Abstract

Terbentuknya Masyarakat Ekonomi ASEAN (ASEAN Economic Community) juga merupakan suatu hal yang harus dilakukan oleh Negara-negara anggota ASEAN dalam rangka menghadapi perekonomian global dan liberalisasi dalam perdagangan internasional. Selain itu, hal ini juga di dorong oleh semakin banyak organisasi atau blok-blok perekonomian regional yang terus terbentuk seiring dengan terjadinya perubahan ekonomi menuju pasar bebas dalam bentuk liberalisasi perdagangan. Dalam hal ini, regionalisasi ekonomi telah menjadi cara untuk meningkatkan daya saing internasional perusahaan-perusahaan dalam wilayah tersebut. Salah satu yang kemudian yang diatur dalam Masyarakat Ekonomi ASEAN juga menyangkut hak kekayaan intelektual. Hak kekayaan intelektual khususnya yang bersifat komunal diantaranya penggetahuan tradisional, ekspresi budaya tradisional dan lainnya merupakan aset bagi negara yang harus dilindungi. Walaupun pada tingkat internasional, WIPO belum berhasil menyepakati pengaturan perlindungan kekayaan intelektual komunal terkait Sumberdaya Genetik, Pengetahuan Tradisional dan Ekspresi Budaya Tradisional, namun Masyarakat Ekonomi ASEAN telah menegaskan untuk melakukan penguatan perlindungannya pada pasar perdagangan regional dan internasional (foreign markets). Berdasarkan hal tersebut maka penelitian ini bertujuan untuk pertama, menganalisis kebijakan Masyarakat Ekonomi ASEAN dalam perdagangan regional terkait Kekayaan Intelektual; dan kedua, untuk memetakan kebijakan nasional dalam penguatan perlindungan Kekayaan Intelektual Komunal. Metode yang digunakan dalam penelitian ini adalah penelitian yuridis sosiologis dengan pendekatan komparatif.

Abstract

This article is a study of socio-economic history that discusses the development of the socio-economic life of women workers at the CV spice export factory. Rasdi & Co Padang City. This study aims to determine the development of the socio-economic life of women workers after working at CV. Rasdi & Co Padang City. This study uses historical methods consisting of heuristic, verification, interpretation, and historiography steps. The results of this study indicate that the lives of women workers can develop well, because the wages they earn are able to meet the daily needs of their families and can improve the education of their children. This can happen because companies often apply overtime and a contract system so that women workers can get additional income beyond their daily wages. So it can be concluded that this company has the goal of empowering women who want to work to help the family's economy without the requirement of a higher education certificate. However, during the Covid-19 pandemic this company was forced to take action to lay off old female workers for the safety of all workers and to maintain the continuity of the company in the midst of economic difficulties because spice export activities were temporarily stopped and only carried out spice delivery activities within Indonesia.

Abstract

Processed food is everything that originates from agricultural, plantation, forestry, fishery, water and water products, either processed or not processed, which are intended as food or drink for human consumption, including processed food additives, processed food raw materials, and processed food ingredients. other products that are used in the process of preparing, processing and/or making food or drink, in order to maintain the safety of processed food, this is where the role of the government through the Food and Drug Supervisory Agency (BPOM) is needed to oversee drug and food distribution. The ineffectiveness of supervision and law enforcement on the distribution of drugs and food is due to the poor legal culture of society which is one of the factors causing the high circulation of processed food without a distribution permit, besides that it is also influenced by the weakness of substance and legal structure. Efforts to tackle crime with criminal law are essentially part of law enforcement efforts. The issue raised in this study is how is law enforcement by Civil Servant Investigators (PPNS) Padang Food and Drug Supervisory Agency (BBPOM) against the circulation of processed food without a distribution permit and what are the obstacles and obstacles. The research used is a sociological juridical approach which is analytically descriptive in nature, namely analyzing the link between applicable laws and regulations and legal theories and implementation practices related to the research object which then produces several conclusions. In carrying out surveillance of processed food circulating in the community, BBPOM still often finds processed food without a distribution permit that does not meet processed food standards. In carrying out law enforcement, BBPOM already has several mechanisms in accordance with statutory regulations where these rules have a juridical aspect that can guarantee certainty that the law functions as a rule that must be obeyed. In fact, the investigation and supervision carried out by BBPOM has not guaranteed legal certainty, because existing regulations are not adhered to and the constraints faced are the lack of availability of human resources and the weak authority of BBPOM in taking action against processed food without a distribution permit.

Abstract

Pekanbaru City, the capital of Riau Province, has long been a major migration hub in Sumatra, attracting diverse ethnic groups since the early years of Indonesia’s independence. This study aims to trace the migration history of the Batak Toba people to the Palas area from the initial phase through the fourth period, and to analyze their socio-cultural adaptation strategies in the new environment. Employing historical research methods encompassing the stages of heuristics, source criticism, interpretation, and historiography, this study explores the dynamics of population mobility and intercultural interaction. The findings indicate that the migration of the Batak Toba to Palas was driven not only by economic factors but also by cultural values such as marserak, the Dalihan Na Tolu customary system, and the ethos of hamoraon, hagabeon, and hasangapon. The HKBP Church played a pivotal role in strengthening solidarity, preserving community identity, and facilitating adaptation to new social, cultural, and economic contexts. This study concludes that Batak Toba migration is a complex historical process with a significant impact on the formation of social networks and community integration in multicultural urban areas such as Pekanbaru. These findings underscore the importance of cultural values and community institutions in fostering successful social integration in urban settings.
