR, serta di Indonesia mencerminkan Pancasila sila kedua, yang dilindungi oleh konstitusi, hukum hak asasi manusia, dan undang-undang perlindungan data pribadi. Sebagai negara hukum, Indonesia menjunjung pendekatan yang seimbang terhadap hak asasi manusia, memastikan hak pelanggan debitur untuk perlindungan data sambil mempertimbangkan hak publik untuk mengakses informasi tertentu dalam kasus-kasus mendesak. Keseimbangan ini sejalan dengan teori utilitarianisme hukum alam, yang menekankan baik pada privasi maupun transparansi yang diperlukan.Kata Kunci: Perlindungan Hukum, Data Pribadi, Debitur, Perbankkan This research aims to examine and analyse how the protection of debtor customer data and information in the perspective of human rights. The research method used is legal research with a statutory approac h, philosophical approach and conceptual approach. The results of this study indicate that the protection of debtor customer data and information is by implementing bank secrecy rules. However, the rules of bank secrecy in Indonesia are inadequate, because the scope of protection is narrow, covering only depositing customers and deposits of depositing customers. This has violated the rights of debtor customers. The protection of data and information is a fundamental human right, as recognized in the UDHR and ICCPR, and in Indonesia, it reflects the 2nd Precept of Pancasila, safeguarded by the constitution, human rights law, and personal data protection law. As a rule-of-law state, Indonesia upholds a balanced approach to human rights, ensuring debtor customers' right to data protection while considering the public's right to access certain information in urgent cases. This balance aligns with the utilitarian theory of natural law, emphasizing both privacy and necessary transparency.Keywords: Legal Protection, Personal Data, Debtors, Banking

Abstract

Notaries in Indonesia have the authority to make authentic deeds, including auction minutes, as stipulated in Article 15 paragraph (2) letter g of the Notary Position Law (UUJN). However, this provision contradicts the Minister of Finance Regulation (PMK) No. 189/PMK.06/2017 which stipulates that class II auction officials have the authority to make auction minutes. The conflict of norms between these two regulations has created legal uncertainty that risks causing disputes related to the validity of the deed of minutes of auction made by a notary. This research aims to analyze the legal certainty of the deed of minutes of auction made by a notary and propose a legal solution in the form of regulatory harmonization to avoid overlapping authority. The research method used is normative legal research with a statute approach, conceptual approach, and historical approach. The results showed that the inconsistency between UUJN and PMK No. 189/PMK.06/2017 can cause the cancellation of the deed of minutes of auction made by a notary, increase the potential for legal disputes, and cause uncertainty for the parties involved in the auction transaction. Therefore, it is necessary to harmonize the regulations by adjusting the UUJN or PMK so that the rules related to the authority to make the deed of minutes of auction are clearer and do not overlap. This step is expected to provide legal certainty for the community and improve administrative efficiency in auction practices in Indonesia.

Abstract

The emergence of algorithmic contracts, made or carried out by independent systems, creates difficult legal problems, especially in Indonesia's regulatory environment. This study examines whether Indonesia’s Information and Electronic Transactions Law is adequate to deal with new problems with algorithmic pricing, EAs, and automated contract creation. The article also examines the different types of algorithmic contracts and how black-box algorithms are used in dynamic pricing in business competition. It shows how unclear the law is about agency, consent, and accountability.  Using doctrinal legal research combined with conceptual, comparative, and interdisciplinary approaches, the study finds that Indonesia's Information and Electronic Transactions Law and Competition Law have become inadequate in responding to developments in AI-driven transactions. It suggests a legal framework that does not favour any one technology and recognises algorithms as helpful agents. It also calls for changes to the law to clarify how electronic agents can work together and negotiate. This method ensures that businesses are held accountable and that the law is clear in the age of self-driving digital contracts.

Abstract

Abstrak Notaris memiliki kewajiban menyelenggarakan protokol yang diawasi oleh Majelis Pengawas Daerah (MPD). Di era digital dan cybernotary, mekanisme pengawasan manual dinilai tidak lagi memadai dalam menjawab tuntutan efisiensi, transparansi, dan akuntabilitas. Meski telah ada inisiatif sistem berbasis teknologi seperti SIEMON, belum tersedia regulasi yang secara khusus mengatur mekanisme pengawasan protokol notaris melalui sistem digital. Kekosongan hukum ini berpotensi menimbulkan ketidakpastian hukum dan melemahkan fungsi pengawasan. Penelitian ini bertujuan menganalisis urgensi pengaturan pengawasan digital oleh MPD dalam menghadapi perkembangan cybernotary. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Analisis dilakukan melalui teori konvergensi hukum dan teknologi, teori hukum progresif, teori kepastian hukum, serta teori kewenangan untuk memahami kelemahan regulasi yang ada dan merumuskan arah pengaturan ideal. Hasil penelitian menunjukkan bahwa sistem pengawasan manual tidak lagi relevan dengan perkembangan masyarakat digital dan kebutuhan layanan hukum modern. Regulasi baru diperlukan untuk memastikan kepastian hukum, integritas jabatan notaris, serta perlindungan hukum bagi masyarakat. Dari aspek filosofis, yuridis, dan sosiologis, pengaturan ini mendesak untuk diwujudkan sebagai dasar hukum yang adaptif terhadap transformasi teknologi, sekaligus menjamin profesionalisme notaris sebagai officium nobile. Kata Kunci: Cybernotary, Pengawasan Digital, Protokol Notaris, Majelis Pengawas Daerah, Kepastian Hukum. Abstract Notaries are obliged to manage protocols under the supervision of the Regional Supervisory Council (MPD). In the digital and cybernotary era, conventional manual supervision mechanisms are no longer adequate to address the demands for efficiency, transparency, and accountability. Although initiatives such as SIEMON have been introduced, there is still no specific regulation governing technology-based supervision of notarial protocols. This legal vacuum may result in uncertainty and weaken supervisory functions. This study aims to analyze the urgency of regulating digital supervision by MPD in response to the development of cybernotary practices. The research employs normative legal methods using statutory and conceptual approaches. The analysis applies the theory of law and technology convergence, progressive law theory, legal certainty theory, and authority theory to examine current regulatory shortcomings and formulate the direction of ideal regulation. The findings reveal that manual supervision is no longer relevant to the dynamics of a digital society and the needs of modern legal services. New regulations are required to ensure legal certainty, uphold the integrity of the notary office, and protect public interests. Philosophical, juridical, and sociological considerations highlight the urgency of establishing adaptive regulations that align with technological transformation while ensuring the professionalism of notaries as officium nobile. Abstract

The validity of a notarial deed as an authentic deed is highly dependent on the fulfillment of formal procedures, one of which is the inclusion of a notary's signature. However, in notarial practice, there are conditions where a notary is unable to affix a signature conventionally due to health reasons or physical constraints. Meanwhile, the Notary Law (UUJN) explicitly requires a signature as part of the validity of the deed. This phenomenon has given rise to an alternative practice in the form of a notary's thumbprint as a substitute for a signature. However, UUJN has not explicitly regulated the legality of this action. This study aims to normatively analyze the positive law regarding notary signatures and evaluate the possibility of a notary's thumbprint being legally recognized in Indonesian positive law. This study uses a normative juridical approach with qualitative analysis techniques. The method used is normative legal research with a statutory approach and a conceptual approach. The results of the study indicate that there is a legal vacuum that has an impact on the uncertainty of the status of deeds that are thumbprinted by notaries. Therefore, it is necessary to reconstruct norms and legal interpretations that are adaptive, responsive and progressive to ensure legal protection and certainty for the parties. Keabsahan akta notaris sebagai akta otentik sangat bergantung pada pemenuhan prosedur formal, salah satunya adalah pencantuman tanda tangan notaris. Namun, dalam praktik kenotariatan, terdapat kondisi di mana notaris tidak mampu membubuhkan tanda tangan secara konvensional karena alasan kesehatan atau kendala fisik. Sementara itu, Undang-Undang Jabatan Notaris secara eksplisit mensyaratkan tanda tangan sebagai bagian dari keabsahan akta. Fenomena ini memunculkan praktik alternatif berupa pembubuhan cap jempol oleh notaris sebagai pengganti tanda tangan. Akan tetapi, UUJN belum secara eksplisit mengatur legalitas tindakan tersebut. Penelitian ini bertujuan untuk menganalisis secara normative hukum positif mengenai tanda tangan notaris dan mengevaluasi kemungkinan cap jempol notaris diakui secara sah dalam hukum positif Indonesia. Penelitian ini menggunakan pendekatan yuridis normatif dengan teknik analisis kualitatif. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa terdapat kekosongan hukum yang berdampak pada ketidakpastian status akta yang dibubuhi cap jempol oleh notaris. Oleh karena itu, diperlukan rekonstruksi norma dan interpretasi hukum yang adaptif, responsif dan progresif untuk menjamin perlindungan hukum dan kepastian bagi para pihak.

Abstract

he purpose of this study are to know the process of online sale and purchase transactions and to find out the problem in online sale transaction and settelment efforts.The approach method used in this research is the normative juridical approach, meaning that legal research is done by examining library materials or secondary data. Data analysis method used is qualitative analysis. From the results of this study it can be concluded 1) the process of buying and selling transactions online (Site Lazada.co.id) include: entry to the site / web shop online, choose the type of goods desired, click the purchase order, make payment transactions, the merchant to send goods 2) problems in online buying and selling transactions and the settlement efforts such as the weakness of the consumer position against the business actors, the validity of the agreement pursuant to Article 1320 Civil Code and no guarantor institution on line. Efforts through the granting of trust by business actors in the website, the consumer can know the business actor is a provider of electronic transactions that can be trusted. The government should increase awareness of consumers to want to report losses due to online transactions

Abstract

Penelitian ini bertujuan untuk menganalisis pembelajaran dua siswa lamban belajar dan mengetahui penyebab lamban belajar pada anak kelas VI SD Negeri Bacem Kabupaten Madiun. Penelitian ini menggunakan pendekatan kualitatif studi kasus dengan metode pengumpulan data observasi, wawancara, dan dokumentasi. Hasil analisis dalam penelitian ini menunjukkan bahwa terdapat salah satu siswa lamban belajar tersebut dalam kegiatan pembelajaran sering tertinggal dibandingkan teman-temannya, selalu mendapatkan nilai di bawah Kriteria Ketuntasan Minimal (KKM), lebih pasif, lebih sensitif, kurang fokus, sering bermain sendiri bahkan memperhatikan tapi materi tidak bisa diserap dengan baik ketika guru menjelaskan materi, Hal ini dikarenakan kognitif siswa lamban belajar terbatas, sehingga setiap mengerjakan soal yang diberikan oleh guru. Hal ini membuat guru merasa kesulitan ketika menghadapi peserta yang mengalami Slow Leaner karena pembelajaran tetap dilanjutkan sesuai waktu namun peserta didik tersebut dibiarkan dan terus menyesuaikan, Beberapa faktor menyebabkan siswa lamban tersebut adalah faktor perkembangan anak, faktor kondisi lingkungan keluarga, sehingga membuat anak tersebut tidak berprestasi optimal secara akademiknya.
