Abstract

Not bereft of the vision of 2030, Saudi Arabia reformed its Islamic family law, which resulted in the issuance of Niẓam al-Aḥwāl al-Syakhṣiyyah 1443 H. However, this modernization attempt is shadowed by the long-term preference for the established madhab. By focusing on the talaq issue, this article aims to investigate to what extent this Niẓam articulated with Hanbali madhab in managing divorce. As a normative study, data were collected by examining the primary resource, Niẓam al-Aḥwāl 1443. The result indicates that the positivization of divorce is primarily attributable to the Hanbali’s source of law. This (intra-doctrinal) positivization is intended to ensure legal certainty for the sake of this nation's modernization efforts. It affirms that the attempt in the private sector is in fact a manifestation of the 2030 political vision.[Tidak lepas dari visi 2030, Arab Saudi mereformasi hukum keluarga Islamnya, yang berujung pada keluarnya Niẓam al-Aḥwāl al-Syakhṣiyyah tahun 1443 H. Dengan berfokus pada masalah talak, artikel ini bertujuan untuk menyelidiki sejauh mana Niẓam ini berkaitan dengan madzhab Hanbali dalam mengatur perceraian. Sebagai kajian normatif, data dikumpulkan dengan mengkaji sumber primer, Niẓam al-Aḥwāl 1443. Hasilnya menunjukkan bahwa positivisasi talak terutama disebabkan oleh sumber hukum Hanbali. Abstract

Aceh represents one of the autonomous regions situated on the western frontier of Sumatra Island within the unitary structure of the Republic of Indonesia. Despite the abundance of natural resources in Aceh, a substantial portion still needs to be adequately managed systematically and in a contemporary manner. Among these resources are artisanal gold mines, where extraction processes rely on manual labor and limited tools. One such mining site is located in the Peulumat Mountains. The operation of this mine suffers from a dearth of technical expertise, primarily managed manually by the local community. However, the utilization of these natural resources should not be managed by entities that neglect ecological justice, which is crucial for fostering the sustainability of nature itself. This research investigates how laborers at the artisanal gold mine in Mount Peulumat navigate their operations to achieve ecological justice. This qualitative research employed a socio-legal approach and was conducted in the rural community of Gampong Gunong Rotan. This study finds a patron-client relationship in the management and allocation of mining proceeds. Two pivotal elements influencing the realization of ecological justice within the mining locale emerged: natural phenomena and a belief in divine principles. Locals perceive certain natural occurrences, such as the flooding of the mining wells, as an indication to cease gold extraction promptly. Furthermore, a prevailing belief dictates that extracted gold should not be solely for personal gain but shared with those in need, reflecting a commitment to divine values.

Abstract

The objective of this study is to explain the problem associated with the application of inheritance division lidzdzakari mitslu hadhdhi al-unstsayain, contemporary studies in juridical, psychological, sociological, and economic perspective. Data were collected through documentation and analyzed using the Miles and Huberman analysis method. The source triangulation method was used to validate and authenticate the data. The results obtained are as follows: firstly, juridically, the 2:1 division of inheritance has an underlying legal umbrella, named QS. An-nisa paragraph 11 and Compilation of Islamic Law (KHI) Book II on Inheritance is in accordance with article 176. However, the application varies with each community due to underlying factors. Secondly, psychologically, division of inheritance should not be done haphazardly to meet the criteria of justice for all parties to avoid conflict between families. Thirdly, sociologically, the application of inheritance is still a pro-con in society with a ratio of 2:1, which has not fulfilled the element of justice. Fourthly, economically, the 2:1 division of inheritance is firmly based on the amount of economic responsibility a man carries.

Abstract

This research is motivated by the problem of many salt farmers in the Galis District who do not understand the importance of developing competence and competitive advantage for the sustainability of the salt business. This research aims to determine and analyze the influence of competency development on the competitive advantage of salt farmers in Galis District, Pamekasan Regency. The research method used is a quantitative method so the data displayed is data from questionnaire results which are processed using SPSS 26 statistics. The type of research used in this research is survey research, data collected through questionnaire results on the research instrument used. The data analysis technique used is the inferential statistical analysis technique. The results of this research can conclude that competency development has a significant effect on the competitive advantage of salt farmers in Galis District, Pamekasan Regency. This research is expected to contribute to competency development efforts to increase the competitive advantage of salt farmers in Galis District, Pamekasan Regency.

Abstract

This article examines the gap between regulations and practices concerning children’s deradicalization in Indonesia. The study analyses four regulations on deradicalization in comparison to the practices observed in four pesantrens (Islamic boarding schools) in the country between 2019 and 2023. The findings reveal that Indonesian deradicalization regulations remain predominantly adult-oriented and have not systematically addressed the fundamental needs of children. They emphasise nationalism, religious moderation, entrepreneurship, and rehabilitation, while education is framed merely as a mean of instilling nationalist and moderate religious values, concepts more aligned with adult-focused programmes. In contrast, the practical implementation of children’s deradicalization highlights education as their primary necessity. Education is viewed as a long-term strategy for social reintegration to ensure a better future for these children. Furthermore, critical aspects such as administrative citizenship, psychological rehabilitation, and disengagement should also receive attention. Future regulations and practices must integrate these dimensions to more effectively support the deradicalization of children associated with terrorism.[Artikel ini mengkaji disparitas antara regulasi dan praktik deradikalisasi anak di Indonesia. Studi ini menganalisis empat peraturan mengenai deradikalisasi dibandingkan dengan praktik di empat pesantren di Indonesia antara tahun 2019 dan 2023. Temuan ini menunjukkan bahwa peraturan deradikalisasi di Indonesia masih sebagian besar berorientasi pada orang dewasa dan belum secara sistematis memenuhi kebutuhan mendasar anak-anak. Peraturan-peraturan ini menekankan nasionalisme, moderasi beragama, kewirausahaan, dan rehabilitasi, sedangkan pendidikan dibingkai hanya sebagai sarana untuk menanamkan nilai-nilai nasionalis dan agama moderat, konsep ini lebih selaras dengan program yang berfokus pada deradikalisasi untuk orang dewasa. Sebaliknya, implementasi praktis deradikalisasi anak-anak menyoroti pendidikan sebagai kebutuhan utama mereka. Pendidikan dipandang sebagai strategi jangka panjang untuk reintegrasi sosial, yang menjamin masa depan yang lebih baik bagi anak-anak. Selain itu, aspek penting seperti administrasi kewarganegaraan, rehabilitasi psikologis, dan pemisihan dari kelompok mereka sebelumnya juga harus dipertimbangkan. Abstract

This article examines how marital authority and gender relations are negotiated among Indonesian Muslim immigrant families in Sydney within the framework of Islamic family law. While Muslim family norms are often portrayed as uniform, migration to multicultural societies creates new contexts in which Islamic legal doctrines are interpreted and practised in diverse ways. This study, therefore, investigates how key concepts of Islamic family law—qiwāmah (leadership), nafaqah (financial maintenance), ṭāʿah (spousal obligation), shūrā (consultation), and muʿāsharah bi al-maʿrūf (equitable marital relations)—are understood and implemented in Muslim immigrant households. Employing a qualitative socio-legal approach, the research draws on fieldwork and in-depth interviews with Indonesian Muslim immigrant couples in Sydney, complemented by participant observation and doctrinal analysis of Islamic legal texts. The findings identify five patterns of marital relations: owner–property, head–complement, senior–junior partner, equal partner, and equity–equality partner. These relational models reflect different interpretations of Islamic legal authority, ranging from hierarchical readings of qiwāmah to more reciprocal and justice-oriented understandings grounded in maqāṣid al-sharīʿah. The study demonstrates that migration operates as a space of legal negotiation in which Islamic family norms are neither abandoned nor mechanically preserved but continuously reinterpreted through processes of contextual reasoning and everyday marital practice. By linking empirical family dynamics with Islamic legal interpretation, this research contributes to socio-legal scholarship on the transformation of Sharīʿah in minority and diasporic contexts. [Artikel ini menganalisis bagaimana otoritas perkawinan dan relasi gender dinegosiasikan dalam keluarga imigran Muslim Indonesia di Sydney dalam kerangka hukum keluarga Islam. Meskipun norma keluarga Muslim sering dipandang bersifat seragam, migrasi ke masyarakat multikultural menghadirkan konteks baru di mana doktrin hukum Islam ditafsirkan dan dipraktikkan secara beragam. Penelitian ini bertujuan untuk mengkaji bagaimana konsep-konsep utama dalam hukum keluarga Islam—qiwāmah (kepemimpinan), nafaqah (nafkah), ṭāʿah (ketaatan), shūrā (musyawarah), dan muʿāsharah bi al-maʿrūf (hubungan yang baik)—dipahami dan dijalankan dalam rumah tangga Muslim di diaspora. Penelitian ini menggunakan pendekatan kualitatif sosio-legal melalui kerja lapangan dan wawancara mendalam dengan pasangan imigran Muslim Indonesia di Sydney, yang dilengkapi dengan observasi partisipatif serta analisis doktrinal terhadap literatur hukum Islam. Hasil penelitian mengidentifikasi lima pola relasi perkawinan, yaitu model berbasis harta, kepala-komplementer, mitra senior-junior, mitra setara, dan mitra setara-adil. Pola-pola tersebut mencerminkan beragam interpretasi terhadap otoritas dalam hukum keluarga Islam, mulai dari pembacaan hierarkis terhadap konsep qiwāmah hingga pemahaman yang lebih resiprokal dan berorientasi pada keadilan berdasarkan pendekatan maqāṣid al-sharīʿah. Temuan ini menunjukkan bahwa migrasi menjadi ruang negosiasi hukum di mana norma-norma keluarga Islam tidak sekadar dipertahankan atau ditinggalkan, tetapi terus ditafsirkan ulang melalui proses ijtihad kontekstual dan praktik kehidupan keluarga sehari-hari. Dengan menghubungkan dinamika keluarga Muslim di diaspora dengan interpretasi hukum Islam, penelitian ini memberikan kontribusi bagi kajian sosio-legal mengenai transformasi syariat dalam konteks masyarakat minoritas dan diaspora.]
