Abstract

This study aims to analyze the normative status of Presidential Regulations (Perpres) within the Indonesian legal system and to examine the urgency of strengthening their role in achieving legal certainty and regulatory simplification. The study employs a normative legal research method using a legislative approach, a conceptual approach, and a case study approach. The legal materials utilized consist of primary, secondary, and tertiary sources, which are qualitatively analyzed through legal interpretation techniques and legal reasoning. The research results indicate that Presidential Regulations hold a strategic position within the hierarchy of legislation because they derive from the President’s constitutional authority as the holder of executive power under Article 4(1) of the 1945 Constitution of the Republic of Indonesia. However, the phenomenon of regulatory obesity, characterized by the proliferation of Ministerial Regulations, has led to regulatory fragmentation, disharmony of norms, and a reduction in legal certainty. Based on Hans Kelsen’s theory of the hierarchy of norms, Hans Nawiasky’s theory of the structure of norms, Gustav Radbruch’s concept of legal certainty, and Philipus M. Hadjon’s theory of authority, this study argues that strengthening Presidential Regulations is necessary to clarify the hierarchical relationships among regulations, enhance policy harmonization, and strengthen government coordination. This study proposes a model for strengthening Presidential Regulations through reinforcing hierarchical functions, limiting Ministerial Regulations to technical aspects, and optimizing regulatory harmonization mechanisms. This model is expected to support regulatory reform, enhance legal certainty, and achieve effective, coordinated, and accountable governance.

Abstract

This study aims to analyze the evolution of green hospitality regulations within hotel and villa certification standards in Indonesia during the 2013–2025 period. The growing emphasis on sustainable tourism development has encouraged the government to integrate environmental sustainability principles into the governance of accommodation businesses. However, studies examining the evolution of green hospitality provisions within hospitality regulations remain limited. This research employed a qualitative approach using document analysis combined with a normative legal perspective. The data consisted of four major regulations governing hotel and villa standards in Indonesia, namely the Ministerial Regulation of Tourism and Creative Economy No. 53 of 2013, No. 29 of 2014, No. 4 of 2021, and the Minister of Tourism Regulation No. 6 of 2025. Data were analyzed using qualitative content analysis based on four key dimensions of green hospitality: energy efficiency, water conservation, waste management, and green procurement. The findings reveal a significant transformation in Indonesian accommodation regulations, shifting from a service-quality orientation toward a sustainability-oriented regulatory framework. Waste management emerged as the most consistently regulated dimension across all regulations, while energy efficiency and water conservation demonstrated the most substantial development in recent regulations. In contrast, green procurement remains relatively underdeveloped. The findings indicate an increasing institutionalization of green hospitality principles within Indonesia’s tourism regulatory framework. The study contributes to the growing body of sustainable tourism literature and provides policy implications for strengthening hospitality certification standards in line with international sustainability practices.

Abstract

Customer satisfaction is an important factor in the banking industry because it reflects customers' perceptions of service quality and influences long-term relationships with the bank. This study aims to analyze the effect of Service Excellence and Complaint Handling on customer satisfaction at PT Bank Pembangunan Daerah Bali Tabanan Branch.This study employed a quantitative research approach with a survey method. The sample consisted of 100 customers selected using purposive sampling. Data were collected through questionnaires using a five-point Likert scale and analyzed using multiple linear regression with the assistance of IBM SPSS Statistics. This research is based on the Expectation Confirmation Theory, which explains that customer satisfaction is achieved when the services provided meet or exceed customer expectations.The results show that Service Excellence has a positive and significant effect on customer satisfaction. Complaint Handling also has a positive and significant effect on customer satisfaction. Simultaneously, both variables significantly influence customer satisfaction at PT Bank Pembangunan Daerah Bali Tabanan Branch. This study concludes that improving service quality and implementing effective complaint handling can enhance customer satisfaction. Therefore, the bank is expected to continuously improve its service performance and complaint handling process to maintain customer satisfaction and strengthen customer trust.

Abstract

This study aims to describe the promotional strategies implemented for the THT Bali Dwipa Savings product at Bank BPD Bali Mangupura Branch and to describe the role of these promotional strategies in increasing customers' saving interest. This study was conducted because, based on the account opening data for the THT Bali Dwipa Savings product throughout 2025, the number of new customers fluctuated and tended to decline during several periods. Therefore, it is necessary to examine the promotional strategies implemented to increase customers' saving interest. This study employed a qualitative method with a descriptive approach. Data were collected through observation, interviews, and documentation. The collected data were then analyzed through data reduction, data presentation, and conclusion drawing. The results showed that the promotional strategies implemented included advertising, sales promotion, personal selling, public relations, and direct marketing. These strategies were carried out through social media, brochures, WhatsApp, telephone communication, socialization and financial literacy activities, the distribution of gifts or souvenirs, as well as direct communication with prospective customers. The promotional strategies played a role in increasing customers' saving interest by helping the public obtain information about the THT Bali Dwipa Savings product, understand its benefits, and consider opening an account. In addition, recommendations from family members and friends also contributed to the interest of some customers in choosing the THT Bali Dwipa Savings product.

Abstract

This study examines the implementation of the Merdeka Curriculum and active learning strategies in enhancing pupils’ competences in the era of Education 4.0. The changing times, characterised by developments in digital technology, demand that the education system produces pupils who are not only academically excellent but also possess critical thinking, creative, collaborative and communication skills, and are able to adapt to change. The Merdeka Curriculum is a policy that provides educational institutions and teachers with the flexibility to design learning experiences tailored to pupils’ needs, whilst active learning strategies encourage pupils’ direct involvement in the learning process through discussion, projects, problem-solving and collaboration. This study employs a literature review method, examining various relevant sources including books, journal articles and educational policy documents. The findings indicate that the implementation of the Merdeka Curriculum, supported by active learning, is capable of enhancing pupils’ competencies across the board, in terms of knowledge, skills and character. Consequently, the synergy between the Merdeka Curriculum and active learning strategies constitutes an effective approach to addressing the challenges of Education 4.0.

Abstract

This study aims to analyze the implementation of service recovery in handling guest complaints within the hospitality industry, using Courtyard Hotel as a case study. The primary focus is to identify the types of complaints submitted by guests via the TripAdvisor platform and to analyze the handling strategies implemented by hotel stakeholders. The research method employed is descriptive qualitative. Data were collected through observations of online reviews on TripAdvisor from March 2021 to December 2022, semi-structured interviews with the Front Desk Manager, and documentation studies. Data analysis techniques followed the Miles and Huberman model, encompassing data reduction, data display, and conclusion drawing. The results indicate five categories of guest complaints: 1) Mechanical Complaints regarding physical facilities such as air conditioning and hot water; 2) Attitudinal Complaints regarding staff behaviour, particularly in the security department; 3) Service-Related Complaints regarding operational service standards; 4) Unusual Complaints, which are subjective and based on individual guest preferences ; and 5) Emotional Complaints, which arise when guests feel undervalued during large-scale events at the hotel. Complaint handling strategies at Courtyard Hotel are implemented through two channels: online and direct. Online handling follows an SOP for resolution within 3x24 hours , while direct handling applies the "first resolution" principle by the staff member who initially receives the complaint. The service recovery provided includes "renewing elements" or compensation, such as complimentary meals, spa treatments, complimentary nights, and the provision of Marriott Bonvoy points. This study concludes that appropriate service recovery not only mitigates complaints but also has the potential to maintain guest loyalty.

Abstract

This study aims to analyze the implementation of the Planning, Organizing, Actuating, and Controlling (POAC) management functions in the procurement of Daily Market List items for the Culinary Department by the Purchasing Department at A hotel, identify the obstacles encountered during the procurement process, and examine the efforts undertaken to overcome these obstacles. This study employed a descriptive qualitative method with a case study approach. Data were collected through observation, interviews, and documentation involving the Purchasing Manager, Purchasing Staff, and Receiving staff at Hotel A. Data were analyzed using the interactive analysis model of Miles and Huberman, which includes data reduction, data presentation, and conclusion drawing. The results indicate that the implementation of the POAC management functions in the procurement of Daily Market List items has been carried out effectively and in accordance with established procedures. This is reflected in procurement planning based on the Daily Market List, clear task allocation and coordination among departments, the implementation of procurement activities following operational procedures, and control through quality and quantity inspections as well as periodic supplier performance evaluations. However, several obstacles remain, including delays in the Daily Market List approval process, late deliveries from suppliers, limited product availability, fluctuations in food ingredient prices, and discrepancies in the quality and quantity of delivered goods. To address these challenges, the Purchasing Department maintains intensive coordination with the Culinary Department and suppliers, utilizes alternative suppliers, identifies suitable substitute ingredients, and conducts regular supplier performance evaluations. These efforts are expected to improve the effectiveness and efficiency of the procurement process, thereby supporting the smooth operation of the Culinary Department at Hotel A.

Abstract

Marketing effectiveness is an important factor in supporting the success of a company, particularly in the ornamental coral business which has sensitive product characteristics, high economic value, and export orientation. This study aims to analyze the marketing effectiveness of ornamental coral based on the marketing mix approach (4Ps), consisting of product, price, place, and promotion, as well as to identify internal and external supporting and inhibiting factors at PT. Agung Aquatic Marine Bali. This research employed a descriptive quantitative method. Data were collected through questionnaires, interviews, and observations involving 15 respondents consisting of management and employees directly engaged in marketing activities. The data were analyzed using a Likert scale to measure the level of effectiveness in each aspect of the marketing mix examined in this study. The results indicate that the overall marketing effectiveness of ornamental coral is categorized as effective to very effective. The product and promotion aspects achieved the highest effectiveness levels due to export-quality products and strong communication with international buyers. Meanwhile, the price and distribution aspects were categorized as effective, although several constraints were identified, including fluctuating market demand and strict export regulations.Based on these findings, the company is expected to maintain its product quality and promotional strategies while improving pricing optimization and market diversification in order to enhance sustainable competitiveness in the global market.

Abstract

Affirmative action policies constitute an essential instrument for enhancing women's participation in political life, including political oversight and electoral supervision. In Indonesia, affirmative action is implemented through regulations requiring at least 30 percent women's representation in political party management and legislative candidacy. Nevertheless, these policies have not fully succeeded in strengthening women's substantive role as political oversight agents, particularly in regions where patriarchal culture remains dominant, such as Southeast Aceh Regency. This study aims to analyze the effectiveness of affirmative action policies in strengthening women's role as political oversight agents in Southeast Aceh Regency. The research employs a qualitative descriptive approach using literature review, document analysis, observation, and interviews involving election administrators, women's activists, academics, civil society organizations, and community leaders. The analysis is based on affirmative action theory, political representation theory, and political participation theory. The findings indicate that affirmative action policies have created broader opportunities for women to participate in election supervisory institutions, participatory monitoring initiatives, and political oversight activities. However, their effectiveness remains constrained by patriarchal culture, limited political education, insufficient leadership capacity, male-dominated political elites, and weak political party support for female cadres. Despite these challenges, women contribute significantly to promoting transparency, accountability, and democratic integrity through election monitoring, civic education, and the prevention of electoral violations. This study recommends strengthening political education for women, enhancing leadership capacity, expanding community-based participatory oversight, and improving the implementation of affirmative action policies to achieve not only numerical representation but also substantive representation in local democracy.

Abstract

The development of information and communication technology has had a positive impact on various aspects of society. However, these technological advancements have also given rise to various forms of cybercrime, causing significant losses to individuals and communities. Victims of cybercrime often suffer not only financial losses but also non-material damages, including violations of their privacy rights and personal data security. This study aims to analyze the legal framework governing the protection of cybercrime victims within the Indonesian criminal justice system, examine its implementation, and identify the obstacles encountered in providing legal protection to victims. This research employs a normative legal research method using statutory and conceptual approaches. The findings indicate that legal protection for victims of cybercrime has been regulated under several laws and regulations, including the Law on Electronic Information and Transactions, the Personal Data Protection Law, and the Law on the Protection of Witnesses and Victims. Nevertheless, the implementation of these legal provisions remains inadequate due to several challenges, such as the limited capacity of law enforcement officers, difficulties in identifying perpetrators, and the transnational nature of cybercrime. Therefore, strengthening the legal framework, enhancing the capacity of law enforcement agencies, and optimizing the protection of the rights of cybercrime victims are essential to improving legal protection within the Indonesian criminal justice system.
