Abstract

This study addresses the inability of workers to resolve industrial relations disputes, thus eliminating their rights. Being unable to settle industrial relations disputes can result in losses jobs, strikes, lockouts, demonstrations, defamation, destruction of property, or even the loss of one's life. These negative impacts greatly affect the peace and comfort of work, national security, and stability. These problems, among others, can be overcome through advocating for workers who are dealing with industrial relations disputes. Mechanisms for resolving industrial relations disputes often do not give satisfactory results or fail if they are carried out based on formal regulations. However, the advocacy model for workers in industrial relations disputes based on the local wisdom of the Mbojo Tribe, Bima, Nusa Tenggara, can be an alternative solution for both anticipating industrial relations disputes that cannot be resolved and for achieving social justice for workers without harming employers. The purpose of this study is to describe the substance and procedure for resolving industrial relations disputes based on the local wisdom of the Mbojo Tribe, Bima, Nusa Tenggara, which is based on Islamic sharia. This legal research uses a conceptual and historic legislative approach. The results of the research find that the local wisdom of the Mbojo tribe written in the BO book can be the basis for alternative solutions that can build an industrial relations dispute resolution system that is closer to the sense of community justice than the current system. Abstrak: Problem dalam penelitian ini, yaitu adanya ketidakmampuan pekerja dalam menyelesaikan sengketa hubungan industrial yang menghilangkan haknya. Tidak dapat terselesainya sengketa hubungan industrial, dapat mengakibatkan kerugian, terjadinya mogok, lock out, unjukrasa, demonstrasi, pencemaran nama baik, pengrusakan barang milik orang lain sampai dengan hilangnya nyawa seseorang. Dampak negatif ini, sangat mempengaruhi ketenangan dan kenyamanan kerja, keamanan dan stabilitas nasional. Problem ini diantaranya akan dapat diatasi melalui advokasi kepada pekerja dalam menghadapi sengketa hubungan industrial. Mekanisme upaya penyelesaian sengketa hubungan industrial, seringkali belum memberikan hasil yang memuaskan atau gagal apabila dilakukan berdasarkan kebenaran formal. Model advokasi pada pekerja dalam sengketa hubungan industrial berbasis kearifan lokal Suku Mbojo, Bima, Nusa Tenggara, akan dapat menjadi alternatif solusi atas antisipasi terjadinya sengketa hubungan industrial yang tidak dapat terselesaikan, serta untuk mencapai keadilan sosial bagi pekerja tanpa merugikan pemberi kerja. Tujuan penelitian ini adalah mendiskripsikan substansi dan prosedur penyelesaian sengketa hubungan industrial berbasis kearifan lokal Suku Mbojo, Bima, Nusa Tenggara, berdasarkan syariah Islam. Penelitian hukum ini menggunakan pendekatan peraturan perundang-undangan konseptual dan sejarah. Hasil penelitian yang diperoleh adalah kearifan lokal suku Mbojo yang tertulis dalam kitab BO dapat menjadi dasar alternatif solusi untuk membangun sistem penyelesaian sengketa hubungan hubungan industrial yang lebih dekat dengan rasa keadilan masyarakat. Abstract

Introduction to The Problem: This research focused on analyzing responsibility of States about COVID-19 pandemic. The concept of international responsibility could be interpreted as a relation between the state sovereignty in national legal mechanism, and also implementation of the principles of the international law in the other sides to fix it about internationally wrongful act. Especially how states contribution to prevent, vaccines, prosperity/ social aid, and health services for people in its states.Purpose/Objective Study: This research would answer the following questions: (1). How the responsibility of states about COVID-19 pandemic under international law ?; (2). What is the dispute settlement mechanism for the fulfillment of international law? obligations by states?Design/Methodology/Approach: This research used socio-legal studies to identify between political, economy, and law approach to understanding what states responsibility regarding COVID-19 pandemic under international law.Findings: This article argued that strong relations regarding state responsibility in the face of international legal mechanisms, through international cooperation mechanisms as well as diplomatic approaches shall be prioritized, to identification regarding internationally wrongful act. Then the fulfilment of basic rights of citizens during COVID-19 pandemic such as access to health services, vaccines, and socio-economic consequences are responsible for the country. Parties that can sue the state in international liability can be from state actors and non-state actors. China as a based on Covid-19 are spread around the world are bears some international responsibility for the unquantifiable damage sustained as a direct result of the state having failed to contain the virus, and to notify the international community of its existence. Therefore, judicial mechanisms through the UN mechanism or outside the UN Mechanism to dispute settlement mechanism.Paper Type: Research Article

Abstract

UMSurabaya juga telah banyak menghasilkan produk inovasi alat bantu disabilitas karya mahasiswa dan dosen sebagai bentuk kepedulian kepada mereka. Produk inovasi alat bantu disabilitas terbaru yang dibuat UMSurabaya berupa BIMA Tuktuk (Inovasi Kursi Roda dengan Kendali Ketukan untuk Mahasiswa Tuna Daksa berbasis Android). Adapun tujuan pembuatan produk ini adalah untuk memberikan kemudahan akses mobilitas yang menunjang penyandang difabel menuju ke ruang pembelajan, meningkatkan efektifitas penggunaan BIMA Tuktuk karena dapat beroprasi secara otomatis, serta meningkatkan partisipasi para mahasiswa disabilitas atas peningkatan fasilitas yang mereka butuhkan. Produk BIMA Tuktuk ini dibuat menggunakan model inovasi yang dilengkapi dengan sejumlah fitur kenyamanan disabilitas dengan adanya sensor presisi tinggi pada bodi, kamera pengenal gambar, dan teknologi AI (Artificial Intelligence), yang memungkinkan BIMA Tuktuk ini beroperasi tanpa memerlukan kendali manusia. Pengembangan produk BIMA Tuktuk diperuntukkan untuk kelas yang menerima mahasiswa disabilitas. Pembuatan produk inovasi ini sebagai bukti bahwa UMSurabaya dapat menjadi contoh kampus inklusif, baik dalam artian kepedulian dan kebijakan, namun juga dalam rangka pengembangan model inovasi yang tepat guna. Harapannya produk inovasi BIMA Tuktuk mampu memberikan kemudahan akses mobilitas menuju ruang pembelajaran, sehingga mereka siap mengikuti pembelajaran secara optimal.

Abstract

This study was intended to understand the pattern of mitigating corruption of social assistance (bansos) for victims of the Semeru eruption based on public awareness to escort the distribution of social assistance to residents affected by the Semeru eruption. The research employed socio-legal with a Participatory Action Research (PAR) approach, a corruption escort approach based on community solidarity. Data was collected through interviews, focus group discussions and online and offline dissemination. The results showed that (1) supervision and legal protection of the role of the community in preventing and enforcing social assistance deviations was critical. The community was vital in ensuring the country's administration ran well and was clean of corruption. (2) The participation of the general public in the administration of the state guarantees the achievement of a better Indonesia, which was still wishful. (3) The opinion of poor and marginalized communities needs to be heard due to they have the same guarantees from the constitution.

Abstract

Rusia melancarkan agresi ke Ukraina serta mengadakan serbuan dari segala penjuru. Hal ini dianggap sebagai " Perang Putin" oleh semua negara. Salah satu bentuk pertanggungjawaban Rusia terhadap Ukraina akibat perbuatan agresi yakni harus reparasi atau pemulihan terhadap negara yang menjadi korban negara aggressor. Konflik ini belum diakui secara resmi sebagai kejahatan terhadap perdamaian internasional. Negara Ukraina dianggap sebagai korban agresi menurut hukum internasional meskipun agresi kepada Ukraina merupakan pelanggaran nyata terhadap piagam pbb serta statuta roma. Permasalahan utama yang akan dikaji ada dua : (1)Bagaimana pertanggungjawaban secara individu dan kolektif ( sebagai negara) terkait agresi ini.  (2) Mekanisme ajudikasi dan non ajudikasi dari kejahatan agresi yang dilakukan Rusia kepada Ukraina. Tujuan penelitian ini untuk mengetahui tindakan agresi militer Rusia terhadap Ukraina beserta implikasi hukum yang berlaku. Metode penelitian yang digunakan adalah Sosio-Legal. Untuk menuntut Putin dan para pemimpin politik dan militer Rusia lainnya di pengadilan kriminal internasional memiliki hambatan dari sisi hukum maupun politik. Pengadilan Kriminal Internasional tidak memiliki data terkait kejahatan agresi, serta penarikan diri Rusia dari Pengadilan Kriminal Internasional mampu mereduksi yurisdiksi ICC. Alternatif lain diupayakan yakni pengadilan ad hoc karena kejahatan agresi erat kaitannya dengan kejahatan terhadap kemanusiaan dan perang. Atau dengan dilakukannya praktik penerapan yurisdiksi universal untuk mengadili pelaku kejahatan agresi.

Abstract

Acts of terror are extraordinary crimes with very complicated impacts, where the perpetrators commit acts of violence and threaten targets that are determined randomly based on certain categories. The various terrorist incidents that have occurred in Indonesia do not rule out the possibility of similar incidents being even more horrific and resulting in more victims in the future. Indonesia as an archipelagic country views maritime security as an important aspect of maritime domain governance. The Sulu-Sulawesi sea area is a vulnerable route throughout Asia, it is considered that crimes committed in the Sulu Sea are extreme crimes called maritime terrorism which can threaten the sovereignty of a country. Terrorism has become an increasingly serious concern in Indonesia since the Bali Bombing and other terrorist tragedies. From these problems, the formulation of the problems that must be answered in this study is (1) What are the legal remedies for perpetrators of maritime terrorism in the perspective of international law, 2) How are efforts to enforce violations of state sovereignty in the national maritime area in maintaining national defense. This study uses the normative legal research to analyze from a legal perspective regarding maritime terrorism by terrorists that endanger state sovereignty, and the national sea in maintaining national defense.

Abstract

This study investigates the Indonesian Anti-Dumping Committee's role and legal efforts in addressing dumping practices within the context of Indonesia's membership in the World Trade Organization (WTO) and adherence to the General Agreement on Tariffs and Trade (GATT). Previous research has demonstrated the existence of dumping in imported polyester staple fiber products, leading to the committee's proposal of anti-dumping duties. The committee is responsible for receiving reports on alleged dumping and producing final reports. Despite these efforts, the study reveals an ongoing increase in dumping cases, causing significant social, psychological, and economic consequences for the country. The current institution dealing with dumping practices is considered inefficient and ineffective. To gain a comprehensive understanding of the issue, the research employs a sociolegal research method with a disciplinary approach, acknowledging that relying solely on normative law is insufficient to address dumping practices. In conclusion, this study aims to shed light on the Indonesian Anti-Dumping Committee's role and its legal framework in countering dumping practices. The rising dumping cases and the perceived inefficiency of the existing institution are worrisome. By utilizing a sociolegal research method with a disciplinary approach, the study strives to offer a holistic understanding and potentially contribute to more effective solutions in combating dumping practices.

Abstract

A whistleblower is necessary for corruption cases in universities. by emphasizing previous research that discusses related, legal protection for reporters to eradicate corruption about academic freedom. Then, the weak coordination of law enforcement corruption. And the pattern of corruption in universities shows that corruption can concern all professions, including academics. This study aims to make a real contribution to the efforts of ethics enforcement and anti-corruption in the university environment. Increasing legal protection for students as reporters is expected to create a more supportive and safe environment for those who want to disclose corruption. So, the researchers used socio-legal methods in this study. This study highlights the relationship between law and society to create a more complex answer to the problem raised. The results of this research contain conclusions about the difficulty of the active role of students and what legal protection efforts are obtained in combating corruption in universities. This study offers something : (1) barriers and legal protection efforts to students as whistleblowers in eradicating university corruption; (2) on how to handle corruption cases in universities, especially students as reporters. This study concluded that the government and university leaders must be able to provide legal certainty by protecting students as reporters, and those who reveal corruption need to be strengthened to avoid retaliation or intimidation so that students are safer reporting allegations of corruption without fear of facing repression or other reprisals.

Abstract

The issues with indigenous peoples are very frequent, the impact of development, investment, and deforestation is accompanied by land conversion activities for oil palm plantations and mining, making the rights of indigenous peoples marginalized. In this context, this study seeks to investigate: (1). What problems are experienced by the Papuan Indigenous Peoples and what protection should be accepted by legal and human rights approaches? (2) What are the challenges of Special Autonomy in Papua following the stipulation of the latest Special Autonomy Law, especially in Southwest Papua, and what kind of projections and challenges are needed to protect the Papuan people at large? This research uses socio-legal methods to identify legal procedures related to socio-cultural and political-economic aspects of the Papuan community. The result of this study shows that several points are specified to protect Indigenous Peoples rights in Papua, especially after Special Autonomy, namely the importance of protecting the human rights of Indigenous Peoples related to the right to self-determination, recognition of adat rights, and basic rights that should have affirmative policies carried out by the state to ensure that Indigenous Peoples can play a major role in protecting the environment and contributing to climate change prevention. Investment or state authority must be limited to protect, promote, and respect Indigenous Peoples in Papua and also Southwest Papuans. Then, with regard to the DOB in Papua, of course, it must be returned to its noble goal of protecting the rights of the Papuan people in realizing welfare and independence. Abuse of various forms of authority, including special autonomy funds in Papua must be condemned and strictly processed. Abstrak Problematika terhadap masyarakat adat sangat sering terjadi, dampak pembangunan, investasi, deforestasi disertai dengan aktivitas alih-fungsi lahan untuk perkebunan kelapa sawit dan pertambangan, menjadikan hak-hak masyarakat hukum adat menjadi tersingkirkan. Pada konteks ini kita perlu mengidentifikasi lebih dalam: (1). Bagaimana  problematika yang dialami MHA Papua dan perlindungan yang harusnya diterima pendekatan hukum dan HAM; (2). Bagaimana tantangan Otsus Papua pasca UU Otsus terbaru, khususnya di Papua Barat Daya, proyeksi dan tantangan seperti apa yang dibutuhkan untuk melindungi masyarakat Papua secara luas. Penelitian ini menggunakan metode sosio-legal untuk mengidentifikasi prosedur hukum serta lebih dari itu berkaitan dengan aspek sosio-kultur, dan  politik-ekonomi masyarakat Papua. Hasil penelitian ini adalahsetidaknya ada beberapa point untuk melindungi hak MHA di Papua khususnya pasca Otsus, yaitu pentingnya melidungi hak asasi dari MHA, berkaitan dengan hak menentukan nasibnya sendiri, pengakuan terhadap hak ulayat, serta hak-hak dasar yang harusnya ada kebijakan afirmatif yang dilakukan oleh negara untuk meastikan bahwa MHA dapat menjalankan peran besarnya dalam melindungi lingkungan hidup serta berkontribusi terhadap pencegahan perubahan iklim. Atas nama investasi atau otoritas negara yang berlebih, harus dibatasi dalam rangka perlindungan, pemajuan, dan penghormatan terhadap MHA, khususnya MHA di Papua. Kemudian, berkaitan dengan DOB di Papua termasuk di Papua Barat Daya, tentu harus dikembalikan kepada tujuan mulianya untuk melindungi hak masyarakat Papua dalam mewujudkan kesejahteraan dan kemandirian.

Abstract

This article aims to examine the phenomenon of cooperation among Southeast Asian countries in dealing with the case of maritime security and counter-terrorism. The study uses the legal approach covering both international law and Islamic law perspectives. The finding of this article reveals that the implementation of the ASEAN Convention on Counter-Terrorism (ACCT) plays a crucial role in combating terrorism in the context of maritime security. Furthermore, relevant ASEAN member state authorities need follow-up support to enhance cooperation. The supports are important to counter, prevent, and suppress terrorism, terrorist organizations, associations, and networks' plans of the act. Yet, the implementation of ASEAN cooperation has faced the challenging reality of the paradox of maritime sovereignty among states in the region. The problem is likely encouraged by the factor of the internal political dynamics within each state involving the instrumentalization of the issue of national security. Instead of remaining as the problem on the surface, the conceptual initiation of the cooperation forged by religious doctrine such as ta'awun may be considered.
