Abstract

The prenuptial agreement is regulated under Article 29 of Law Number 1 of 1974. This agreement is made either during or before the marriage takes place. The prenuptial agreement must be made and legalized in the presence of a lawyer or notary, and then ratified by the Religious Affairs Office (KUA) or Civil Registration Office. The research method used in this study is a normative juridical approach, focusing on issues within the scope of prenuptial agreement. The principle of balance is crucial to emphasize in order to ensure equality between the rights and obligations of the parties involved. A prenuptial agreement typically includes main clauses concerning property division, rights and obligations, child protection, and dispute resolution. The Indonesia government need to provide education to the public about the principle of balance in prenuptial agreements. The government should also establish standard clauses that accurately reflect this principle of balance, and should cover all important matters typically included in such agreements.

Abstract

The role of women is very important in instilling the noble values of motherhood culture and noble values that must be preserved even though the times have changed where there are modernization challenges. Responding to globalization while maintaining the noble values of culture requires efforts to cultivate and form characters that are able to adapt to changes while maintaining local wisdom, because education is actually a civilizational process that cannot be separated from the role of women to realize it. This research aims to find out the role of indigenous women in maintaining traditional rituals and providing knowledge to the next generation in Kesepuhan Sinar Resmi. This field research uses survey or observation methods in the field, interviews with Ambu (traditional leaders) and Abah (traditional leaders), and Focus Group Discussion (FGD) with 12 traditional leaders and elders to obtain data as a primary source. The research approach used is a sociological, historical, and normative approach. The participation of women can be seen in the daily life of the indigenous people of Kasepuhan Sinar Resmi in maintaining and implementing the noble cultural values of their community "Mother earth, father of the sky, queen of the land" which in essence in their lives the community must preserve nature in the rice culture society.

Abstract

This research delves into the alignment of regulations governing the Termination of Employment (PHK) due to grave misconduct, as outlined in Government Regulation No. 35 of 2021, with the principles safeguarding workers' constitutional rights enshrined in the 1945 Constitution (UUD 1945). Employer-initiated unilateral dismissals based on allegations of urgent violations, as specified in Article 52 paragraph (2) of PP 35/2021, pose a significant risk of contravening the tenets of due process and the right to legal safeguards guaranteed under Article 27 paragraph (2) and Article 28D paragraph (1) of the UUD 1945. This inquiry also draws on Constitutional Court Decision No. 012/PUU-I/2003, which underscored the necessity of judicial proceedings in termination cases linked to severe breaches, and Decision No. 91/PUU-XVIII/2020, which highlighted procedural deficiencies within the Job Creation Law. Employing a normative legal research methodology with an analytical lens, this study emphasizes legislative analysis and case law examination. Originality of this study lies in its finding that the application of unilateral termination of employment (PHK) without a court process can lead to injustice and harm workers who may lose their jobs without the opportunity to defend themselves. This research concludes that the provisions on urgent layoffs in PP 35/2021 should be reviewed to align with constitutional principles that offer fairer protection for workers. It is recommended that new employment regulations be created with a focus on balancing the protection of workers' rights with the interests of employers.

Abstract

This study aims to describe coping strategies for outstanding students in boarding high schools. The case study method was used to obtain an overview of students' coping strategies. An overview of coping strategies was obtained from three students who had the highest achievements in their class using thematic analysis. The results of the study revealed that students used various coping strategies in dealing with stressors, students used Emotion-Focused Coping to adapt to stressors and did Problem Focus Coping to overcome the problems they faced. This research reveals that with the right strategy, individuals can maintain their performance and deal with existing pressures both from within and from the environment.

Abstract

This research scrutinizes the behavior of tax aggressiveness exhibited by manufacturing companies listed on the IDX over a five-year period (2016-2020), by using two independent variables as a primary factors sales growth and capital intensity and using Effective Tax Rate (ETR) as the measurement. While previous studies offer conflicting evidence, this paper provides clarity by employing robust empirical analysis. Findings reveal that capital intensity significantly and positively impacts tax aggressiveness, as firms utilize asset depreciation to reduce taxable income. Conversely, sales growth shows no significant effect on tax aggressiveness, suggesting that revenue fluctuations do not necessarily correlate with strategic tax planning. These results underscore the nuanced nature of corporate tax behavior and offer insights for investors, policymakers, and academics to better understand and regulate tax optimization practices. The study contributes to the broader discourse on balancing profit maximization and tax compliance in the corporate sector.

Abstract

This article discusses the digitalization of performance services for State Civil Apparatus employees at the Regional Personnel Education and Training Agency of Grobogan Regency. Digitalization of performance services is needed to follow up on Grobogan Regent Regulation Number 40 of 2019 concerning Electronic-Based Government System Governance (SPBE). In implementing the digitalization of performance services for State Civil Apparatus employees in the Grobogan Regency, problems are still found in performance assessments that are less objective and not in line with organizational assessments. The theory used is the successful elements of digitalization from Indrajit (2006), which consists of Support, Capacity and Value with qualitative research methods to obtain data. The results of the study show that the support of the Grobogan Regency Government is not optimal because it does not yet have a Regent Regulation that regulates performance assessments using the e-Kinerja application. In addition, from the capacity aspect, there is still a lack of supporting devices in the form of computers in the field of apparatus performance assessments and awards at the Regional Personnel Education and Training Agency of Grobogan Regency. From the Value aspect, the benefits felt by the government and State Civil Apparatus at the Regional Education and Training Personnel Agency have been widely felt, especially for employees with functional positions who have been facilitated in managing their credit score assessments through the e-Kinerja application. Based on these findings, it can be concluded that the implementation of digitalization of State Civil Apparatus employee performance services at the Regional Education and Training Personnel Agency in Grobogan Regency is not yet optimal in terms of support and capacity because problems related to the legal basis and lack of information technology infrastructure are still found.

Abstract

Sulfur gas such as SOx is one of the harmful residual gases resulting from combustion in vehicle engines due to the high sulfur content in fuel oil, especially diesel. Conventional processes in sulfur reduction still use technology with high process operating conditions and are expensive, thus charging the selling price of low sulfur diesel oil. Light energy is a promising alternative in sulfur reduction process with low production cost. This research will examine the sulfur reduction process with red light assisted by tin catalyst. The results showed that tin catalyst increased the photon energy in red light with sulfur reduction up to 800 ppm in 10 hours. The removal of C-S and O-H groups indicates the formation reaction of DBTO2 after DBT can be cracked from diesel oil hydrocarbon.

Abstract

This study aims to describe the Management of Planning and Organizing of Educators at the Ministry of Religion, Bulukumba Regency. This research uses a qualitative approach, with data collected through interviews, documentation, and observation. The data analysis technique involves four stages: data collection, data reduction, data presentation, and conclusion drawing. The results of the study indicate that the planning of educators is carried out systematically based on regulations, through needs analysis based on the number of students and class capacity. School principals propose the need for educators to the Ministry of Religious Affairs in Bulukumba Regency, which is then mapped and assigned by the Ministry of Religious Affairs of the Province in coordination with the Ministry of Religious Affairs of Bulukumba Regency. As for the organizing of educators at the Ministry of Religious Affairs in Bulukumba Regency, it has been carried out with a very structured and systematic procedure, involving various stakeholders such as school principals, madrasah supervisors, and the personnel division. This organizing process includes placement, mutation, rotation, and attendance management, all based on educational needs and applicable policies.

Abstract

The Belt and Road Initiative (BRI) reflects Cina's grand ambition to strengthen its economic and geopolitical influence in the strategic Southeast Asian region including Indonesia through investment in transnational infrastructure. Cina sees Indonesia as a vital nation within the worldwide oceanic course due to the country's position that interfaces the Indian Sea and the Pacific Sea through the Strait of Malacca. This investigate employments a expressive subjective approach through different auxiliary sources such as official government reports, research reports, academic articles, sources and news media. The research aims to analyze the various factors behind Cina's motivation in launching BRI in the Southeast Asian region, especially in Indonesia. The knife in this research is the concept of national interest from Donald E. Nuchterlein to analyze more deeply the national interests underlying Cina's implementation of BRI in Indonesia. This study found that Cina's implementation of BRI in the Southeast Asian Region including Indonesia is to reduce dependence on foreign investment, utilize excess production capacity, secure energy supplies, maintain national defense stability, especially in maritime areas such as the South Cina Sea, and create a positive image in the eyes of the world by embracing BRI cooperation partner countries by emphasizing economic, cultural and non-intervention aspects.

Abstract

This study aims to (1) Explain the mosque-based baitulmal strategy at the Kurir Langit Modern Mosque, so that it can be a reference for the development and management of other mosques; (2) Know the baitulmal strategy of the Kurir Langit Modern Mosque in empowering the mosque and empowering the ummah. This research uses the type of field research, which is research that intends to understand the phenomenon of what is experienced by the research subject. The results of this study indicate that 1) The Mosque Baitulmal strategy at the Kurir Langit Modern Mosque is implemented as a ZISWAF collection, management and distribution Lembagaon. Takmir mosque as amil zakat and nadzir waqf. So that this research finds differences in implementation with other mosques and LAZIS so that social charity programs, waqf charities, da'wah & mosque charities, business charities, and educational charities are realized. 2) The Mosque empowerment strategy of Baitulmal Masjid contributes in the form of Ubudiyah Role, Tarbiyah Role, and the Role of Ijtimaiyah.
