Abstract

Housing is a basic human need, so that sharia housing financing needs to be assessed for its compliance with sharia principles. This study aims to describe the implementation of Murabahah and Istishna’ contracts in Sharia Home Ownership Credit (KPR) products at Bank BTN KCPS Jombang and analyze the SWOT aspects of both contracts. The study uses a descriptive qualitative approach with a case study design. Data were collected through participatory observation, in-depth interviews, and documentation, then analyzed using the Miles and Huberman model. The results of the study indicate that the Murabahah lil Amri bi Syira’ contract in the BTN Sejahtera iB KPR product is in accordance with the DSN-MUI Fatwa No. 04/DSN-MUI/IV/2000. The Istishna’ contract in the BTN Indent iB KPR product has also been implemented in accordance with the DSN-MUI Fatwa No. 06/DSN-MUI/IV/2000 and No. 09/DSN-MUI/IV/2000. A SWOT analysis shows that the murabahah contract excels in installment certainty and margin transparency, but has weaknesses in the disbursement process. Meanwhile, the Istishna' contract excels in home design flexibility, but faces the risk of construction specification discrepancies.

Abstract

This study analyzes the role of a number of companions' atsars and tabi'in (followers) regarding zakat—including jewelry/gold and silver, agricultural products, honey, gems, livestock, and recommendations for submission to authorities—in the development of zakat management in Indonesia. Using a library research method with a normative-comparative approach, primary data were collected from al-Mu'minin.ṣAnnafIbn Abī Shaybah and national regulations (Law No. 23/2011, PP No. 14/2014, Permenag No. 52/2014 and its amendments), then mapped through two-column thematic coding and cross-atsar matrix↔regulatory articles. The results show normative consistency that the object of zakat is determined by the substance of the value and economic utility of the assets, not merely the form or function of use; this principle is in line with the "umbrella" architecture of Indonesian regulations, so that modern commodities not expressly stated in the texts (e.g., palm oil, horticulture, honey, or gem trade) are still captured through the categories of agriculture/plantations/forestry, commerce/industry, fisheries, money & securities, and income & services. The findings of this study also show that the series of atsar in al-MuṣAnnafIbn Abī Shaybah can be used as a normative basis to support the renewal and development of zakat management in Indonesia.

Abstract

This study investigates the differing interpretations and applications of the hadith prohibiting women from traveling without a maḥram in Saudi Arabia and Indonesia. Through a comparative analysis grounded in historical, legal, and socio-cultural contexts, the research reveals that Saudi Arabia traditionally applies the hadith in a strict, textualist manner, rooted in the Ḥanbalī legal tradition and guardianship system. Indonesia, influenced by pluralistic scholarship and social realities, adopts a more flexible, contextualist approach through ijtihād by religious organizations. Despite these differences, the study affirms that the original ruling remains valid: a woman traveling without a maḥram is impermissible (ḥarām) unless in rare, necessity-based exceptions. The presence of a maḥram is not merely ideal but a critical safeguard upheld throughout Islamic legal history to protect women’s dignity (ʿirḍ) and safety (nafs). In modern contexts where security may seem assured, Muslim women must still prioritize obedience to Allah and His Messenger, over social convenience or personal autonomy. Modern adaptations must not override divine directives. Thus, the hadith's relevance continues, and contextual flexibility must remain within the bounds of Sharīʿah—aimed at upholding the protective purpose of Islamic law rather than promoting unrestricted freedom.

Abstract

This article discusses the implementation of multidisciplinary, interdisciplinary, and transdisciplinary approaches in Islamic Education learning in Islamic Elementary Schools. Through a case study at SDIT Robbani Banjarbaru, this research aims to identify the practice of integrating Islamic knowledge and values in a holistic learning process. A qualitative method with a case study approach was used to deeply explore the dynamics of teachers, students, and the learning strategies implemented. The results of the study indicate that the integrative approach is able to encourage integration between religious knowledge and general knowledge, as well as shape students' character spiritually, intellectually, and socially. Furthermore, this study found that the application of multidisciplinary, interdisciplinary, and transdisciplinary approaches encourages the creation of a contextual, active, and enjoyable learning atmosphere. Teachers not only act as transmitters of knowledge, but also as facilitators, motivators, and role models who internalize Qur'anic values in each subject. In this way, students not only acquire cognitive knowledge but also experience the process of developing morals and life skills relevant to the challenges of the modern era.

Abstract

The context of this research is the prevalent practice of delaying the distribution of inheritance for an indefinite period in South Kalimantan Province. Consequently, the objective of this study is to examine this phenomenon from the perspective of Islamic law. This research is included in the type of qualitative normative research, starting from the legal behavior of the South Kalimantan Muslim community which is then studied within the scope of Islamic legal normativism. The data source used is secondary data, including primary legal materials and secondary legal materials. The data collection technique uses the documentation method. The analysis indicates that the postponement of inheritance distribution is not necessarily haram, as there is no specific substantiation in the Qur'an or hadith texts regarding the time limit for inheritance distribution. Additionally, there are numerous regulations that can validate the practice of delaying the distribution of inheritance, such as the principle of لِلْوَسَائِلِ حُكْمُ الْمَقَاصِدِ , which maintains that the law of the means of an action is equivalent to the law of the action. Therefore, the law of postponing the distribution of inheritance is relative and dependent upon the purpose or consequences of the delay.

Abstract

The ability to read and write the Qur'an is very important for students because it can understand and gain new knowledge derived from the Qur'an. Many students have not mastered how to read the Qur'an well and correctly. One factor is the family environment factor that lacks knowledge about reading the Qur'an. Therefore, it is necessary for every school to implement a Qur'an reading program so that students can learn to read the Qur'an well and correctly. This study aims to describe the Al-Qur'an deepening program for beginner, tahsin, pre-tahfidz and tahfidz classes in improving the ability to read and memorize the Qur'an at Darussyafa'ah Genteng Banyuwangi Middle School. The research approach used is a qualitative approach with a case study research type. The results of the study show that the implementation of learning in beginner, tahsin, pre-tahfidz, and tahfidz classes has a uniform sequence of activities, which begins with greetings, muhadarah, reading Al-Fatihah, and opening prayers, then continued with classical sessions and deposits, and closed with prayers and greetings. In terms of methodology, the beginner, tahsin, and pre-tahfidz classes use the Yanbua method, while the tahfidz class uses the setor method. The evaluation system at all levels includes mid-semester, end-of-semester, and class promotion exams, with additional quality improvement evaluations specifically for the tahsin class.

Abstract

Every child has the fundamental right to obtain a legal identity through legal identity documents, especially birth certificates. However, problems arise when in practice stepfathers are often positioned as father figures who are then included in birth certificates. From a normative perspective, state administrative law explicitly recognizes only biological fathers as legal parents who can be recorded. Meanwhile, Islamic law also rejects the position of stepfathers as marriage guardians and heirs, because there is no nasab bond or blood relationship between stepfathers and stepchildren. This research uses a normative-empirical approach through the study of legislation, the Compilation of Islamic Law, and the reality of social practices in society. The results show that there is a misalignment between legal norms and social reality, causing problems in the form of unorganized population administration, unclear legal status of children, and the risk of marriage invalidity. Therefore, efforts are needed to strengthen socialization regarding the position of stepfathers from a legal perspective, so that legal certainty is maintained while paying attention to the social needs of the community.

Abstract

The Walagara tradition in Tenggerese weddings in Ngadas Village, Malang Regency, is a form of local wisdom that serves as a customary legalization of marriage. This tradition involves two main elements: the recitation of mantras and the presentation of offerings, understood as a medium of spiritual communication with the gods, water maidens, and ancestral spirits to request safety and blessings for the bride and groom. This study aims to analyze the symbolic meaning of the Walagara tradition and its legal implications from an Islamic legal perspective through an 'urf' approach. The method used is qualitative-descriptive with Clifford Geertz's symbolic-interpretive analysis. The results indicate that the mantras serve as a spiritual medium, recited by traditional shamans in the ancient Tenggerese language, accompanied by offerings containing cosmological meaning. Although the Tenggerese Muslim community continues to participate in this tradition, interpreting it as a form of cultural respect, under Islamic law, this practice is categorized as 'urf fāsid' due to its potential to contain elements of polytheism. Therefore, a wise approach to da'wah is needed to ensure that cultural preservation remains in line with the principles of monotheism.

Abstract

Research on the historicity of hadith has been strongly influenced by methods developed by non-Muslim scholars, such as matn dating, sanad analysis, hadith codices, and isnad cum matn analysis, which often question the attribution of hadith to the Prophet Muhammad. Scholars like Ignaz Goldziher, Joseph Schacht, and Harald Motzki introduced theories such as common link and argumentum e silentio, leading to skepticism regarding hadith authenticity. This study examines Kamarudin Amin’s critique of these approaches. He argues that dating methods alone cannot serve as a definitive basis for validating or rejecting hadith historicity. Instead, he proposes an integrative approach that combines sanad and matn criticism to achieve a more comprehensive analysis. Kamarudin Amin contends that common links do not necessarily indicate fabrication but reflect systematic transmission processes. He also addresses debates on the justice of the Companions by contextualizing historical events such as the Jamal War and the assassination of ‘Uthman. Through textual reconstruction and variant analysis, this research highlights his contribution to developing an integrative and context-sensitive methodology in hadith studies, reinforcing the relevance of Islamic scholarly traditions in contemporary academic discourse.

Abstract

Since the time of the Messenger of Allah ﷺ, the mosque has functioned not only as a center of worship but also as a social institution with a strategic role in developing the community’s economy. However, over time its function has tended to be reduced to ritual religiosity alone, leaving its role as a stabilizer of the community’s economy less than optimal. This article aims to reassess the mosque’s functions through the lens of social fiqh and their implementation in contemporary practice. The approach employed is normative-empirical: it examines Qur’anic verses, hadiths, and classical fiqh literature, then contextualizes them within modern mosque management practices encompassing the administration of zakat, infaq, charity (sadaqah), and productive waqf. The findings indicate that revitalizing the mosque’s functions can serve as an instrument for wealth distribution, the economic empowerment of congregants, and the safeguarding of Islamic business ethics. In addition, contemporary practice reveals models of “productive mosques” capable of becoming centers for community-based economic empowerment. Thus, the mosque holds significant potential as a pillar of the socio-economic balance of Muslim society, provided it is managed professionally, accountably, and in integration with Islamic financial institutions.
