Abstract

This research examines the regulations surrounding Public Information Disclosure, which mandates that public institutions in Indonesia furnish and manage public information as part of their governmental duties. The purpose of this study is to analyze the normative aspects and practices of implementing public body obligations that are the object of Article 7 Paragraphs (1) and (3) in providing and managing public information. The research method used is normative juridical. From the results of the study, it can be concluded that Article 7 paragraphs 1 and 3 of the KIP Law have normative aspects and implementation of public body obligations. The results of the study indicate a gap between the legal norms regulated in the KIP Law and their implementation in the field. The juridical analysis identified several inhibiting factors, including diverse legal interpretations, limited supporting legal infrastructure, and lack of harmonization between the KIP Law and other sectoral regulations. The conclusion of the study is that effective implementation of Article 7 of the KIP Law requires a comprehensive approach involving legal reform, institutional strengthening, and increasing legal awareness of government officials and the public towards more transparent and accountable governance.

Abstract

In the realm of construction, contracts form the fundamental basis of projects involving multiple parties with clear responsibilities and obligations. This research explores a case of breach of contract (wanprestasi) in a construction project involving an individual, which not only caused financial and reputational harm to other parties involved but also compromised the integrity and quality of the project. The legal framework governing construction services and contracts, including Article 1 paragraph (3) of Law Number 2 of 2017 concerning Construction Services, sets the ground for understanding obligations and rights under Indonesian civil law. The methodology employed in this study is a qualitative analysis, focusing on the application of legal principles, relevant regulations, and real-life practices related to cases of breach of contract using literature reviews and case document analysis. This approach has allowed for an in-depth understanding of the legal norms and the actual enforcement of laws in similar situations. The findings reveal that the specific breaches included not meeting agreed specifications and delays in project completion, which are deemed as wanprestasi under Article 1243 of the Indonesian Civil Code. These violations stem from poor project management, opaque fund usage, and unilateral decisions by the executing party, highlighting the need for stringent legal enforcement and protection for the aggrieved parties. Abstract

In the business world, contractual relationships often involve agreements between two parties, each of whom has obligations or "performances" to fulfill. However, issues may arise where one party fails to fulfill their obligations, which is referred to as breach of contract or "default" (wanprestasi). This paper aims to address two key questions: what are the legal consequences of default in a debt agreement, and how does the court analyze the reasoning behind the decision in case number 1/Pdt.G/2021/PN Idm? The research method employed is normative legal research. The study's findings indicate that the legal consequence of default in a debt agreement is a claim for damages. According to Article 1243 of the Indonesian Civil Code (KUHPerdata), damages may include costs, losses, and interest. To claim damages, a prior demand for performance or formal notice (somasi) is generally required, except in certain circumstances where a warning is unnecessary. In the court decision number 1/Pdt.G/2021/PN Idm, the judge concluded that the defendant failed to meet their obligation to repay the debt to the plaintiff as agreed. The default occurred when the defendant did not pay the remaining debt of IDR 90,000,000 (ninety million rupiah) with an interest rate of 3% on the principal debt of IDR 475,000,000 (four hundred seventy-five million rupiah). According to the concept of default, three conditions can determine whether a party has breached the contract: 1) not fulfilling the obligation at all, 2) fulfilling the obligation but poorly or incorrectly, and 3) fulfilling the obligation but not on time.

Abstract

Transparansi menjadi kunci dalam upaya pencegahan dan pemberantasan tundak pidana korupsi (tipikor). Tanpa adanya transparansi, tindakan korupsi sulit untuk terdeteksi dan diatasi. Data dan informasi yang jelas, akurat, dan dapat diakses oleh publik akan mendorong akuntabilitas para pejabat pemerintah. Namun, implementasi transparansi sering kali dihadapkan pada berbagai tantangan, seperti budaya birokrasi yang tertutup, lemahnya penegakan hukum, dan minimnya partisipasi masyarakat dalam pengawasan. Rumusan Masalahnya yaitu bagaimana pengaturan transparansi yang ada saat ini berkontribusi dalam pencegahan korupsi? Dan bagaimana hambatan yang dihadapi dalam implementasi pengaturan transparansi di pemerintahan?. Metode Penelitian yang digunakan yaitu yuridis normatif. Hasil penelitian menunjukkan pengaturan transparansi yang ada saat ini menunjukkan bahwa pengaturan tersebut memiliki kontribusi signifikan dalam pencegahan korupsi. Dengan meningkatkan akses informasi publik, mendorong akuntabilitas, dan memfasilitasi partisipasi masyarakat, pengaturan transparansi dapat mengurangi peluang untuk tindakan korupsi. Abstract

The approach of Maqosith Syariah Alal Al-Fashi towards sex by maturation done by married couples through Video Call because long-distance relationships are allowed because in terms of benefits, the law in maturation is still being debated so that ijtihad is needed in determining the law, maximizing reason as an effort of ijtihad is very important to know and weigh the benefits and harms of maturation done by married couples caused by long-distance relationships, so that by combining the theory of Maqosith Alal Al-Fashi, the theory of Islamic Progressive Law and by using the method of sociological empirical research will be obtained a result that Sex by maturation using Video Call due to long-distance relationships is allowed and has more benefits than harms, and the most important thing from this study shows that sex with maturation through Video call husband and wife will create harmony in the family.

Abstract

This study analyses the legal certainty of circular resolutions outside the General Meeting of Shareholders (GMS) on nominee shares based on Decision Number 815/PDT/2022/PT SBY. This study focuses on the legality and legal implications of circular resolutions in corporate practice in Indonesia. Through a normative juridical approach and analysis of relevant regulations and case law, this study finds that circular resolutions made without fulfilling formal and material requirements may be potentially legally invalid. The results of this study provide recommendations on the need for stricter law enforcement regarding the use of nominee shares in the Indonesian legal system.

Abstract

Abstract This study aims to analyze legal protection for children who act as witnesses within the criminal justice system in Indonesia. Children often face risks of trauma and intimidation during legal proceedings, which necessitates special legal protection as stipulated in Law No. 11 of 2012 on the Juvenile Criminal Justice System. This research explores the implementation of such protection and the challenges encountered in safeguarding the rights of children as witnesses. Through a qualitative approach utilizing literature review and in-depth interviews, the study reveals that despite having an adequate legal framework, its implementation faces several obstacles. These obstacles include lack of coordination among law enforcement agencies, limited resources, and social and cultural barriers that hinder optimal protection for child witnesses. Additionally, children often do not receive adequate psychological support, while child-unfriendly legal procedures exacerbate their psychological and emotional conditions. The study recommends more comprehensive policy revisions, enhanced training for law enforcement on children's rights, and strengthening of psychosocial support and infrastructure to protect children during legal processes. Effective implementation can be achieved through increased cooperation among institutions such as the police, social workers, and child protection agencies to create a system that is more responsive to the needs of child witnesses. The study emphasizes the importance of a child-centered and rehabilitative approach to ensure their physical, mental, and social well-being throughout their involvement in criminal justice proceedings.

Abstract

The purpose of this study is to determine the leadership of women in migrant workers’ organizations in Serikat Buruh Migran Indonesia (SBMI) Wonosobo. The type of research used is qualitative research with observation and interview methods. The theory used is critical theory in organizational studies that focuses on gender equality in organizations. The results showed that women leaders are able to develop Human Service Organizations (HSO) with the women’s leadership strategy used, namely servant leadership. This leadership style prioritizes the common interests and aspirations of the people being led as well as an orientation to serve. Some characteristics of this leadership style include love, empowerment, vision, humility, and trust. This strategy is considered effective because it can develop organizations and realize gender equality.

Abstract

Children are prohibited from being exploited economically and/or sexually. Every person including children in conflict with the law who violates the provisions of Article 76 I of Law No. 17 of 2016 is held criminally responsible for their actions. The legal fact is that there are still children who are economically exploited (used as prostitutes). This is also the case with the legal facts in Simalungun Regency, where one of the cases has been enforced as referred to in Decision Number: 13/Pid.Sus-Anak/2023/PN Sim dated 21 December 2023.  This research discusses the application of responsibility for children in conflict with the law for committing criminal offences of economic and/or sexual exploitation. This research uses a type of holistic normative research where existing data is used as a research supplement. This research is categorised as analytical prescriptive research. The data is analysed deductively qualitatively and combines 4 approaches, namely legislation approach, concept approach, philosophy approach, and case approach. This research uses the Theory of Criminal Liability. The results of the study concluded that the application of criminal responsibility for children in conflict with the law due to criminal acts of economic and / or sexual exploitation is to apply penalties based on the provisions of Article 88 jo Article 71 D paragraph (1) of Law Number 17 Year 2016. In fact, Decision Number: 13/Pid.Sus-Anak/2023/PN Sim applies a sentence based on the provisions of Article 88 of Law Number 17 of 2016.

Abstract

The increasing use of vape e-cigarettes in Indonesia, particularly among adolescents, poses new challenges in terms of public health and legal regulation. They are often perceived as a safer alternative to conventional cigarettes, although their long-term effects are still not fully understood. This study aims to analyse the regulation of the use and circulation of vape in Indonesia, and compare it with the regulation in Malaysia, in order to identify the similarities, differences, and legal implications of these policies on society. The research method used is a normative juridical approach with literature study and comparative legal analysis. The results show that the regulation in Indonesia is still focused on the fiscal aspect through the application of excise tax, while the supervision of product distribution and content is still weak. In contrast, Malaysia applies stricter regulations, including a ban on sales to individuals under the age of 18 and a ban on the use of nicotine liquids since 2015. The conclusion of this study shows that Indonesia needs to improve its regulations by balancing the protection of public health and economic interests, and learn from the best practices implemented in Malaysia. More comprehensive policies and public education are expected to reduce the prevalence of vape use among adolescents and reduce long-term health risks.
