Abstract

This study aims to analyze the role of the Tulung Selapan Ilir Village Government, Tulung Selapan District, Ogan Komering Ilir Regency in increasing community participation in the development of village road infrastructure in 2024 and identify supporting and inhibiting factors. This study uses a qualitative method with a descriptive approach. Data were obtained through interviews, observations, documentation, and distribution of questionnaires to 50 respondents as supporting data. Data analysis uses the theory of the role of village government which includes facilitators, mediators, motivators, and regulators as well as the theory of community participation according to Marshall (2006) which includes the existence of a forum to accommodate community participation, the ability of the community to be involved in the process, and the provision of access for the community to express opinions in the decision-making process. The results of the study indicate that the Tulung Selapan Ilir Village Government has carried out its role well by providing a deliberation forum, building communication and coordination, providing motivation to the community, and implementing development based on the results of deliberations and agreed planning. Community participation is also classified as good, indicated by community involvement in the deliberation forum, participation in the development process according to ability, and the opportunity to express aspirations in decision-making. The interview results were reinforced by the questionnaire results, which showed that the majority of respondents gave a positive assessment of the role of the village government. Supporting factors included the community's need for adequate road access, good communication, budget availability, and perceived community benefits from the development. Inhibiting factors included the busyness of some community members, differences of opinion during deliberations, and limited community involvement during the development implementation phase. Based on the research findings, it can be concluded that the role of the village government and community participation are mutually supportive in achieving the success of village road infrastructure development in 2024.

Abstract

This study aims to analyze the implementation of Level 1 Procurement of Goods and Services (PBJ) Training and Competency Testing at the Regional Human Resources Development Agency (BPSDMD) of South Sumatra Province in 2025. The study used a qualitative approach with descriptive methods through interviews, observation, documentation, and questionnaires. The results indicate that the implementation of Level 1 PBJ training and competency testing has been running well in accordance with the provisions of the Government Goods/Services Procurement Policy Agency (LKPP). The success of the program is supported by effective communication, adequate resource availability, high commitment and responsibility of implementers, and a clear and coordinated bureaucratic structure. Despite several administrative obstacles and budget limitations, program implementation remains effective through ongoing monitoring and evaluation mechanisms. Overall, this program has been able to support the improvement of the competency of State Civil Apparatus (ASN) in the procurement of goods and services and strengthen professionalism in carrying out government duties.

Abstract

The phenomenon of sea fences in coastal waters raises legal issues because there are currently no specific regulations governing their status within the Indonesian legal system, even though the utilization of marine space is already regulated by various laws and regulations. This study aims to analyze the legal framework regarding the existence of sea fences within the context of marine spatial planning and coastal zone management in Indonesia, as well as their implications for the rights of coastal communities. The study employs a normative legal research method utilizing statutory and conceptual approaches, analyzing primary, secondary, and tertiary legal materials through a descriptive-qualitative method. The findings indicate that sea fences constitute a form of marine space utilization that must comply with regulations concerning marine spatial planning, coastal zone management, and marine space utilization mechanisms. Although not specifically regulated, the construction of sea fences cannot be undertaken arbitrarily; it must align with spatial plans and applicable regulations. The presence of sea fences—which restrict public access to marine space—conflicts with the principle of state control as stipulated in Article 33, Paragraph (3) of the 1945 Constitution of the Republic of Indonesia and potentially infringes upon the rights of coastal communities to utilize marine space.

Abstract

The national cooking oil industry experienced a price crisis in 2022, influenced by fluctuations in raw material prices in the global market. This condition prompted the government to implement a Maximum Retail Price policy as an effort to control prices and protect consumers. However, the policy created distortions in the domestic market equilibrium and affected cooking oil production and distribution activities. Several business entities responded to these conditions by limiting production volumes and supply. These actions subsequently became the basis for the competition authority to impose administrative sanctions based on indirect evidence. This study aims to analyze the legal considerations of the Supreme Court in overturning the sanctions through Decision Number 85 K/Pdt.Sus-KPPU/2025. This study employed a qualitative method using statutory and judicial case study approaches. The findings indicate that the Supreme Court did not accept the standard of proof applied by the Business Competition Supervisory Commission and emphasized the importance of evidence capable of demonstrating the existence of a cartel agreement. Supply restrictions under certain circumstances may be considered a rational economic response to market conditions. Legal certainty is therefore necessary to protect legitimate business activities while supporting supply chain stability and maintaining fair and healthy business competition.
