Abstract

The increase in cases of personal data breaches in Indonesia in recent years has become a very serious problem. So a personal data protection institution is needed to guarantee the protection of personal data. The existence of an independent personal data protection agency is an important aspect in carrying out personal data protection and is key in ensuring independence in the monitoring, auditing and prosecution processes. This is very crucial because regulations regarding personal data security apply to all public institutions, including executive, legislative and judicial. This research uses a normative juridical research type with a statutory approach, a comparative approach and a conceptual approach. The research results show that the personal data protection law that regulates this institution shows that there is executive involvement in the formation of the institution, thereby reducing its independence. As a result, this institution is at risk of being influenced by political interests and unable to carry out its duties accountably, effectively and efficiently.

Abstract

This study aims to find the existence of abuse of circumstances in the placement of labor and the legal consequences that occur from the existence of abuse of circumstances in the placement of labor. By using empirical legal methods and through the approach of legislation, conceptual and case analysis. This study resulted in that there were several placements of labor as household assistants. The agreement from one of the placement places was not in accordance with the agreement in general, namely by not fulfilling one of the valid conditions of the agreement. In addition, the placement of labor that existed did not meet the legal regulations applicable to a place of placement of labor, that the placement place had not been registered as an official institution for placement of labor and from this it could cause several legal consequences, including the agreement that was made could be canceled, not getting a way to resolve it if a problem occurred through legal channels, and so on. This study contributes to the need for a valid agreement in accordance with the norms of the contract in accordance with positive law in Indonesia.

Abstract

The issue of impeaching the President in Indonesia has sparked public debate, particularly due to allegations of the President’s interference in elections, labeled as “cawe-cawe.” The Constitution indeed provides for the impeachment of the President, prompting questions regarding the timing and circumstances under which impeachment can occur. Specifically, whether impeachment can happen before an election or at the end of the President’s term and whether election interference constitutes a constitutional violation warranting impeachment. This research aims to address these questions by examining legal rules and procedures for presidential impeachment in Indonesia, exploring how impeachment intersects with elections and the end of the presidential term from a constitutional perspective, and comparing presidential impeachment processes across various jurisdictions. This research uncovers several key findings using a doctrinal legal research approach with statutory, conceptual, case, historical, and comparative analyses. Firstly, while the Indonesian constitution provides guidelines for presidential impeachment, it lacks specific regulations concerning the actions of presidential candidates during elections. Consequently, impeaching the President before an election or at the end of the term remains an issue without explicit legal basis. Looking at experiences in other countries, there have been instances of presidents facing impeachment both before elections and at the end of their terms; however, they were not necessarily removed from office. In conclusion, the research highlights the absence of explicit and detailed regulations regarding presidential impeachment in Indonesia. Recommendations are made to the MPR, DPR, and President to enhance policies concerning presidential impeachment, ensuring clarity and effectiveness in the impeachment process. AbstrakIsu pemakzulan Presiden di Indonesia menggema dan menjadi perdebatan masyarakat. Alasannya, Presiden dianggap cawe-cawe dalam Pemilu. Konstitusi telah mengatur pemakzulan Presiden. Pertanyaannya, apakah pemakzulan Presiden dapat dilakukan menjelang Pemilu dan di akhir masa jabatan? Pertanyaan selanjutnya, apakah perbuatan Presiden cawe-cawe dalam Pemilu merupakan pelanggaran konstitusi yang dapat dimakzulkan? Apakah di negara lain juga pernah terjadi hal tersebut? Penelitian ini merumuskan masalah: (1) bagaimana aturan hukum dan prosedur pemakzulan presiden di Indonesia? (2) bagaimana pemakzulan Presiden saat menjelang Pemilu dan di akhir masa jabatan dari perspektif konstitusi? dan (3) bagaimana perbandingan pemakzulan Presiden di berbagai negara hukum? Penelitian ini penelitian hukum doktrinal dengan pendekatan perundang-undangan, konseptual, kasus, sejarah, dan perbandingan. Hasil penelitian ini mengemukakan, bahwa konstitusi Indonesia mengatur secara materil dan formil terkait pemakzulan Presiden. Namun, konstitusi belum mengatur tindakan cawe-cawe Presiden dalam Pemilu. Pemakzulan Presiden menjelang Pemilu dan di akhir masa jabatan, untuk saat ini sebatas isu. Melihat kondisi di negara lain, memang sudah ada Presiden dimakzulkan menjelang Pemilu dan di akhir masa jabatan. Namun hasilnya tidak diberhentikan sebagai Presiden. Penelitian ini menyimpulkan belum ada aturan materil dan formil secara eksplisit dan rinci tentang pemakzulan Presiden. Saran kepada MPR, DPR, dan Presiden untuk perbaiki kebijakan tentang pemakzulan Presiden.

Abstract

The Constitutional Court in a country has a very important role for the implementation of the constitution in a country, so the recruitment process is ensured to be carried out transparently, participatively, objectively and accountably. The principles of the constitutional judge recruitment mechanism have not been implemented properly, because the law does not clearly regulate the parameters of the selection mechanism. Talking about the recruitment process for Constitutional Court judges. Germany which is considered an independent country in carrying out the recruitment process for constitutional judges. This study aims to explain the comparison and legal consequences of the recruitment process for Constitutional Court judges in Indonesia and Germany. In Indonesia, the nomination process for Constitutional Court judges is carried out by President, the House of Representatives (DPR), and the Supreme Court (MA). While in Germany it is proposed by the Bundestag and Bundesrat. Each proposing institution creates a mechanism for selecting Constitutional Court judges and integrates it with a reliable and professional merit system. Germany in an effort to accelerate and increase the efficiency of the recruitment process for Constitutional Court judges can consider several things, including determining the consensus deadline.

Abstract

Pembentukan Peraturan Desa saat ini dapat dikatakan telah berkembang secara pesat dari segi kuantitas. Karena hampir setiap desa pada setiap tahun membentuk Peraturan Desa. Tetapi perkembangan tersebut tidak diikuti dengan aspek demokrasi dan aspirasi dalam pembentukannya. Hal tersebut menimbulkan suatu pertanyaan yaitu (1) bagaimana mekanisme penyerapan aspirasi masyarakat dalam pembentukan Peraturan Desa? dan (2) bagaimana desain pembentukan Peraturan Desa yang demokratis dan aspiratif? Hasil penelitian yang dilakukan oleh peneliti menunjukan bahwa pembentukan Peraturan Desa sudah sesuai dengan aspek peraturan perundang-undangan. Namun pembentukan tersebut secara substansi tidak demokratis dan aspiratif. Walaupun telah ada proses mekanisme penyerapan aspirasi, tetapi proses tersebut hanya dilakukan secara formal saja dan belum maksimal dalam hal substansi. Hal ini sesuai dengan bukti-bukti yang ada dalam artikel ini. Kondisi tersebut tentu membutuhkan formulasi desain pembentukan Peraturan Desa yang demokratis dan aspiratif. Penelitian ini telah berhasil memformulasikan desain pembentukan Peraturan Desa yang demokratis dan aspiratif. Desain tersebut tidak hanya bersifat formal saja, melainkan juga bersifat substansi. Desain tersebut juga menempatkan masyarakat sebagai pusat untuk terlibat dalam pembentukan Peraturan Desa melalui penyerapan aspirasi yang terbuka dan demokratis.

Abstract

Reformasi dan Perubahan Konstitusi yang terjadi di Indonesia telah membuka keran lahirnya otonomi daerah. Dampaknya daerah semakin otonom dan dapat melakukan pembangunan sesuai dengan kekuatan dan kreatifitas yang dimiliki oleh masing-masing daerah. Namun dalam perjalanannya, pelaksanaan otonomi daerah memberikan terjadinya kesenjangan. Daerah yang kaya akan semakin kaya, sedangkan daerah yang miskin berpotensi terus miskin. Akibatnya banyak daerah miskin yang tidak dapat melakukan pembangunan karena keterbatasan yang dimiliki, salah satunya keterbatasan anggaran. Perda dana cadangan merupakan salah satu strategi alternatif yang dapat dilakukan untuk pembangunan daerah. Perda dana cadangan diharapkan mampu menyelesaikan problem atau kendala keuangan dalam pelaksanaan pembangunan di daerah. Penelitian ini menemukan Perda dana cadangan sebagai strategi alternatif pembangunan daerah dengan menguraikan (1) Perda dana cadangan di era otonomi daerah; dan (2) Perda dana cadangan dan pembangunan daerah. Penelitian ini juga menemukan kendala yang dihadapi dalam pembentukan dan pelaksanaan Perda dana cadangan.

Abstract

The holding of general elections or elections is a consequence that must be carried out by democratic countries including Indonesia. Implementation election in Indonesia is always covered by legal instruments. Welcoming election in 2019 the overarching legal instrument is Law Number 7 of 2017 concerning General Elections. The legal instrumen in its situation turns out to have problems. Problem include presidential threshold, parliamentary threshold, electoral system, electoral district of magnitude, and result conversion method. The existence of these problems is certainly a challenge in the implementation of Law Number 7 of 2017 concerning General Elections wich must be faced. Before facing the challenge, it is better to know in advance the legal politics of Law Number 7 of 2017 concerning General Elections. It is very important to know the purpose of making regulations about elections. This article dicusses the legal politics of Law Number 7 of 2017 concerning General Elections usin three criteria, namly (1) legal policies issued; (2) legal policy background; and(3) law enforcement from policies issued. This aricle also reviews the problem and substnace of Law Number 7 of 2017 concerning General Elections as mentioned.

Abstract

Upaya membumikan Pancasila di negeri ini masih menghadapi banyak tantangan. Salah satunyaterlihat dari adanya perlakuan diskriminatif yang diterima kelompok-kelompok minoritas, sepertiJemaat Ahmadiyah dan pengikut Syiah. Artikel ini bertujuan untuk merumuskan merumuskanstrategi membumikan Pancasila, terutama dalam upaya melindungi kelompok agama ataukeyakinan minoritas. Ada tiga pembahasan yang dikaji dalam tulisan ini yaitu (1) pemaksaan dankriminalitas terhadap kelompok minoritas; (2) ruang publik untuk ekspresi semua kelompok; dan(3) strategi membumikan Pancasila untuk melindungi minoritas. Ada tiga strategi yangdirekomendasikan dalam artikel ini: (1) Penanaman nilai-nilai Pancasila harus lebih dilakukansecara bottom up; (2) Penguatan jiwa Pancasila dengan menjadikan negara atau pemerintahsebagai lokomotif; dan (3) Penguatan peran pemerintah dalam rangka menjaga kesinambungandan keberlanjutan upaya membumikan Pancasila. Peran pemerintah dapat dilakukan salahsatunya melalui peran BPIP. Namun demikian, perlu ada penguatan BPIP secara kelembagaandan kewenangan. Hal ini agar BPIP mampu menjadi lokomotif bangsa dalam membumikanPancasila. Simpulan dalam penelitian ini terdiri dari tiga hal sebagai jawaban terhadappermasalahan.

Abstract

The existence of Pancasila must be maintained. The post-truth era that is already in sight can certainly have a negative impact on national identity. Pancasila as the identity of the Indonesian nation must be maintained and become a bulwark against the negative impacts of the post-truth era. The writing of this article is very important in providing an understanding to the Indonesian people that the post-truth era cannot be avoided. As a nation that has an identity called Pancasila, Pancasila should be implemented in the life of the nation and state, especially in the face of the post-truth era. This is where the importance of this article in reminding about the negative impact of the post-truth era on national identity. This article discusses three important issues related to Pancasila and post-truth. These three things are (1) various kinds of negative impacts that can or even have been caused by the post-truth era; (2) finding the relevance of the post-truth era with Pancasila; and (3) describes how to maintain the existence of Pancasila in the vortex of the post-truth era. There are at least three negative impacts of the post-truth era, namely (a) the existence of lies; (b) the existence of slander; and (c) the presence of hate speech. The relevance of the post-truth era with Pancasila lies in the identity of the nation. The post-truth era can have a negative impact on national identity. Pancasila is the identity of the Indonesian nation. The existence of Pancasila in the post-truth era must of course be maintained so that it is not negated by the negative impacts of the post-truth era. The way to maintain the existence of Pancasila in the post-truth era is to apply Pancasila in the life of the nation and state and to strengthen literacy. The conclusion of this article is to answer the problem formulation and find the purpose of this article.

Abstract

Changes that occur in human life in society can be understood as social change. This social change is absolute because it will be experienced by every society wherever and whenever. This article was written with the aim of elaborating on various important things and highlighting several main concepts in social change in society. This is so that the phenomenon of social change in society can be understood more fully. This article was written using a qualitative descriptive method by describing important concepts which are the main points in this article. Data collection is supported by using literature study techniques. From the results of the study, we get a picture that social change as a process of change that occurs in social life always takes place without stopping and will continue along with human existence itself. As a process, social change in a society is not an outcome or finished product. There is a process of mutual agreement or decision taken by each individual or community group. Various agreements in social change in society can be regarding social values, social norms, patterns of organizational behavior, the structure of social institutions, layers in society, power and authority, social interactions and soon.
