Abstract

This article aims to analyze the changes in the structure and operations of deposit products in Islamic banking following the enforcement of the Islamic Financial Services Act 2013 (IFSA). The stricter Shariah compliance requirements and regulations introduced by IFSA have affected how Islamic banking institutions classify and offer their deposit products. The main issue faced is how Islamic banking institutions can maintain the competitiveness of their deposit products while ensuring adherence to Shariah principles and strict regulatory requirements. The objective of this study is to identify the challenges and opportunities in Islamic deposit product innovation, as well as strategies that can be used to attract customer interest and enhance their understanding of these products. The methodology used in this study involves content analysis and semi-structured interviews with officers from Bank Islam and Bank Muamalat, two leading Islamic banking institutions in Malaysia. The findings show that there is an urgent need for innovation in Islamic deposit products, particularly in the use of Shariah contracts such as wakalah and tawarruq. The study also found that while there are challenges in ensuring Shariah compliance, there are significant opportunities to enhance the competitiveness of Islamic deposit products through more effective marketing strategies and improved customer understanding. This article provides an in-depth insight into the potential and obstacles in the development of Shariah-compliant Islamic deposit products, as well as recommendations for improvements in the operations and offerings of these products.

Abstract

The rapid advancement of information technology over the past two decades has significantly transformed societal dynamics, presenting new challenges and opportunities for public administration. The digital era, characterized by unprecedented access to information and accelerated technological and scientific innovation, has compelled governments to continuously adapt their bureaucratic systems to deliver public services that are effective, efficient, and responsive to citizens’ needs. This study examines the digitalization of bureaucracy and public services in Aceh Province from an Islamic Sharia perspective. The research employs qualitative data analysis using NVivo 12 Plus, specifically utilizing the crosstab and NCapture features to identify patterns and relationships within the data. The findings indicate that the digitalization of bureaucracy and public services in Aceh has been largely successful, with technological innovation emerging as the most influential factor. Additional key determinants include strategic planning, human resource capacity, leadership, and community participation. Nevertheless, the effective implementation of digital public services requires strict adherence to fundamental public administration principles, particularly accountability, transparency, affordability, and responsiveness. From an Islamic Sharia perspective, digitalization is expected to prioritize public convenience and social benefit (maslahah) while ensuring justice and equality for all members of society. These findings highlight the importance of aligning technological innovation with ethical and normative values in the governance of digital public services

Abstract

This study seeks to examine the modalities of disimplementation of the Islamic family law in addressing the rights of ex-wives post-divorce. The study is crucial as the disimplementation of the law can lead to injustice, legal confusion, and dissatisfaction for the people that the law is intended to protect. This case study examines the disimplementation of ex-wives' rights post-divorce within the religious courts of Pinrang, Sidrap, Tangerang, and Pariaman in Indonesia. Data were collected through interviews and document analysis. The data analysis employed a three-stage interpretative method: restatement, description, and interpretation. The findings reveal that the disimplementation of the Islamic family law regarding the rights of ex-wives post-divorce arises from three factors: firstly, the ex-husband's failure to fulfill his obligations towards his ex-wife's rights. Secondly, the presence of a complex execution process for realizing the wife's rights necessitates substantial financial resources (bureaucracy). Third, deficiencies in law enforcement include the complexities of the legal process for victims (ex-wives), inadequate penalties, and limited legal literacy among ex-wives concerning their rights. The inability to uphold these rights has resulted in economic, social, and psychological damages for ex-wives. This disimplementation is theoretically attributed to inadequate law enforcement, alongside the influences of law enforcement agents, culture, and societal dysfunction.

Abstract

Fisheries resources, especially capture fisheries, are inherently open access; however, without proper management or when exploited excessively, they risk depletion or even extinction. At the global level, fish consumption continues to rise, while production from capture fisheries has shown a steady decline. This situation can be interpreted as evidence of widespread overfishing of capture fisheries resources. If this trend persists, it will pose a serious threat to global food security, particularly within the fisheries sector. Aceh Province is a maritime region surrounded by seas and possesses significant potential for capture fisheries. Nevertheless, illegal, unreported, and unregulated (IUU) fishing presents a serious risk to the sustainability of fisheries resources in the area. At the same time, Acehnese fishing communities are supported by a traditional maritime institution known as Panglima Laot, which, grounded in local wisdom, has played an important role in preserving the sustainability of fisheries resources up to the present. This article examines the role of local wisdom in sustainable fisheries management in Aceh Province. The study employs a normative legal research approach, with data collected by means of an analysis of legal documents. The findings indicate that Aceh Province holds the authority to implement sustainable fisheries management based on both national legislation and Aceh Qanun governing the sector. In addition, fisheries management is conducted through the customary institution of Panglima Laot, which has its own organizational structure and regulatory framework, particularly in overseeing fishing activities at sea. The local wisdom values embedded in this institution include justice, solidarity, and sustainability. In this regard, Panglima Laot has made a significant contribution to resolving conflicts within fishing communities.

Abstract

This study aims to integrate the Tawhidic paradigm with the local wisdom found in Amatoa ri Kajang to develop a comprehensive framework for ecological fiqh. The research adopts a qualitative approach, utilizing content analysis of the Amatoa ri Kajang text and Islamic theological sources such as the Qur’an and Hadith. By examining the teachings on ecological balance, simple living, and resource management from Amatoa ri Kajang, the study explores how these principles align with Islamic values of tawhid (oneness of God), Khalifa (stewardship), and ihsan (ethical conduct). The results show that both frameworks emphasize the importance of maintaining harmony between humans and nature, with strict prohibitions on environmental exploitation. The originality of this study lies in its integration of Islamic jurisprudence with indigenous wisdom, offering a new perspective on how ecological fiqh can be developed to address contemporary environmental challenges. The research implications suggest that this framework could be institutionalized within Islamic legal systems, providing culturally relevant and ethically grounded solutions for environmental governance.

Abstract

Penelitian ini mengkaji praktik nikah siri di Kecamatan Tanjung Raya yang terbagi menjadi dua jenis, yaitu nikah yang tidak sah menurut agama dan negara serta nikah yang hanya sah menurut agama. Praktik nikah siri yang hanya sah secara agama lebih dominan terjadi, terutama disebabkan oleh ketidakmampuan salah satu pihak menunjukkan akta cerai, yang dianggap sulit, rumit, dan memakan waktu dalam pengurusannya. Logika hukum masyarakat pelaku nikah siri didominasi oleh pemahaman hukum Islam, di mana pernikahan yang memenuhi rukun dan syarat agama dianggap sah, sementara pencatatan di KUA hanya dipandang sebagai urusan administratif. Selain itu, kondisi sosio-kultural masyarakat turut memengaruhi praktik ini, dengan faktor-faktor seperti kuatnya pengaruh ulama, karakteristik wilayah yang agamis, budaya instan, lemahnya penegakan hukum, dan kebiasaan masyarakat yang mendukung praktik tersebut. Sebagai solusi, diperlukan kolaborasi berbagai pihak untuk melarang nikah siri, termasuk penyusunan aturan khusus di tingkat nagari, mendorong pengajuan kasus secara kolektif ke pengadilan, inovasi di tingkat KUA, dan penyederhanaan proses administrasi di Pengadilan Agama, khususnya terkait biaya pengurusan. Temuan ini menyoroti perlunya pendekatan komprehensif dalam menangani fenomena nikah siri secara holistik.

Abstract

This study examines the influence of Majelis Ulama Indonesia (MUI) fatwas on Islamic education management in Indonesia, particularly in aligning sharia principles with contemporary educational practices. The purpose of this research is to explore the role of MUI fatwas in policy formation, curriculum adjustment, and governance frameworks to address the challenges posed by globalization and digitalization in Islamic education. Using a qualitative approach with a case study method, data were collected through in-depth interviews and document analysis of policies implemented in various Islamic education institutions in Indonesia. The study focused on three key fatwas discussed in Ijtima Ulama forums: the third in 2009, the sixth in 2018, and the seventh in 2021. The findings reveal that MUI fatwas contribute significantly to three areas: the establishment of sharia-compliant educational policies, the adaptation of curricula to contemporary needs, and the promotion of equitable governance in Islamic education institutions. However, challenges such as varying interpretations and resistance from stakeholders hinder effective implementation. This research is original in its comprehensive analysis of the direct and indirect impacts of MUI fatwas on Islamic education management, providing new insights into the intersection of sharia principles and modern educational demands. The study has significant implications for policymakers, educators, and religious scholars. It highlights the need for harmonization between sharia-based fatwas and modern management practices to ensure the sustainability and relevance of Islamic education in Indonesia's evolving sociocultural landscape.

Abstract

The debate over authority in contemporary Quranic interpretation surrounding Islamic family law remains a frequent issue, particularly for female ulama. This article examines how female ulama in East Kalimantan negotiate religious authority through Quranic reinterpretation to transform the understanding and practice of Islamic family law. Using a convergent mixed-methods design, this study combines quantitative analysis of 30 purposively selected female ulama in five districts/cities. Then, qualitative methods derived from in-depth interviews with experts in Islamic interpretation and family law are analyzed using the theory of maqāṣid al-sharīʿah. The research findings reveal that 86.7% of participants actively engage in progressive reinterpretation of Quranic texts related to crucial issues of family law, including dowry, divorce (khulʿ), child custody (ḥaḍānah), and joint property. Statistical analysis shows a significant correlation (p < 0.05) between a hybrid educational background integrating Islamic boarding school education with modern Islamic higher education and a stronger tendency to challenge conventional interpretive paradigms. Quranic interpretation functions not merely as a theological practice but also as a process of negotiating religious authority through contextual reasoning, maqāṣid al-sharīʿah, and intertextual hermeneutics. This article contributes to the body of scholarship on Islamic feminism, religious authority, and legal pluralism in Indonesia, while also highlighting grassroots dynamics in Islamic family law reform.

Abstract

This study evaluates the role of ecotourism as a strategy for promoting sustainable waste management in environmentally friendly tourist destinations in Lhokseumawe City, Aceh. Research using qualitative methods was conducted with a case study approach in several tourist destinations that have implemented ecotourism concepts, such as community-based waste management and the use of environmentally friendly technology. Data were collected through in-depth interviews, observations, and a literature review, complemented by questionnaires administered to explore the perceptions of tourists, local communities, and business actors regarding the effectiveness of, and support for, sustainable waste management policies. The findings indicate that the implementation of ecotourism has not yet played a significant role in improving waste management effectiveness in tourist areas. Ecotourism principles have not been comprehensively applied; as a result, destinations have not succeeded in maintaining environmental cleanliness, attracting sustainability-conscious visitors, or fostering synergy between local communities and the government. Although tourists and local residents generally responded positively to these initiatives and expressed support for ecotourism-based waste management policies, many still perceive waste management as primarily the responsibility of the government. This study contributes to the literature on sustainable waste management and may serve as a reference for policymakers and tourism practitioners seeking to enhance environmental quality through an ecotourism approach.

Abstract

This study explores the impact of Islamic legal literacy on promoting environmentally sustainable practices within the An-Nadzir community in Gowa, South Sulawesi. The primary aim of the research is to examine how knowledge of Islamic environmental ethics influences behaviors that contribute to environmental conservation. The study adopts a qualitative approach, gathering data through participatory observation, in-depth interviews, and a review of relevant literature. Interviews were conducted with members of the An-Nadzir community, while observations focused on their daily practices related to environmental sustainability. The findings suggest that a higher level of Islamic legal literacy significantly shapes the community’s adoption of environmentally friendly practices, including organic farming, waste management, and collective environmental efforts. The community’s leader plays a key role, as his example and teachings on Islamic stewardship (tadbīr al-khalīfah) have been central to promoting these practices. The research concludes that Islamic legal literacy fosters a cultural shift within the community, transforming environmental conservation into a shared responsibility. This cultural transformation highlights the potential of integrating religious teachings into practical environmental actions. Moreover, it offers valuable insights for other religious communities, showing how faith-based legal literacy can influence sustainable development. The study suggests that future research could examine similar cases in other religious contexts, helping to further explore the role of religious literacy in promoting sustainable practices across different communities.
