Abstract

Perbankan syariah memiliki fungsi yang sangat strategis dalam system perekonomian nasional,selain fungsi intermediasi perbankan syariah juga memiliki fungsi sosial. Sehingga menarik untuk diteliti mengenai peranan perbankan syariah dalam pengelolaan wakaf uang di Indonesia. Penelitian ini dilakukan dengan menggunakan metode pendekatan yuridis normatif. Peranan perbankan syariah dalam pengelolaan wakaf uang di Indonesia berdasarkan Undang-Undang No. 41 Tahun 2004 Tentang Wakaf dan peraturan pelaksanaannya adalah sebagai Lembaga Keuangan Syariah Penerima Wakaf Uang yang menerbitkan sertifikat wakaf uang, serta menempatkan wakaf uang tersebut di dalam produk penerimaan dana dengan akad titipan (wadi’ah) atas nama Nazhir dan dapat mengelola dana tersebut sampai nazhir menentukan lain.

Abstract

Kredit yang dikeluarkan oieh bank mengandung resiko sehingga dalam pelaksanaannya setiap pemberian kredit bank harus memperhatikan prinsip kehati-hatian dan asas perbankan yang sehat, baik secara internal maupun secara ekstemal.Imlementasi prinsip kehati-hatian secara internal bagi Sumber Daya Manusia (SDM) bank adalah dengan menerapkan Prinsip Manajemen Risiko. Permasalahannya adalah bagaimana penerapan manajemen risiko dalam pemberian kredit perbankan serta kendala dalam menerapkan manajemen risiko. Penerapan manajemen risiko pada pemberian kredit mencakup pengawasan aktif Direksi dan Dewan Komisaris, kecukupan kebijakan dan prosedur Manajemen Risiko serta penetapan limit Risiko dan kecukupan proses identifikasi, pengukuran, pemantauan, pengendalian Risiko, serta sistem informasi Manajemen Risiko dan sistem pengendalian intern yang menyeluruh. Penyaluran kredit merupakan sumber timbulnya risiko kredit yang paling besar, risiko terkait dengan penyaluran kredit yaitu risiko kredit, risiko operasional, risiko hukum, dan risiko reputasi. Kendala dalam penerapan manajemen risiko Perbankan, antara lain SDM yang terlibat dalam pemantauan penerapan manajemen risiko masih relatif kurang siap.

Abstract

This study aims to analyze the regulation of registration requirements as a seller in the Marketplace owned by the Regional Government in terms of the concept of MSE empowerment in Government Regulation Number 29 of 2021 concerning the Implementation of the Trade Sector and the regulation of commission fees in the Marketplace owned by the Regional Government in terms of the concept of MSE empowerment in Law Number 20 of 2008 concerning Micro, Small and Medium Enterprises (UMKM Law). The research method used in this research is normative legal research using a statutory approach. Based on the results of the research, two things can be concluded. First, Marketplace Si Bakul is in line with the concept of MSE Empowerment in Government Regulation Number 29 of 2021 concerning the Implementation of the Trade Sector, especially in Article 58. Second, the commission fee at Marketplace Si Bakul is different from the concept of MSE empowerment, as stated in Article 9 Letter B of the UMKM Law.

Abstract

Factoring is an alternative form of financing that is increasingly popular among companies, especially SMEs, as a solution to accelerate cash flow. Through factoring, companies can sell their receivables to third parties (factoring) to get cash immediately, without having to wait for payment due from customers. This article discusses the mechanism of factoring, the types of factoring, the benefits and risks involved, and how factoring can be a strategic instrument in managing a company's liquidity. This study also looks at case studies of the application of factoring in small and medium-sized companies as a solution to increase financial flexibility

Abstract

The increase in the buying and selling of residential properties has led to intense competition between developers, who are trying to sell quickly with the use of the pre-project selling system. However, this system has a high risk for consumers, as happened in the sealing of Jatiasih Central City housing unit with PT Hadez Graha Utama as a developer who built housing illegally and resulting on harm to 260 consumers. Therefore, legal protection is required for consumers who are harmed both internally and externally. Based on Law No. 8 of 1999 concerning Consumer Protection and Law No.1 of 2011 concerning Housing and Residential Areas, consumers can file a Class Action lawsuit to the court demanding PT Hadez Graha Utama to be responsible for default and unlawful acts (PMH).

Abstract

Prinsip utama dalam lembaga keuangan adalah prinsip kehati-hatian. Prinsip kehati-hatian sering kali diartikan secara sempit karena hanya melihat kehati-hatian dalam memberikan pembiayaan. Penerapan prinsip kehati-hatian terbagi menjadi tiga, yaitu kehati-hatian terhadap lembaga keuangan syariah itu sendiri, kehati-hatian dalam memberikan pembiayaan, dan kehati-hatian yang dibebankan kepada organ perusahaan dalam menjaga kepercayaan nasabah. Peran penting Dewan Pengawas Syariah dalam Fintech Syariah adalah mengawal penerapan Prinsip Syariah dalam menjalankan pembiayaan yang dipadukan dengan teknologi. Peraturan AAOIFI dan IFSB mewajibkan ada Dewan Pengawas Syariah di perusahaan syariah. Perkembangan teknologi juga membutuhkan sumber daya manusia yang lebih kompeten dalam menghadapi perkembangan teknologi. Persoalan yang akan diangkat adalah bagaimana kesiapan negara-negara yang menggunakan sistem syariah untuk menerapkan prinsip  kehati-hatian dalam membangun sharia compliance terutama dalam teknomogi finansial. Dalam memaksimalkan peran Dewan Pengawas Syariah perlu memperhatikan independensi, kompetensi, ketekunan, kompensasi, dan dukungan perusahaan. Keberadaan Dewan Pengawas Syariah di beberapa negara seperti Indonesia, Malaysia, dan Pakistan patut menjadi bahan perbandingan guna memaksimalkan Dewan Pengawas Syariah. Dewan Pengawas Syariah Indonesia masih berbentuk lembaga yang terpisah dari pemerintah, berbeda dengan Malaysia dan Pakistan yang sudah ada di pemerintahan sehingga pelaksanaan fatwa yang dikeluarkan dapat memiliki kekuatan hukum mengikat.

Abstract

The existence of marketplaces helps MSMEs expand their business reach and facilitates their transformation into digital MSMEs. However, issues have emerged concerning private marketplace platforms in Indonesia, particularly related to the increasing commission fees and direct-to-consumer sales by producers that bypass traditional distribution channels, disadvantaging smaller businesses. This raises the question of how local governments, as part of the welfare state, can establish and regulate marketplaces to empower MSMEs. The research method used is normative legal research with a statutory approach. The results of the study show that in accordance with the welfare state principle, the government bears responsibility for the economic welfare of its citizens. Local governments play a crucial role in supporting MSMEs by developing regionally owned marketplaces. These platforms implement policies such as differentiated commission rates based on the scale of the business, where smaller enterprises are subject to lower fees, and allow only MSME-scale producers and those selling perishable goods to conduct direct sales. These measures are intended to provide fairer access and greater protection for micro small and medium enterprises within the digital economy.

Abstract

Standard clauses in consumer protection are terms or conditions unilaterally determined by business actors. Standard clauses are regulated in Article 18 of the Consumer Protection Act. Understanding standard clauses is essential for consumers and business actors, so legal counseling is needed to increase awareness and understanding for consumers and business actors. The Consumer Protection Act does not prohibit the inclusion of standard clauses in agreement documents between consumers and business actors. The Consumer Protection Act only prohibits the inclusion of standard clauses contrary to Article 18, paragraphs (1) (2) of the Consumer Protection Act. Article 18 paragraph (3) of the Consumer Protection Act determines that the standard clause that contradicts Article 18 paragraph (1), (2) of the Consumer Protection Act is declared null and void. In addition, the legal consequences for business actors for the inclusion of standard clauses that are contrary to Article 18 paragraph (1), (2) of the Consumer Protection Act based on Article 62 paragraph (1) of the Consumer Protection Act are threatened with imprisonment for a maximum of five years or a maximum fine of two billion. In including standard clauses in documents or agreements with consumers, business actors must pay attention to the provisions of Article 18 of the Consumer Protection Act. This legal counseling activity increases the awareness and understanding of consumers and business actors regarding standard clauses based on consumer protection laws, which can ultimately realize consumer protection.

Abstract

ABSTRACTRegulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 5 of 2020 concerning Electronically Integrated Mortgage Rights Services (Permen HT-el) regulates the electronic registration of Mortgage Rights, where the application for registration must be made by the creditor without being authorized by the Land Deed Official (PPAT) as in the conventional Mortgage Rights system. Electronic registration of Mortgage Rights will create legal certainty for the holder of the Mortgage Rights in the form of an Electronic Mortgage Rights Certificate. In practice, there are still creditors who have not or do not register electronic Mortgage Rights at all, causing legal certainty not to be guaranteed because the Mortgage Rights are not born. This study aims to determine and analyze the legal certainty of electronic registration of mortgage rights, where the application for registration is the obligation of the creditor. The research method used is normative juridical, namely research on principles, norms and legal rules. The research specification uses descriptive analytical method, namely by providing an explanation of the facts contained in the research object comprehensively, systematically, accurately and factually and then correlating it with relevant legal theories. The results show that without an application for electronic registration of Mortgage Rights by the creditor, the Mortgage Rights are considered to have never existed. The banking party as the creditor must increase human resources who are ready and there must be additional human resources from the Bank as a creditor specifically to register electronic Mortgage Rights. Keywords: APHT, Electronic Mortgage Rights, Legal Certainty.
