Abstract

Abstract: The area of oil palm plantations in Indonesia has increased over time. The growth of oil palm plantations even exceeds the percentage of the area of paddy fields, especially in Gunung Mas Regency. This phenomenon is accompanied by the implementation of "Regional Regulation No. 1 of 2020 concerning Land Fire Control". The regulation aims to prevent land fires due to human activities. However, local people believe that burning can increase land productivity. As a result, many people convert their land to plant oil palm, because it is considered to guarantee economic improvement compared to paddy fields. Remote sensing satellite imagery is the basis and main source in the analysis. With spatio-temporal analysis, mapping of land use changes in a certain period of time and its relationship with the distribution of agricultural wet and dry areas. As a result, the proportion of palm oil land in Gunung Mas Regency is higher than the proportion of paddy fields. If oil palm expansion continues in the future, agricultural drought could become more widespread. Abstract

Abstract: This research examines the legal uncertainties arising from the issuance of Building Use Rights (HGB) certificates on land with Management Rights (HPL) owned by the Special Capital Region of Jakarta. The lack of clarity in the National Land Agency's certificate, which does not explicitly state that the building use rights are based on land management rights, leads to confusion and a sense of deception among consumers, making this issue crucial. This issue holds significant importance as the National Land Agency's certificate, which does not explicitly state that building use rights are based on land management rights, leads to consumer confusion and feelings of deception. When consumers applied for a certificate extension 20 years after the National Land Agency issued the Certificate Extension Decision Letter, the agency abruptly retracted both the Decision Letter and the certificate. This was due to the BPN's recent realization that the land was under Land Management Rights. This research uses a normative juridical approach to analyze the legal responsibility of the National Land Agency in the issuance of certificates. The data collection technique uses document studies, while the analysis technique uses court decision studies. Research results indicate that Building Use Rights (HGB) certificates that do not specify the type of land—whether it is on state land, Land Management Rights, or ownership rights—have the potential to harm consumers and cause legal disputes. Therefore, this study recommends land policy reforms to ensure legal certainty and consumer rights protection in property transactions. Abstract

Abstract: Spatial planning in Batam, Bintan, and Karimun (BBK) areas is prioritized because it has an important impact on the national economy. This research aims to identify the potential leading sectors in the BBK areas as a reference in regional development. This study uses time series data on Gross Regional Domestic Product (GRDP) based on constant prices in the BBK areas from 2011 to 2021. The analytical tools used in this research are Location Quotient to identify basic and non-basic sectors, Shift Share Analysis to determine changes and shifts in sectors, and Klassen Typology to determine the classification of sector in each region. The three analytical tools combined results demonstrate that economic growth in Batam is supported by the processing sector. A growing sector in Bintan is related to the tourism. Economic potential in Karimun dominated by the agricultural, forestry, and marine sectors. Tanjungpinang’s economic potential is dominated by the service sector, which supports the city’s role as the capital of the Riau Islands Province. However, the fisheries sector has not developed optimally. As an archipelago, regional development policies in the BBK areas should develop other sectors to optimize the maritime economic potential. Abstract

Abstract: The rapid growth in tourism has had a direct impact on the local economy and the potential for changes in land value. This study aims to analyze the influence of tourist attractions and accessibility on land value changes in Getasan District from 2017 to 2024, amidst the significant growth of tourism. The research employed a descriptive and quantitative approach to analyze the data comprehensively. Quantitative analysis was carried out using multiple linear regression to evaluate the influence of proximity to tourist attractions and road accessibility on land value. The land value zone maps for 2017 and 2021 were obtained from the Semarang Regency Land Office, while the 2024 land value zone was created through the update of the 2021 zone. This update resulted in 130 zones with 688 sample points collected through field surveys based on fair market prices. Multiple linear regression analysis was conducted to evaluate the influence of straight-line distance from the zone centroid to tourist attractions and collector roads. The results showed that the p-value in the simultaneous test was 0.03647 (? 0.05), indicating that tourist attractions and accessibility have a simultaneous and significant influence on land value zone changes, with an impact size of 7.87%. These findings highlight the urgency of considering the rapidly developing tourism sector and accessibility in regional management and development, given their effect on land values in Getasan. Abstract

Abstract: An agrarian reform program encompassing asset and access arrangement was implemented to address the inequality in land ownership. Furthermore, asset management and access management models are integrated in the same location to increase the effectiveness of the agrarian reform program. As a pilot project, the first Kampung Reforma Agraria (KRA) was implemented in Mekarsari Village, Panimbang District, Pandeglang Regency, by distributing land to 225 subjects. However, after five years of implementing agrarian reform, some subjects still have not occupied KRA locations. This condition indicates that some subjects are reluctant to live in the designated location. Therefore, this research aims to analyze the profile and characteristics of TORA subjects’ residences who have yet to occupy the land granted in the KRA and the influence of these two factors on their spatial preferences regarding agrarian reform policies. By interviewing 23 TORA subjects who had yet to occupy the Tanah Objek Reforma Agraria (TORA) location and transfer their land rights, the results show that 52.5% wanted to move to KRA. In contrast, 47.5% did not want to occupy their land in KRA. Based on the analysis of the physical characteristics of the TORA subjects’ residences, the relationship between the physical distance from the subject’s current residence to KRA and the subject’s preference to move to KRA was not very significant. The factors most influencing the subject’s preferences are the residence’s non-physical characteristics, the land’s current legal status, and the socio-economic profile. Based on these findings, policymakers responsible for setting the criteria for land recipients should enhance the supervision system for subject selection from the outset. Furthermore, when designing access provision programs, it is essential to account for the diverse preferences and needs of each subject group. Abstract

Abstract: Agrarian reform without interaction between the state and society only addresses temporary issues. The implementation of agrarian reform in Indonesia has been overly focused on achieving outputs based on easily measurable quantities, leaving social problems unaddressed. The aim of this research is to elaborate the implementation of agrarian reform, particularly in the management of assets in the Mekarsari Agrarian Reform Village. The method used is a quantitative approach using questionnaires and in-depth interviews with 50 respondents who are beneficiaries of agrarian reform. The data were then analyzed using descriptive statistics method. The results of the study indicate that the implementation of management at the planning, implementation, and monitoring and evaluation stages shows that the interaction between the responsibility of state actors and community participation is low. As a result, the implementation of agrarian reform is still one-way, limited to completing the output targets of land redistribution and granting access decided by the organizers. Without meaningful community participation, it will be difficult for the community to take control to decide on the appropriate use of resources. For this reason, the implementation of agrarian reform in Mekarsari Village still needs to be contested. Keywords: Agrarian reform, Contested, State-society interaction

Abstract

Abstract: The issue of land disputes in urban areas during the New Order era intensified due to the massive use of land for housing needs and to support various development projects. Especially in the late 1970s, land issues had become a major concern in cities at the municipal level. This paper analyzed the causes of land disputes involving the Pawirorejo family in the city of Surakarta. This historical research used archival sources such as trial documents from the Surakarta Court Office, regional statistical data, and newspapers. The study's results suggest that the state-controlled lands in Surakarta, which did not receive full attention, triggered the Pawirorejo land dispute; consequently, the city government's weak control also played a role. Furthermore, land as a commodity with significant value in the city of Surakarta is vulnerable to conflicts, and the adage "land for the people" becomes very difficult to fully realize amidst the strengthening currents of development and the interests of the authorities. Therefore, the use and ownership of land in urban areas, especially state land in Surakarta, require explicit regulation through legal means. Abstract

Abstract: This study aims to examine the state of food sufficiency and gender equality in Purwabakti Village and the relevance of community land empowerment programs in achieving food sufficiency and gender equality. The research follows a qualitative case study approach, collecting data through interviews, observations, and document analysis. Data were analyzed qualitatively using the fishbone diagram method, focusing on four primary variables: human resources, machinery, methods, and materials. Data on malnutrition and stunting indicate that issues of food vulnerability compromise food sufficiency in Purwabakti Village. Furthermore, gender equality remains a challenge within this predominantly patriarchal society. Women tend to fulfill traditional gender roles with domestic responsibilities, while men assume public roles. This patriarchal rural society generally accepts the predominant land ownership by men (as heads of households), reflecting gender inequality. The fishbone diagram analysis indicates that, despite some progress, community land empowerment programs still exhibit limitations in addressing the SDGs, particularly the goals of “zero hunger” and gender equality. Abstract: The Plotting check serves as a strategic solution to address land-related issues where parcels are registered but remain unmapped due to the transition from analog to digital data systems. This necessitates the synchronization of both spatial and textual data through the implementation of KKP-Web and AutoCAD GeoKKP applications. This process is in alignment with the Ministry of Agrarian Affairs and Spatial Planning / National Land Agency's objectives to enhance electronic services. This research aims to map all land parcels within the Sitirejo II subdistrict as a decision-support tool for resolving land management challenges. The ultimate goal is to establish a harmonious integration between administrative functions, policy frameworks, and land information infrastructure, thereby contributing to the realization of sustainable development. The study employs a mixed-methods approach, combining quantitative techniques utilizing secondary data and spatial analysis, alongside qualitative methods through interviews. The analysis involves overlaying all registered land parcels onto the national coordinate system and validating land parcels, survey documents (SU), and land books (BT) using the KKP-Web application. The findings of this research resulted in a comprehensive land map of Sitirejo II, covering a total of 1,317 parcels, categorized into two distinct groups: (i) 1,013 parcels with complete data sets, including parcel details, SU, and BT, and (ii) 304 parcels with incomplete or missing data on parcels, SU, and BT. In conclusion, the plot-checking initiative for the Medan Land Office significantly enhances the quality of both spatial and textual land data, facilitating informed decision-making and policy development, and supporting the orderly management of land administration. Abstract

Abstract: The purpose of this study is to investigate and analyse how the law is implemented in managing wasteland, as well as the challenges and solutions related to the enactment of Government Regulation Number 11 Year 2010 concerning land control and utilisation. This study includes a sociological study of law (non-doctrinal) that involved descriptive research. The fourth-law concept is a pattern of social behaviour that has been created as an empirical variable in this study. The method of collecting data in this study is literature study and using qualitative data analysis as a data analysis method. Based on the findings, the wasteland in Aceh is managed by Baitul Mal and land offices. The wasteland management method that has been used is farming activities. Therefore, the implementation of this method can be applied to increase the local community's income and also eradicate poverty issues. Keywords: Government Regulation, Poverty, Reform, Wasteland
