Abstract

Penelitian ini bertujuan untuk menganalisis konsep legal reform fatwa DSN-MUI tentang akad Ijarah Maushufah fi Dzimmah (IMFD). Metodologi yang digunakan untuk mengupas masalah tersebut ialah dengan menggunakan metode telaah pustaka (Library Research) dengan pendekatan sosio historis dan factual historis dan ata bersumber pada buku, jurnal, dan karya-karya lainnya. Hasil penelitian ini menjaslakan bahwa konsep reformasi dalam akad IMFD adalah dengan memakai term yang diidentifikasikan sebagai upaya mencari legitimasi hokum untuk kepentingan tujuan-tujuan baik dengan Hilal bi istihsan atau Hilal bi al maslahah. DSN-MUI mereformasi hokum fatwa karena menganggak perlu adanya penafsiran positif dan kreatif terhadap akad transaksi keuangan kotemporer sesuai konteks perkembangan pasar keuangan modern yang bersifat multi dimensional.

Abstract

The purpose of the study is to analyze the concept of murabahah on the one hand whose technical guidelines are determined by the National Sharia Council which refers to Islamic sharia and on the other hand must also be in accordance with positive law to obtain protection and legal certainty, then sharia law and positive law should be followed consistently by Islamic banking in providing murabahah financing whose contracts. First, according to Law Number 21 of 2008 concerning Islamic Banking in Article 1 number 7, Islamic Banks are Banks that carry out their business activities based on Sharia Principles and according to their types consist of Islamic Commercial Banks and Islamic People's Financing Banks. It is emphasized that the Sharia Principle according to Law Number 21 of 2008 concerning Islamic Banking in Article 1 number 12 is the principle of Islamic law in banking activities based on fatwas issued by institutions that have the authority to determine fatwas in the field of sharia. From the financing of murabahah agreements in BPR Syariah in terms of determining profits in accordance with sharia principles because the National Sharia Council allows that murabahah sales and purchases transactions, either cash or installments, with the terms and conditions can be met. In the murabahah agreement in BPR Syariah, partnerships are always prioritized, transparent so that customers can accept the agreement or agreement that has been agreed upon with the note that both parties agree must be based on Islamic law. In BPR Syariah, customers are allowed to negotiate earlier for the purchase of goods either on credit or paid in cash.

Abstract

: Kajian ini difokuskan untuk mengetahui pemikiran-pemikiran K.H. Dr. Idham Chalid tentang pemerintahan Islam dan sistem pemerintahan Islam yang ideal menurut beliau. Penelitian ini merupakan penelitian pustaka (library research). Berdasarkan data-data yang terkumpul dalam bentuk deskripsi (tulisan), maka penelitian ini menggunakan pendekatan kualitatif yaitu dengan pendekatan studi tokoh. Penelitan ini telah menemukan beberapa pemikiran Idham Chalid tentang politik Islam, beliau cenderung mengikuti kelompok yang berpandangan bahwa agama dan negara berhubungan secara mutualistik, yaitu berhubungan timbal balik dan saling membutuhkan-menguntungkan. Beliau menyatakan bahwa tidak boleh memberontak kepada pemerintahan yang sah, NU dan ummat diharapkan untuk bersifat tawasuth dan I’tidal, tasamuh, tawazun, dan Amar Ma’ruf Nahi Munkar. Beliau mengakui Pancasila sebagai dasar Negara dan tidak perlu menggantinya dengan ideologi Islam. Demokrasi Islam adalah tepat digunakan dalam pemerintahan Indonesia. Penetapan Presiden sebagai ulil amr harus dipandang wajar, karena kalau tidak maka kewenangannya sebagai wali hakim bagi perempuan yang tidak mempunyai muhrim bisa menjadi masalah. Idham Calid memposisikan NU menjadi penengah antara umat Islam dan Negara Indonesia. NU mengakui dan mendukung Negara yang Demokratis, menerapkan prinsip Musyawarah, bersumber pada ajaran Aswaja, berkarakter al-Tawassuth wa al-I’tidal serta tidak mempertentangkan antara agama dan negara, akan tetapi saling berhubungan dan membutuhkan.

Abstract

This research aims to: 1) understand the judicial process for juvenile offenders with disabilities; and 2) examine and analyze the concept of resolving criminal cases committed by juvenile offenders with disabilities in the future. This study is categorized as normative research using a statutory and conceptual approach. The type of data used is secondary data, consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The data collection techniques used include literature study and gathering data through electronic media related to the issues being studied. The data analysis technique applied is deductive reasoning, which involves drawing conclusions from general to specific, formulating facts, identifying causes and effects, and reasoning based on case studies. This study concludes that Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (JCJS) serves as a crucial legal foundation for protecting the rights of children in conflict with the law. The JCJS Law provides room for diversion for juvenile offenders with exceptions, namely if the offender is not a repeat offender and the offense is punishable by less than seven years of imprisonment. From a material perspective, the provisions in the JCJS Law do not rigidly explain the rights of children with disabilities when facing the law. The regulations in the JCJS Law still predominantly focus on children with normal physical conditions. From a formal perspective, there is a legal vacuum specifically regulating the rights of children with disabilities in conflict with the law, akin to the regulations for children in conflict with the law under the JCJS Law and for women in conflict with the law under Supreme Court Regulation No. 13 of 2017 on Guidelines for Adjudicating Women in Conflict with the Law. Thus, the judicial process for juvenile offenders with disabilities still applies the normal judicial system as used for other children without disabilities. In the future, if diversion is pursued for resolving criminal cases involving juvenile offenders with disabilities, another alternative for handling such cases is that judges may apply judicial pardon when making decisions. Judicial pardon is regulated under the new Criminal Code in Article 54(2), which provides a normative basis for judges in their decision-making.

Abstract

This research aims to examine the implications of the Constitutional Court decision Number 116/PUU-XXI/2023, one of which contains the elimination of the 4% parliamentary threshold regulated in Law Number 7 of 2017 concerning Elections as one of the legal bases for implementation. election in 2029. The Constitutional Court (MK) considers that the parliamentary threshold provisions are not in line with the principles of popular sovereignty, electoral fairness, and violate the legal certainty guaranteed by the constitution. This research is library research which examines the Constitutional Court Decision Number 116/PUU-XXI/2023. This research is descriptive analytical in nature, namely by describing the description of the object under study based on facts that appear as they are and then analyzing them to reveal the meanings behind these facts. The approach used in this research is a normative approach. In this research, it is explained that the existence of the Parliamentary Threshold is not effective enough as a mechanism to simplify the existence of political parties in the electoral system in Indonesia. It even tends to harm the constitutional rights of citizens who represent their constituents. The existence of the Constitutional Court Decision Number 116/PUU-XXI/2023 provides a breath of fresh air to create justice in the implementation of the 2029 elections in Indonesia

Abstract

The evolution of international human rights instruments and national legislation has strengthened the recognition of indigenous communal ownership institutions, including the Permanent Inalienability Principle. Countries like Australia (Native Title) and Canada (Aboriginal Title) have demonstrated robust commitments to upholding communal property regimes. This comparative analysis employs a normative research approach to examine the parameters of existence and relevance of regulations in maintaining the Permanent Inalienability Principle in Indonesia. The findings indicate a strong legal commitment in select countries to safeguard indigenous ownership rights through accommodation, formulation, and enforcement of regulations.

Abstract

The province of West Nusa Tenggara, which consists of two islands (Lombok and Sumbawa), has 8 regencies and 2 cities with its capital in Mataram. It is one of the provinces in Indonesia, and its vision and mission is to lead its people towards prosperity, as outlined in the vision and mission of the province of West Nusa Tenggara, namely: ‘Moving forward’ is the vision of the Acting Governor of West Nusa Tenggara in leading the provincial government to make West Nusa Tenggara more advanced and move forward with a stronger accelerative spirit. The West Nusa Tenggara government continues to develop and advance the region. Its efforts for a more advanced West Nusa Tenggara are not merely about appearance but also about acceleration. West Nusa Tenggara is ready to continue moving forward and become an even better province in the future. However, in implementing this vision and mission, West Nusa Tenggara faces significant challenges related to achieving the well-being of its people, particularly the high rate of early marriage. This is a major issue in West Nusa Tenggara and requires special attention to resolve it, ensuring that the people of West Nusa Tenggara can achieve their well-being. The objectives of this study are: 1. To analyse the causes of child marriage, 2. To understand local wisdom and the role of local governments in addressing child marriage, 3. To analyse the challenges faced in addressing child marriage. This research employs a qualitative research approach. Data collection methods include interviews, documentation, observation, and literature review. Child marriage occurs due to several factors, including technology, such as smartphones, as most children now own Android smartphones, leading to free-wheeling social interactions. There is also a lack of clear guidelines addressing this issue, and there is a need for a Memorandum of Understanding (MOU) between traditional leaders, community leaders, and the local government to reduce the incidence of child marriage.

Abstract

Tujuan penelitian ini adalah untuk mengetahui bagaimana implementasi keadilan restorative pada sistem peradilan pidana anak, system peradilan umum dan pada kepolisian. Jenis Penelitian ini adalah penelitian hukum normatif, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder. Metode yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif. Pendekatan yuridis normarif (doktriner) yaitu pendekatan dengan mempergunakan kepustakaan atau studi dokumen dan pendapat para ahli yang berkaitan dengan judul diatas. Hasil Peneilitian yaitu restorative justice merupakan sebuah upaya untuk mempertemukan semua pihak yang terlibat untuk bersama-sama mencari solusi untuk merestorasi dan memulihkan semua pihak yang terkena dampak kejahatan. Pelaksanaan restorative justice tidak selamanya menghilangkan pidana dan bertujuan untuk perdamaian namun hakekatnya ialah merestorasi korban. Meskipun memang, perdamaian dapat tercapai seiring berjalannya proses restorative justice, dan penyelesaian perkara melalui proses hukum diluar pengadilan yang bertujuan untuk mencapai keadilan yang menekankan pada pemulihan atas kondisi pelaku dan korban.

Abstract

Artikel ini membahas proses positivisasi hukum Islam dan hukum adat ke dalam kerangka hukum nasional Indonesia dengan pendekatan interdisipliner dalam konteks penelitian hukum normatif. Peneliti mengidentifikasi fakta bahwa hukum adat dan hukum Islam memiliki peran penting dalam sistem hukum Indonesia yang kompleks dan multi-layered. Hukum adat, sebagai produk sosial yang tumbuh dari nilai dan norma suatu komunitas, diakui secara resmi dalam kerangka hukum positif di Indonesia, di mana hal ini sejalan dengan prinsip penyelesaian konflik di tingkat lokal dalam aspek tanah, warisan, dan hubungan sosial masyarakat. Sementara itu, hukum Islam menghadapi tantangan dalam pengintegrasiannya dengan hukum positif nasional, terutama dalam konteks Pancasila sebagai ideologi negara yang harus diinternalisasi dalam penerapan hukum. Penelitian ini menyoroti dinamika interaksi antara hukum adat dan hukum Islam, serta bagaimana keduanya dapat saling melengkapi dalam mewujudkan keadilan dan pemenuhan nilai sosial dalam masyarakat yang heterogen. Oleh sebab itu, pemahaman mendalam tentang interaksi ini penting untuk mengembangkan hukum yang progresif di Indonesia, yang mampu menjawab tantangan-tantangan yang muncul dalam konteks global dan lokal. Keberhasilan integrasi ini diharapkan mampu memberikan keadilan yang lebih inklusif bagi seluruh elemen masyarakat dalam sistem hukum nasional.

Abstract

Pernikahan beda agama tidak bisa dihindari dikarenakan karena suka sama suka dengan kata lain saling cinta. Pernikahan beda agama di Indonesia tidak diperkenankan dan terkadang sering kali pula terjadinya konflik pernikahan tersebut. Tujuan dari penelitian yaitu untuk mengidentifikasi latar belakang terjadinya konflik Pra-Pernikahan beda, mengidentifikasi konflik yang terjadi Pra-Pernikahan Beda Agama dan mengalisis penyelesain konflik Pra-Pernikahan beda agama. Hasil penelitian menunjukkan bahwa terjadinya konflik Pra-Pernikahan beda agama di Kecamatan Gangga melibatkan berbagai pihak, termasuk pasangan calon pengantin, keluarga, tokoh agama, dan masyarakat. Konflik ini terutama terjadi antara individu beragama Islam dan Buddha yang mengalami tekanan sosial serta perbedaan nilai terkait keyakinan mereka. Bentuk konflik yang muncul meliputi ancaman, penyerangan, serta pengucilan sosial terhadap pasangan. Penyelesaian konflik umumnya dilakukan melalui mediasi oleh pihak ketiga, seperti Kepala Dusun dan aparat desa, yang sering kali berujung pada perpindahan agama salah satu mempelai karena tidak adanya pengakuan legal terhadap pernikahan beda agama di Indonesia.
