Abstract

The circulation of illegal cigarettes by distributors in Indonesia is a serious problem and has a negative impact on many aspects, including the national economy, industry, and general health. The increasing prevalence of illegal cigarettes in circulation can cause state excise revenue to decrease. A number of products that are taxed in this context include tobacco, and the largest product is cigarettes. Cigarettes are a processed tobacco product that is popular among the public. With a large number of users and high excise implementation, this has led to the emergence of individuals who take advantage of avoiding paying excise. This research aims to analyse criminal acts related to the circulation of illegal cigarettes and the criminal liability of illegal cigarette dealers. The method used is the normative juridical method through its approach to the rules of Law Number 39 of 2007 and legal analysis to understand the process of criminal liability for the circulation of illegal cigarettes. The findings of the study indicate that criminal liability for the circulation of illegal cigarettes in Indonesia is very clearly regulated through the Excise Law, the norm contained is that every person who produces, distributes, or sells cigarettes without a valid excise sticker will be subject to imprisonment and fines. The resulting findings are expected to clearly illustrate criminal liability for the circulation of illegal cigarettes in Indonesia.

Abstract

Korupsi merupakan penyebab utama atas kerugian negara dalam pengelolaan keuangan negara. ICW mencatat 791 kasus korupsi terjadi selama tahun 2023, yang meningkat sebesar 26,8 % dibandingkan tahun 2022. Tidak dipungkiri pengungkapan kasus korupsi tidak lepas dari upaya penegakan hukum yang dilakukan bersama oleh APH dan BPK dalam audit investigasi. Dalam pekasanaanya, waktu pelaksanaan audit investigasi sangat beragam, sehingga APH sering kali memilih untuk berkooridnasi dengan BPKP dan Inspektorat dalam audit investigasi untuk menghitung kerugian negara. Penelitian dilakukan dengan tipe penelitian yuridis normatif dan tujuan penelitian ini yaitu menjelaskan prosedur audit ivestigasi yang dilakukan oleh BPK dan kendala yang ada dalam pelaksanaan audit investigasi. Hasil penelitian menunjukan dalam audit investigasi BPK mengacu pada Peraturan BPK Nomor 1 Tahun 2020 dan Keputusan BPK RI Nomor 2/K/I-XIII.2/4/2020. Namun demikian, untuk mengatasi kendala dalam memperoleh bukti yang cukup dan andal untuk membuktikan kerugian negara/daearah, dikembangkan prosedur alternatif dalam pelaksanaanya, juga menggunakan sistem Big Data Analysis dan Laboratorium Forensik Digital. Untuk dapat lebih mengembangkan pencapaian audit investigasi, BPK diharapkan dapat membakukan prosedur audit terutama prosedur alternatif kedalam suatu pentunjuk teknis dan petunjuk pelaksanaan serta memberikan dukungan penuh terhadap sumber daya terkait audit investigasi sehingga mutu dan keandalan hasil pemeriksaan dapat tetap terjamin.    Kata Kunci: Audit Investigasi, Korupsi , Kerugian Negara , Pembuktian, Keuangan Negara

Abstract

This article outlines the sources of law in Islam and the legal evidences in Islam, whether they are agreed upon (Muttafaq) or disputed (Mukhtalif). As followers of a religion, we should adhere to the laws reflected in its teachings, just as Islam also has rules and laws that its followers are obligated to observe. The sources of law in Islam are the Qur'an and the Sunnah, which are the word of Allah and the revelations of the Prophet, forming the foundation of Islamic teachings.The author employs a qualitative method, with the type of research used being library research. The reason for choosing this title is to examine the primary sources of law in Islam and to assess the validity (hujjah) of each legal provision in Islam.The results of this study show that understanding these two sources of law is crucial because they are interrelated in explaining the legal provisions applicable in Islam. Therefore, having a correct understanding of both should be a top priority, as errors in understanding them can undermine the validity of the legal sources themselves. By understanding the Qur'an and Hadith, we will gain legal guidance in accordance with the teachings of Sharia and the Sunnah of Prophet Muhammad (peace be upon him).

Abstract

This research examines the following instances from a justice standpoint: The procedure that the Sibuhuan Religious Court follows in situations concerning polygamous marriages is outlined in Articles 90/Pdt.P/2023/PA.Sbh and 217/Pdt.P/2022/PA.Sbh: 1) What are the procedures for carrying out the rulings of the Sibuhuan Religious Court regarding polygamous marriages? 2) The cases of 90/pdt.p/2023 PA.Sbh and 217/Pdt.P/2022/PA.Sbh include polygamous marriage; what was the judge's decision on this matter? How did the court arrive at its decision? What factors and cases were considered? Sources consulted included the 1974 Marriage Law, Islamic legal treatises, Supreme Court circulars, judgements made by religious courts, publications, journals, and prior study on family law fiqh, as well as other primary and secondary sources. In line with SEMA No. 3 of 2018, the Sibuhuan Religious Court approved the marriage based on these findings. Problems have arisen as a result of court rulings in cases 90/Pdt.P/2023/PA.Sbh and 217/Pdt.P/2022/PA.Sbh, which suggest legal smuggling connected to the certification of polygamous marriages. There is variability in the way the judges take legal factors into account.

Abstract

Criminology theory has various approaches to understanding the causes of criminal behaviour. This study aims to analyse Differential Association Theory proposed by Edwin Sutherland, which emphasises that criminal behaviour is learned through social interaction with individuals involved in criminal practices. Meanwhile, Anomie Theory proposed by Émile Durkheim explains how instability of social values can trigger criminal acts. Social Control Theory highlights the importance of social bonds in preventing deviant behaviour, while Subculture Theory explains how certain groups develop norms and values that differ from the wider community, which can encourage criminal behaviour. Finally, Personality Theory focuses on psychological factors that influence individuals, suggesting that certain personality characteristics can contribute to the tendency to commit crimes. Each theory offers unique insights that are important for understanding the complexity of criminal behaviour in social and individual contexts. A deeper understanding of criminology theory also increases public awareness of how to overcome the challenges of crime.

Abstract

This research examines the history of Islamic economic thought in Indonesia, especially during the Kingdom, Dutch colonialism and after the proclamation of independence, as well as the role of several important figures who influenced these developments. During Dutch colonialism, Islamic economic thought experienced oppression and marginalization, because the colonial economic system dominated by Western capitalism hampered the development of Islamic economics. However, at the beginning of the 20th century, the rise of the modern Islamic movement in Indonesia also influenced Islamic economic thinking. This movement emphasizes the importance of reform in various aspects of life, including economic practices based on Islamic teachings. The methodology used in this research is qualitative with a literature study approach, and uses historical studies to explore differences in thought. The research results show that Islamic economic thinkers in Indonesia establish Islamic principles as the basis for achieving just and sustainable economic goals.

Abstract

Family law has a central role in the study of Islamic law because it is considered the starting point for understanding Islamic law. In the mid-20th century, reform and renewal occurred. This research aims to describe the history of family law that occurred in Islamic countries using normative research methods. Data collected through relevant document sources related to the history of family law. The results of this study are as follows: 1) Islamic countries are defined as countries that apply Islamic law purely and countries with the largest adherents of Islam; 2) Family law reform is divided into two categories: intra-doctrinal reform and extra-doctrinal reform; 3) Family law reform began in Turkey in the early 20th century, followed by Egypt, Iran, Syria, Pakistan and Indonesia.

Abstract

The present study aims to examine how Lawrence M. Friedman's legal system theory views market conduct as an ideal legal effort in realising consumer data protection in p2p lending. This research employs a doctrinal approach, utilising qualitative legal analysis through two distinct methodologies: the statute approach and the conceptual approach. The findings suggest that the pursuit of market conduct as an ideal legal effort in realising consumer data protection in peer-to-peer lending can be achieved by fulfilling three legal aspects: legal substance, legal structure, and legal culture. In essence, the most critical prerequisite is to ensure harmonisation, both in terms of principles and norms, in all regulations pertaining to consumer data protection, both vertically and horizontally. In legal structure, it is essential to delineate clear boundaries of authority for the institutions responsible for consumer data protection in p2p lending. In the context of legal culture, it is imperative to prioritise the five principles of Pancasila as a paradigm for the development of a legal culture that is congruent with the values and ideals that delineate the nation and society. This will facilitate the development of an optimal legal culture

Abstract

In the current digital era, the amount of information shared through social media continues to increase, including patient data that is vulnerable to leakage caused by healthcare workers who use social media in their professional activities and during data collection. This situation poses risks of privacy violations and legal issues. Law No. 17 of 2023 concerning Health does not yet provide sufficient protection for patient data, as it lacks explicit provisions regarding criminal sanctions. This study examines the appropriate legal standards for protecting patients' personal data in Indonesia to address these issues. The main objective of this research is to analyse criminal sanctions for healthcare workers who disclose patients' personal information through social media. The legal gap in the current health law, which does not specifically regulate criminal sanctions for breaches of patient data privacy, is the core subject of this study. The legal analysis conducted in this research is expected to strengthen legislation related to patient privacy protection and assist health authorities in preventing the misuse of patient information on social media by medical and healthcare personnel in hospitals.

Abstract

The humanitarian conflict affecting the Rohingya ethnic group in Myanmar continues to this day. The conflict, which began after Myanmar's independence in 1948, has resulted in millions of Rohingya fleeing to other countries, including those in Southeast Asia that border Myanmar. Indonesia is also one of the destination countries for refugees. Recently, news about the influx of Rohingya refugees in Indonesia has flooded the mass media and social media. To what extent does Indonesia have the authority to resolve the Rohingya refugee conflict? This study complements existing studies, which lack focus on Indonesia's sovereignty in handling the Rohingya refugee case. This problem formulation is divided into three questions. First, what is the history of the Rohingya ethnic conflict? Second, what has been the response and attention of the international community to Rohingya ethnic refugees? Third, to what extent does Indonesia's sovereignty resolve the Rohingya ethnic refugee issue? This study is a literature study conducted using qualitative research. The data used is secondary data, namely books, articles, news, and other literature. The analysis in this study uses the content analysis theory ( ). The results are as follows. First, the Rohingya ethnic group, which has long occupied Myanmar, which borders Bangladesh, has been massively discriminated against by other ethnic groups and the Myanmar government. Second, the international organisations involved in handling Rohingya refugees are ASEAN, UNHCR, OIC, IMO, and the UN. Third, Indonesia has the absolute sovereign right to determine its own policies in accordance with the principles of the second principle, Civilised Humanity.
