Abstract

ABSTRACTThis study focuses on analyzing the legal accountability of budgetary power in refocusing covid-19. According to data from Indonesia Corruption Watch (ICW), state losses in 2020 amounted to Rp. 18.173 trillion, while in 2021, state losses due to corruption cases amounted to Rp. 26.83 trillion. this is in line with the case of social assistance provided by the government including the PKH (Hope Family Program), the Basic Food Card Program, the Bulog Rice Assistance Program, and the BST (Cash Social Assistance) Program. Related legal issues raised and analyzed, 1) Discussion on legal accountability (KSSK) in the analysis of article 27 paragraph (2) Perppu No.1 of 2020 and 2) Legal efforts in enforcing the COVID-19 budget refocusing. Using social-legal methods. The results of the study based on 1) Article 27 paragraph (2) of Perppu No.1 of 2020 and Government Regulations of Presidential Instruction No. 4 of 2020 show the enforcement of budget refocusing by placing the position of regional heads or executive organs in budgeting and budget execution issues. With criminal justice with imprisonment and fines in accordance with Article 12 letter a of Law of the Republic of Indonesia Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended in Law of the Republic of Indonesia Number 20 of 2001. 2) Strengthening the mechanism of the role of law enforcement in the budget refocusing system is needed by maximizing implementation of the rules of corruption during the Covid-19 pandemic effectively and provide a deterrent effect through a letter of claim.

Abstract

The issue of cyber security and personal data in Indonesia is a problem that cannot be underestimated. The National Cyber ​​Security Index (NCSI) report noted that Indonesia's cyber security index score was 38.96 points out of 100 in 2022. This figure places Indonesia in the 3rd lowest ranking among the G20 countries. The legal issues in this research are: Responsibility of cyber security actors for leaks of personal data within a company and what form of legal protection in Indonesia exists in maintaining the security of personal data. The research method uses a socio-legal approach to identify IT and law. The results of this research show that cyber security actors in a company can be held accountable in accordance with Article 30 of the PDP Law and are responsible for leaking personal data and managing users' personal data within the company. The form of legal protection for individuals in safeguarding personal data is in the form of a legal product, Law Number 27 of 2022 (PDP Law).

Abstract

Rusia melancarkan agresi ke Ukraina serta mengadakan serbuan dari segala penjuru. Hal ini dianggap sebagai " Perang Putin" oleh semua negara. Salah satu bentuk pertanggungjawaban Rusia terhadap Ukraina akibat perbuatan agresi yakni harus reparasi atau pemulihan terhadap negara yang menjadi korban negara aggressor. Konflik ini belum diakui secara resmi sebagai kejahatan terhadap perdamaian internasional. Negara Ukraina dianggap sebagai korban agresi menurut hukum internasional meskipun agresi kepada Ukraina merupakan pelanggaran nyata terhadap piagam pbb serta statuta roma. Permasalahan utama yang akan dikaji ada dua : (1)Bagaimana pertanggungjawaban secara individu dan kolektif ( sebagai negara) terkait agresi ini.  (2) Mekanisme ajudikasi dan non ajudikasi dari kejahatan agresi yang dilakukan Rusia kepada Ukraina. Tujuan penelitian ini untuk mengetahui tindakan agresi militer Rusia terhadap Ukraina beserta implikasi hukum yang berlaku. Metode penelitian yang digunakan adalah Sosio-Legal. Untuk menuntut Putin dan para pemimpin politik dan militer Rusia lainnya di pengadilan kriminal internasional memiliki hambatan dari sisi hukum maupun politik. Pengadilan Kriminal Internasional tidak memiliki data terkait kejahatan agresi, serta penarikan diri Rusia dari Pengadilan Kriminal Internasional mampu mereduksi yurisdiksi ICC. Alternatif lain diupayakan yakni pengadilan ad hoc karena kejahatan agresi erat kaitannya dengan kejahatan terhadap kemanusiaan dan perang. Atau dengan dilakukannya praktik penerapan yurisdiksi universal untuk mengadili pelaku kejahatan agresi.

Abstract

Introduction to the Problem: Indonesia has been continuously developing its legal framework regarding many aspects of digital spaces, including cybersecurity, in the quest of maximizing the potentials of Industry 4.0. However, this rapid development of legal framework must be analyzed thoroughly to make sure that it’s in line with the principles of human rights. Purpose/Study Objectives: Drawing from international standards of human rights, this research focuses on analyzing the cybersecurity legal framework in Indonesia, and how the laws and regulations related to it fare against international standards of human rights. Design/Methodology/Approach: Using the normative legal research method, this research analyzes secondary data in the form of primary Indonesian and international law sources to evaluate the protection of human rights in the midst of this legal development. Findings: Findings of this research show that the legal framework in Indonesia does leave many rooms for potential human rights abuse, with normative loopholes and underestimation of potential issues regarding the denial of human rights, within digital spaces. Abstract

At the end of 2018, residents replanted the land with thousands of banana trunks. In January 2019, Pakel residents were reported by P.T. Bumi Sari; the police summoned 11 residents. In 2020, residents established a command post and planted it for six months. However, in 2020 PT BUMI SARI said it had pocketed the latest Right to Cultivate, which entered some of the villages included in their Right to Cultivate (HGU.). However, a copy document is not owned by the head of the town and residents in Pakel village. This research is a field research or empirical legal research. This research is intended to analyze about the reclaiming reclaiming carried out by the Pakel community, whether it is justified. Futhermore, this research also analyze whether PT Bumi Sari's control of land in Pakel village is against the law. This research concluded that reclaiming by Pakel residents is the right of Pakel residents as with the purpose of the formation of the Basic Agrarian Law (UUPA), which is to bring prosperity, happiness, and justice to the State and the people, especially to the peasants. Right to Cultivate of PT Bumi Sari does not comply with the laws and regulations stipulated in the UUPA. and Government Regulation of the Republic of Indonesia Number 40 of 1996 concerning Cultivation Rights, Building Use Rights, and Land Rights.

Abstract

UMSurabaya juga telah banyak menghasilkan produk inovasi alat bantu disabilitas karya mahasiswa dan dosen sebagai bentuk kepedulian kepada mereka. Produk inovasi alat bantu disabilitas terbaru yang dibuat UMSurabaya berupa BIMA Tuktuk (Inovasi Kursi Roda dengan Kendali Ketukan untuk Mahasiswa Tuna Daksa berbasis Android). Adapun tujuan pembuatan produk ini adalah untuk memberikan kemudahan akses mobilitas yang menunjang penyandang difabel menuju ke ruang pembelajan, meningkatkan efektifitas penggunaan BIMA Tuktuk karena dapat beroprasi secara otomatis, serta meningkatkan partisipasi para mahasiswa disabilitas atas peningkatan fasilitas yang mereka butuhkan. Produk BIMA Tuktuk ini dibuat menggunakan model inovasi yang dilengkapi dengan sejumlah fitur kenyamanan disabilitas dengan adanya sensor presisi tinggi pada bodi, kamera pengenal gambar, dan teknologi AI (Artificial Intelligence), yang memungkinkan BIMA Tuktuk ini beroperasi tanpa memerlukan kendali manusia. Pengembangan produk BIMA Tuktuk diperuntukkan untuk kelas yang menerima mahasiswa disabilitas. Pembuatan produk inovasi ini sebagai bukti bahwa UMSurabaya dapat menjadi contoh kampus inklusif, baik dalam artian kepedulian dan kebijakan, namun juga dalam rangka pengembangan model inovasi yang tepat guna. Harapannya produk inovasi BIMA Tuktuk mampu memberikan kemudahan akses mobilitas menuju ruang pembelajaran, sehingga mereka siap mengikuti pembelajaran secara optimal.

Abstract

In the global era with all demands and expectations for a better economic condition in a country that an international trade is needed. Fair competition can be carried out in competition between business actors and commodity (goods or services) in overseas with business actors and commodity (goods or services) in country. One form of creating justice in international trade competition is by providing subsidies. The issue of subsidies created the problems and disputes. The problem formulations of this research were: (1) how are the effects of subsidies and countervailing in international trade regulations? (2) how is the case analysis related to subsidies and countervailing measures according to the provisions of the GATT 1994, The SCM Agreement and other legal provisions? The results showed that (1) the effect of subsidies and countervailing measures based on their types (red light, yellow light, green light) in international trade regulations had provided clear provisions as well as the impact and limitations in implementing these provisions in accordance with the provisions. GATT 1994 and The SCM Agreement. (2) The several cases described regarding subsidies that were not allowed because they created injustice that the subsidies were only carried out in an emergency situation and their nature rescued them from an economic crisis.

Abstract

Indonesia is still ranked 96th out of the 180 most corrupt countries in the world. This is evidenced by many corruption cases that occur, such as the corruption case of embezzlement of social assistance funds for PKH members in Malang, the corruption case that ensnared the inactive West Bandung Regent Aa Umbara, and the corruption case that made former Social Minister Juliari Batubara a suspect. The phrase "certain circumstances" in Article 2 paragraph (2) of the Anti-Corruption Law raises problems. First is considered capable of providing a deterrent effect for corruptors, but on the other side the article is considered to trigger injustice. The legal issues raised are 1) The imposition of the death penalty for the perpetrators of the Covid-19 social assistance corruption crime based on Article 2 paragraph (2) of the Anti-Corruption Law. 2) Legal efforts in the sentencing process for the perpetrators of the Covid-19 social assistance corruption. This study uses socio-legal research methods. The results of this study 1) The death penalty in article 2 paragraph (2) of the Anti-Corruption Law can be imposed on perpetrators of the Covid-19 social assistance corruption. 2) One of the causes of difficulties in handling corruption cases is in terms of evidence, for this reason, the Adjudication and Non-Adjudication efforts through RALA are the right strategy to improve legal mechanisms in the process of criminalizing the perpetrators of the Covid-19 social assistance corruption. involving institutions related to the implementation of the criminal justice system.

Abstract

This research focused on analyzing the debates and roles of academic freedom movement in Southeast Asian. The dynamics of protection related to academic freedom cannot be separated from its protection on the one hand and the threats accompanying it. The issue of academic freedom creates a threat to the academic community in producing knowledge, both within universities and those who are active as independent researchers, especially in Southeast Asian. Authoritarianism, in turn, has affected the worse situation of free expression, including academic freedom. In the current situation, the digital sphere has been targeted as well. This article will discuss the following questions: (1). What is the situation of the academic freedom movement and protection for the academic community in Southeast Asia? (2). How are efforts to maintain the movement of academic freedom in Southeast Asia, especially in Indonesia, amid efforts to subjugate the campus by the state and the practice of authoritarianism? Using an interdisciplinary approach as a part of socio-legal research, this article argued that there is a strong relationship between the threat of academic freedom movement in Southeast Asian countries and the implications in Indonesia. The academic freedom situation in Southeast Asia has been shaped by the political and economic aspects of the region as well as in their respective countries. The role of independent and progressive alliances to struggle for their rights or to understand the role of professor unions in defending academic and scientific freedom. To what extent is academic freedom considered a strong pillar for democratic societies, including providing important scientific, economic, cultural, and social progress from which we may all benefit? This roundtable is also aimed to promote possible strategies in challenging democracy declines, affecting the shrinking civic space, and how academic resilience in the digital space is a keyword that should be strengthened in its social movement since this will be more complicated due to manipulating information and anti-science politics through systematic repression.

Abstract

Countries in the world are currently moving towards  to the development of sophisticated intelligent automated systems including the State of Indonesia where this system is able to achieve digital transformation which is considered as one of the most important pillars of modern economic growth.  With the PBB's call to implement the 2030 sustainable development plan, right in the context of this transformation, countries including Indonesia are trying to utilize modern technology in combating many issues that haunt society, namely corruption. The researcher will answer the questions (1) The legitimacy of the use of AI by the KPK in the Eradication of Corruption in Indonesia (2) The ideal legal mechanism to accommodate the use of artificial intelligence technology in eradicating corruption in Indonesia. This research uses a sociolegal approach. The results in this study indicate that in the legitimacy of the KPK in eradicating corruption criminal acts by using artificial intelligence products for eradicating corruption criminal acts, there are several articles that can be reviewed that the importance of the KPK is to use technology products in eradicating corruption criminal acts and the use of technology in handling evidence collection. and strengthen the evidence that states the existence of  corruption acts
