Abstract

Indonesia's retributive sentencing system, dominated by imprisonment, has caused serious problems including prison overcrowding. The Indonesian National Penal Code addresses this by incorporating community service as a principal punishment, marking a paradigm shift toward a rehabilitative approach. This study aims to compare the regulation of community service punishment in Indonesia's National Penal Code with the Dutch Wetboek van Strafrecht (WvSr) using normative legal research methods with statutory, conceptual, and comparative approaches. The findings reveal similarities in both systems regarding the classification of community service as one of primary sanction with its unpaid nature and the 240-hour maximum. However, significant differences exist when both penal code were being compared. The Indonesian National Penal Code restricts its application through sentencing thresholds and cumulative subjective criteria, whereas the WvSr offers a more flexible framework through categorical prohibitions for serious offenses, pre-adjudication mechanisms, sentence combinations, recidivism regulations, and a comprehensive juvenile justice sub-system.

Abstract

Keberadaan pinjaman online/daring ilegal menjadi persoalan dalam masyarakat. Keterbatasan literasi hukum menjadikan sebagian masyarakat mudah terjerat dalam praktik pinjaman daring ilegal yang disertai bunga tidak wajar. intimidasi, dan penyalahgunaan data pribadi. Penelitian ini bertujuan untuk menganalisis bagaimanakah bentuk perlindungan bagi masyarakat untuk menghindarkan jeratan pinjaman daring ilegal. Penelitian dilakukan menggunakan metode campuran, yaitu metode empiris untuk melihat kondisi faktual di masyarakat. Pendekatan normatif digunakan untuk menganalisis bagaimana konsep perlindungan berbasis komunitas dapat ditempuh. Penelitian ini menyimpulkan bahwa perlindungan terhadap masyarakat dari jeratan pinjaman daring dilakukan melalui edukasi hukum berkelanjutan dan mendorong pembentukan bank komunitas di lingkungan Kelurahan Kadipiro Surakarta. Implikasi dari penelitian ini adalah perluasan model perlindungan berbasis komunitas. Kata Kunci: Perlindungan masyarakat, komunitas, pinjaman online/daring illegal.

Abstract

This research examines the criminal liability of Indonesian migrant workers involved in migrant smuggling, whether intentionally or unintentionally, within the framework of human rights and criminal law. Using a doctrinal legal approach, the study finds that migrant workers, as victims of human trafficking, cannot be held criminally liable for smuggling since they are treated as objects of the crime, although they may still be accountable for other offenses under applicable law. Criminal liability rests with individuals or organized groups that profit from smuggling activities. The study emphasizes the need to protect the rights of Indonesian migrant workers and to prevent the criminalization of those who become victims of human trafficking.
