Abstract

This study analyzes the legal political dimensions of the Regulation of the Minister of Education and Culture Number 34 of 2018 concerning National Standards for Vocational High School Education/Vocational Madrasah Aliyah. This study aims to uncover the political background, objectives, and implications of the regulation on the vocational education system in Indonesia. Through a qualitative approach, this study found that Permendikbud Number 34 of 2018 is a reflection of the government's efforts to improve the quality of human resources and the nation's competitiveness. This regulation also shows a paradigm shift in vocational education, where the business world and industry have a more central role. However, the implementation of this regulation still faces various challenges, both internally and externally. the implementation of this regulation still faces various challenges, such as the availability of facilities and infrastructure, the quality of teachers, and the dynamics of the world of work that continues to change. This study concludes that the success of the transformation of vocational education is highly dependent on the commitment and synergy between the government, the business world, and the community.

Abstract

This research explores how digital tools are reshaping efforts to preserve Indonesia’s tropical forests, focusing on technologies like drones, satellite monitoring, and IoT sensors. Employing a qualitative case study methodology complemented by detailed interviews, the study reveals that digital innovations significantly enhance forest oversight by boosting data precision, enabling quicker wildfire alerts, and streamlining inter-agency collaboration. Despite these advancements, critical obstacles remain, including inadequate digital infrastructure, limited tech know-how among local populations, and policy disconnects between national and regional authorities. The study also underscores the vital role of empowering local communities through education and accessible technology to foster active participation in conservation. Ultimately, successful integration of digital solutions depends on flexible governance frameworks and capacity-building initiatives that collectively drive sustainable ecological, social, and economic benefits. The insights gathered are intended to guide the formulation of more impactful and enduring tropical forest conservation policies in Indonesia.

Abstract

Technological advances in the fields of transportation, communication, and information have accelerated globalization and triggered the rapid growth of electronic commerce (e-commerce). However, this development presents significant challenges in the national legal system, especially related to the application of corporate law in online transactions. This research aims to examine the legal framework and regulatory challenges in the development of e-commerce in Indonesia, highlighting the applicable policies and their juridical implications. The method used is a normative juridical approach with descriptive-analytical specifications, which allows the identification and analysis of legal norms contained in laws and regulations, legal doctrines, and relevant legal principles. Data are collected from primary, secondary, and tertiary legal materials, and then analyzed qualitatively through interpretation of existing legal substances. The results of the study show that the regulation of e-commerce in Indonesia has been accommodated through Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE), which was updated through Law Number 19 of 2016, as well as Law Number 7 of 2014 concerning Trade and Government Regulation Number 82 of 2012 concerning the Implementation of Electronic Systems and Transactions. However, obstacles are still found in its implementation, including weak electronic contract proof mechanisms, issues of trust and accountability, and low public understanding of digital transaction objects. This study recommends the drafting of a special law on e-commerce companies to strengthen legal certainty, consumer protection, and the sustainability of digital economy expansion in Indonesia.

Abstract

Diskresi ialah kewenangan yang dimiliki para pejabat administrasi publik dalam mengambil keputusan ataupun tindakan ketika peraturan perundang-undangan tidak memberikan petunjuk yang jelas. Dalam praktik pemerintahan, tulisan ini bertujuan untuk mengkaji konsep diskresi dalam hukum administrasi negara serta bagaimana prinsip negara hukum, khususnya legalitas dan akuntabilitas, dan serta membatasi bagaimana prinsip negara hukum dan juga mengarahkan penggunaan kewenangan tersebut. Hasil kajian juga menunjukan bahwa diskresi tidak hanya diakui secara hukum dalam Undang-Undang Nomor 30 Tahun 2014 tentang mengkaji administrasi pemerintahan, tetapi penggunaanya juga tidak boleh hanya digunakan sebagai dalih untuk tidak sewenang-sewenang saja. Maka dari itu pengawasan dalam internal dan eksternal terhadap direksi harus sepenuhnya diperlukan atau dilakukan dengan baik demi menjamin baiknya praktik administrasi pemerintahan yang sesuai dengan prinsip negara hukum dan dalam Undang-Undang.

Abstract

Pembangunan infrastruktur memainkan perenan krusial dalam mendorong pertumbuhan ekonomi sekaligus meningkatkan kualitas hidup Masyarakat. Di Indonesia, administrasi negara memiliki peran penting dalam menyusun kebijakan, mengoordinasikan pelaksaan, serta melakukan evaluasi terhadap proyek - proyek infrastruktur, baik di tingkat nasional maupun daerah. Tulisan ini bertujuan untuk mengkaji kontribusi administrasi negara dalam pembangunan infrastruktur, dengan fokus pada kebijakan publik, koordinasi kelembagaan, dan efektivitas tata kelola pemerintahan. Menggunakan pendekatan kualitatif melalui studi literatur dan analisis kebijakan, artikel ini menunjukkan bahwa keberhasilan pembangnan infrastruktur sangat bergantung pada kapabilitas birokrasi, kejelasan regulasi, serta keterlibatan aktif sektor publik dan swasta. Namun demikian, sejumlah tantangan seperti tumpang tindih kewenangan, praktik korupsi, serta keterbatasan pendanaan masih menjadi hambatan serius. Oleh karena itu, dibutuhkan reformasi dalam sistem administrasi dan penguatan tata kelola agar pembangunan infrastruktur dapat berlangsung secara berkelanjutan dan merata di seluruh wilayah Indonesia.

Abstract

This study aims to analyze the implementation of good governance principles in public service at the Department of Population and Civil Registration. Principles such as transparency, accountability, responsiveness, and public participation are the main focus in evaluating the quality of population administration services. The research employs a qualitative approach with in-depth interviews, observations, and document analysis. Findings indicate that some principles have been well implemented, particularly in information provision and digital-based administration systems. However, challenges remain, such as limited public participation, uneven responsiveness among staff, and users’ low digital literacy. The study recommends strengthening participatory mechanisms, service-oriented human resource training, and enhancing inclusive information systems. Overall, the study highlights the importance of integrating good governance principles to promote more effective, equitable, and sustainable public service governance.

Abstract

Political parties are a key instrument in the modern democratic system, serving as a means of articulating and aggregating the people's interests. Their existence plays a vital role in determining the quality of democracy, particularly in the implementation of legislative elections in Indonesia. This study aims to analyze the existence of political parties as pillars of democracy in the context of legislative elections, by reviewing their roles, functions, and the challenges faced in strengthening political representation of the community. The method used is normative research with a legislative, conceptual, and historical approach, complemented by an analysis of academic literature and related regulations. The results of the study indicate that although political parties have been constitutionally recognized as the main pillars of democracy, their implementation still faces various problems, such as weak internal party democratization, oligarchic practices, money politics, and a crisis of popular representation. This has resulted in declining public trust in political parties. Therefore, strengthening regulations, internal party reform, and increasing public political participation are necessary so that political parties can optimally carry out their functions as pillars of democracy. This research is expected to contribute to the development of constitutional law and politics, as well as serve as a reference in the formulation of election policies in Indonesia.

Abstract

Nurse Anesthetist has the authority to provide anesthesia services in preanesthesia, intraanesthesia, and postanesthesia. In terms of legal regulations, nurse anesthetist have clear regulations as a reference in carrying out their professional practice. However, in its implementation there are still health workers who work in anesthesia services who do not meet the statutory requirements based on competency, certification, registration and licensing as a nurse anesthetist which must be proven by having a nurse anesthetist Registration Certificate and a nurse anesthetist practices License. The aim of this research is to find out how Clinical Privilege for nurse anesthetist is viewed from a legal aspect. The research method uses a qualitative approach with a combined method of literature study and field study with Qualitative Descriptive Analysis Techniques.

Abstract

In the context of the Fourth Industrial Revolution, which intertwines biological and digital advancements, technologies like teledentistry are revolutionizing healthcare delivery in Indonesia. Teledentistry enables remote dental and oral health services through methods such as teleconsultation, teleeducation, telemonitoring, and telesurgery (Anggayanti et al., 2023). Legislation such as Law Number 17 of 2023 on Health Management in Indonesia plays a pivotal role in regulating teledentistry and ensuring patient and dentist protection. This law outlines the rights of patients to receive safe, quality, and affordable healthcare services, encouraging the use of information and communication technologies in healthcare delivery (Amril, 2023). The normative legal approach utilized in this study examines primary and secondary legal materials to analyze the implications of Law Number 17 of 2023 on teledentistry practices.This study concludes that teleconsultation in teledentistry is a valuable tool for overcoming geographical barriers and improving access to dental care in Indonesia. However, further specific legislation is recommended to foster patient trust and optimize the use of teledentistry for achieving optimal dental and oral health outcomes.

Abstract

This research examines legal protection for patients who are victims of traditional medical malpractice based on Law Number 17 of 2023 concerning Health. In the context of the increasing use of traditional medicine in Indonesia, it is important to understand existing legal protection mechanisms and how effective these regulations are in protecting patients' rights. This study uses a qualitative approach with literature study methods and analysis of related laws and regulations. The research results show that Law Number 17 of 2023 has provided a clearer legal framework in regulating traditional healing practices and provides protection mechanisms for patients. However, implementation in the field still faces various challenges, including a lack of effective supervision, limited public knowledge about their rights as patients, and differences in service quality in various regions. This research also identifies the important role of local governments in supervising and coaching traditional medicine service providers, as well as the need to increase education and outreach to the community regarding patient rights. In conclusion, although Law Number 17 of 2023 has provided a significant legal basis, there is still room for improvement in the implementation of this regulation to ensure optimal protection for traditional medicine patients in Indonesia.
