Abstract

The rise of social media has created new opportunities for female preachers in Aceh, known as Teungku Inong (female clerics), to disseminate religious teachings in broader, more inclusive, and interactive ways. This development marks a significant shift in women's roles within digital da'wah (Islamic preaching), while simultaneously presenting new challenges particularly in balancing their public responsibilities as religious leaders with their private roles within the family. This study examines the impact of social media engagement on the family life of Teungku Inong, focusing on the dynamics of their dual roles and the strategies employed to navigate the demands of both professional and domestic spheres. Utilizing a qualitative case study approach, the research centers on female clerics in North Aceh and draws on theories of social roles and Islamic communication. Data were collected through in-depth interviews and content analysis of their social media presence. The findings reveal that the ability of Teungku Inong to manage dual responsibilities is strongly supported by both emotional and technical assistance from family members, particularly husbands and siblings. Key strategies include disciplined time management, open family communication, and the adaptive use of digital tools to facilitate da'wah activities without compromising domestic obligations. Sociologically, this study highlights the essential role of family support and digital literacy in enabling female preachers to thrive in the digital era. From the perspective of Islamic communication, the emergence of female clerics utilizing social media as a medium for da'wah represents a progressive development in both the professionalization of da'wah and the evolving roles of women in Islamic discourse. These findings contribute to a deeper understanding of women's participation in digital religious spaces and the negotiation of work–family balance in socio-religious contexts

Abstract

This study investigates the impact of family background on Islamic entrepreneurial competencies among students in Aceh’s Islamic higher education institutions. Utilizing a quantitative survey, the research explores key variables such as the occupational backgrounds of both parents. The findings reveal two significant factors influencing students’ Islamic entrepreneurial competencies: the occupational backgrounds of their fathers and mothers. However, the mother’s influence is more prominent, particularly in shaping students’ psychomotor competencies, while no significant effect was found on cognitive and affective domains. The study highlights the need to incorporate family influences into the broader framework of entrepreneurial education in Islamic institutions. It suggests that educational policies should not only focus on skill development but also engage families actively in the learning process. By integrating family support, these institutions can empower students to leverage their backgrounds, fostering both economic and spiritual development within the community.

Abstract

The advancement of technology in the era of the Industrial Revolution 4.0 has significantly expanded access to Islamic knowledge; however, it simultaneously presents challenges related to the imbalance between technological utilization and the reinforcement of the Islamic faith. This study addresses the core issue of Muslim family faith resilience and the critical need for digital da'wah, as perceived by scholars from Al-Aziziyah Islamic Boarding School. Employing a qualitative methodology grounded in Islamic philosophical theory, data were collected through in-depth interviews with key informants, including boarding school leaders, educators, and students. Complementary literature was reviewed from journals, books, and scientific reports. The research was conducted at Dayah Jamiah Al-Aziziyah in Samalanga, Bireuen, Aceh. Findings indicate that strengthening the resilience of aqidah within Muslim families involves multiple strategies, such as leveraging technology and social media as platforms for Islamic learning, alongside maintaining traditional religious instruction through regular taklim assemblies led by teachers and ulama. The boarding school, as a traditional educational institution, plays a pivotal role in effectively disseminating Islamic teachings via social media and online platforms. Furthermore, fortifying aqidah entails rigorous supervision of technology use, effective time management, verification of information, and collaborative efforts among the boarding school, families, and communities, with Al-Aziziyah Samalanga serving as a central hub. From the perspective of the Islamic philosophy, which prioritizes truth and the principles rooted in divine revelation as the ultimate reality, these efforts align with the beneficial aspects of scientific and technological progress. This study contributes an Islamic philosophical framework emphasizing the urgent necessity of digital da'wah to sustain and strengthen the aqidah resilience of Muslim families in the contemporary digital era.

Abstract

Land disputes, which frequently arise, require comprehensive policies and integrated solutions for effective resolution. At the national level, the government has issued technical regulations through Ministerial Regulations. In Aceh, however, land dispute resolution also falls under the jurisdiction of regional laws, including the Aceh Governance Law and Qanun, which reflect customary practices. This study employs an empirical legal research method, using a socio-legal approach to analyze how law operates within the society. Data were collected through in-depth interviews and document analysis. Respondents included officials from the Land Office, members of the Aceh Customary Council (MAA), customary leaders, academics, and local community members. Documents reviewed consisted of legal regulations, case reports, journal articles, and academic texts related to land disputes. The study finds that the Land Office resolves land disputes through a multi-step process: Case Study, Preliminary Assessment, Investigation, Presentation of Findings, Coordination Meeting, Final Assessment, and Case Resolution. However, traditional leaders and institutions such as the Aceh Customary Council have not been involved in this process, despite their official role in supporting governance, development, community affairs, and social conflict resolution. Currently, the Land Office and customary institutions operate independently, each following its own procedures. The study argues that a more integrated approach between the two entities could enhance the effectiveness of land dispute resolution. Such collaboration would strengthen the legitimacy and public trust in both institutions. Furthermore, customary law has demonstrated its capacity to resolve societal conflicts, including land disputes, thereby underscoring the value of incorporating traditional mechanisms into formal legal processes.

Abstract

This research examines the role of the fatwa of the National Sharia Council of the Indonesian Ulema Council regarding the permissibility of using electronic money as a law responsive to socio-economic phenomena and its impact on the economic practices of Muslim communities in Indonesia. With a descriptive-analytical qualitative approach, this research uses primary data from in-depth interviews and secondary data from official documents to understand the implementation and impact of the fatwa. The research results show that the DSN MUI fatwa provides important legal certainty for Muslims, ensuring that the use of electronic money follows Sharia principles such as the prohibition of usury, gharar, and haram transactions. In addition, this fatwa emphasizes security and transparency in transactions, increasing public trust in the digital financial system and supporting financial inclusion by enabling access to modern financial services for people previously unreachable by conventional banking. In conclusion, the DSN MUI fatwa supported the adaptation of Islamic law to the development of modern financial technology, ensuring the integration of technological innovation in the lives of Muslims without sacrificing their religious values. This research was conducted without conflict of interest, with all processes being independent and objective to ensure scientific integrity.

Abstract

Indonesia, as an archipelagic country, possesses a vast geographical area and an extensive coastline. Its coastal areas hold abundant natural resource potential, such as tourism assets, fisheries, seaweed, and coral reefs, all of which offer economic value and contribute to the welfare of local communities. This study employed an empirical juridical method and analyzed the issues of sea fence and public policy on the welfare of fishermen families in Tangerang, Indonesia, through the lens of public policy theory. Data were collected by means of interviews, document analysis, and a review of laws and regulations. Findings reveal that a lack of environmental impact assessments, community involvement, and transparency have rendered the sea fence construction policy ineffective. Additionally, sea fences have a direct impact on the well-being of fishing families, including reduced incomes, health problems, restricted access to fishing areas, higher operating expenses, and detrimental effects on marine biodiversity and seawater quality. Hence, efforts must be made to address the issues surrounding sea fences to enhance the welfare of fishermen and their families. Government policies on sea fences should include increasing the capacity of fisherman’s families through training and education, establishing supporting infrastructure, and boosting fishermen and local community organizations. Policy review, more dialogic communication, and the implementation of fairer and more sustainable fisheries welfare measures are among the recommendations.

Abstract

Child marriage is widely regarded as a violation of children’s rights by the international community. The topic has generated significant public debate in Malaysia, especially following the federal government’s 2018 proposal to raise the minimum marriage age to 18 for both genders. However, this proposal faced rejection and criticism from several Muslim groups and religious authorities, who hold substantial influence over policy and law-making. This article examines the perspectives of Malaysian Muslim stakeholders on child marriage and the legal reforms aimed at ending the practice. The study involved two focus group discussions with Muslim stakeholders (n=21) and in-depth interviews with religious officials (n=22) from various Islamic authorities. The findings reveal a polarised stance on child marriage: while some stakeholders and religious officers acknowledge the practice’s harms and support legal reforms, others oppose such changes. The resistance from religious authorities and Muslim groups highlights the need for enhanced advocacy efforts on children’s rights among these influential parties to ensure successful legal reform in Malaysia.

Abstract

The right to claim matrimonial property (jointly acquired property) is an exclusive entitlement of the husband or wife that could be pursued in the event of a divorce, polygamy, death or conversion to another religion. In cases where such claims arise following a death of either spouse, the Syariah Court has allowed heirs to continue the claim for matrimonial property on behalf of the deceased, provided that the deceased had initiated such a claim while the deceased was still alive. However, complications arise when heirs attempt to file such claims even though the deceased never pursued any claim during the deceased’s lifetime. This article explores the legal standing, or locus standi, of heirs who adduce claims on matrimonial property after the death of a relative, based on Syariah Court decisions in Malaysia. This qualitative study employed document analysis, presented descriptively through the case study methodology, involving Syariah Court proceedings. Findings indicate that, in principle, heirs, other than the husband or wife who is still living, do not automatically possess the legal standing to claim matrimonial property on behalf of the deceased, as they do in matters of inheritance under Islamic estate law, unless the deceased had explicitly delegated such authority to them. Nonetheless, it is essential to first determine why eligible parties had failed to file the claim during their lifetime. Given the absence of clear textual evidence from Islamic sources, either permitting or prohibiting such claims by heirs, and the lack of specific provisions addressing this issue in state-enacted Islamic family law, judges have exercised their discretion in varying ways when deciding these cases.

Abstract

This study addresses the urgent need for a Shariah-Compliant Index for Social and Reproductive Health Education (SCI-SRHE) in Malaysia, given the growing misalignment between current SRHE modules and Islamic principles. The core research questions aim to explore to what extent existing SRHE modules, particularly the ACE and PEERS modules, align with the objectives of Maqasid al-Shariah, and how a Shariah-based framework can enhance content compliance. Employing a qualitative content analysis, this research critically examines these modules against Islamic sources, including Qur’anic texts, Prophetic traditions, classical scholarship, and national fatwa rulings. The study further conceptualizes SCI-SRHE by integrating Maqasid al-Shariah with Fiqh al-Awlawiyyat to guide content prioritization. The findings reveal that while PEERS emphasizes abstinence and moral conduct, it often leaves key values implicit and open to varying interpretations. In contrast, ACE reflects liberal values, including promotion of safe sex, gender fluidity, and contraceptive use without marital distinction, which conflict with Islamic teachings. The study proposes SCI-SRHE as an evaluative tool to systematically realign SRHE content with Shariah objectives, offering a principled framework for policymakers, educators, and religious authorities. This framework aims not only to protect Muslim youth from moral confusion but also to uphold the integrity of the family institution. The proposed index has potential as a model for Muslim-majority countries seeking to harmonize sexuality education with religious values

Abstract

This study examines the strategic role of Sharia People's Financing Banks (BPRS) in supporting micro, small and medium enterprises (MSMEs) as a driver of Indonesia's economic recovery in the aftermath of the Covid-19 pandemic. Despite having a smaller share of total financing than Islamic Commercial Banks, BPRS plays a crucial role in reaching underserved microeconomic segments. Previous studies have shown that MSMEs are the backbone of the Indonesian economy, yet their access to financing remains limited. This research uses a qualitative method with a field approach through observation, in-depth interviews, and document analysis in selected regions. The findings show that BPRS financing has significantly contributed to MSME resilience and job creation, yet the sector still faces regulatory and policy challenges. Therefore, optimizing BPRS’ contribution requires legal frameworks that support risk mitigation, sustainability, and inclusive economic growth.
