Abstract

Problems in cooperatives are often in the management of cooperatives and businesses. This problem is because until now many cooperatives are managed by people who are not professional in their fields, so that the progressiveness of cooperatives is difficult to develop. The purpose of this study is to determine the legal implications of the Cooperative legal entity declared bankrupt by the Commercial Court. The research method used is normative legal research, namely legal research by examining legal data sourced from the literature related to the literature related to the topic of this research. The results of this study are the legal consequences of a legal entity being declared bankrupt by the Commercial Court, including: a) Bankruptcy against a Cooperative does not necessarily end with the liquidation and dissolution of the Cooperative legal entity; b) Cooperatives can still carry out legal activities; c) The curator specified in the bankruptcy decision shall immediately be tasked with administering and controlling the bankruptcy estate; d) Actio Paulina applies; c) The lease can be terminated; and d) Employees may be terminated (PHK).

Abstract

The aim of this research is to determine the application of restorative justice to children who are criminals in the juvenile criminal justice system in Indonesia and to reveal the problems of obstacles in the application of restorative justice as an alternative in the process of implementing the justice system for children in conflict with the law. This research methodology is included in the category of normative legal research, because normative research mainly uses library materials as a source of research data or also known as (library research), a method used to collect data from various literature. This research is descriptive analysis, which is included in the scope of research that describes, examines, explains precisely and analyzes the laws and regulations related to this research. The results of the research can be concluded that, First, the existence of Law Number 1 of 2023 concerning the Criminal Code (UU KUHP) as the new Criminal Code (KUHP) in Indonesia seeks to implement the legal ideals of restorative justice. the only concepts that are substantively built into the newly passed Criminal Code.

Abstract

This qualitative research explores people's understanding of the application of Islamic law in the context of modern life in Indonesia. As the country with the largest Muslim majority population in the world, Indonesia is a unique case study to see the intersection between Islamic law and the dynamics of contemporary society. Through in-depth interviews and thematic analysis, this study explores the diverse perspectives, beliefs and experiences of Indonesian individuals regarding Sharia principles and their relevance in today's society. The findings highlight the complexities of reconciling religious norms, cultural traditions, and modern realities in Indonesian society, and provide insights for policymakers, scholars, and civil society actors seeking to promote social cohesion, religious tolerance, and legal reform.

Abstract

This qualitative research investigates public perceptions of the impact of technological challenges on human rights in Indonesia. Through in-depth interviews with 15 participants from various backgrounds, this research explores the perceived benefits and challenges of technology, attitudes towards government regulation, and trust in technology companies. The findings reveal a nuanced understanding of the intersection of technology and human rights, highlighting concerns about privacy, freedom of expression, and corporate accountability. While technology offers opportunities for empowerment and connectivity, it also carries risks such as data breaches, online censorship and the digital divide. This study underscores the importance of balancing innovation with the protection of fundamental rights and calls for transparent, accountable and ethically responsible practices in the digital realm.

Abstract

This article discusses the protection of children's rights in Palestine, especially children who are victims of war and prisoners of war by Israel, in the context of international humanitarian law. In situations of armed conflict plaguing Palestine, children face various obstacles such as limited access to health and education services, attacks on vital infrastructure, and economic barriers. The implementation of international humanitarian law and human rights in the protection of Palestinian children is still limited, with violations of children's rights often not followed up properly. The research method used is normative research with qualitative analysis of legal principles contained in legal provisions and legal doctrine. This research aims to identify obstacles in the protection of children's rights in Palestine and offer concrete solutions to strengthen the protection of children in armed conflict.

Abstract

Pelanggaran hak asasi manusia (HAM) yang sistematis terhadap Muslim Uighur di Xinjiang, China, telah menjadi isu global yang mengkhawatirkan. Artikel ini mengeksplorasi dimensi perlindungan hukum humaniter yang dibutuhkan untuk mengatasi krisis kemanusiaan ini. Dengan mengidentifikasi bentuk-bentuk pelanggaran seperti penahanan massal, pembatasan kebebasan beragama, dan pengawasan berlebihan, penelitian ini menganalisis kebijakan represif pemerintah China yang bertentangan dengan instrumen hukum internasional. Dampak nyata dari pelanggaran ini terhadap kehidupan Muslim Uighur juga disorot, mulai dari kesehatan fisik hingga disintegrasi masyarakat. Selanjutnya, evaluasi kerangka hukum nasional dan internasional mengungkapkan kesenjangan dalam perlindungan efektif, menekankan perlunya reformasi dan penguatan kerjasama global. Upaya penegakan hukum humaniter dan advokasi HAM dibahas secara komprehensif, mencakup langkah-langkah dari komunitas internasional, organisasi HAM, dan masyarakat sipil. Artikel ini menyoroti urgensi untuk mengakhiri pelanggaran HAM, memastikan perlindungan hukum yang memadai, dan memulihkan martabat serta hak-hak dasar Muslim Uighur sebagai kelompok minoritas.

Abstract

This study combines the perspectives of international humanitarian law and Islamic law to analyze the use of modern weapons in armed conflict. In an effort to protect victims of war, including civilian populations, international humanitarian law is applied based on the principles of humanity, proportionality and distinction. On the other hand, Islamic law, which is derived from the teachings of the Quran and Hadith, emphasizes the importance of protecting people who are not involved in combat as well as protecting the environment during war. However, advances in military technology, such as the use of drones and long-range missiles, have created new challenges in the application of these two legal systems. Unavoidable civilian casualties are often a consequence of the use of such technology, raising questions about the relevance of religious law and international law in the modern context. This study utilizes a normative juridical approach, which considers legal principles and historical background. The aim is to evaluate the impact of the use of modern weapons in armed conflicts and identify possible violations.

Abstract

This research investigates the effectiveness of personal data protection policies in protecting human rights in the context of the technological era in Indonesia, using normative juridical analysis. The rapid advancement of digital technology has raised concerns regarding personal data protection, which directly impacts individuals' rights to privacy and freedom from exploitation. This research critically examines Indonesia's existing legal framework, including key regulations and the Personal Data Protection Bill, and assesses its alignment with international standards such as the GDPR. It identifies significant gaps and challenges in the current legal framework, including issues relating to law enforcement, public awareness, and the rapid pace of technological change. The findings suggest that while Indonesia has made progress in building a legal foundation for data protection, further improvements are needed to ensure robust protection for human rights in the digital age. The study concludes with recommendations to improve legal mechanisms to better protect individual rights in an ever-evolving technological landscape.

This study examines the regulation of online content and its impact on the right to freedom of speech on digital platforms in Indonesia, utilizing a juridical normative analysis. With the rapid growth of digital platforms, concerns over the balance between regulating harmful content and safeguarding free expression have intensified. The research explores the legal frameworks governing online content in Indonesia, analyzing how these regulations align with constitutional guarantees of freedom of speech. The findings reveal significant tensions between state interests in maintaining public order and individual rights to free expression, highlighting the potential for regulatory overreach and the chilling effect on public discourse. The study underscores the need for a more balanced approach to content regulation, advocating for clearer legal guidelines and independent oversight to ensure that regulations do not undermine democratic principles. This research contributes to the ongoing debate on the legal and ethical dimensions of content regulation in the digital age, offering insights for policymakers, legal practitioners, and digital platform operators.

Abstract

Corruption is a very detrimental crime, having a broad negative impact on the social, economic and political aspects of the country. In dealing with this problem, Indonesia has implemented preventive and repressive efforts, but many public officials are still involved in corruption. One of the proposed sanctions is the revocation of political rights for perpetrators of criminal acts of corruption. This research evaluates the urgency and effectiveness of revocation of political rights as an additional punishment, and considers a human rights perspective. Using normative juridical methods, this research analyzes written law and relevant doctrine, as well as examining primary and secondary legal materials. The research results show that revoking political rights can have a deterrent effect and prevent the repetition of criminal acts of corruption, but clearer regulations regarding time limits and implementation are needed so as not to violate human rights. It is hoped that this research can provide recommendations for policy makers and law enforcers in improving the legal system to ensure fair and effective law enforcement in eradicating corruption.
