Abstract

The Toba Batak hold customary land. Will, but in practice, the range of customary rights has shrunk owing to control and takeover by other parties. The takeover has caused economic challenges for the Toba Batak people, who are unable to use their land and woods to support their daily necessities. This position contradicts Article 3 of the LoGA, which provides that the State expressly acknowledges the existence of ulayat rights and comparable rights derived from the customary law community as long as they exist in fact. The statute is endorsed by the Minister of Agrarian Affairs/Head of BPN Regulation 5 of 1999, which establishes guidelines for the settlement of Ulayat Rights Issues in the Indigenous statute Community. The research technique in this paper is descriptive, with an empirical legal approach. Data was gathered via collecting both primary and secondary data. Primary data was acquired through interviews with informants. Secondary data is gathered from both main and secondary legal documents. Document studies and interviews were utilized as data gathering tools in this study, and the results were examined qualitatively. Thus demonstrating that lands have become commodities that may be traded at any moment, as occurs in metropolitan areas, and that the mystical religious significance of the land has shifted to economic (commercial) value. This also demonstrates that individuals are more prepared to hold land separately from the land (ripe-ripe), allowing the land to be exchanged. BAL emphasizes the need of land registration in order to shift the emphasis of legal certainty via verification of rights in paper to the unwritten character of traditional customary law.

Abstract

Conflicts among shareholders are considered to be close firms' weak point. They can take many various forms, but they typically manifest as shareholder impasses, minority mistreatment, or persecution of the majority. The behavioral law and economics movement, which is now very popular, demonstrates how many cognitive biases and heuristics—such as information asymmetry, availability and representativeness heuristics, over-optimism, and strategic behavior—contribute to their genesis. Depending on the specific governance objective to be met, entrepreneurs use a variety of contractual protections in international corporation law practice to successfully avoid and settle the aforementioned shareholder conflicts. Abstract

The purpose of this study is to demonstrate the impact of discipline, job happiness, and motivation on the performance of employees in the production department of PT. Intracawood Manufacturing Tarakan City. Quantitative study was conducted utilizing the survey approach. Data collecting approaches based on observation (questionnaire and interview). The research sample was selected using probability sampling. Simple random sampling was used to select 190 personnel from PT. Intracawood Manufacturing's production department in Tarakan City. Hypothesis testing were also performed using multiple regression analysis models and partial t-tests with the SPSS software. The results prove that discipline has a positive and significant effect on employee performance, meaning that the higher the level of discipline, the higher the employee performance, the higher the job satisfaction, the higher the employee performance, the higher the level of job satisfaction, the higher the employee performance, the higher the level of motivation, the higher the employee performance.

Abstract

This study examines the allocation strategy of Special Autonomy Funds (Dana Otsus) in Papua as an effort to strengthen Papua's integration within the framework of the Unitary State of the Republic of Indonesia (NKRI) amidst challenges of separatism and social injustice. A qualitative approach was adopted, involving an in-depth literature review of policies, government reports, and academic resources. The study aims to analyze the effectiveness of Dana Otsus management in addressing development disparities, enhancing welfare, and alleviating social tensions in Papua. The findings indicate that major challenges in managing Dana Otsus include misalignment of development priorities with local needs, weak transparency, and limited human resource capacity. While Dana Otsus has had a positive impact, particularly in the education and healthcare sectors, its implementation remains suboptimal. The study concludes that improving coordination between central and local governments, ensuring transparency, and increasing local community participation are crucial. An inclusive and locally responsive allocation strategy is recommended to optimize the role of Dana Otsus in promoting equitable development and strengthening NKRI.

Abstract

This research explores the use of Problem Based Learning (PBL) in air traffic control education to enhance students' control techniques skills through simulation. PBL encourages individual and group problem-solving, fostering contextual understanding. The study examines various simulation types and PBL characteristics aimed at improving these skills among air traffic control students. Results indicate that 750 students achieved an average score of 84.43, classified as very good. The research also discusses the advantages and challenges of implementing PBL in developing control techniques for air traffic control students.

Abstract

Family members who commit violence against each other are called domestic violence (KDRT). This form of violence can be physical, psychological, sexual or economic. Domestic violence often occurs in intimate relationships, but can also involve other family members, such as children or parents. One of the most common cases is violence against children, which can be found in various places throughout Indonesia's provinces. This is very paradoxical because parents are supposed to provide sincere love, guidance and education to children, who are supposed to be the next generation. The family, which should be a safe and comfortable place, actually creates fear for children. Children who experience physical, verbal, emotional, mental, or sexual abuse experience symptoms of mental disorders that can interfere with development and social interactions, according to research. To implement the Child Protection Law, the government, society and various parties must work together to create a positive environment that supports children's development. With the right steps, it is hoped that cases of violence against children can be minimized and victims receive the necessary protection.

Abstract

This research analyzes superior commodities and their derivative products (multistrata products) in West Halmahera Regency, North Maluku Province. The study was conducted in Golo village, Sahu sub-district from March to August 2024, using both quantitative and qualitative methods. Data collection involved primary sources through field surveys and secondary sources from government agencies. Location Quotient (LQ) analysis revealed banana (1.562), coconut (1.544), nutmeg (1.243), and corn (1.240) as base sector commodities, while durian (0.116) was identified as a non-base sector commodity.

Abstract

The historical journey of the Indonesian nation from the colonial era to independence can be understood as a paradigmatic journey. Politically, Indonesia underwent a transformation from a peripheral nation to an entity that took over the center of power through the proclamation of independence in August 1945, moving from the Dutch East Indies to the Republic of Indonesia. Not all nations that have achieved independence have tried to build a new life based on innovative principles. In this context, the role of Pancasila and the 1945 Constitution (1945 Constitution) has a very important significance to these fundamental changes. Pancasila, as a basic state norm (staatssfundamentalnorm), functions as a grand design  for society and a new life in Indonesia. Similarly, the establishment of Law Number 1 of 2023 concerning the National Criminal Code (KUHP) still reflects the values of Pancasila as the country's basic norm which will come into effect in 2026. Law Number 1 of 2023 (New Criminal Code) introduces a number of new criminal concepts that are different from the previous Criminal Code. This renewal is expected to be able to answer the legal challenges faced today and replace colonial concepts that have become obsolete and no longer relevant in overcoming contemporary problems. This update covers three main issues in criminal law: first, the formulation of unlawful acts; second, criminal liability, both against individuals as perpetrators and against legal entities; and third, the type of crime and actions that can be applied. The change in the concept of penal in the National Criminal Code is influenced by the development of criminal theory, which shows a shift from a retributive approach to restorative justice. Therefore, the purpose of criminalization is not only to focus on punishment, but also to try to balance two aspects of community protection, namely the victim and the perpetrator.

Abstract

This research discusses the importance of asset recovery in combating illicit enrichment in Indonesia, with a comparison to the United States and South Korea. Where the level of illicit enrichment has become crucial in this country. The study's goal is to examine asset recovery laws and practices and pinpoint ways that Indonesia might improve. The method used is a literature study with comparative analysis of regulations and practices in the three countries. The results show that Indonesia faces significant challenges in asset recovery, while the United States and South Korea have more comprehensive legal frameworks. The conclusion of this study recommends strengthening the legal system and passing an asset forfeiture bill to increase the effectiveness of corruption eradication in Indonesia.

Abstract

The research evaluates the implementation of offset policies in Indonesia's defense sector, focusing on its role in advancing domestic industries and technology transfer. Using a qualitative descriptive approach with SWOT analysis, this study examines secondary data, including global best practices and Indonesia's collaborative efforts with France, Germany, UAE, and Russia. Findings reveal Indonesia's potential in leveraging offsets for industrial growth but highlight regulatory, monitoring, and resource challenges. The study concludes that clear regulations, enhanced R&D investment, and structured offset mechanisms are critical for maximizing benefits. Strategic recommendations include establishing a dedicated offset agency and fostering international partnerships. These insights contribute to academic knowledge and offer actionable strategies for Indonesia's defense and economic resilience.
