Abstract

Background. This study was conducted to analyze and assess the barriers in the implementation of oil palm plantation contributions to the government and local communities in Kampar Regency, Riau. Purpose. The samples of this research are oil palm plantation companies and local communities located in Kampar Regency, Riau. Method. n its discussion, the researcher uses a normative juridical approach, the normative juridical approach used in this research is an approach through positive law, namely positive legal rules to find the legality of the data used is secondary data where journals, articles, books, reviews, papers, and others become the main source in this research. Results. The results of this study indicate that 1) the analysis of the contribution of development in the field of capitalization of oil palm plantations by plantation companies to the government and society has not been significant to economic growth. 2) the implementation of oil palm companies towards the government and the people of Kampar Regency, Riau is a different understanding and implementation in perceiving the law, the effectiveness of the budget year is still lacking, the budget is not absorbed, and employment is not absorbed. Conclusion. In addition, field research can also be used as a complement, namely interviews supported by primary data.

Abstract

Background. The use of Intellectual Property Rights, especially product brand registration for Micro, Small and Medium Enterprises, has not been running optimally in Indonesia, and especially in the city of Pekanbaru, due to the lack of understanding of home industry entrepreneurs about brands and registration procedures, lack of technical guidance and programmatic socialization from the Regional Government. Purpose. This study aims to analyze the low implementation of product trademark registration for Micro, Small and Medium Enterprises and to analyze the role of the local government of Pekanbaru city in the implementation of product trademark registration for Micro, Small and Medium Enterprises in improving trade business. Method. The approach used in this study is a normative juridical approach and an empirical juridical approach to obtain correct and objective research results. Results. Based on the results of the study, it is known that the implementation of product trademark registration for Micro, Small and Medium Enterprises in Pekanbaru city has not been running as expected, as evidenced in 2022, out of 25,074 trademarks circulating in the market, only 8 (eight) have implemented their trademark registration. Conclusion. Furthermore, it is known that the role of local government in the implementation of trademark registration for Micro, Small and Medium Enterprises in Pekanbaru city is not running as expected, because the local government of Pekanbaru city has not given maximum attention to Micro, Small and Medium Enterprises so that they do not develop and make updates in innovating in accordance with science and technology and community needs.

Abstract

Indonesia menghadapi paradoks pembangunan, yaitu memiliki kekayaan sumber daya alam yang melimpah tetapi masih mengalami keterbatasan dalam menghasilkan dan mengomersialisasikan kekayaan intelektual berbasis inovasi. Ketergantungan terhadap sektor ekstraktif menyebabkan nilai tambah ekonomi dari berbagai komoditas strategis lebih banyak dikendalikan melalui teknologi dan paten negara lain. Penelitian ini bertujuan menganalisis faktor struktural yang menyebabkan lemahnya kedaulatan kekayaan intelektual Indonesia serta merumuskan desain kelembagaan riset berbasis keunggulan wilayah sebagai strategi transformasi menuju ekonomi berbasis pengetahuan. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, historis, dan komparatif. Data penelitian diperoleh melalui kajian terhadap peraturan perundang-undangan, literatur akademik, serta data sekunder dari lembaga resmi seperti World Intellectual Property Organization (WIPO), UNESCO Institute for Statistics, Badan Pusat Statistik, dan Direktorat Jenderal Kekayaan Intelektual. Hasil penelitian menunjukkan bahwa keterlambatan Indonesia dalam pengembangan kekayaan intelektual tidak semata-mata disebabkan oleh rendahnya kapasitas inovasi, tetapi dipengaruhi oleh kelemahan desain hukum, rendahnya pembiayaan riset, sentralisasi kelembagaan penelitian, serta lemahnya mekanisme alih teknologi. Penelitian ini menawarkan konsep Zonasi Riset Berbasis Keunggulan Wilayah (ZRKW) melalui pembentukan pusat riset otonom yang disesuaikan dengan karakteristik biogeografis setiap wilayah dan didukung sistem pendanaan multipihak. Kesimpulannya, penguatan hukum kekayaan intelektual perlu diarahkan sebagai instrumen pembangunan strategis untuk mengubah ketergantungan terhadap sumber daya alam menjadi ekonomi berbasis inovasi, meningkatkan daya saing nasional, serta memperkuat kedaulatan teknologi Indonesia.

Abstract

Legal history is a branch of study that examines the evolution of law over time and the factors influencing changes in a society's legal system. This research aims to analyze the historical development and formation of the Indonesian legal system, spanning the colonial period, independence, the Old Order, the New Order, and the Reform Era. The study employs a normative-juridical method with historical and conceptual approaches, utilizing a literature review of legislation, books, and scholarly journals. The findings indicate that the Indonesian legal system is an amalgamation of various legal systems: customary law (*adat*), Islamic law, and the Continental European legal system inherited from the Dutch. Following independence, national legal development focused on decolonizing the law, with Pancasila and the 1945 Constitution serving as the primary foundations. The evolution of Indonesian law has been shaped by the political and social dynamics of each governing era. During the Reform Era, the legal system underwent reform through amendments to the 1945 Constitution and the establishment of various independent institutions designed to strengthen the rule of law and democracy. Consequently, an understanding of legal history is essential for building a national legal system that is responsive, equitable, and aligned with societal developments.

Abstract

This study examines how the history of Indonesian independence law can be integrated into social studies teaching at elementary school level. Legal awareness among children in Indonesia tends to grow late, partly because historical and legal content in the curriculum is delivered as isolated facts rather than connected narratives. Using a qualitative descriptive approach supported by simple quantitative measurement, data were collected through classroom observation, document analysis of the social studies syllabus, interviews with grade V teachers, and a short comprehension test given before and after a one-semester teaching program at three elementary schools. Findings show that teachers rarely link independence-era legal milestones, such as the drafting of the 1945 Constitution and early nationality regulations, to present-day rights and obligations that pupils already experience. Three teaching patterns emerged among teachers who attempted integration: narrative retelling, contextual classroom discussion, and simple rule-making simulation. Pupils exposed to these patterns showed stronger comprehension gains on indicators of rights, obligations, and fairness compared with pupils taught through a conventional lecture-based approach. The study concludes that legal history offers a natural entry point for civic and legal literacy in elementary education, provided teachers are supported with contextual teaching materials, simple narrative techniques, and continued mentoring rather than isolated training sessions.
