Abstract

Indonesia sebagai salah satu negara kepulauan, telah meratifikasi UNCLOS/ United Nations Convention On The Law Of The Sea dengan UU Nomor 17 tahun 1985 sebagai kelanjutan perwujudan dari konsep Doktrin Wawasan Nusantara yang merupakan satu kesatuan terhadap tanah, daratan dan perairan. Namun dalam hal ini masih ada masalah yang timbul di antaranya adalah masalah alur laut kepulauan yang diatur oleh IMO/ International Maritime Organization dan masalah yurisdiksi dari International Tribunal yang menurutnya overlapping dengan yurisdiksi International Civil Aviation Organization (ICAO)Council. Hal ini semata-mata berkaitan dengan “Penafsiran hak lintas Udara”.

Abstract

Everyone either alone or jointly surely be the consumers to a particular product or service. That requires the legal protection of the parties in a balanced manner both at the time prior to the transaction and/or at the time after the transaction. Generally known there are four basic consumer rights that must be protected, namely: the right to safety, the right to information, right to vote and the right to be heard. In practice the legal protection of consumers still poses various problems that affected various factors, among others: relating to the legal structure, the substantive law and legal culture and bureaucratic apparatus. For addressing these problems, it is necessary to look for solutions, among others: As soon as possible to revise the existing UUPK; law to be formed is responsive law; and the seriousness of law enforcement to monitor, process and resolve any violations with penalties/sanctions were firm and commensurate so deterrent to those who commit violations

Abstract

Perjanjian Kerja Bersama sebagai salah satu sarana dalam pelaksanaan hubungan industrial sebagaimana diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Hal inilah yang menjadi dasar permasalahan dalam penelitian ini, yaitu: (1) bagaimana kedudukan Perjanjian Kerja Bersama dalam pelaksanaan hubungan industrial?; dan (2) apa fungsi Perjanjian Kerja Bersama dalam pelaksanaan hubungan industrial?. Penelitian ini menggunakan metode penelitian hukum normatif yang kemudian dianalisis secara deskriptif kualitatif. Hasil penelitian ini menyimpulkan, (1) kedudukan Perjanjian Kerja Bersama adalah sebagai komponen penting dalam pelaksanaan hubungan industrial; dan (2) Perjanjian Kerja Bersama berfungsi sebagai suatu perjanjian antara pengusaha, serikat pekerja/buruh dan pekerja/buruh, maka para pihak dalam hubungan industrial wajib melaksanakan isi Perjanjian Kerja Bersama. Kata Kunci : Perjanjian Kerja Bersama, kedudukan, fungsi, hubungan industrial.

Abstract

This study aims to develop the model of CSR Bela Negara with an assumption that the ethical value of a company will seek to defend itself for the sake of the sustainability of a business. Starting from the ThreeDimensional Performance Model of Corporate Performance by Archie B. Carroll on CSR's Relationship with Corporate Performance to understand the phenomenon of two different companies, the problematic company (PT.Freeport Indonesia is changing from Contract of Work to IUPK) and company which supports both central and regional regulation (PT.Chevron, fixed with Contract of Work status). There are three elements of concern; categories of understanding of social responsibility, involvement of social problems, and philosophy of accountability. The results of research indicate that awareness of corporate discretion that is able to respond to the needs of the environment, especially the political condition of the state seen a multinational company persist. which persist by emphasizing on CSR-Discretion. For that Conceptual Model of Three Dimensional Companies Archie B Carrol can be developed as a Model of CSR Bela Negara. Perbedaan jender pada dasarnya merupakan hal yang biasa atau  suatu kewajaran. Sepanjang  tidak menimbulkan ketidak adilan jender. Akan tetapi realitas didalam masyarakat menunjukkan  bahwa perbedaan jender telah  menimbulkan  berbagai bentuk ketidak adilan, baik bagi  kaum laki- laki dan terutama  kaum perempuan. Abstract

Hukum ketenagakerjaan lahir dari pemikiran untuk memberi perlindungan bagi para pihak terutama pekerja/buruh sebagai pihak yang lemah dan keadilan sosial dalam hubungan kerja diantara para pihak yang memiliki persamaan dan perbedaan yang cukup besar.   Salah satu bentuk perjanjian kerja yang dilakukan dalam hukum ketenagakerjaan adalah dengan sistem outsourcing. Dalam melaksanakannya dibutuhkan perlindungan terhadap pekerja/buruh, meliputi: Perlindungan ekonomis, perlindungan sosial, perlindungan teknis Selain perlindungan hukum terhadap pekerja/buruh, perlindungan hukum terhadap pengusaha juga sangat diperlukan mengingat peranannya sebagai penyedia lapangan kerja dan sebagai penggerak roda perekonomian suatu negara.  Namun dalam praktek, perlindungan pekerja/buruh outsourcing sering tidak terlaksana. Hal ini menimbulkan permasalahan bahkan sampai ke pengadilan. Untuk mengatasi permasalahan tersebut, dibutuhkan solusi, antara lain: Outsourcing harus dapat diterima semua pihak karena dirasakan ada manfaatnya, mempunyai kepastian hukum dan memberi perlindungan bagi  semua pihak; Dibutuhkan campur tangan  untuk menjaga keseimbangan bagi para pihak melalui peraturan perundang-undangan; Perjanjian kerja  outsourcing hendaklah berdasarkan  pada syarat untuk sahnya suatu perjanjian (Pasal 1320 KUHPerdata ) dan keselarasan dari seluruh prinsip umum yang terdapat pada hukum perjanjian; Pelaku bisnis menerapkan suatu pola hubungan win-win solution yang mencerminkan suatu hubungan simbiosis mutualisma.  Dengan demikian diharapkan dapat memberi perlindungan dan keadilan seperti yang terdapat pada : Pancasila; Pembukaan dan Pasal 27 ayat 2, Pasal 28 D ayat 1, ayat 2 , Pasal 33 UUD 45; Undangundang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan; Putusan Mahkamah Konstitusi No. 27/ PUU-IX/2011 yang ditindaklanjuti dengan Surat Edaran Menakertrans No. B.31/PHI.JSK/I/2012, Tentang Outsourcing dan Perjanjian Kerja Waktu Tertentu (PKWT), Peraturan Menteri Tenaga Kerja dan Transmigrasi No.19 Tahun 2012 Tentang Syarat-syarat Penyerahan Sebahagian Pelaksanaan Pekerjaan kepada Perusahaan Lain. Selain itu pengawasan dan penegakan dibidang ketenagakerjaan juga sangat dibutuhkan.

Abstract

Crime is a problem faced by humans from time to time. Talking about crime, especially murder, continues to experience growth accompanied by style and shape are very diverse, from the most simple to very sophisticated. Sometimes the killing was done in ways that vicious as first tortured, burned and even mutilation. Becomes an interesting thing because mutilation is a murder followed by shredding the victim's body up into multiple parts made with the aim to destroy evidence. Not only that, the issue of sanctions against the perpetrators of criminal acts of mutilation murders under construction in the Indonesian criminal law there is no definite rules. Article which is often used as a legal basis for the criminal murder mutilation is Article 338, 340 and 351 Criminal Code with a maximum penalty of death, sometimes as an alternative to imprisonment. While the Islamic criminal law sanctions for deliberate murder is Qisas. And the impact of the crime of murder mutilation is very large, in addition to sadistic perpetrator in treating the bodies of the victims, but also causes damages to the family of the slain of the two sides, they lose those who earn a living, and his heart was sad at the loss of loved ones. Abstract

Man in fulfilling his various interests perform various ways, one of them by making a covenant. It is therefore necessary to understand important matters relating to a treaty, such as: What is the agreement, the terms of the agreement, the principles of the agreement, the object of the agreement, the terms of the agreement, the form of the agreement, the parties involved, the right and the obligations of the parties, the structure and the anatomy of the agreement, the settlement of disputes and the termination of the agreement. Article 1313 of the Civil Code states: The Covenant is an act by which one or more persons commit themselves to one or more persons. In general, the agreement is: The parties' agreement on something that gives birth to a legal relationship, creates rights and obligations, if not executed as the promised will impose sanctions. In order for what is promised to run well then required a regulating rule, called the law of agreement. The purpose of the treaty is to protect the parties in the event of future problems, order, is used as the basis for its settlement or legal certainty so as to create justice for the parties. In the making of the treaty, several important matters must be considered, among others: the terms of the validity of the agreement, the principles of the contractual law, the consequences of the law of agreement and the termination of the agreement. One of the most important principles in the agreement is the principle of equilibrium. However, in practice it is often not in accordance with the objectives of the agreement, among others: The existence of protection for the parties, the creation of justice, order, and legal certainty. The discussion in this research is about: What things should be considered or fulfilled to realize the achievement of the purpose of the agreement and How the role of the principle of balance in realizing the purpose of the agreement. The method used is normative juridical. In the event of a dispute concerning the treaty, it should be settled not only based on what is written in the agreement but taking into account the principles contained in the treaty law, especially the principle of equilibrium. Abstract

The environment can’t be separated from the world movement to give greater attention to the environment, given the fact that the environment has become a problem that needs to be tackled together for the sake of survival on this earth. Unresponsible acts by those who take advantage of such nature may trigger a reaction from both local and international communities. Environmental disputes are disputes between two or more parties arising from the presence or suspicion of environmental pollution and / or damage. Countries suffering losses from exploitation and environmental pollution by other countries may seek redress and liability. This paper reviews the roles of the International Court of Justice in resolving international environmental disputes. The International Court of Justice is the main organ of the United Nations. In an effort to settle the case to the International Court of Justice is not a state obligation but only facultative. States in the choice of ways of dispute resolution can be through other means such as diplomacy, mediation, arbitration and other peaceful means. Thus the settlement of cases filed with the International Court of Justice is optional and voluntary to the parties to the dispute.  Keyword : The Environment, the International Court of Justice, the disputes.

Abstract

Hubungan kerja dapat menimbulkan barbagai akibat salah satu diantaranya PHK. Dampaknya sangat kompleks, karena itu mekanisme dan prosedurnya harus diatur sedemikian rupa. Tujuannya agar pekerja/buruh tetap mendapatkan perlindungan yang layak dan memperoleh hak-hak normatifnya sesuai dengan ketentuan hukum yang berlaku. Karena tenaga kerja mempunyai peranan dan kedudukan yang sangat penting sebagai pelaku dari tujuan pembangunan Nasional yaitu mewujudkan masyarakat yang sejahtera,adil, makmur, yang merata baik material maupun spiritual berdasarkan Pancasila dan UUD Negara Republik Indonesia tahun 1945. Perlindungan hukum bagi pekerja didasarkan pada ketentuan Pasal 27 (1), ayat (2), Pasal 28 D ayat (1), ayat (2), UUD 1945. Apabila PHK terjadi harus mendapat kompensasi hak-hak dari pekerja/buruh yg di PHK berupa: uang Pesangon, Uang Jasa, dan Penggantian hak sesuai dengan ketentuan UU No. 13 Tahun 2003 dan UU No.2 Tahun 2004 Didalam menyelesaikan PHK, hakim harus dapat memberikan kepastian dan perlindungan hukum bagi Tenaga Kerja. Pertimbangan hakim merupakan jiwa dan intisari putusan Kata Kunci : Perlindungan Hukum bagi Tenaga Kerja yang mengalami PHK
