Abstract

The implementation of a Village Information System (SID) in public services is regulated in Law Number 6 of 2014 concerning Villages. However, many villages in Lamongan regency have not used the application due to various factors, even though in Lamongan there is a SID application called SIGENDUK (Superior Village Movement Information System with Character). This article discusses assistance in the use of the SIGENDUK application to improve public services in Lamongan district. Assistance was carried out in three villages in Lamongan regency, namely RejoTengah, Kendalkemlagi and Menongo, because the three villages have not used the SIGENDUK application in public services. Assistance is carried out using the Participatory Action Research (PAR) method. The assistance results concluded that the village government did not use the SID application because there was no socialization and training on SID, there was a lack of human resources who were technology experts and because of costs. On the other hand, the Lamongan Regency Government has a SID application called SIGENDUK which can be used for free. Based on this, socialization and training on the SIGENDUK application were held for residents and village officials. With this socialization and training, the village government has access rights to use the SIGENDUK application and devices to serve various administrative and data storage services.

Abstract

Sirri marriage is valid regarding religion but is not registered at the KUA; consequently, its legal force is still problematic. This article answers two problems: first, the phenomenon of sirri marriage in Surabaya; second, maqasid al-syariah analysis of the phenomenon of sirri marriage in Surabaya. This research used descriptive qualitative methodology. The data collection technique used documentation and interview techniques. The results showed that many sirri marriage practices were carried out by the Surabaya community. Many factors cause the choice of sirri marriage, namely the lack of understanding of legal awareness of the mandatory registration of marriage in Indonesia, the factor of pregnancy outside of marriage, and the polygamy factor. Responding to the phenomenon of sirri marriage in Surabaya, the KUA also made various prevention and handling efforts, such as socialization about the importance of marriage registration, the impact of sirri marriage, coaching for perpetrators of sirri marriage, and others. Based on the maqasid al-syariah study, the phenomenon of sirri marriage is not an ideal marriage for Indonesian society because it cannot realize the objectives of sharia.

Abstract

Custom is a habit that is inherited by local people from generation to generation, which a source of law is known as customary law. Like the Javanese customary marriage law that grows and develops in an area. In Javanese customary marriage law there are practices or prohibitions that must be obeyed by the community. The author's goal here is to map practices or prohibitions in Javanese traditional marriages in Nglawak Village, Kertosono District, Nganjuk Regency, and compare them with marriages according to Islamic law. The research method used was field research (Field Research), meaning that the research was carried out by going directly to the object area under study using interviews with the community, traditional leaders, elders, and village heads. As well as by combining library research methods (Library Research), meaning that the data obtained by collecting secondary data such as reading and obtaining through various books and journals/articles related to marriage according to customary and Islamic law, which later these data will be combined and discussed in detail, so that they complement each other. The results of the study show that practices and prohibitions in Javanese traditional marriages are still applied in the village of Nglawak, because many people still adhere to ancestral traditions. However, there are some people who have abandoned this belief. Because in Islamic law there are no prohibitions or restrictions as in traditional marriages.Suatu kebiasaan yang diwarisi oleh masyarakat daerah secara turun temurun, merupakan sumber hukum yang disebut sebagai hukum adat. Seperti halnya hukum perkawinan adat Jawa yang tumbuh dan berkembang di suatu daerah. Dalam hukum perkawinan adat Jawa terdapat praktik ataupun larangan yang harus ditaati oleh masyarakat. Terdapat kebaruan dalam penelitian ini terkait dengan praktik larangan dalam perkawinan adat Nglawak. Adapun tujuan penulis disini untuk memetakan praktik dan larangan dalam perkawinan adat jawa yang terdapat di Desa Nglawak, Kecamatan Kertosono Kabupaten Nganjuk yang ditinjau menurut hukum Islam. Penelitian ini merupakan penelitian lapangan (Field Reasearch), yang dilakukan dengan cara terjun langsung ke daerah obyek yang diteliti dengan pengumpulan data menggunakan metode interview kepada masyarakat, tokoh pemangku adat, sesepuh, dan kepala desa. Hasil penelitian menunjukan bahwa praktik dan larangan dalam pernikahan adat Jawa masih kental diterapkan di desa Nglawak, namun ada sebagian masyarakat yang sudah meninggalkan kepercayaan tersebut. Islam memandang adat yang yang ada boleh dilaksanakan asalkan tidak ada praktik yang dilarang oleh syariat, sehingga larangan pernikahan adat dikembalikan kepada niat individu masing-masing karena dalam hukum Islam tidak terdapat larangan ataupun pantangan-pantangan seperti dalam perkawinan adat.Suatu kebiasaan yang diwarisi oleh masyarakat daerah secara turun temurun, merupakan sumber hukum yang disebut sebagai hukum adat. Abstract

Polygamy is one of the most talked-about and controversial issues of marriage. It is rejected in a variety of arguments such as normatively and psychologicaly. Even, it is always associated with a gender inequality as expressed by some of the gender activists or women activists. Western writers often claim that polygamy is evidence that the teaching of Islam in the field of marriage is very discriminatory against women. On the other hand, polygamy is campaigned because it is considered as an alternative to solve the phenomenon of cheating and prostitution. Whatever the reasons expressed, polygamy is clearly mentioned in the Qur‟an, regardless of how the verse is applied. The problem is in what conditions and by whom the concept of polygamy can be implemented. This paper will investigate the polygamy as the simultaneous social solusion and sexual tour. To answer to questions of the research, the author will use Law No. 1 Year 1974, and Islamic Law Compilation (KHI) as a blade analysis. To get more comprehensive discussion, writer will also use the phenomenological approach. [Poligami merupakan salah satu persoalan dalam perkawinan yang paling banyak dibicarakan sekaligus kontroversial. Satu sisi poligami ditolak dengan berbagai macam argumentasi, baik yang bersifat normatif, psikologis, bahkan selalu dikaitkan dengan ketidakadilan gender— sebagaimana diungkapkan aktivis gender atau pegiat perempuan. Bahkan penulis Barat sering mengklaim, bahwa poligami adalah bukti, bahwa ajaran Islam dalam bidang perkawinan sangat diskriminatif terhadap perempuan. Pada sisi lain, poligami dikampanyekan karena dianggap sebagai salah satu alternatif untuk menyelesaikan fenomena selingkuh dan prostitusi. Apapun alasan yang diungkapkan, yang jelas poligami merupakan shari‟ah agama yang keberadaannya jelas di dalam al-Qur‟an, terlepas bagaimana ayat tersebut diterapkan. Permasalahannya adalah dalam kondisi yang bagaimana dan oleh siapa shari‟ah poligami ini bisa dilaksanakan. Tulisan ini mencoba mengkaji poligami yang pada satu sisi berdampak pada solusi sosial, pada sisi yang lain bisa dianggap sebagai wisata seksual yang dilakukan suami, dan bisa juga kedua alasan tersebut berkelindan secara bersamaan. Selanjutnya penulis membahas poligami tersebut dengan pisau analisis Hukum Islam, UU No. 1 Tahun 1974, dan KHI (Hukum Positif). Tidak hanya itu, penulis juga berupaya merelevansikan kajian poligami ini dengan pisau analisis teori fenomenologi dalam ilmu sosiologi.]

Abstract

This study describes the application of sharia economic principles in Micro, Small and Medium Enterprises (MSMEs). This business is a type of business that is growing rapidly in the current era of society, which includes various specific business fields. MSMEs have an important role in addressing the issues of unemployment and poverty. They are also the backbone of the economy that is widely run by the community, especially in the sale of iced tea in Wonocolo District, Surabaya. These MSMEs play a very important role in the Indonesian economy, especially in addressing the issues of unemployment and poverty. This study aims to explore how sharia economic principles can be applied in MSME business practices that are not only oriented towards financial gain but also sustainability and justice. The research method chosen is descriptive qualitative. Through interviews, 10 MSME actors became the research subjects. The results show that MSME players in Wonocolo Sub-district have applied sharia principles such as justice, business ethics, and social responsibility, integrated in their operations. In addition, it has been found that the application of sharia economic principles helps improve competitiveness and sustainability for entrepreneurs, as well as providing social benefits for the surrounding community. So it can be concluded that the application of Islamic economic principles can be a solution to face the challenges in an increasingly competitive and complex business world.

Abstract

Abstract: this article discusses changes brought by the ruling of Constitutional Court No. 69/PUU/XIII/2015 which reviewed Marriage Law No. 1/1974, article 29 on pre nuptial agreement. The article previously stated that such an agreement must be done prior or at the eve of marriage contract was signed. The Constitutional Court decided upon a petition that nuptial agreement may be done prior the marriage or during the marriage. The implication of this reuling by Constitutional Court is the additional legal protection regime that women can have in marriage against misfortunes such as domestic violence and property loss. In doing so, married couples will be focused on the realization of islamic marriage of everlasting, peaceful and happy family. Abstrak: Salah satu tujuan utama pernikahan adalah terbentuknya keluarga yang bahagia, kekal, penuh kasih sayang di antara suami istri. Namun di luar itu berkemungkinan terjadi permasalahan dalam perkawinan, sehingga butuh diadakan sebuah perjanjian perkawinan. Dalam Undang-Undang Perkawinan Nomor 1 Tahun 1974 pasal 29 ayat (1) disebutkan bahwa perjanjian perkawinan harus diadakan saat atau sebelum perkawinan dilaksanakan. Hal ini dapat mengganggu konsentrasi pasangan terhadap tujuan utama perkawinan. Ditetapkannya putusan MK Nomor 69/PUU/XIII/2015, menjadikan frasa “pada waktu atau sebelum perkawinan dilangsungkan” dalam pasal 29 ayat (1) dimaknai dengan “pada waktu, sebelum dilangsungkan atau selama dalam ikatan perkawinan”. Jadi, perjanjian perkawinan yang semula harus diadakan sebelum atau saat perkawinan dilangsungkan, sekarang boleh diadakan setelah perkawinan dilangsungkan selama dalam ikatan perkawinan. Implikasi dari hal ini adalah adanya perlindungan hukum lebih, terutama bagi perempuan agar tidak menjadi korban kekerasan dalam rumah tangga, menjamin perlindungan terhadap hak milik atau hak guna bangunan suatu harta, pasangan juga lebih fokus terhadap tujuan utama perkawinan yakni membentuk keluarga yang bahagia, kekal, penuh kasih sayang bersama pasangan.

Abstract

Pemilu serentak merupakan gabungan antara pemilu legislatif dan pemilu Presiden yang dilaksanakan secara serentak, hal ini merupakan tindak lanjut dari Putusan Mahkamah Konstitusi Nomor 14/PUU-XI/2013. Dalam kenyataannya, pemilih pada Pemilu 2024 berasal dari Generasi Z dan Milenial, sekitar 55%. Untuk itu, generasi muda penting tidak hanya mengenali, menganalisis, memeriksa visi dan misi serta program yang ditawarkan peserta pemilu, termasuk partai politik, caleg, calon presiden dan wakil presiden, namun juga ikut membantu Komisi Pemilihan Umum dalam proses pelaksanaan Pemilu 2024. Pemilih muda dalam pemilu diharapkan menjadi pemilih yang cerdas, hal ini memiliki korelasi dengan fikih good governance. Fikih good governance merupakan bagian dari fiqh siyāsah, karena semua kebijakan yang diambil oleh pemerintah bersumber dari hasil pemikiran manusia untuk merealisasikan kesejahteraan rakyat, penegakan hukum dan agar dijauhkan dari kerusakan. Cara pandang pemilih muda dalam memilih pemimpin yang jujur, anti korupsi dan memperjuangkan negara utama atau bahagia seperti disampaikan oleh Abū Naṣr al-Farābi. Negara utama merupakan negara yang pelembagaannya membutuhkan kerjasama dari semua warganya dan kepemimpinan yang kuat dari seorang penguasa berbudi luhur yang pengetahuannya telah membimbingnya dan penduduknya tolong menolong untuk memperoleh kebahagiaan yang diibaratkan seperti badan yang sehat. Negara utama tersusun dari bagian-bagian yang berbeda yang saling memenuhi. Adapun kontestasi dan dinamika pemilu 2024 dapat dipahami adanya persaingan dan perebutan suara, baik dari calon Presiden maupun legislatif. Kontestasi ini harus dilakukan dengan sportif. Dalam hal dinamika, ada pembaruan pemilu yang dulu secara terpisah sekarang secara langsung dan serentak. Adanya kebaruan ini merupakan keniscayaan dalam negara demokratis. Simultaneous elections is a combination of legislative and presidential election held simultaneously, This is a follow-up to the Constitutional Court Decision Number 14/PUU-XI/2013. In reality, voters in the 2024 Election come from Generation Z and Millennials, around 55%. For this reason, it is important for the younger generation not only to recognize, analyze, examine the vision and mission and programs offered by election participants, including political parties, legislative candidates, presidential and vice presidential candidates, but also to help the General Election Commission in the process of implementing the 2024 elections. Young voters in elections are expected to be intelligent voters, this has a correlation with good governance fiqh. Good governance fiqh is part of siyāsah fiqh, because all policies taken by the government originate from the results of human thought to realize people's welfare, enforce the law and prevent damage. The perspective of young voters in choosing leaders who are honest, anti-corruption and strive for a premier or happy country as conveyed by Abū Naṣr al-Farābi. The main country is a country whose institution requires the cooperation of all its citizens and the strong leadership of a virtuous ruler whose knowledge has guided him and his people to help them achieve happiness which is likened to a healthy body. The main state is composed of different parts that fulfill each other. As for the contestation and dynamics of the 2024 election, it can be understood that there will be competition and competition for votes, both from presidential and legislative candidates. This contest must be carried out with sportsmanship. In terms of dynamics, there is a renewal of elections which used to be separate now directly and simultaneously. This newness is a necessity in a democratic country.

Abstract

Buying and selling transactions using damaged/defective money is a topic of concern in the Islamic view. Because of this, this research was made to discuss the use of damaged/defective money in buying and selling transactions from the point of view of community leaders and traders in Wonocolo District which will then be analyzed by Law Number 7 of 2011. This research was conducted through a qualitative approach using interviews and participatory observation as method of collecting data. The results of the study show that there are differences of opinion between community leaders and traders regarding the use of damaged/defective money in buying and selling transactions. Some community leaders and traders are of the opinion that the use of damaged/defective money in buying and selling transactions is not in accordance with the legal perspective stipulated in Law Number 7 of 2011. They are of the opinion that the money used in transactions must meet the criteria of validity, not be defective, and have stable exchange rate. They also stated that the use of damaged/defective money could violate the principles of fairness and reduce trust in buying and selling transactions. However, different views also emerge, especially among traders.
