Abstract

Abstrak. The development of the times is so rapid, the mode of spreading pornographic content has also spread through the internet. The formulation of the crime of pornography is also regulated in article 27 paragraph (1) of Law Number 11 of 2008 concerning Electronic Information and Transactions, which reads: "Every person intentionally and without right distributes and/or transmits and/or makes electronic information accessible and/or Electronic Documents that contain content that violates decency.”the formulation of the problem that will be raised in this thesis is: How is the law enforced for perpetrators of spreading pornographic content on the internet? What are the criminal sanctions for those who spread pornographic content on the internet? This type of research is normative legal research. Normative legal research is solving legal problems normatively which basically relies on a critical and in-depth study of library materials and legal documents that are relevant to the legal problems being studied. Conclusion: Legal review of the distribution of pornographic content on the internet according to Law number 1 of 2024 concerning the second amendment to Law number 11 of 2008 concerning electronic information and transactions, that content within the scope of information and electronic transactions which is included in the category of decency is several types of content pornography, namely in the form of writing, images or videos. Meanwhile, Legal sanctions for the purpose of distributing pornographic content on the internet according to Law Number 44 of 2008 concerning Pornography must meet the criminal elements for uploading decency content on social media according to Law Number 1 of 2024 concerning the second amendment to Law Number 11 of 2008 Regarding electronic information and transactions, content or sentences uploaded to social media services that contain elements of decency are distributed without any rights and become public consumption for users. other social media services. The legal consequences arising from the use of content containing decency on social media based on the criminal law in force in Indonesia are that you will be punished with imprisonment for a maximum of 6 (six) years and/or a fine of a maximum of IDR. 1,000,000,000.00 (one billion rupiah) in accordance with Article 45 of Law Number 1 of 2024. Second amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions. Keywords: Criminal Sanctions, Distribution, Pornographic Content, Internet Abstrak. Perkembangan zaman yang begitu pesat, modus penyebaran konten pornografi pun juga merambah melalui internet. Rumusan tindak pidana pornografi juga diatur pada pasal 27 ayat (1) Undang-Undang Nomor 11 Tahun 2008 mengenai Informasi dan Transaksi Elektronik, yaitu berbunyi: “Setiap orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya Informasi Elektronik dan/atau Dokumen Elektronik yang memiliki muatan yang melanggar kesusilaan.”Penelitian ini menjelaskan penegakan hukum pelaku penyebaran konten pornografi di internet? Bagaimana sanksi pidana pelaku penyebaran konten pornografi di internet ? Penelitian hukum normatif adalah memecahkan masalah hukum secara normatif yang pada dasarnya bertumpu pada penelaahan kritis dan mendalam terhadap bahan- bahan pustaka dan dokumen- dokumen hukum yang relevan dengan permasalahan hukum yang dikaji. Kesimpulan penyebaran konten pornografi di internet menurut Undang-undang nomor 1 Tahun 2024 tentang perubahan kedua atas Undang-undang nomor 11 tahun 2008 tentang informasi dan transaksi Elektronik, Bahwa konten dalam lingkupan informasi dan transaksi elektronik yang termasuk dalam kategori kesusilaan adalah beberapa jenis konten pornografi yaitu dalam bentuk tulisan, gambar atau video. Sedangkan Sanksi hukum penyebaran konten pornografi di internet menurut Undang-undang Nomor 44 tahun 2008 tentang Pornografi harus memenuhi unsur pidana atas unggahan konten konten berbentuk kesusilaan pada media sosial menurut Undang-undang nomor 1 Tahun 2024 tentang perubahan kedua atas Undang-undang nomor 11 tahun 2008 tentang informasi dan transaksi Elektronik adalah konten-konten atau kalimat-kalimat yang diunggah kedalam layanan media sosial yang mengandung unsur kesusilaan disebar luaskan secara tanpa memiliki hak dan menjadi konsumsi publik bagi pengguna layanan media sosial lainnya. Akibat hukum yang timbul terhadap penggunaan konten yang mengandung kesusilaan pada media sosial berdasarkan hukum pidana yang berlaku di Indonesia adalah akan dipidana dengan pidana penjara paling lama 6 (enam) tahun dan/atau denda paling banyak Rp. 1.000.000.000,00 ( satu miliar rupiah) sesuai dengan Pasal 45 Undang-Undang Nomor 1 Tahun 2024 Perubahan kedua atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik. Abstract

The Province of Papua holds a special constitutional status under Law No. 2 of 2021, implemented through Government Regulation (PP) No. 106 of 2021, which assigns 23 governmental functions to regional authorities. The regulation embodies asymmetric decentralization intended to protect the rights of Indigenous Papuans (OAP) and address local needs. However, it raises legal concerns regarding ambiguous authority distribution between central, provincial, and municipal levels, as well as the unclear operational role of the Papuan People’s Assembly (MRP). The main research problem is whether PP No. 106/2021 provides a coherent and constitutionally consistent governance framework. This study applies doctrinal legal research using normative-analytical methods, including statutory interpretation, constitutional tests, and comparative perspectives. The findings indicate weak accountability mechanisms in managing Special Autonomy Funds, limited integration of customary law, and institutional fragility in newly established bodies such as BP-DOP and UPAP. The study concludes that PP No. 106/2021 does not fully align with the constitutional principles of legal certainty and decentralization. It recommends substantial revisions, strengthening MRP’s legal status, formal recognition of customary law through Perdasus, and an institutional blueprint with clear performance indicators to ensure effective, inclusive, and adaptive governance in Papua

Abstract

Penelitian ini membahas pertanggungjawaban hukum terhadap anggota partai politik yang terlibat dalam tindak pidana korupsi. Korupsi yang dilakukan oleh anggota partai politik memiliki dampak serius terhadap kepercayaan publik, integritas sistem politik, dan efektivitas pemerintahan. Tujuan penelitian ini adalah untuk menganalisis dasar hukum, bentuk pertanggungjawaban, serta hambatan dalam penegakan hukum terhadap anggota partai politik yang terbukti melakukan korupsi. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, kasus, dan konseptual. Hasil penelitian menunjukkan bahwa anggota partai politik yang melakukan tindak pidana korupsi dapat dikenai pertanggungjawaban pidana berdasarkan Undang-Undang Nomor 31 Tahun 1999 jo. Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi. Selain itu, mereka juga dapat dikenai sanksi administratif dan etik melalui mekanisme internal partai atau lembaga etika publik. Namun, implementasi penegakan hukum kerap menghadapi kendala, seperti intervensi politik, lemahnya integritas lembaga penegak hukum, serta kurangnya keberanian partai politik dalam menindak tegas kadernya yang terlibat. Oleh karena itu, dibutuhkan reformasi kelembagaan dan penguatan independensi aparat penegak hukum untuk menjamin akuntabilitas politik dan supremasi hukum.

Abstract

Penelitian ini bertujuan untuk menganalisis pertimbangan hukum hakim dalam putusan Pengadilan Negeri Tanjung Karang Nomor 101/Pid.Sus/2024/PN Tjk terkait tindak pidana pencabulan terhadap anak. Kasus ini menjadi penting dikaji karena menyangkut perlindungan hukum bagi anak sebagai korban kejahatan seksual, serta bagaimana hukum diterapkan untuk memberikan keadilan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan kasus (case approach). Data diperoleh dari studi pustaka dan dokumentasi putusan pengadilan. Hasil penelitian menunjukkan bahwa hakim dalam menjatuhkan putusan telah mempertimbangkan alat bukti yang sah, keterangan saksi, keterangan korban, serta keterangan terdakwa. Selain itu, hakim juga mempertimbangkan keadaan yang memberatkan dan meringankan terdakwa dalam menentukan besarnya pidana. Putusan ini dinilai telah mencerminkan upaya penegakan hukum terhadap pelaku kekerasan seksual terhadap anak, meskipun masih terdapat ruang evaluasi terhadap aspek perlindungan korban dan rehabilitasi pelaku. Penelitian ini diharapkan dapat menjadi kontribusi akademik dalam mengkaji penerapan hukum pidana terhadap kejahatan seksual pada anak.

Abstract

Kerek District is a densely populated area where the majority of the people work as traders and fishermen, urban education is still low, the people of Kerek District have middle and high school education, the average population is 67,163 people, consisting of 33,196 famale residents. and 33,967 people are famale. In the Kerek area there is 1 health center, 17 villages and 17 posts, where each village has 1 village midwife in each village sub-district who is tasked with monitoring the health of mothers and children so that the number of  midwives follows number of midwives. Kerek Subdistrict Village includes 17 midwives and 1 Kerek Community Health Center coordinating midwife whose duties include providing private health services that serve maternal and child health in their work area, but are required to carry out supervision. The problem is that how many incidents of malpractice in Kerek sub-district carried out by midwives on women giving birth which causes harm to the patient, namely the baby dies, so the health sciences faculty collaborates with the Indonesian Midwives Assosiation Kerek sub-district branch and the Kerek Community Health Center to provide guidance and counseling to all village midwives in Kerek sub-district to improve service quality for patients with the aim to reducing maternal and infant morbidity and mortality.

Abstract

Freight forwarding agreements in Indonesia frequently contain exoneration clauses that exempt logistics providers from liability for loss or damage, raising serious concerns regarding consumer protection. While such clauses are designed to manage contractual risk, they often conflict with the principles enshrined in Law No. 8 of 1999 on Consumer Protection (UUPK), particularly those ensuring fairness, good faith, and legal accountability. This study investigates the legality and ethical implications of exoneration clauses within standard-form freight forwarding contracts used by companies such as JNE, TIKI, and SiCepat. Employing a doctrinal legal research methodology, the study integrates statutory, conceptual, and case-based approaches to analyze primary legislation, judicial decisions, and relevant legal doctrines. It critically evaluates the use of these clauses in light of consumer rights, contract theory, and the economic impact on service quality. Findings reveal that exoneration clauses not only contravene the UUPK but also create systemic contractual imbalances due to the lack of negotiation opportunities and transparency. The study proposes a normative legal framework for reform, including clause classification, interactive consent mechanisms, and regulatory enforcement to ensure contractual fairness. This research contributes to both legal scholarship and policy development by highlighting the urgent need for doctrinal clarity and regulatory oversight in Indonesia's logistics sector.

Abstract

This study critically examines the constitutionality of Indonesia’s presidential candidacy threshold under Article 222 of Law No. 7 of 2017 in relation to the principle of popular sovereignty in Article 1(2) of the 1945 Constitution. The threshold requiring a party or coalition to hold 20% of DPR seats or 25% of the popular vote has been controversial for limiting voter choice and reinforcing oligarchic dominance. Using a normative legal research method, the study applies doctrinal interpretation through grammatical, systematic, historical, and teleological approaches to evaluate whether the threshold is consistent with constitutional democracy. The analysis identifies a disconnect between the legislative rule and the constitutional concept of sovereignty residing with the people, informed by theories of democracy, sovereignty, and progressive legal thought. While procedurally legitimate, the threshold lacks substantive constitutional validity because of its exclusionary impact on political participation. The study proposes four reform options: repeal, proportional adjustment, judicial reinterpretation, and constitutional amendment. These reforms would realign electoral rules with democratic principles and restore voters’ political agency. A doctrinal reinterpretation model is offered, framing the threshold as a regulatory instrument rather than a rigid barrier, advocating a legal structure that promotes inclusivity and reflects the people’s general will.

Abstract

The right to health is a fundamental human right that remains inherent to prisoners. This study aims to examine the legal protection of prisoners' right to health care as regulated in Law Number 22 of 2022 on Corrections, as well as its implementation in correctional institutions. The research uses a normative juridical method with statutory and conceptual approaches. The findings show that Law Number 22 of 2022 formally guarantees prisoners' access to health services, including mental health care and special protection for vulnerable groups such as women, the elderly, and persons with disabilities. Key provisions in Articles 10, 11, 12, and 14 establish the state's obligation to provide adequate health services equivalent to community standards. However, in practice, the realization of this right faces several obstacles including: (1) overcapacity of correctional facilities exceeding 180% of ideal capacity, (2) limited medical personnel with many institutions lacking permanent doctors, (3) inadequate health facilities and medicine supplies, (4) complicated referral procedures causing delays in emergency treatment, and (5) insufficient budget allocation. Strengthening technical regulations, improving infrastructure, enhancing cross-sectoral collaboration, and implementing effective oversight mechanisms are essential to ensure effective protection of prisoners' health rights as mandated by the constitution and international human rights standards.

Abstract

This study aims to analyse the role of the Department of Manpower in providing protection to former Indonesian Migrant Workers (PMI) returning from abroad and to identify the challenges encountered in performing this function. This research employs a normative juridical approach using secondary data sources, including statutory regulations, scientific journals, and institutional reports from 2020 to 2025. The findings reveal that the Department of Manpower plays several key roles, including providing information and education, coordinating with related agencies, offering legal assistance, supporting social and economic reintegration, and monitoring non-procedural placements. These roles are firmly grounded in Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers and Government Regulation Number 59 of 2021. However, implementation remains constrained by inaccurate data, limited human resources and budget, weak institutional coordination, and suboptimal legal complaint services. Despite these challenges, efforts have been made through strengthening integrated services, staff training, public education, and the use of information technology. This study concludes that the protection of former migrant workers requires a holistic, participatory, and sustainable approach to ensure the fulfilment of their rights as mandated by law.

Abstract

Drug abuse constitutes a serious threat to public health, social stability, and national security. This study examines law enforcement mechanisms against drug abuse under Indonesian Law Number 35 of 2009 on Narcotics and evaluates preventive measures implemented to combat this phenomenon. Employing a normative juridical approach through a comprehensive literature review, this research analyses the implementation of both penal and non-penal approaches in addressing narcotics-related offences. The findings reveal that law enforcement practices predominantly emphasise punitive measures, despite legislative provisions accommodating rehabilitation for drug users. The dual approach integrating criminal sanctions with social and health services remains suboptimal due to institutional constraints, limited rehabilitation facilities, inadequate training for law enforcement personnel, and weak inter-agency coordination. Preventive efforts through education, family empowerment, school-based programs, community engagement, and media campaigns have been implemented but continue to face challenges, including social stigma and insufficient public awareness. This study recommends strengthening restorative justice implementation, expanding rehabilitation service capacity, and enhancing cross-sectoral collaboration to build societal resilience against drug abuse while ensuring that users receive appropriate treatment rather than mere criminalisation.
