Abstract

Penelitian ini menginvestigasi perbandingan hukum pidana pelanggaran hak cipta di beberapa negara, dengan tujuan untuk mengeksplorasi pelajaran yang dapat diambil untuk Indonesia. Pelanggaran hak cipta menjadi isu global yang semakin kompleks dengan perkembangan teknologi dan digitalisasi. Studi ini menggunakan pendekatan kualitatif studi kepustakaan untuk menganalisis kerangka hukum yang berlaku di negara-negara terpilih, termasuk Uni Eropa, Amerika Serikat, dan negara-negara Asia. Tujuan utama penelitian ini adalah untuk membandingkan pendekatan hukum pidana dalam menangani pelanggaran hak cipta antara berbagai negara dan mengeksplorasi dampak implementasinya terhadap penegakan hukum di Indonesia. Metode studi kepustakaan digunakan untuk mengumpulkan dan mengevaluasi data dari berbagai sumber literatur, termasuk peraturan hukum, studi kasus, dan tinjauan akademis yang relevan. Hasil penelitian menunjukkan perbedaan signifikan dalam pendekatan hukum pidana terhadap pelanggaran hak cipta antara negara-negara yang diteliti. Uni Eropa, misalnya, menerapkan kerangka hukum yang ketat dengan fokus pada perlindungan hak kekayaan intelektual, sementara di Amerika Serikat, pendekatan lebih berorientasi pada sanksi pidana yang tegas terhadap pelanggaran hak cipta. Di Asia, berbagai negara memiliki pendekatan yang bervariasi, terpengaruh oleh konteks budaya dan ekonomi regional.

Abstract

The Civil Service Police Unit, abbreviated as Satpol PP, is an instrument of the Regional Government in maintaining peace and public order and enforcing Regional Regulations. In this article, the role of the Semarang Regency Satpol PP is to have the authority to control and supervise advertising violations related to permits and installation procedures, whether carried out in a persuasive or repressive pattern. The efforts made in the disciplinary operation for holding advertisements carried out by the Semarang Regency Satpol PP had several obstacles. These obstacles are the size of the area, the lack of Satpol PP personnel and the lack of mobilization facilities used. So the Satpol PP has a solution, namely coordinating with BKUD regarding Semarang Regency PP permits and taxes by collaborating with the Semarang Regency Regional Financial Agency (BKUD). Abstract

Pelaksanaan transaksi e-commerce dengan metode pembayaran Cash On Delivery (COD) tidak jarang menemukan kendala-kendala seperti kurir mendapatkan perlakuan kurang menyenangkan dari konsumen akibat penolakan dari konsumen. Peneliti berkeinginan untuk meneliti bagaimana perlindungan hukum terhadap kurir transaksi E-Commerce pada sistem Cash On Delivery. Penulis juga berniat menganalisis apakah ada hambatan sekaligus solusi penerapan perlindungan hokum terhadap kurir.Dalam penelitian ini pendekatan yang digunakan adalah dengan menggunakan metode pendekatan yuridis empiris, Metode penelitian yang digunakan adalah metode kualitatif. Pengumpulan data dilakukan dengan wawancara, observasi dan studi kepustakaan. Hasil dari penelitian menunjukkan bahwa, kedudukan kurir dalam sistem pembayaran COD sebagai orang yang menggantikan perusahaan jasa pengiriman barang dalam menjalankan kuasa yang diberikan oleh penjual kepadanya dalam hal pengiriman barang kepada pembeli. Terhadap kerugian yang dialami oleh kurir, wajib digantikan dan dipertanggung jawabkan oleh penjual, jika kurir tidak dibayar oleh konsumen dalam transaksi tersebut maka kurir tidak dibayar oleh perusahaan dan tidak diberikan bonus apabila dalam satu hari kurir tidak bisa memenuhi target pengiriman barang tersebut, Perbuatan pembeli yang menolak membayar barang yang telah diterima dapat dikategorikan sebagai bentuk wanprestasi dan dapat di tuntut ganti rugi atau pembatalan pembelian, Pembatalan Sepihak Transaksi dari Konsumen Kepada Kurir yang mengakibatkan kerugian, Adanya pembeli yang menolak untuk membayar barang yang dipesannya dalam system Cash On Delivery dan adanya pengancaman dengan kekerasan oleh pembeli kepada kurir, merupakan beberapa faktor penghambat perlindungan hukum bagi kurir. Pengaturan Hukum Pidana Terhadap Perbuatan Tidak Menyenangkan Oleh Customer Bagi Kurir COD yaitu pasal 335 KUHPidana, Pasal 368 KUHPidana dan Pasal 369 Ayat 1 KUHPidana.

Abstract

Hate speech is a significant issue that has been escalating with the rapid growth of social media. Hate speech involves communication actions such as provocation, incitement, or insults directed at individuals or groups based on race, skin color, gender, disability, sexual orientation, nationality, and religion. To address this issue, Indonesian law regulates such offenses through various articles in the Indonesian Penal Code (KUHP), including Articles 310, 311, 315, 317, and 318, as well as the Electronic Information and Transactions Law (UU ITE) Article 45A. Effective and consistent legal measures are necessary to curb the spread of hate speech and protect victims from its negative impacts. Awareness of legal consequences and ethical communication on social media is crucial for fostering a safer and more respectful digital environment.

Abstract

Semarang City Government relocation policy against cadger( PKL ) from street Pahlawan to street Menteri Soepeno will cause the pros and cons of the respective cadger. Cadger should Obtain legal and social protection of post-relocation to comfort, well - being and the smooth cadger trading business in a new location. The method used in this study is qualitative research and descriptive research with socio-Juridical approach. While the methods of data collection used in the study were interviews, observation and documentation. Validity of the processing of data using triangulation techniques. The method of the data analysis used in this study is the data collection, data reduction, the data displa, conclusion. Results and discussion of this study were (1) the underlying policy relocation of cadgerfrom street Pahlawan to street Menteri Soepenois in order to create a SETARA program using basic equivalents Regional Regulation No.11 Year 2000 concerning Regulation and Development cadgerand the Decree No. . 511.3/16 on the Determination of Land / Territory Location of cadger in the city of Semarang .( 2 ) pos -relocation of cadger in the Street Menteri Soepeno in fact have repressive and preventive legal protection. Then the result of the relocation of cadger do not get social optimum protection. Get merchandisers limited to trade land compensation in the form of shelter and amenities along with a license for each cadger selling but they do not get social assistance in the form of a guarantee of labor and capital. Suggestions from the research and discussion are (1) Instead of Semarang City Government through their policies in curbing cadger should give serious attention to post-relocation of cadger (2) Semarang City Government should also give special attention to the social and legal protection against post-relocation of cadger in order to further its survival to develop prosper in the post-relocation wefforts

Abstract

This study examines the effectiveness of criminal law enforcement against street children associated with the "Kreak" phenomenon in Semarang Regency within the framework of the Juvenile Criminal Justice System (SPPA). The research is grounded in the identified gap between Indonesia's child-centered juvenile justice norms, particularly diversion and restorative justice, and their inconsistent implementation in practice. Using a normative juridical method, this study analyzes primary legal materials, including Law No. 11 of 2012 on the Juvenile Criminal Justice System and Law No. 1 of 2023 on the Criminal Code, supported by relevant legal literature. The findings indicate that law enforcement effectiveness remains limited due to inconsistent diversion practices, weak inter-agency coordination, insufficient rehabilitation and reintegration facilities, and a limited understanding of restorative justice among law enforcement officials. Social stigma and the complex socio-economic background of children further hinder reintegration efforts. This study emphasizes that effectiveness should be measured through rehabilitative outcomes rather than punitive indicators and recommends strengthening restorative justice training, harmonizing SPPA implementation with the Criminal Code, enhancing institutional coordination, and expanding community-based prevention and reintegration programs to ensure child protection and sustainable public safety.

Abstract

Copyright is an essential instrument within the Intellectual Property Rights (IPR) system, providing legal protection for works of art, literature, and science, including the economic and moral rights of the creator. In Indonesia, copyright regulation has evolved from Law No. 6 of 1982 to Law No. 28 of 2014, which affirms that copyright arises automatically based on the declarative principle and grants creators exclusive rights to exploit, use, and derive economic benefits from their works. This study employs a normative legal method by examining primary, secondary, and tertiary legal materials, including relevant legislation and court decisions. Copyright protection plays a crucial role in ensuring that creators receive recognition, control, and economic benefits from their works. The use of artistic works for commercial products without permission, such as the silhouette sketch of the “Tugu Selamat Datang” by PT Martina Berto Tbk, constitutes a violation of the creator’s economic and moral rights. Law No. 28 of 2014 emphasizes that copyright arises automatically once a work is realized, so any adaptation or use of a work still requires permission from the rights holder. The analysis indicates that copyright protection is vital for preventing unilateral exploitation of artistic works, ensuring legal certainty for creators, and promoting compliance within the creative industry

Abstract

The rapid development of digital technology has introduced cryptocurrency as a new investment instrument that raises complex legal issues, particularly within the framework of Islamic economic law. In Indonesia, cryptocurrencies are legally recognized as tradable commodities but are not permitted as lawful means of payment. Meanwhile, Islamic law provides conditional permissibility for crypto investment, as reflected in the Fatwa of the National Sharia Council of the Indonesian Ulama Council (DSN-MUI) No. 140/DSN-MUI/XI/2021. This study aims to analyze the legal construction of cryptocurrency investment within the Indonesian Islamic economic law system, examine its legality under both positive law and Islamic law, and assess its conformity with maqashid al-sharia principles. This research employs a qualitative method with a normative juridical approach, relying on library research of statutory regulations, sharia fatwas, and relevant academic literature. The findings indicate that cryptocurrency investment may be legally acceptable under certain conditions, provided that it is conducted transparently, based on clear contractual arrangements, and free from elements of gharar, maysir, and excessive speculation. The maqashid al-sharia approach plays a crucial role in evaluating the protection of wealth and ensuring public benefit in digital investment practices.

Abstract

The marginalization experienced by the Suku Dalam (indigenous and isolated community) reflects the persistent weakness of human rights protection for indigenous peoples, particularly in ensuring the right to a decent standard of living through control over customary land (tanah ulayat). Customary land is not merely an economic asset, but constitutes a living space, cultural identity, and the foundation of social and ecological sustainability for the Suku Dalam. This study aims to analyze the forms of human rights protection afforded to the Suku Dalam in relation to the right to a decent life, to examine the legal status and recognition of customary land within the national legal system, and to assess the role and responsibility of the state in guaranteeing the protection of indigenous peoples’ rights. This research employs a normative juridical method with statutory and conceptual approaches, based on library research of legislation, court decisions, and national as well as international human rights instruments. The findings indicate that although the legal recognition of indigenous peoples and customary land exists normatively, its implementation remains weak due to overlapping regulations, limited participatory mechanisms, and the dominance of economic development interests. Therefore, the state is required to strengthen substantive protection through affirmative policies, recognition of customary territories, and consistent application of human rights principles to ensure a dignified and decent life for the Suku Dalam. Abstract

The rapid development of information technology has changed people's behavior in conducting transactions from conventional methods to electronic commerce (E-Commerce), where the Cash on Delivery (COD) payment system has become a popular option due to its convenience and efficiency. However, this buying and selling practice often poses legal risks and losses due to a lack of understanding of the rights and obligations of the parties involved. This study aims to analyze two main aspects: the legal basis governing the COD payment system in E-Commerce transactions and the forms of legal protection for consumers in such transactions. The research method employed is a normative juridical approach with an analytical and prescriptive focus, which involves reviewing literature and secondary data, as well as applicable legal norms, to provide arguments regarding emerging legal issues. The results of the study show that the legal basis for COD transactions in Indonesia is based on the Civil Code (KUHPer) concerning agreements, the Electronic Information and Transactions Law (UU ITE), and is specifically regulated in the Minister of Communication and Informatics Regulation Number 8 of 2025 concerning Commercial Postal Services, which provides a legal framework for on-site payment facilities. Legal protection for consumers is guaranteed through Law Number 8 of 1999 concerning Consumer Protection (UUPK), which regulates the right to comfort, security, and truthful information, as well as the obligation to act in good faith. In conclusion, existing regulations have established a robust legal framework to protect both consumers and business actors.
