Jurnal El-Ahli adalah Jurnal Hukum Keluarga Islam yang diterbitkan oleh Program Studi Hukum Keluarga Islam Sekolah Tinggi Agama Islam Negeri Mandailing Natal. Jurnal ini terbit secara berkala dua kali dalam satu tahun yakni bulan Juni dan bulan Desember. Fokus dari jurnal ini mengkaji penelitian dibidang pemikiran hukum islam dan hukukm keluarga islam, baik penelitian literasi ataupun penelitian lapangan. Abstract

Substitute heirs are a form of renewal of Islamic law in Indonesia which is then sublimated in the statutory regulations contained in the Compilation of Islamic Law (KHI). The granting of inheritance rights to substitute heirs is the result of ijtihad which is influenced by the sociological conditions of Indonesian society which also has three inheritance law systems, namely civil inheritance BW, Islamic inheritance and customary inheritance. The concept of inheritance in Indonesia at the practical level influences each other considering that the three inheritance models are applied in Indonesia. This research will reveal the concept of inheritance of substitute heirs contained in KHI which is different from the concept of inheritance contained in fiqh books whose designation has been explained in detail qath’i in the text. This type of research is descriptive qualitative based on literature research with analysts data through a descriptive critical analysis approach resulting in a responsive understanding of Islamic inheritance law. This study concludes that the granting of inheritance rights to substitute heirs is a form of modernization of inheritance law in Indonesia by considering the benefit side but creates several legal consequences by making Islamic inheritance law a law that is zanni dilalah so that it can be ijtihad, causing legal uncertainty and undermining the legal order of Islamic inheritance which is the consensus of the ulama. Abstract

Para mustahiq zakat dijelaskan dalam al-qur’an surat at- Taubah ayat 60 yang terdiri dari 8 golongan, yaitu fakir, miskin, amil zakat, muallaf, riqab (budak), gharim (orang yang berhutang), fi Sabilillah dan Ibnu Sabil. Kemudian secara umum ada lagi golongan yang diharamkan menerima zakat diantaranya orang kaya, orang kuat bekerja, non muslim, anak dan ayah, istri, keluarga dan kerabat Rasulullah. Jika zakat itu sudah diberikan kepada sasaran yang tepat tapi di antara mereka ada yang termasuk golongan fakir namun termasuk dalam kategori fasiq. Dalam hal ini jika dilihat dari segi fakir atau miskinnya maka ia termasuk kepada golongan yang berhak menerima zakat dan orang fasiq juga tidak termasuk kepada golongan yang diharamkan menerima zakat. Penelitian ini bertujuan untuk mengetahui hukum memberikan zakat kepada orang fasiq dalam kajian filosofis hukum Islam. Penelitian ini menggunakan kajian kepustakaan (library research) dengan data utama berasal dari jurnal, buku, dan internet. Pengumpulan data dilakukan dengan membaca, mencatat, mengelompokkan sesuai dengan tema yang dibahas, kemudian dianalisis menggunakan teori menggunakan teori deskriptif, induktif dan menyajikannya menjadi tulisan yang layak untuk dibaca. Hasil penelitian menunjukkan bahwa secara filosofis hukum Islam orang fasiq berhak mendapat peruntukan zakat akan tetapi pertama, hukumnya makruh jika dengan diberikanya harta zakat maka tidak berubah dan tetap kepada kefasiqannya pada level tahsiniyah. Kedua hukumnya mubah jika dengan pemberian harta zakat akan menrubah ke fasiqan nya menjadikan mereka mau untuk melaksanakan perintah Allah dan meninggalkan larangan Allah pada level tahsiniyah.

Abstract

Consumer protection is a set of legal rules made to provide protection to consumers, so that there is a balance between service businesses and consumers. In the case of business actors who offer barber services, of course, sometimes things do not meet consumer expectations, for example, mistakes in cutting and tidying hair, injuries resulting from negligence of barbering services that cause losses to customers or consumers. This situation provides an understanding of the need for consumer protection as a party that is often harmed. Fair protection and equal treatment before the law has been contained in the law. The problem is regarding how to arrange compensation by barber service business actors to consumers as a result of errors in cutting hair and causing injuries during the shaving process and how is the implementation of compensation by barber service business actors to consumers due to errors in cutting hair and incurring injuries during the process shaving. The method used is empirical research by looking at social phenomena in society based on existing data in the field.

Abstract

The waiting period after the breakup of a good marriage caused by death, divorce, and court decisions is an act regulated in the Compilation of Islamic Law and the Civil Code which has differences and similarities in concept, with the aim of knowing thoroughly about the waiting period, the difference findings are the length of the waiting period 90 days in KHI, and 300 days in the Civil Code. The provisions for the iddah period in KHI are very clear and detailed and in the Civil Code it is very limited. The similarity of the iddah period in Islamic law and the Civil Code is that it prohibits new marriages before the end of the iddah or waiting period, and the iddah period is calculated from the fall of a court decision that has permanent legal force. The purpose of the iddah period in Islamic law and the Civil Code is to prevent mixing of seeds or confistus sanginis (hereditary doubts).

Abstract

Penelitian ini bertujuan untuk mengkaji implementasi hukum waris dalam Islam melalui studi komparatif tentang praktik waris di beberapa negara Muslim. Penelitian ini menggunakan metode deskriptif komparatif dengan mengumpulkan data melalui studi pustaka dan analisis terhadap literatur yang relevan. Beberapa negara Muslim yang menjadi objek studi meliputi Arab Saudi, Mesir, Indonesia, dan Malaysia. Negara-negara ini dipilih karena mewakili berbagai tradisi hukum Islam yang berbeda dan memiliki perbedaan dalam praktek waris mereka. Hasil penelitian ini menunjukkan bahwa meskipun ada kesamaan dalam prinsip-prinsip hukum waris dalam Islam, implementasinya dapat berbeda di setiap negara. Arab Saudi, sebagai negara yang menerapkan Syariah secara ketat, mengikuti sistem waris yang ditentukan dalam Al-Qur'an dan hadis-hadis Nabi Muhammad. Mesir, di sisi lain, memiliki sistem waris yang dipengaruhi oleh hukum nasional mereka yang terkadang bertentangan dengan prinsip-prinsip Islam. Indonesia dan Malaysia, yang menerapkan sistem hukum campuran, memiliki aturan-aturan waris yang mencakup prinsip-prinsip Islam namun juga mempertimbangkan faktor-faktor budaya dan adat istiadat setempat. Diharapkan hasil penelitian ini dapat menjadi dasar untuk memperbaiki dan mengembangkan sistem hukum waris di negara-negara Muslim, sehingga dapat mencapai keadilan sesuai dengan prinsip-prinsip Islam.

Abstract

Abstract Minangkabau has two forms of inheritance, namely high inheritance and low inheritance and the kinship system in Minangkabau adheres to the matrilineal principle. Because in Minangkabau custom there are two forms of inheritance distribution, namely individual and collective, so there are differences in inheritance distribution in adat and Islamic law. The Compilation of Islamic Law which is a collection of rules used as a reference for Muslims in Indonesia also regulates inheritance. This study aims to see whether Islamic law intervenes in customary law, especially in the Compilation of Islamic Law regarding inheritance. This study uses a literature review (library research) with a descriptive method through a qualitative approach with the main data coming from journals, books, and the internet. Data collection is done by reading, taking notes and comparing according to the themes discussed. The results of this study indicate that there is an intervention Islamic law regarding the inheritance system that exists in Minangkabau custom in several articles in the Compilation of Islamic Law, for low inheritance in its distribution in customary law and KHI both use faraidh law, while high inheritance according to KHI is not included in inheritance because ownership cannot be individually owned. Abstract

Abstract Adhol guardians are guardians who do not want to marry someone, adhol guardians are permitted as long as they do not conflict with Islamic law. Interesting to examine here is the decision of the Bengkalis Religious Court Number: 41/Pdt.P/2013/PA.Bkls, which can be identified in the Bengkalis Religious Court accepting, adjudicating and determining the walii adhol case due to customary factors, even though the two candidates have already established a relationship. It's been a long time and it's hard to separate, it's been 2 years and they love each other. The future husband has a very suitable salary to build a household to meet his household needs, and the prospective husband has approached his future wife's biological father as much as possible to be willing to accept the proposal from the prospective wife. her husband, but her biological father still refused on the grounds of customary issues. The results of research on the basis of judges' considerations in deciding or determining cases refer to Article 23 paragraph (2) of Legislation No. 1 of 1991 concerning the Compilation of Islamic Law which basically states that among the absolute competencies of the Religious Courts is to receive, examine and determine cases at the court of first instance, PA Bengkalis has direct authority to adjudicate these cases, so that in formal and material procedural law, in cases has fulfilled the requirements, the panel of judges is obliged to analyze and decide the walii adhol case. The panel of judges determines or decides cases in accordance with the rules of fiqh regarding the obligations of leaders or judges towards the community in terms of decisions or policies to determine a case in the Religious Court. Abstract

AbstrakPenelitian ini dilatar belakangi oleh ketidakabsahan pernikahan yang tidak dicatatkan berdasarkan hukum positif dan hukum Islam. Dalam hukum Islam pencatatan pernikahan adalah sebagai syarat mutlak dalam istinbath hukum Islam. Pernikahan yang tidak dicatatkan dengan aturan hukum Islam mengenai syarat mutlak bagi pencatatan perkawinan menjadi perkara yang kontradiktif yang terjadi dalam praktek pernikahan di tengah masyarakat. Penelitian ini bertujuan untuk mengetahui makna pencatatan perkawinan dalam istinbath hukum Islam dan ingin mengetahui makna pencatatan dalam hukum Islam. Serta ingin mengetahui makna pencatatan pernikahan dalam upaya merealisasikan tujuan maslahah yang ada pada diri manusia. Penelitian ini menggunakan pendekatan kualitatif dengan metode kepustakaan (library research). Hasil penelitian menunjukan bahwa makna pencatatan pernikahan adalah syarat mutlak dalam istinbath hukum Islam dan makna pencatatan pernikahan adalah bagian dari rukun nikah yaitu saksi dalam hukum Islam. Makna pencatatan pernikahan dalam upaya merealisasikan tujuan maslahah yang ada pada diri manusia adalah Maslahah Daruriyyah seperti penjagaan yang harus dijaga adalah ad-Din, an-Nafs, al-‘Aql, an-Nasab wa al-Mal.

Abstract

This research explores traditional values in the traditional inheritance distribution system carried out by the Sidojadi community in Mandailing Natal Regency from the perspective of Islamic law. So, the research aims to understand how local customary values and traditions coexist with various principles contained in Islamic law regarding the inheritance distribution process. The data found were analyzed using the descriptive-analytical method, namely analyzing primary and secondary data obtained through interviews and literature studies and trying to see the relationship between the two. The results of the research explain that the relationship between the customary inheritance system and the principles of Islamic law which is reflected in the arrangements for the distribution of inheritance in the Sidojadi community, starting from the appointment of heirs, as well as the involvement of traditional institutions in this process has illustrated a very positive thing. Apart from that, the research results also explain that the harmony between traditional values and principles in Islamic law related to the context of inheritance distribution in Sidojadi society is very appropriate.

Abstract

One of the conditions for someone to receive inheritance is that one of the family members dies (muwaris) and leaves behind his/her assets. Then the heirs can obtain a portion of the inheritance in accordance with the applicable provisions (faraid). However, things are different if one of the heirs is of a different religion or converts from Islam to a religion other than Islam (apostatizes), then according to Islamic jurisprudence scholars, he is no longer an heir and absolutely does not receive a share of the inheritance of the muwaris. This article uses a qualitative descriptive method with data collection techniques in the form of literature. This article is interesting to discuss in more depth because if an heir has apostatized, he will not receive a single cent of inheritance from the muwaris because Islamic law states that a Muslim cannot inherit from a non-Muslim. This is also clearly regulated in the Compilation of Islamic Law (KHI). However, there is another option if an heir who was previously Muslim becomes an apostate, but he still wants to get a share of the inheritance, Therefore, Islamic law in Indonesia permits it by way of a mandatory will, on the condition that the gift of assets does not exceed 1/3.
